Below you will find comments made regarding the proposed development and its critical values. This information is based on County and State regulations as they exist to date. Please contact me at (360) 427-9670, ext. if you have questions. +nre , Rick Mraz Land Use Planner Mason County Planning Department 3/18/02 1 of 2 RLC2002-00017 Resource Lands & Critical Area Site Evaluation 3/18/02 Case No.: RLC2002-00017 Comments A field inspection of the subject property was conducted on 3/14/02 to evaluate critical areas issues relative to the replacement of a manufactured home. The parcel contains frontage on an unnamed type IV stream. The Mason County Resource Ordinance (RO) requires a 115' setback from type IV streams. Per the provisions of the RO, a development activity that proposes to encroach on the setback typically requires a variance supported by a Habitat Management Plan. However, exemptions exist in the RO for normal repair and maintenance (which has been interpreted to include total replacement of manufactured homes) provided that the new building footprint does not exceed the previous footprint by more than 10% A review of the parcel history indicates that the lot had been the source of past environmental health complaints. The site inspection noted that the original structures onsite had been demolished and removed. Many small pieces of debris remained onsite, imbedded in the ground and sidecast near the stream. No clear evidence was present to indicate the size of the original structures. During the site inspection, staff indicated that the site plan showing a proposed 40' setback from the stream was acceptable. No portion of the new construction should encroach closer than 40' from the edge of the stream. A review of the Mason County Assessor's database indicates that the original home was a 14' X 50' single-wide (700 sq. ft.) with a 63 sq. foot deck. Another 125 square foot "under roof' structure was also assessed. These structures total 888 square feet. This amount is well below the speculated coverage discussed during the site inspection. A strict interpretation of the County ordinance would allow only a 977 square foot replacement. Significant exceedence of this amount would require a variance from the Resource Ordinance and a supporting Habitat Management Plan (HMP) as outlined in the ordinance. If there are historical photos that demonstrate other structures on this property then the footprint limit may be raised. A copy of the Fish and Wildlife Habitat Conservation Areas chapter of the Resource Ordinance is enclosed for your review. It contains details about the contents of a HMP and specific guidance as to the variance procedure.
