The Examiner approves the application without conditions. 11 12 ORAL TESTIMONY 13 Kell McAboy introduced the staff report. John Keates introduced information on 14 behalf of Mason County Parks Department. See transcript/tape of hearing. 15 EXHIBITS 16 See "Exhibits" attached to the staff report by Kell McAboy dated June24, 2008 for a list of all exhibits. 17 FINDINGS OF FACT 18 Procedural: 19 1. Applicant. The applicant is Mason county Parks Department, with staff 20 representative John Keates. 21 2. Hearing. The Hearing Examiner conducted a hearing on the application 22 on June 24, 2008, at 1:00 p.m., in the Mason County Board of Commissioners Meeting Chambers. 23 24 Substantive: 25 3. Site/Proposal Description. The Mason County Parks Department requests a vacation of a dedication, specifically vacating the dedication of public access area between lots 45 and 46 in the plat of Mason Lake Estates, known as lot 72. (Exhibit #2) Mason County owns the unimproved 1.13 acre lot located at 1320 E. Mason Lake Jewell SSD P. 1 Findings, Conclusions and Decision {BFP696098.DOC;1/13009.900000/} v Dr. So. Grapeview, Washington in Section 07, Township 21 N., Range 2 W., W.M. 1 Vacation of the dedication to public access area is requested to allow Mason County 2 to surplus the lot for residential use and utilize the resulting revenue to improve existing parks and/or acquire new park property consistent with the Mason County 3 Parks and Recreation Comprehensive Plan. (Exhibit#4) 4 4. Characteristics of the Area. The parcel is located in a rural, mostly forested area. The site is located on Mason Lake, and is neighbored on both sides by 5 lots approximately half the size. The lot is located in the plat of Mason Lake Estates, 6 which has 71 other lots also abutting Mason Lake. Most of the lots in the vicinity are developed with a single family residence, and are approximately half an acre (Exhibit 7 #2). The lots located on either side of the parcel are both developed with single family residences. The land located to the south of the parcel is undeveloped forest 8 land. And all of the lots abut the lake on their northern or northwestern edge. 9 5. Adverse Impacts of Proposed Use. The staff concludes in its report that 10 there does not appear to be impact on surrounding properties for any adverse impacts. The parcel is currently sitting undeveloped between two developed lots, and its only 11 use appears to be for occasional access to the lakefront. In addition, the neighborhood of Mason Lake is adequately served by parks on the lake, as well as in 12 the surrounding vicinity, and will not be affected by the vacation of this public dedication. The county has not developed the property, nor does it have any intention 13 of doing so in the future. Also, the possible sale of this lot would allow the Parks 14 Department to raise spending on other parks to meet the level of service deficiencies at developed parks already in service. No comments from the public at large have 15 been received, and no significant adverse impacts are apparent from the record. Pope Resources, who dedicated the parkland as the developer of Mason Lakes Estates, has 16 relinquished any remaining legal interest it may have in the property, including any right to object over use of the property for nopark purposes (See Exhibit 5). 1 Consequently, vacation and sale of the parkland would not appear to result in any 18 adverse title or use issues to the County. 19 CONCLUSIONS OF LAW 20 Procedural: 21 1. Authority of Hearing Examiner. MCC 15.03.050(11) provides the 22 Examiner with the authority to review and act upon plat vacation permit applications. 23 Substantive: 24 2. Zoning Desimation. The area is zoned as Rural-Residential. The Mason 25 County Comprehensive Plan designation for the site is Rural. Under MCC 1.04.222(A), a single family residential development is a permitted use in RR-5, which is the intended future use after the proposed sale of this property following the approval of this application. RCW 58.17.212 governs vacations of subdivision and the procedures to be followed. Under RCW 58.17.212, whenever any person is interested in the vacation of any subdivision or portion thereof, or any 3 area designated or dedicated for public use, that person shall file an application for vacation with the legislative authority of the city, town, or county in which the 4 subdivision is located;in this case with the Mason County Hearing Examiner. 5 RCW 58.17.212 VACATION CRITERIA: 6 1) The applicant shall set forth the reasons for vacation. 