NOTICE OF MASON COUNTY CODE VIOLATION
Richard W. Whipple
PO Box 187
Tracyton, W 98393-0187
The receipt of this notice shall constitute service regarding notification of violations of
the Mason County Code, Title 14, Building and Construction. The violation(s)are
occurring at the following property:
Enforcement Case File No.: ENF2004-00472
Parcel No: 12330-50-00051
Site Address: 60 NE Davey Jones Pl., Belfair,WA
❑ The Mason County Building Department investigated on 11/19/04 a complaint
regarding the occupancy of a manufactured/mobile home at the above location which
was previously posted by this department for non-occupancy. The building inspector
noted that the complaint appeared valid and posted a Correction Notice.
According to the Mason County Assessor records, parties named above hold legal
interest in the parcel and are therefore subject to enforcement action for failure to
comply.
In order to bring your site into compliance you must: 1)Immediately vacate or cause to
be vacated the mobile home with non-permitted addition. Continued occupancy
will result in additional enforcement action against you.
The mobile home and addition were originally posted for non-occupancy on February 4,
2000 for failure to obtain inspections on the mobile home under expired permit number
#10713 and failure to obtain the permit for the wood frame addition. As a result of that
posting, you informed me on February 16,2000,that you were in the process of drawing
plans for the Washington State Department of Labor and Industries and Mason County to
obtain the after the fact permits for the wood frame structure addition that is bearing on
the mobile home unit and assured me that the unit would remain vacated until occupancy
approval had been granted by Mason County.
When the most recent complaints were received, your file was referred back to me for
compliance action. I failed to locate any records that indicate you had received the
required inspections or permits that we had discussed were necessary in February of
2000.
Please make the necessary arrangements to achieve compliance prior to December 22,
2004. If the permits are not received by December 22, 2004, we will pursue additional
enforcement action against you, including but not limited to civil infractions, liens against
the property through the Mason County Hearings Examiner process and/or criminal
prosecution as allowed under Title 14 and Title 15 of the Mason County Code.
In the event that you feel you have received this notice in error or that the facts are
inaccurate, I strongly encourage you to contact me at(360)427-9670 ext 356 to discuss
your concerns immediately.

Tami Griffey
Building Inspector/Code Enforcement
Case No. ENF2004-00472
Tami:
I received in the mail and by certified mail a notice from your office. I am directed to have
my mobile home located at 60 NE Davey Jones Pl. not occupied. I am also directed to
take the steps that I should have done in 2000. I have not, and for that I am sorry, but I
Will.
The problem that I am having at this point is major. I currently have a person that is
supposed to be renting from me living there; but what is really happening is that Evelyn
McFeely is sucking from the system. When she moved in I was promised a check from
DSHS for $710.00 to help her to move in. She also gave me $50.00 cash and a check for
$100.00. The check turned out to be written on a closed account and my bank returned it
to me with a bounced charge.
To this date I have received no further monies from Evelyn. She moved in on September
5'h 2004. She was to have the electricity changed into her name and to pay me rents for
living there. This has not happened. As I understand it from the neighbors she is running a
drug induced live in for like minded individuals. All of which are receiving monies from
the State or County to not be employed.
The County Sheriff s office has been notified and the Drug Task force of Mason County
and Kitsap County is watching the place and has raided the place on several occasions.
The Beard's Cove Community Organization has written me in protest due to the large
amount of people living there and the fact that Evelyn has given permission to another
person to park a trailer on the property and live there. The Sheriff has notified me that
even though I want the trailer moved and so does Beards Cove Community Org. Their
hands are tied due to the fact that Evelyn is"Renting" and has given permission for the
trailer to be there. The Sheriff came out and tried to get the trailer towed, but since it was
occupied they could do nothing.
Evelyn is receiving monies from the State/County, her son is receiving money from the
State/County for going to school {he is not or has not been going to school). I have
obtained help from an attorney in Shelton; but since Evelyn hides in the mobile and never
leaves I have not been able to serve her the proper papers to get them out. The Landlord
& Tenants Act is tying my hands.
I do realize that I am in deep trouble from your office by what I have done (modifying) to
the mobile home and I will fix that. I intend in the spring to remove all of the roof system
that is there, put in engineered trusses and support the system as it should have been
originally. This I shall do with your ok and plans given to L&I and your office.
As to removing the people in the mobile, I need your help or someone's help. They are
taking monies from the system and abusing the system. I have heard from the neighbors
that Evelyn does this repeatedly when ever she can. I do not have the power to get them
out even though I would like that place empty and locked up until clear from your office.
The sheriff has not the power; so what can I do?
Evelyn and all of those living there are receiving money from the State/County, her son is
receiving money from the State/County. There is drug activity going on all the time. There
is a trailer on the property with out my permission. There is a large amount of people
living there and not paying for the privilege. I want them out! You want them out. Ok
what can I do?
My address is : P.O. Box 187 Tracyton, WA. 98393 I work at Kitsap Lumber in
Bremerton the address is 450 National Ave. Phone 479-4414. My cell phone is 649-3373.
I have called your office and left a message for you to call and not heard anything. Please
help me. I wish to get this matter resolved and the property back into the system. Money
for your office and money for me, not a drag on the system.
Thank you
Richard W. Whipple
