RE: Concrete recycling
Dear Mr. Shearer,
This letter is to confirm what regulations you are required to meet to recycle concrete in
Mason County. The regulations that govern recycling are listed in Washington
Administrative Code(WAC) 173-304-300.
Mason County Department of Health Services does not require a permit to recycle
concrete in Mason County as long as the following regulations are met.
WAC 173-304-300(3)(b)-Applicable waste recycling facilities shall submit annual
reports to jurisdictional health department and Department of Ecology by March I of the
following year for which the data is collected on forms supplied by the department. The
annual reports shall include quantities and types of waste recycled...
WAC 173-304-300(3)(c)-All facilities storing solid waste in outdoor piles or surface
impoundments for the purpose of waste recycling shall be considered to be storing or
disposing ofsolid waste rf.
(i) At least fifty percent of the material has not been shown to have been
recycled in the past three years and any material has been on-site more
than five year;or
(ii) Ground water or surface water,air and/or land contamination has occurred
or will likely occur under current conditions of storage or in case of fire,
or flood.
Upon such determinations by the jurisdictional health department that(c)
(i)or(ii)of this subsection are met,the jurisdictional health department
may require a permit application and issuance of a permit under WAC
173-304-600 of these rules.
WAC 173-304-300(3)(d)-Waste recycling facilities shall allow jurisdictional health
department and department representatives entry for inspection purposes and to
determine compliance with these rules at reasonable times.

WAC 173-304-300(3)(e)...
WAC 173-304-300(3)(f)-All waste recycling facilities shall comply with applicable local,
state and federal law and regulations, including but not limited to environmental
regulations and laws.
It is important to meet each of these regulations or you will be required to obtain a solid
waste permit. It is also important that you meet with Mason County Building and Mason
County Planning to ensure that you will meet with any requirements or concems they
may have regarding your project. Having been exempted for a permit by Mason County
Health does not release you from meeting other county, state and federal regulations.
To address the issue of the 2,562.90 cubic yards (3,417,240 lbs.)of concrete already
buried at 121 NE Log Yard Rd. As stated in our earlier discussions any buried inert
waste over two thousand cubic yards requires a solid waster permit. Due to the fact you
are already over the 2000 cubic yard requirement you must remove a minimum of 562.90
cubic yards of concrete from the ground or apply for a solid waste permit. It is essential
you realize a solid waste permit will be required if you add anymore solid waste to this
site.
Solid waste is defined, in WAC 173-340-100(73),as all putrescible and nonputrescible
solid and semisolid wastes,including but not limited to garbage,rubbish, ashes,industrial
wastes, swill,demolition and construction wastes, abandoned vehicles or parts thereof,
and discarded commodities. This includes all liquid,solid and semisolid,materials which
are not the primary products of public,private, industrial,commercial,mining,and
agricultural operations. Solid waste includes but is not limited to sludge from wastewater
treatment plants and septage, from septic tanks,woodwaste,dangerous waste,and
problem waste.