7 Based on the Mason County Parks and Recreation Comprehensive Plan, the park is 8 too small, at approximately one acre, to be developed into a park, and does not have sufficient parking available. In addition, the park could be either sold for 9 development to obtain funds to acquire additional property to meet level of service 10 deficiencies and/or to provide a waterfront park that could potentially include a new parkland or open space. (Exhibit#4) 11 2) Is the subdivision subject to restrictive covenants which were filed at the time of 12 the approval of the subdivision, and will the application for vacation result in the 13 violation of such a covenant. 14 The only covenant brought up in a search of the property, as presented in Exhibit#9, is that the lots in Mason Lake Estates be used for residential purposes only. 15 Therefore, subdivision is not subject to restrictive covenants filed at the time of the approval of the subdivision, and as such, the vacation will not result in the violation 16 of any covenants. To the extent that the dedication for park use is construed as a covenant, the release by Pope Resources of any interest in the use and sale of the 17 property(Exhibit 5)eliminates any covenant compliance issue. 18 3) The legislative authority of the county shall give notice as provided in RCW 19 58.17.080 and 58.17.090. 20 A public notice of hearing(Exhibit #1) was mailed to the property owners within the 21 subdivision and published in the Shelton Journal (Exhibit #10) for one week at least 10 days prior to the scheduled public hearing. 22 4) The county shall conduct a public hearing on the application for a vacation. 23 The public hearing occurred on June 24, 2008 at 1:00 p.m., in the Mason County 24 Board of Commissioners Meeting Chambers. 25 5) Will the public use and interest be served by the vacation. Jewell SSD p. 3 Findings, Conclusions and Decision BFP696098.DOC;1/13009.900000/} Mason County Parks and Recreation Comprehensive Plan (Exhibit#4) states that the 1 lot is too small to be developed into a park, and does not have sufficient parking. The plan goes on to say that the parcel should be sold in order to meet level of service deficiencies elsewhere in the County. The lot is heavily wooded with thick underbrush and is not being utilized by the public for its original intended purpose. In addition, the Mason Lake area is already serviced by other park areas on the lake, as 4 well as other parks nearby. Since the proceeds of the property sale would be used for other park development, the proposed vacation is in the public interest since the net 5 result is to shift park resources to areas where they are more needed. 6 MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW: 7 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review 8 proposed development according to the following criteria: 9 1. The development does not conflict with the Comprehensive Plan and meets 10 the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. 11 2. Development does not impact the public health, safety and welfare and is in the public interest. 12 3. Development does not lower the level of service of transportation and/or 13 neighborhood park facilities below the minimum standards established within the 14 Comprehensive Plan. 15 6. As indicated in the staff report, the project is consistent with the Mason County comprehensive plan, as it calls out for the sale of this lot, which can occur 16 after vacating the dedication of the public access area. The project meets the requirements and the intent of Titles 6, 8, and 16. As there is no development at 17 question in this application, merely a vacation of a dedication, there will be no impact 18 on the public health, safety, and welfare. In addition, because the property is not being used for its intended purpose as a park currently, and because the sale of the 19 property would facilitate a higher level of service to other County Parks in underserved areas, the approval of this application is in the public interest. The 20 neighborhood of Mason Lake is adequately served by parks and will not be affected 21 by the vacation of this public dedication. Grapeview, Washington in Section 07, Township 21 N., Range 2 W., W.M. Tax Parcel# 22107-50-00072 IV. Findings A. RCW 58.17.212 Criteria 1. Notice required as provided in RCW 58.17.090. Staff Response:A public notice of hearing(Exhibit # 1) was mailed to the property owners within the subdivision and published in the Shelton Journal for one week at least 10 days prior to the scheduled public hearing. Page 1 of 3 DDR2008-00095 2. Conduct a public hearing to consider a vacation of said dedication; Staff Response: The hearing is scheduled for June 24, 2008. 