lost. The grading and filling project includes the construction of 2,530 feet of distributary
channels, 1,200 feet of graveled beach, and several large woody debris habitat structures.
Within HOOD CANAL and/or its associated wetlands is exempt from the requirement of substantial development
because the development is categorized under WAC 173-27-040(2) as being category
K-dikes, ditches, drains

The Washington Department of Fish and Wildlife(WDFW)has reviewed your request for
WDFW approval under RCW 90.58.147 (Substantial Development Permit-exemption for
projects to improve fish or wildlife habitat or fish passage) for the Beards Cove estuary
restoration project entitled"Beards Cove Restoration."
Based on the information you provided,we have determined that your project meets the
requirements for WDFW approval to improve fish or wildlife habitat. Your project must still be
reviewed through the State Environmental Policy Act(SEPA)process,and will require
Hydraulic Project Approval (HPA)from WDFW.
To receive the exemption from the Shoreline Substantial Development Permit requirements of
local governments authorized by RCW 90.58.147,you must first submit a complete Joint
Aquatic Resources Permit Application(JARPA),along with a copy of the SEPA determination
to WDFW. Within 45 days of receipt of the complete,written application, WDFW will issue an
HPA or deny approval. If WDFW issues a HPA for your project you must include copies of this
letter and the HPA with a request to the local government for exemption from their Shoreline
Substantial Development Permit requirements.

There are no wetlands within the estuary restoration excavation zone. There is a tidal influence wetland
on the north side of the excavation zone that will not be impacted by the proposed construction. A 50
foot buffer of natural vegetation will be left between the construction zone and the wetland. The
excavation zone was filled several years ago for use as a community park. The goal of the project is to
remove the fill material from the estuary and re-establish an amount of estuarine habitat equivalent to
the amount of estuarine habitat lost to filling. The site is bounded on the south, east, and west b

Most of the site is covered with grasses, small trees, and noxious plants (Scotch Broom and
Blackberries). The attached Preliminary Engineering Report, Wetland Report, and Cultural Resources
Report clearly illustrates the vegetation coverage.

The properties to the south, west, and east are Hood Canal estuarine habitat. The property to the north
is not developed. During the 1960's the property to the north was excavated and soil was used as fill
on the project site.

There is an existing derelict swimming pool and a bathroom building on the BCCO's property. These
structures will be demolished and removed to make way for the estuary restoration. The BCCO will
likely replace the bathroom facilities on the remainder of their property but the new bathroom is not part
of this proposal.

Part 6—Project Description

See attached engineering drawings and the preliminary engineering report for the project. This project
will remove fill from the estuary in Hood Canal and re-establish 7.3 acres of estuarine wetlands that
has been lost. The project includes the construction of 2,530 feet of distributary channels, 1,200 feet of
graveled beach, and several large woody debris habitat structures.
6b. Describe the purpose of the project and why you want or need to perform it. nei
The Union River Estuary and Lynch Cove nearshore surrounding the 96 acre Klingel/Beards Cove
project site (see Lynch Cove Ownership Map) provide vitally important habitat to juvenile salmon of
ESA-listed stocks from the Union River, as well as other south Hood Canal rivers, such as the
Skokomish and Tahuya. These include Chinook and summer chum stocks from the top of the recent
HCCC stock rankings, including the #1-ranked Skokomish Chinook, and the #8-ranked Union River
summer chum. Historically, the site provided nearshore, salt-marsh and side-channel habitat and
maintained connectivity among the habitats surrounding it (see 1884 T-sheet).
However, the tidal area of a portion of the site was filled in c. 1973; in preparation for the building of
Beards Cove Community Organization (BCCO) recreation facilities (see 1973 Construction Aerial and
T Sheet with Current Conditions). This once-vital habitat area is no longer available to the ESA-listed
salmon stocks that need it, and creates a migration barrier disrupting connectivity among the
subestuarine habitat surrounding it (HCCC Summer Chum Salmon Recovery Plan, p. 218). The
HCCC Summer Chum Salmon Recovery Plan specifically cites the removal of this barrier as a
recommended action (p. 230). The Mid Hood Canal Chinook Recovery Planning Chapter cites the
filling of subestuaries as a key habitat factor for both Chinook and summer chum recovery, and that
"the key habitat factors for summer chum are directly applicable to Chinook habitat recovery strategy"
(p. 19).
The overall Klingel/Beards Cove project area includes a restoration site, a 7 acre Conservation
Easement Donation area, and Great Peninsula Conservancy's (GPC) Klingel Restoration, completed in
2011 (restoration site and 2011 Klingel Restoration shown on attached Restoration Site Map;
Conservation Easement Donation shown on Lynch Cove Ownership and Conservation Easement
Donation Maps). The completed Klingel Restoration project (partially funded by SRFB/RCO—#05-
1602), removed a dike and flood-gates, and restoring 16 acres of salt-marsh habitat as well as 1,400
feet of side-channels. This 2011 project and the currently-proposed restoration abut, with a portion of
the 2011 project occurring within the GPC-owned tax parcel comprising most of restoration site. The
7-acre Conservation Easement Donation area abuts the southwestern side of CPC's Klingel Preserve,
filling a gap between the permanently protected Klingel Preserve and Washington Department of Fish
and Wildlife (WDFW)-preserved estuarine habitat surrounding the overall Klingel/Beards Cove project
area on three sides.
The restoration site currently hosts a recreation area for BCCO, including a road, parking area, a
derelict swimming pool, bathhouse, trailer, utilities, septic system, covered picnic area and swing-set.
The 3.9 acre recreation area is surrounded on three sides by a 14.9 acre parcel owned by Great
Peninsula Conservancy (GPC). The fill site extends over roughly 7.3 acres of GPC, BCCO, and
WDFW lands, displacing tidal marsh habitat and disrupting connectivity among salt marsh habitat
areas to the east, under WDFW ownership and GPC's recently restored Klingel Wetland Preserve to
the southwest. The restoration portion of this proposed project will remove fill, structures,
infrastructure, and invasive plants; return grade to historic conditions prior to 1973 fill; restore historic
side channels; plant appropriate native species; and restore connectivity among the vital estuarine and
nearshore habitats preserved by GPC and WDFW to the east and west of the project, The

