X 2) Contractor registration laws are governed under RCW 18.27 and enforced by the WA State Dept of Labor and Industries, Contractor Compliance Division. X 10) The construction of the permitted project is subject to inspections by the Mason County Building Department. All construction must be in conformance with the Uniform Codes as amended and adopted by Mason County. Any corrections, changes or alterations required by a Mason County Building Inspector shall be made prior to requesting additional inspections. x 1- 11) All property lines shall be clearly identified at the time of foundation inspection. This review letter contains only those comments related to the Building Department review and does not reflect any additional needs of the other county departments. Please follow the site plan instructions, enclosed is the checklist I originally mailed to you for informational purposes. Please note the requirements you checked off. 2). I am unable to complete a code compliance review based on the submitted"construction plan"drawn on the back of your site plan. Box 186/426 W. Cedar Shelton, WA 98584 Ms. Griffy On October 2, 2002, we discovered that someone with the initials of TR had posted a Stop Work Order(#3071) on the carport that Nancy M. Martin had constructed in the early summer of 2000 to repair the original carport that had fallen down due to old age and heavy snowfall. We were surprised to find the notice in the first place and then somewhat taken back with the fact that TR had opened our chain link fence gates and entered our property without taking the effort to determine if anyone was at home. Even though we were busy packing to leave for my work assignment in Florida, an effort on the part of TR to communicate with us at that time may have brought a quicker end to this matter. Because it was past your office closing time when we discovered the notice, we did not call that day. However, in the following two days, I did make two attempts to contact the number that had been left as POC on the Stop Work Order,that being 360427-9670 ext. 359. The recording I connected with gave me the name of TR, now identified as Terry Ryan, and accordingly, I left enough information to have Mr. Ryan return my call, either to myself on my cell phone or to either Nanc(s cell phone or house phone number. Because our schedule required us to leave by the 4t of October, I did make another call on the 3rd and on the 4t"but never got through to a live person. For both calls, I left messages containing the relevant information necessary to contact either one of us. On October 7th, after arriving in Hemet, CA, I again tried to contact the POC number left on the Stop Work Order and after being routed to you at your office, I eventually talked with a person by the name of Jenny. In that conversation, I informed Jenny that we were headed for Jacksonville, FL and that once we were located, we needed to wait for our mail to catch up with our travels. During that conversation, Jenny informed me that the total cost of the permit would be in the neighborhood of$450.00, based on the permit costs and the enforcement fees required when a Stop Work Order is placed on a construction site. Needless to say, I was surprised at the cost and requested that the information be mailed to our mailing address and that once it arrived in our hands, we would submit the necessarypaperwork to bring us into compliance with the count p P g P Y requirements. We finally received the information from, I presume, your office on October 22, 2002 without any billing information and after waiting one day to hear from you or Jenny, we attempted to decode the rules and information and I find that I can not come up with a figure anywhere close to $450.00. Therefore, the only thing that we can do is to sul—jR'E E I VED OCT 2 8 2W2 M.C.Community.Development the request for a permit and then await your determination of the actual amount of the final charges. I must inform you that we feel the enforcement fee should be reconsidered and suspended because our misunderstanding of the county codes did not lead us to attempt to circumvent our requirement to pay the necessary fees, we just didn't realize that a permit was necessary for a repair to an existing structure and that if Mr. Terry Ryan had taken the effort to discuss this matter with us on the day he hung the Stop Work Order, we are confident that this situation could have been handle correctly prior to our departure to Florida. Thank you for taking the time to review this matter and please send all correspondence to our mailing address but, please be advised that we are receiving all our mail through Nancy's daughter who bundles it in a big package and sends it twice a month. When we first started this process, I was under the impression that you and your staff were aware that the subject carport had already been constructed on the site of the original metal carport that had fallen down. With that in mind,when we received the application for the carport permit,I took it for grated that all we needed to do was give your office some kind of reference material to indicate the design and location of the year 2000 erected carport. Nancy's father built the carport as a replacement for the old metal carport and as such,they were under the impression that a permit was not required to replace an existing structure. The information we received came to us while we were in Jacksonville,FL and at that time I was not able to scale out a full size plan, so I sent back what I thought was enough information for your records to facilitate obtaining and paying for a permit in an"after the fact"construction situation. No fees where submitted at that time because it was my assumption that all your office needed was some indication of where and how the carport was constructed. I did not understand that your staff would consider that this was a completely new application and go through all the process steps, including the calculation for plan review fees and permit application fees. I felt that all we needed was to pay the final permit fee and that would end the matter. i • After we returned from Florida and after I had met with one of your staff during your absence,things have been somewhat hectic in our lives and the requested information was placed on the back burner. We now submit to you and your staff a full scale drawing of the subject carport and await your response. Hopefully this information will cover all the requirements necessary to obtain the permit and put an end to this continuing saga. Box 186 Shelton, WA 98584 RE: BLD 2002-01631-221 NE Schooner Loop Ms. Nickerson We are completely at a loss when attempting to understand the requirements of Mason County Building codes and need some kind of assistance from you or your office. I am sending you a copy of our original letter address to Ms. Tammy Griffy to make sure that we are all on the same page. First: Construction of the new carport was done to replace an existing structure that had collapsed due to age and snow weight. Second: Personal contact by your office or any office of Mason County would have created a better working relationship with the people you support. Third: At present we are in Jacksonville, Florida and do not have access to a local designer in Mason County to facilitate preparation of the documents you request and the technical data that seems to be required by you office. Four: We plead ignorance in the fact that we assumed that a repair did not require a permit. Our questions are: Is it really necessary to go through all of this pain and suffering to obtain a building permit for such a structure as a cover for our cars? Is it necessary to consume all of these man-hours to obtain a permit for a structure that was constructed better than the original structure that was replaced? Is there any credit that we can claim for the three years that we paid taxes on the fallen down carport prior to replacing it with one that adds to the neighborhood? Is there anyway that we can send in photos of the new structure and pay for the permit and any other charges without further research of setbacks, land slopes, etc.? And finally: In that we are in Jacksonville, Florida and unable to get the necessary construction advice that is required to obtain a correct set of plans, site maps and other extraneous pieces of paperwork, is it possible to set this issue aside until our return? That return date is, at J present, under consideration and we may not be back to Belfair and Mason County until sometime in May. In closing, we would appreciate a review of our situation,that our request be re-evaluated and the required fees totaled so that we can feel comfortable with this simple stand-alone carport with nothing, such as plumbing or electrical wiring, added.