3. Public use would not be served. Staff Response:Mason County Parks and Recreation Comprehensive Plan (Exhibit # 4)states that the lot known as "Mason Lake Picnic Park"is too small to be developed into a park, and does not have sufficient parking. The plan goes on to say that the parcel should be sold in order to meet level of service (LOS) deficiencies elsewhere in the County. The lot is heavily wooded with thick underbrush and is not being utilized by the public for its original intended purpose. B. Mason County Code Title 15 - Type III Review Criteria In addition to preparing a Staff Report and holding a public meeting, Type III permit applications shall be reviewed as follows: 1. The development does not conflict with the comprehensive plan and meets the requirements and intent of the Mason County Code. 2 . The development does not impact the public health, safety and welfare and is in the public interest. 3. The development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the comprehensive plan. Staff Response: This request is consistent with the above criteria. Chapter 7 of the Mason County Parks and Recreation Comprehensive Plan calls out for the sale of this lot, known as Mason Lake Picnic Park, which can occur after vacating the dedication of public access area. In addition, the sale of this lot will allow the Parks Department to raise the LOS of parks in an area of the County that is currently under-served. The neighborhood of Mason Lake is adequately served by parks and will not be affected by the vacation of this public dedication. V. CONCLUSIONS Upon reviewing this request(and the controlling RCW s)for vacation of subdivision, specifically vacating the dedication of access area from Mason Lake Estates, the Mason County Department of Community Development Planning Staff recommends approval. VI. ACTION OPTIONS 1. Approve dedication removal request. 2. Deny dedication removal request. 3. Conditionally approve the dedication removal request. 4. Postpone for further information. (9/17/59)" CHAPTER 7 LEVEL OF SERVICE STRATEGIES Community Parks: Proximity Standard: The figure "Mason County Parks and Facilities Community Parks" on page 36 shows the service area for Community Parks. Each circle represents a five-mile travel distance from each present Community Park location. There are service area deficits in Mason County based on a standard that Mason County residents reside within five miles of a community park. The recommended demand standard of 1.57 acres per 1,000 population establishes a need of 95.4 acres. An additional 10.77 acres would be needed by 2012 to reach this standard. Acquisition of Harvey Rendsland Park: The acquisition of Harvey Rendsland Park from Washington State Parks will help satisfy the existing deficit for a community park in the northeast area (Tahuya - Belfair) of the County. The park is 8 acres and is presently undeveloped. Future plans would include a picnic area, walking trails, water access, and other passive uses. As of the writing of this plan, Mason County is working with Washington State Parks to acquire the park. Possible Future Park Near Star Lake, Lost Lake, Lake Nahwatzel, or Cloquallum Road: The largest deficit is located in the west and southwest section of Mason County. Currently, the only park in this area in Truman Glick Memorial Park. The County should investigate the potential of acquiring a minimum of ten to fifteen acres of property to develop a community park, which would address the deficit in this portion of the County. A park that provides swimming access would be most beneficial - addressing both the acreage deficit and water access need. Latimer's Landing: if funding can be secured, the County should attempt to acquire the 2.35-acre parcel adjacent to Latimer's Landing to enhance and improve the existing boat launch. The property is currently for sale. If acquired, the park-boat launch would be significantly improved and would provide greatly enhanced waterfront access on Pickering Passage and would provide an additional 2.35 acres of community parkland toward the current acreage deficit. This acquisition would also address the public support for new and improved waterfront access and a current water access deficit. The property acquisition would enable Latimer's Landing to be a destination Community Park. Regional Parks: Proximity Standard: The figure "Mason County Parks and Facilities Regional Parks" on page 40 shows the service area for Regional Parks. Each circle represents a fifteen-mile travel distance from each present Regional Park location. There are deficits in Mason County based on a standard that Mason County residents reside Parks and Recreation Comprehensive Plan 56 12.1 1.06 within fifteen miles of a regional park. The current deficit is located in the southwest portion of Mason County. The recommended demand standard is 3.48 acres per 1,000 population. Current regional park inventory is 151.87 acres and the proposed acreage in 2012 is 208.8 acres, leaving a deficit of 56.9 acres. Development of Oakland Bay Park: High priority should be placed