VARIANCE REQUEST
SET BACK FROM EASEMENT LINE
TO: MASON COUNTY COMMISSIONERS
FROM: MIKE BYRNE
RE: VARIANCE REQUEST
FOR: CHUCK AND TERRI FRYER
LOT 44 DIV. 7, BEARD' S COVE
BELFAIR, WASHINGTON
BLD94-0771
Attached is a variance request from Chuck and Terri Fryer
indicating a set back that would place their structure eight (8)
feet from the South property line. This would place the structure
three (3) feet from the easement line instead of the required five
(5) feet as stated in the Mason County Set Back Ordinance.
Included in the variance request is a letter of explaination,
structure property set back document signed and notorized, plot
plan and a copy of the fee receipt .
The Building Department has no objection to this request and
would recommend approval .
Chuck or Terre Fryer will be present at the July 26th meeting
to answer questions . They will arrive for the 10 : 00 am scheduled
time for General Services .

To whom it may concern:
We would appreciate very much if you would consider granting
us a variance on the utility easement for lot 44 division 7
Beards Cove located at NE 260 Santa Maria Lane. (Tax parcel
number is 123305400044)
On May 26 , 1994 we submitted an application for a building
permit along with two sets of printed blue prints to the
Mason County building department . We had a ten foot set back
on one side and an eight foot set back on the other side from
the property line . We were under the impression that that
was within the five foot setback limits .
We have since been informed of another five foot easement
that applies to the water and power ditches.
Our lot sits next to lot #38 to the North of us and lot #45
to the South of us . Utilities gain entrance on both the
North and South of sides of our lot . Our lot is 73 'x130'
(see attached plot plan) because of the size of the lot there
is very limited usable land for our three bedroom home . The
house was only able to go on the lot as proposed. The
proposed house size is 55 'x25 ' , thus leaving a ten foot set
back on the North property line, and only an eight foot set
back on the South property line.
Because of the hardship this would create if we were to have
to cut down the garage or living space, we would appreciate
the granting of the variance.
