Dear Mr.Johnson,
I have called Mike Wnek and also have a call in to you,my phone calls have not been returned.It
has been nearly 6 months since we met onsite and discussed the procedures required to obtain a
permit.As of May 24,2006 we have not received any of the documents required to permit your
composting operation.
As far as the rest of the operation;the recycling of the concrete,asphalt and woodwaste is exempt
from solid waste permitting only if you follow the requirements in the Washington State
Administrative Code(WAC) 173-350-210(documents previously sent to you).The requirements
for exemption are spelled out very specifically in this WAC.Basically you would have needed to
file a report to our office and to the Department of Ecology(DOE).You are required to do this
each year,reporting the annual quantities and types of waste recycled(concrete,asphalt and
woodwaste).Mason County Department of Health Services(MCDHS)will charge a fee,which is
currently$150.00 for the original exemption notification and$100.00 for an annual review and
inspection(to insure that the recycling operations continue to meet the guidelines for the
exemption). We have not received the notification,report or fees as is required.
It is the conclusion of MCDHS that your operation involving composting is in operation without
a permit as is required under WAC 173-350-220.The amount of compost that was observed
onsite is estimated at 2,777 cubic yards,this amount is over the 250 cubic yards that is allowed
without a permit.You must either apply for or obtain a permit as required or make arrangements
to remove the compost if you have not already done so.As you have not followed the
requirements in WAC 173.350-210 the other recycling operations at this site are in violation.You
will need to follow through with the requirements for exemption,apply for a solid waste permit
or cease all recycling activities at this site.
I expect to hear from you within 10 days regarding this letter and thank you in advance for your
cooperation.