on developing Oakland Bay Park. The current inventory of 151.87 acres includes the 81 .87 acres at Oakland Bay Park, even though the park is not yet developed. Mason County does not have a regional park that provides passive recreation such as nature viewing, hiking-walking opportunities, picnic areas, and environmental education. The development of Oakland Bay Park would help meet this need. Any development of Oakland Bay Park must be consistent with the Conservation Easement between Mason County and the Capital Land Trust. Lake Isabella State Park: Washington State Parks has contacted Mason County regarding the "potential" for selling or transferring all or a portion of Lake Isabella State Park. It would in the best interest of the County to keep this 190- acre state park facility under public ownership. If Lake Isabella were to be acquired by Mason County, the acquisition would satisfy the deficit of a Regional Park in the southwest portion of the County and would also provide another location that could provide passive and active recreation in addition to water access and trails. Acquisition of all or a part of the property, alone or in partnership would be recommended. A second option would be to form a partnership with Washington State Parks to develop all or a portion of the site as a regional park. Natural Areas / Open Space: Proximity Standard: The County has a present inventory of 1 16.7 acres of natural areas and open space. A recommended demand standard has been established of 8.5 acres per 1 ,000 population, which would create a need for 516.7 acres in 2012 - a deficit of 400 acres. The County will need acreage for Regional Trails and may also be involved in possible transfer of property from other government entities. Potential Sale of Mason Lake Picnic Park: This park site, located on Mason Lake, is just less than one acre, is too small to be developed into a park, and does not have sufficient parking.This park should either be sold for development to acquire additional property to meet current LOS deficits and/or to provide a waterfront park that could potentially include a new parkland or open space. Potential Property Acquisition from Transfers. Donations, or Partnerships: Mason County should continue to work with other government entities, private enterprise, and non-profit groups to preserve and enhance natural areas and open space. As mentioned in the section on Regional Parks, Washington State Parks has been evaluating their parks and facilities in Mason County. Rather than lose precious natural areas to potential land sales by other government organizations, Mason County should continue to keep an open dialogue with landowners regarding the status of natural areas and open space in the County. Monty, attached is information I have put together regarding property owned by Mason County at Mason Lake. This property was originally platted in 1959 and owned by Pope & Talbot, Inc. On the face of the plat that was recorded in 1959, there is a dedication with regard to this property, dedicating it to the use of the public. In 1985, Pope & Talbot, Inc. conveyed to Pope Resources its interest of certain identified properties to several counties, including Mason. On October 3, 2003, Pope Resources determined that they no longer had adjoining lands or had any benefit from retaining this parcel so they offered it to Mason County for an administrative fee of $1,000. This offer was accepted by Mason County, thus the property has been in County ownership since that time. There were no conditions applied to the property at the time of conveyance other than the original dedication from 1959. I received an inquiry from John Keates, MC Parks & Trails Director, in which he asked about the feasibility of selling the land to anyone in the general public in order to utilize the revenue from the sale to improve other County Parks. There have been no improvements to the subject site since the County obtained full ownership, and according to John, the County does not intend to make improvements. As you know Mason County already has a fairly substantial park/boat launch facility at Mason Lake which is maintained annually by the Parks &Trails Department. In response to this inquiry I asked Dennis Pickard from Mason County Title to research the deeds of the lots existing within Mason Lake Estates Subdivision to determine if there were any deed restrictions that would prevent sale of this property for potential private development. No deed restrictions were found among the lots within the subdivision. RCW 58.17.215 outlines the procedure for alteration of a subdivision. The removal of the current dedication on the face of the plat of Mason Lake Estates would require an alteration of the subdivision. There is no state statute that