(2) The violations listed above are located on tax parcel number 12329-43-00270 in Mason County, Washington. The violations of County regulations cited as COUNTS 1 through 8 above are the result of the placement of illegal non-residential A-frame board signs more than 10' from the business building entrance and made of design and materials that are not high-quality. (3) Three previous Warning Notices have been issued to Gregory Alexander for violations of the above-referenced codes on June 1, 2006, August 7, 2006, and March 8, 2007. (4) This Notice is effective immediately upon posting at the site and/or receipt by the person(s) to whom it is directed. (5) Any non-compliance with Mason County Code Title 7, 8, 14, 15, or 17 or other applicable regulations must immediately cease. (6) This Notice shall serve as a "Stop Work" Order until the violation is corrected and/or remediated as specified under number(6) below. (7) You must immediately remove all signs that are not made of high-quality design and materials. If an A-frame board sign is used to advertise this business, and it is made of high- quality design and materials, it must be located within 10 feet of the individual building entrance. (7) Failure to comply with the requirements listed above may result in further enforcement actions, including civil fines and criminal penalties. The County is authorized to recommend a $1,000 fine for each violation. Each separate day, event, action or occurrence shall constitute a separate violation. Signs which are legally established prior to the effective date of this chapter, 2004,may continue for a period of ten years,provided that,if a non-conforming sign is changed or moved,it must be brought into conformance with this chapter at that time. Notwithstanding the previous sentence,sandwich boards or A-frame boards,which are legally established prior to the effective date of this chapter,may continue fora period of 90 days,provided that after that time: 1. the sign shall be removed or brought in to conformance,and 2. prior to any enforcement action,the county shall attempt to notify the property and/or business owner of the non-conformity. B. if this chapter is amended so as to create new non-conforming signs from signs which were in conformance with this chapter,those signs may continue for a period of ten years from the date of the amendment that made them non-conforming,provided that,if a non-conforming sign is changed or moved,it must be brought into conformance with this chapter at that time. C. Parcels affected by roadway construction identified in the Belfair Sub-Area Plan my be granted an extension of 6 months past project completion to bring non-conforming signs into conformance. The following guidelines apply to all signage for non-single family residential development: A. B. Signage shall always complement a building's character and design(e.g.,walls signs should avoid covering building columns). C. Signs may be fabricated of mixed media,including metal reverse-illuminated letters, suspended neon letters,illuminate individual letters,or signs etched or cut out of solid material,such as wood or brass,and illuminated from behind. D. Keep signs as simple as possible,relying on symbols to avoid needless clutter and complexity. E. Use landscaping in conjunction with monument signs to enhance the appearance. F. Light colored lettering and logos on a dark background is highly recommended for readability,sense of quality and design continuity. G. Non-illuminated mixed-media,and other special mixed-media signs will be subject to approval by the County. Figure 23. Appropriate sign location and size. 17.34.360 Permitted Commercial Monument Sign Standards A. Monument Site Entry Signs may be located at major vehicular or pedestrian entries along the street front. B. Only one monument sign is allowed per site. For large sites,more than one monument sign shall be permitted as long as such signs are placed no closer than 150 feet apart along the street front. C. Monument signs size limits: (1) Single tenant signs shall be no more than 8 feet in height and 32 square feet in area per face(Two sign faces are allowed). (2) Single tenant signs for retail uses larger than 50,000 square feet in gross floor area shall be no more than 10 feet in height and 50 square feet in area per face. (3) Multi-tenant(more than 3 tenants)signs shall be no more than 10 feet in height and 40 square feet in area per face. It has been continually documented that the A-frame signs are still being placed more than 10' from the building and handmade signs are still being used to advertise the business. The roof sign is also still in place and has not been modified to meet the Belfair sign regulations. According to the Mason County Assessor records, parties named above hold legal interest in the parcel and are therefore subject to enforcement action for failure to comply. The parties shall respond to the county within twenty days of the postmark, posting on site, or delivery of the notice. Records indicate that this enforcement issue has not been resolved and is outstanding at this time. In order to bring your site into compliance you must also: 1) Immediately remove all hand-made commercial signs from public view. 2) Place all A-frame signs within 10' of the business. 3)Modify the building sign so that it is not on the roof of the building and is less than 10' in height. If compliance has not been achieved by March 30, 2007, a hearing will be scheduled before the Hearing Examiner of Mason County. Mason County may request up to a $1,000 fine per violation, per day. The Sign Ordinance additionally specifies that signs shall be made with high-quality design and materials. Also under this ordinance, all permanent signs are grandfathered for a period of ten years, unless they are moved or changed. In the event that permanent signs are moved or changed, they must meet the current regulations. On May 31, 2006, Mason County Planning Staff observed several A-frame signs and several hand-made signs advertising the "Crab Guy" business at 23720 NE State Route 3. The Belfair Sign Ordinance Section 17.34.400 states, "Miscellaneous tenant signs including those hung from building canopies (blade signs), temporary ground placed A-Board signs, and window signs are allowed provided they do not exceed 12 square feet and provided they are within 10' of the individual or multiple tenant building entrance." The Design Guidelines in section 17.34.360 say that "Signage must be of high-quality design and materials." Under Section 17.34.400, the Ordinance also states that "prior to any enforcement action, the county shall attempt to notify the property and/or business owner of the non-conformity". This letter shall serve as notice of the non-conformity. On August 1, 2006, it was also noted that a roof sign had been placed on the business Section 17.34.220.A of the Belfair Sign Code states that commercial roof signs are prohibited f The non-conforming A-frame signs, the handmade signs, and the roof sign must be removed or brought into compliance by August 31, 2006. If compliance is not achieved by August 31, 2006, the Mason County Planning Department is authorized to issue civil infractions in the amount of$250 for the first violation and up to $500 for each subsequent violations (15.13.020.D Mason County Code). Every day of violation shall be a separate violation (15.13.020.A), and action may be brought by the County against the owner of such land or the operator who performed the violation (15.13.030.C)..
