Dear Ms. Griffey.
During this last year we deceided to improve our property by installing a retaining wall.
This would enhance our property in two ways. 1.) To maintain the existing bank so as to
prevent soil erosion onto our neighbors properties to the East of our residence. 2.) To
provide a visual distinction between our property and the neighbors to the East and North
of our residence.
When we began the project a friend, Steve Bright who owned a tractor, offered to come
over and assist by clearing and leveling the property lines to the East and the Northeast of
our property.
To prevent any problems with the property lines bordering my property and Dave Ford's
property and Jim Eby's property, Steve Bright and myself,met with all parties
concerned. The section of the wall bordering Eby property was agreed verbally by all
parties concerned, that Jim Eby did not want the projected wall placed directly on the
property line so that each 2'block used would intrude on his property by one foot. For
that reason, all parties agreed to where the existing property lines were and I agreed to
place the retaining blocks on my side of the existing property line bordering his property.
When it came to Dave Ford's property line, all parties concerned agreed to place the
retaining blocks directly on the center of the property line, which would leave each
retaining block intruding one foot onto the Culliton property and one foot onto Dave
Ford's property. This verbal agreement was witnessed by Steve Bright before he would
consider assisting in the project with his equipment. Steve Bright also agreed to level the
rear of Dave Ford's property at no cost to him. There were several other parties that also
witnessed this verbal agreement between Dave Ford and myself.
During the construction of the wall Dave Ford assisted in the placing of the blocks and
was satisfied with the placement location of each block and the finished retaining wall.
I would be more that happy to obtain an after-the-fact permit and will comply to the
directions of the Building Inspector to resolve this unfortunate situation., Thank you for
any and all considerations in this matter.

Dear Mr. Culliton,
Thank you for your cooperation recently regarding the
complaint made against you.
After reviewing your response and the site, this department
has determined that the structure presently on site is exempt from
the permitting process pursuant either to the Uniform Building
Code, Section 301 (b) 2, and/or Section 301 (b) 5 .
It was indicated on your plot plan and by you that the
fence/retaining wall was on the property line and intentionally
placed there by verbal agreement with the owner of the adjacent
property. The owner of the adjacent property complained that
consent was never given for the placement in that location.
Established policies by this department pertaining to
structures exempt from the permit process with an ensuing property
line complaint are referred back to the complainant to pursue as a
civil matter and this department has concluded to close this
complaint file based on that information.
At this time, I will be voiding the after-the-fact permit
application due to the permit exemption allowed by the Uniform
Building Code and as adopted by Mason County Ordinance No. 138-92
and informing the complainant of this departments decision.

Dear Mr. Ford,
In response to a complaint received by you on 5-4-94, our
office conducted a site investigation at the above property. After
reviewing all the information received from the owner of that
property and reviewing exemptions as allowed by the Uniform
Building Code, Mason County Ordinance 138-92 and policies
established related to the type of complaint, it has been
determined that this situation must be handled by the complainant
and the property owner and pursued as a civil matter between those
parties.
Enclosed you will find a copy of the letter of determination
written to the owner and a excerpt from the Uniform Building Code
that applies.
The policy to refer these types of complaints back to the
complainant to pursue civilly was established after discussing all
the legal liabilities with the Mason County Prosecutors office.

Uniform Building Code Violation

Dear Mr. Culliton,
In response to a complaint received by our office on 5-4-94, this office
performed a site investigation at the above described property. The complaint
was that a retaining wall had been constructed over the property line and
without a permit. After a file search, it was determined that the required
building permit to construct the retaining wall had not been obtained.
It will be necessary for you to either remove the retaining wall which was
constructed in violation of Mason County Regulation and Uniform Building Code
requirements or obtain an After-The-Fact permit. I have included the permit
application for you. Please provide the detail as listed on the plot plan and
indicate the property lines and setbacks as requested.
This property file complaint has been marked with a compliance date of
June 15, 1994. Failure to respond with your intentions prior to this date will
result in the file being forwarded to the Mason County Prosecutor's office for
further actions.
If you should have any questions regarding the permitting process, please
contact the building department at (206)427-9670 between the hours of
9:00am and 5:00pm, Monday-Friday.