prohibits removal of a dedication, as long as the procedure for this action is followed. Rick Brush has raised a question that the current dedication may have a restriction because it is a public right to travel to the water, and as such may be considered a road and subject to RCW 36.87.130, which prohibits vacating roads that abut water. He also has a question about abutting property owners, asking if they own an underlying fee in this property. There is no legal deed restriction or any other documentation that would support this question. As for the restriction that it is a public right to travel to the water is also not substantiated, as it has never been used for that purpose, nor did the original dedication allude to that restriction. Rick also mentions RCW 58.07.015, however, again, I do not see that this statute has any bearing on the issue of an alteration to a plat. I believe that we have the authority to proceed with an alteration to the plat, following the procedures outlined in RCW 58.17.215, but would ask your legal opinion of concurrence before proceeding. There was also a question about the abutting owners: Do they own the underlying fee in this property as they do for the roads they abut. If so,we couldn't sell it without deeds from them releasing their interests. RCW 58.08.015,which was quoted in the OPG letter you sent me, says that every dedication in a plat is to be considered a quitclaim deed. However, there is an exception to that,which is not mentioned. Roads dedicated in a plat are easements only and those property owners who abut the roads own the underlying fee. So, if this property is in fact a dedicated right of way,there is a"cloud on its title"because the abutting owners have potential"claims of title"against it. In other words,we don't own it free and clear. Another possible problem with RCW 58.08.015 may be that it seems designed to make it clear that a dedication conveys full ownership so that the grantee is free to use the dedicated property without any claim of residual ownership interest by the grantor. It also says that the grantee is free to use the dedicated property"for the purposes intended by the grantor." Having full ownership would seem to make it possible to amend the plat, but does the phrase, "for the purposes intended by the grantor,"place a restriction on that? Why don't we get together with Monty Cobb and possibly with the attorney you mentioned and discuss it? A legal analysis and opinion from the Prosecutor's Office is needed, I think. Probably don't need SEPA(though check with Bob on this). Michael RCW 58.17.215 Alteration of subdivision -- Procedure. When any person is interested in the alteration of any subdivision or the altering of any portion thereof, except as provided in RCW 58.17.040(6), that person shall submit an application to request the alteration to the legislative authority of the city,town, or county where the subdivision is located. The application shall contain the signatures of the majority of those persons having an ownership interest of lots, tracts, parcels, sites, or divisions in the subject subdivision or portion to be altered. If the subdivision is subject to restrictive covenants which were filed at the time of the approval of the subdivision, and the application for alteration would result in the violation of a covenant,the application shall contain an agreement signed by all parties subject to the covenants providing that the parties agree to terminate or alter the relevant covenants to accomplish the purpose of the alteration of the subdivision or portion thereof. The RCW on alteration of a subdivision states that if an alteration of a subdivision would result in the violation of a covenant, the application shall contain an agreement signed by all parties subject to the covenant providing that the parties agree to terminate or alter the relevant covenants to accomplish the purpose of the alteration of the subdivision. This would mean that Pope Resources, as original owner, would have to agree to elimination of the language that the two lots be dedicated to the public forever. There are service area deficits in Mason County based on a standard that Mason County residents reside within five miles of a community park. The recommended demand standard of 1 .57 acres per 1,000 population establishes a need of 95.4 acres. An additional 10.77 acres would be needed by 2012 to reach this standard. ,s Acquisition of Harvey_Rendsland_Park: The acquisition of Harvey Rendsland Park from Washington State Parks will help satisfy the existing deficit for a community park in the northeast area (Tahuya - Belfair) of the County. The park is 8 acres and is presently undeveloped. Future plans would include a picnic area, walking trails, water access, and other passive uses. As of the writing of this plan, Mason County is working with Washington State Parks to acquire the park. s5tble_Future Park Near Star_La_ke, Lost Lake 1�Lake_Nahwatzelr_or Cloquallum Road: The largest deficit is located in the west and southwest section of Mason County. Currently, the only park in this area in Truman Glick Memorial Park. The County should investigate the potential of acquiring a minimum of ten lo fifteen acres of property to develop a community park, which would address the deficit in this portion of the County. A park that provides swimming access would be most beneficial - addressing both the acreage deficit and water access need. Latimer's Landing: ---- O"s.