Ladies and Gentlemen:
We have reviewed your application to install an 8-foot by 30-foot grated float that will be
anchored via helical screw type anchors in Pickering Passage, Puget Sound at Harstine Island,
Mason County, Washington. Based on the information you provided to us, this"Letter of
Permission"(LOP)permit authorizes your proposal as depicted on the enclosed drawings dated
April 16, 2011, which are made part of this permit. In order for this LOP authorization to be
valid,you must ensure that the work is performed in accordance with the enclosed Letter of
Permission General Conditions and the following special conditions:
a. You must provide a copy of the permit transmittal letter,the permit form, and drawings to
all contractors performing any of the authorized work.
b. In order to meet the requirements of the Endangered Species Act(ESA) and for the
protection of Puget Sound Chinook salmon,Puget Sound steelhead, Coastal Puget Sound Bull
trout and Surf smelt, you may conduct the authorized activities from July 16 through October 14
in any year this permit is valid. You shall not conduct work authorized by this permit from
October 15 through July 15 in any year this permit is valid.
c. You must implement and abide by the ESA requirements and/or agreements set forth in
your Appendix A, Application form for RGP-6 you submitted on April 16, 2012. The National
Marine Fisheries Service (NMFS) concurred with a finding of"not likely to adversely affect'
based on this document on July 19, 2012 (NMFS Reference Number 2012/02346). The U.S.
Fish and Wildlife Service (USFWS) concurred with a finding of not likely to adversely affect'
based on this document on August 2, 2012 (USFWS Reference Number 01EWFW00-20124-
0260). Failure to comply with the commitments made in this document constitutes
non-compliance with the ESA and your U.S. Army Corps of Engineers Corps (Corps)permit.
The USFWS/NMFS is the appropriate authority to determine compliance with ESA.

d. Surf smelt may be spawning in the project area during the allowed work window. In
order to meet the requirements of the Endangered Species Act and for the protection of surf
smelt,prior to construction,the applicant must have a qualified biologist confirm, in writing,that
no surf smelt are spawning in the area. If a Washington Department of Fish and Wildlife
(WDFW)Habitat Biologist has volunteered to conduct a survey as part of the Hydraulic Project
Approval,this survey may be submitted to the Corps. The letter or memorandum from the
qualified biologist or the WDFW Habitat Biologist must include the date of the inspection,the
surf smelt findings, and must be provided to the Corps, Seattle District,Regulatory Branch,FAX
(206) 764-6602,prior to construction. Address the letter or memorandum to Darren Habel and
include the reference number NWS-2012-309. If the qualified biologist or WDFW Habitat
Biologist confirms that no surf smelt are spawning in the project area, you have one week from
the date of the inspection to complete all work below mean high water.
We have reviewed your project pursuant to the requirements of the ESA and the Magnuson-
Stevens Fishery Conservation and Management Act in regards to Essential Fish Habitat. The
Corps has determined that this project will comply with the requirements of the above laws.
Puget Sound is a water of the U.S. If you believe this is inaccurate, you may request a
preliminary or approved jurisdictional determination(JD). If one is requested, please be aware
that we may require the submittal of additional information to complete the JD and work
authorized in this letter may not occur until the JD has been completed.
Any change in the plans for this work will require that you submit revised drawings to this
office and receive our written approval of those changes prior to conducting the work. If you
object to any terms or conditions of this LOP or the jurisdictional determination, you may
request an administrative appeal under our regulations (33 CFR Part 331)as described in the
enclosed Appeal Process Fact Sheet and the Notification of Administrative Appeal Options and
Process and Request for Appeal form.
Your authorization to conduct the proposed work under this permit expires 3 years from the
date of this letter. Within 30 days of completing the authorized work,you must fill out and
return the enclosed Certificate of Compliance with Department of the Army Permit form to the
address indicated on the form. Your signature on this form is our assurance you have conducted
the work and any required mitigation in accordance with the terms and conditions of this LOP,
including all special conditions. Please remember that failure to comply with the terms and
conditions of this LOP, including any special conditions, will invalidate your authorization and
could result in a violation of Federal law.

Please fully complete this form and attach vicinity,plan and elevation drawings and any other relevant
information. Submit the information to: U.S. Army Corps of Engineers,Regulatory Branch,P.O.Box 3755,

This application is for residential overwater structures in inland marine waters in Washington State. You may use
this application whether or not your project meets all requirements of Regional General Permit 6(RGP 6).
However,projects not meeting all requirements must undergo Section 7 Endangered Species Act(ESA)
consultation with the National Marine Fisheries Service(NMFS)and U.S.Fish and Wildlife Service(USFWS).
Section 7 ESA consultation could require a more conservative design or additional mitigation. Therefore,projects
not meeting all requirements should provide a greater amount of mitigation than is required by RGP 6 in order to
offset impacts to the aquatic environment.
