Notification of Mason County Code Violation

Notice
The receipt of this notice shall constitute service regarding notification of violations of the Mason County
Code, and shall also serve as Warning Notice pursuant to Mason County Code, Title 15, Section
15.13.035. The violation(s) are occurring at the following property:
Enforcement Case: Enf2015-00052

Site Address: 121 NE Santa Maria Lane, Belfair
Legal Description: Beards Cove Div 6 lot 28
❑ An inspection by a Mason County Building Inspector observed a number of recreational
vehicles at this addresses.
Mason County Title 16.22.050 definition of a Recreational Vehicle Park.
"Recreational vehicle park" means a tract of land that is occupied or designed for
occupancy by two or more recreational vehicles for transient dwelling purposes in
accordance with this chapter (including campgrounds); provided that landowners using
their land for personal recreational purposes may have their recreational vehicle and
three guest recreational vehicles and not be considered a recreational vehicle park;
provided further that at no time shall guest recreational vehicles be occupied for any
longer than three weeks in any sixty-day period on the premises; provided further that
landowners using their land for family reunions and other personal gatherings where
more than three R.Ws are involved shall not be considered a recreational vehicle park,
as long as the gathering lasts no longer than five days, and that no health problems,
litter problems, etc., develop; provided further that recreational vehicles set up in a
permanent fashion, as defined by the building code, shall be permitted as permanent
residences.,,
❑ Based on my inspection and photo the site location of 121 NE Santa Maria Lane, Belfair is
currentiv in violation havinq to manv recreational vehicles as defined above.
According to the Mason County Assessor records, parties named above hold legal interest in the parcel
and are therefore subject to enforcement action for failure to comply.
The parties shall respond to the county within twenty-one days of
the postmark of this notice.
Order
YOU ARE HEREBY ORDERED to abate the violation by following one of the options below:
1. Remove the extra recreation vehicle(s) from property. Please ensure all occupants
understand no further recreational vehicles can be placed or replaced. Please notify
me when this is complete. A site inspection will be done to verify compliance.
2. Apply for a Re-Zone then a Permit to be a Recreation Vehicle Park. See enclosed.
Penalties
This notice is to inform you that in the event that you fail to comply, we will pursue additional
enforcement action against you, including but not limited to recording against the parcel, civil
infractions ($250.00 per day), liens against the property through the Mason County Hearings
Examiner process and/or criminal prosecution as allowed under Title 15.13 of the Mason County
Code. In accordance with MCC15.11.20, Appeals to this decision shall be filed with the Clerk of
the Board within 14 days after the date of the decision.