-- If funding can be secured, the County should attempt to acquire the 2.35-acre parcel adjacent to Latimer's Landing to enhance and improve the existing boat launch. The property is currently for sale. If acquired, the park-boat launch would be significantly improved and would provide greatly enhanced waterfront access on Pickering Passage and would provide an additional 2.35 acres of community T parkland toward the current acreage deficit. This acquisition would also address the public support for new and improved waterfront access and a current water access deficit. The property acquisition would enable Latimer's Landing to be a destination Community Park. Regional Parks: Proximity Standard: The figure "Mason County Parks and Facilities Regional Parks" on page 40 shows the service area for Regional Parks. Each circle represents a fifteen-mile travel distance from each present Regional Park location. There are deficits in Mason County based on a standard that Mason County residents reside Parks and Recreation Comprehensive Plan 56 12.1 1.06 within fifteen miles of a regional park. The current deficit is located in the southwest portion of Mason County. The recommended demand standard is 3.48 acres per 1,000 population. Current regional park inventory is 1 51.87 acres and the proposed acreage in 2012 is 208.8 acres, leaving a deficit of 56.9 acres. Development of Oakland Bay Park: High priority should be placed on developing Oakland Bay Park. The current inventory of 1 51.87 acres includes the 81 .87 acres at Oakland Bay Park, even though the park is not yet developed. Mason County does not have a regional park that provides passive recreation such as nature viewing, hiking-walking opportunities, picnic areas, and environmental education. The development of Oakland Bay Park would help meet this need. Any development of Oakland Bay Park must be consistent with the Conservation Easement between Mason County and the Capital Land Trust. Lake Is4l)ella State Park: Washington State Parks has contacted Mason County regarding the "potential" for selling or transferring all or a portion of Lake Isabella State Park. It would in the best interest of the County to keep this 1 90- acre state park facility under public ownership. If Lake Isabella were to be acquired by Mason County, the acquisition would satisfy the deficit of a Regional Park in the southwest portion of the County and would also provide another location that could provide passive and active recreation in addition to water access and trails. Acquisition of all or a part of the property, alone or in partnership would be recommended. A second option.would be to form a partnership with Washington State Parks to develop all or a portion of the site as a regional park. (aural Areas / Open Space: Proximity Standard: The County has a present inventory of 116.7 acres of natural areas and open space. A recommended demand standard has been established of 8.5 acres per 1,000 population, which would create a need for 516.7 acres in 2012 - a deficit of 400 acres. The County will need acreage for Regional Trails and may also be involved in possible transfer of property from other government entities. This park site, located on Mason Lake, is just less than one acre, is too small to be developed into a park, and does not have sufficient parking. This park should either be sold for development to acquire additional property to meet current LOS deficits and/or to provide a waterfront park that could potentially include a new parkland or open space. Potential Propel Acaujsitipn from Transfers. Donations, or Partnerships, Mason County should continue to work with other government entities, private enterprise, and non-profit groups to preserve and enhance natural areas and open space. As mentioned in the section on Regional Parks, Washington State Parks has been evaluating their parks and facilities in Mason County. Rather than lose precious natural areas to potential land sales by other government organizations, Mason County should continue to keep an open dialogue with landowners regarding the status of