COMMENTS:
Application materials need SEPA checklist submitted to Dept. of Community
Development to complete processing; the proposal meets the specific
permitted use standards of Ordinance 05-98 for Cellular Communication
Facilities for a 135 foot tower with 15 foot antennas attached, including
an easement with the adjacent owner to the north.

SUBJECT: NEXTEL COMMUNICATIONS PROJECT *iV11
In reviewing the information submitted by Nextel to install the tower I agree
with Bob. This being the case no permit can be issued. Michael should
prepare a letter to Nextel explaining such (I believe we just did one for
Sprint along the same lines).
However there is a bit more with this one which I believe should be included
in the letter to Nextel.
We received a letter from the attorney representing Beard's Cove. They
have expressed some concerns that need to be brought to the attention of
Nextel. These concerns need to be included in the letter to Nextel. I would
also ask you point out to Nextel that not only are we unable to issue the
permit because of the invalidity but the concerns need to be looked at.
Please take the steps to prepare this letter for my signature.
Also Allan please take the time to prepare a letter for my signature in
response to the letter from the Beards Cove attorney. You can point out
what we are currently doing. I want you to also point out that at this point
we do not feel that it is necessary to withdraw the mitigated DNS. We will try
and see what Nextel will have for input then go from there.

Dear Mr. Penland:
Mason County Department of Community Development is informing you of the status of the
above noted permit (Mason Co. Permit No. BLD99-0447) and the results of the environmental
review under SEP99-0144, ending on October 1, 1999. Enclosed is an important letter signed
by Gary Yando, Director, Department of Community Development, that states that the permit
application does not meet the exemption criteria for the January 14, 1999 Order of Invalidity
and will be held until further date when the issues related to the Mason County Comprehensive
Plan are resolved through the Growth Management Hearings Board.
Also enclosed is the letter of comment received by this Department in response to the
Mitigated Determination of Nonsignificance and environmental checklist for your proposed
telecommunication tower, circulated to agencies and the public from the dates of September 17
to October 1, 1999. The Beard's Cove Community Organization has submitted comments to
Mason County through their attorney. Their comments state that the tower will be visible
from properties in Beard's Cove, that the Mason County Telecommunication Towers and
Antennas Ordinance encourages locations away from the views of county citizens (in Rural and
Long-Term Commercial Forest areas), and that a sole use tower with a height of 90 feet would
be suitable and allowed under the Ordinance. Their comments conclude by urging Mason
County to find probable significant impacts by the proposal and withdraw the Mitigated
Determination of Nonsignificance decision on this tower as proposed. Mason County
Department of Community Development is currently considering these project comments.
With this information at hand, Mason County Department of Community Development cannot
continue your application review to the point of permit issuance until the Mason County
Comprehensive Plan issues are resolved. You may wish to refine the project proposal to
reflect the comments of the Beard's Cove Community Organization and Mason County's
response to them in regard to project environmental review. If you have further questions on

Dear Sir or Madam,
This letter is in regards to your application to install a
communications tower in Mason County. Please find enclosed a
Notice to Applicants . As stated in the notice, Mason county is
subject to an Order of Invalidity imposed by the Western
Washington Growth Management Hearings Board on January 14th of
this year.
Unfortunately the Order of Invalidity does affect your project as
proposed. Your project can not be approved by the Planning
Department at this time for the following reasons :
1) The application was turned in after January 14, 1999 with no
claim of vesting.
2) Your tower would be located in a portion of the county that
was designated by the Comprehensive Plan as a "Rural Area, " and
is therefor subject to the Order of Invalidity.
3) The tower is defined as a structure in the Mason County
Development Regulations.
4) The proposal does not appear to meet any of the invalidity
exemption criteria as described in RCW36 . 70A. 302 (enclosed) .
Your permit will be placed on "Hold" until the situation has been
resolved.
According to our records, this project has not completed the
required "Pre-Application" meeting (application enclosed) . At
that meeting you will meet with representatives of the various
county departments who can explain how their regulations will
affect your project . If you have any further questions, please
call Planner Allan Bordan at extension 365 .