approximately 2 acre BCCO-owned portion of the fill area, that the restoration will submerge, will also
be purchased and permanently protected by GPC as part of this project (cite attached Restoration Site
Map, Preliminary Grading Plan Design, Baseplan with Existing Site Conditions, and Site Condition
Photos).
The surrounding Lynch Cove estuarine wetlands have been the focus of three decades of conservation
work by local land trusts, the Pacific Northwest Salmon Center, state agencies and the local school
district, adding up to over 650 acres of preserved sub-estuarine, nearshore, riparian, and adjacent
upland habitat (see Lynch Cove Ownership Map). The restoration of the BCCO site and the
preservation of the Conservation Easement Donation fill the last remaining gaps in a full 1.7 miles of
u
nbroken estuarine habitat alongthe northern shore of Lynch Cove that will be preserved in perpetuity.

We will be merging the new estuary into the existing wetlands around the edges of the fill removal
excavation. This estuarine wetland restoration project will restore up to 1,550 feet of natural shoreline and
1,200 feet of tidal channels, and approximately 7.3 acres of tidal marsh/estuary habitat. The restoration of
these natural estuarine wetland processes will more than mitigate for any incidental impacts to the
surrounding wetlands that will take place during this project. And project design and construction specifies
the reconnecting of restored wetland to existing wetland only during low tide periods when tidal waters are
not present.

The project will be creating 7.3 acres of estuarine wetlands. The contractor will use the standard excavator and
11 CY dump trucks for the excavation. Waste soils will be hauled to an approved and permitted waste soil
disposal area. 42,000 CY of fill will be removed to re-create the historic estuarine habitat.

Subject: Shoreline Permit for the Beards Cove Estuary Restoration Project.
Dear Alan,
The Beards Cove Estuary Restoration Project has been funded and we are preparing to proceed to
construction this summer.
Critical to the construction schedule for this project is the issuance of a shoreline exemption by Mason
County Department of Community Development. The entire purpose of this project is to restore the
shoreline of Lynch Cove in Hood Canal and add extremely valuable estuarine habitat that will promote
the survival of salmon (summer chum) fry in the Union River estuary.
The following projects have previously received Shoreline Exemptions projects in Lynch Cove: The
Little Mission and Big Mission (Belfair State Park) Estuary Restoration Project, the Klingel Wetlands
Estuary Restoration Project, and the Union River Estuary Restoration Project. These projects included
the removal of existing levees along with imported fill, the removal of fish passage barriers, the
construction of setback dikes, and the construction of bridge structures. The Beards Cove Estuary
Restoration Project is simpler in scope. It involves the removal of over 42,000 cubic yards of fill from the
Union River Estuary and the re-construction of historic distributary channels.
We have included a letter from WDFW identifying that RCW 90.58.147 applies to this project.
The Great Peninsula Conservancy requests that Mason County grant a shoreline exemption for the
project. Note that we have already submitted a SEPA application and JARPA to Mason County DCD for
the project