natural areas and open space in the County. For example, in addition to Lake Isabella State Park, Washington State Parks 57 Parks and Recreation Comprehensive Plan 12.1 1.06 1 I r 3. Natural Area - Open Space: Mason County recognizes that natural areas and open space are a vital component of the health and well being of the County and provide natural resources for habitat protection. Preserving and protecting these properties is essential to retaining the abundance of recreational opportunities in the region. Mason County desires to work with interested organizations to achieve this goal. The County can also partner with non-profit organizations groups such as the Trust for Public Land and Capital Land Trust to retain natural areas and open space. Currently, Mason County owns and manages four sites as a Natural Area - Open Space. These sites include: ♦ Foothills Park I ♦ Harstine Island Park + Intake Picnic Park ---- I ♦ Watson Wildwood Park Existing Conditions: Mason County is not a highly urbanized county and fortunate to have a great deal of natural areas-open space. Currently, in addition to inventory owned by the County, there is a significant amount of natural areas and open space owned by Washington State Parks, Department of Natural Resources (Tahuya State Forest), Olympic National Forest, and Olympic National Park. Green Diamond Resources, and the Manke Company are also providers of private natural areas. Much of this private land is managed for timber resources. The Theler Wetlands near Belfair are also a very popular destination of statewide significance. Washington State Parks has several tracts of land that provide significant open space, including Harstine Island (310 acres), Hoodsport Trails (80 acres), Hope Island (106 acres), and Lake Isabella (193 acres), and they are currently studying the long-range plans and use for some of their parks-natural areas. Maintenance Impacts: The maintenance of natural areas and open space tends to be minimal and is less costly than maintaining Community Parks, Regional Parks, and certain Special Use Areas. Public Input and TreC s: Participate in Off Road Vehicle Recreation? ld The Countywide parks survey indicates that respondents highly desire pedestrian and bicycle trails. (now Pope Resources LLQ platted lands on the shore of Mason Lake known as,Mason Lake Estates. When the Plat was created,one piece of land,Mason County tax parcel 22107-50-00072,was designated as"Dedicated Public Access"and was intended to provide public recreational access to Mason Lake. Over the decades, Pope never developed that access and it was eventually transferred to the County in 2004. The"Dedicated Public Access"has never been developed into a public space, understandably,as Mason County Parks has already developed a recreational access at the Mason Lake County Park, a wonderful 18 acre park that includes a public boat launch and beach. It is clear to us that the piece of land we dedicated so long ago does not serve its intended purpose and maybe of greater value to Mason County if it was sold as a developable lot and proceeds from that sale we reinvested in improving or developing new water access areas in Mason County. As such,Pope Resources would be amenable to amending the Mason Lake Estate Plat to change the"Dedicated Public Access"to a salable lot. Although now under County ownership, the original dedication of these lots to the public forever does present the problem of selling the land. The RCW on alteration of a subdivision states that if an alteration of a subdivision would result in the violation of a covenant, the application shall contain an agreement signed by all parties subject to the covenant providing that the parties agree to terminate or alter the relevant covenants to accomplish the purpose of the alteration of the subdivision. This would mean that Pope Resources, as original owner, would have to agree to elimination of the language that the two lots be dedicated to the public forever. You indicated that Pope Resources would be agreeable to such change. Is there a way to get that in writing so that we can process the change through th e plat a teration process? My conversation with John Rose and Brandon Bird at Pope/Olympic Property Group, is that it was thought of as a park space but not a right of way. When I advised them that the sale of the property could help Mason County do 2 or 3 other parks and that Mason Lake is already served by a great County Park, they said they were open to preparing an amendment for clarification of the terms used in the plat, as the original plat applicant. I have a meeting with Pope on Friday, November 16th in the AM. While I am working with them on several conservation projects in Mason and Kitsap County, I'd like to work this property in.
