The Decision was dated 06/06/2008 and approves the application by the Hearing Examiner per the recommended conditions in the staff report. The request for the special use permit for a change in use to a Game Arcade (pool hall) in the Mixed Use District(MU) of the Belfair Urban Growth Area was review and approved under MMC 17.23.140,private recreation facility including game arcade is a permitted use subject to a special use permit in the MU Districts in Belfair UGA. The Examiner 10 approves the application. 11 ORAL TESTIMONY 12 James Scholz introduced the staff report and exhibits into the record and answered 13 questions from the Hearing Examiner. See Tape. 14 EXHIBITS 15 See "Case Index" attached to the April 10, 2008, staff report for DDR2008-00046. 16 FINDINGS OF FACT 17 Procedural: 18 1. Applicant. The applicant is Sean Allen. 19 20 2. Hearing. The Hearing Examiner conducted a hearing on the application on April 22, 2008, at 1:00 p.m., in the Mason County Board of Commissioners 21 Meeting Chambers. 22 Substantive: 23 3. Site/Proposal Description. The proposal is for the establishment of a pool 24 hall/coffee and ice cream shop within an existing building in the Belfair Urban Growth Area. The parcel is approximately 0.25 acres in size. There is a subdivided 25 building on the parcel with an existing business (Mr. Bill's Cards). There is an existing septic system on site and existing designated parking. The parcel is a middle lot with SR 3 running south to north along the east property line. TR 21 OF SW SE of Sect 29, 1 Township 23 N,Range 1 W,Parcel# 12329-43-00210. 2 4. Characteristics of the Area. The site is located in an area zoned as Mixed 3 Use in the Belfair UGA. Many of the surrounding properties are commercial businesses and are of similar size. North of and adjacent to the proposed business and 4 within the same building is Mr. Bill's Cards. North of the proposed site on SR 3 are two additional businesses, the Crab Guy and the Woodshed. To the northeast of the 5 proposed site is a strip mall that contains four different commercial businesses of 6 similar size. Directly south of and adjacent to the proposed site is a commercial business known as the Rice Bowl. Directly west and across SR 3 from the proposed 7 site is Mitchell Lumber, Key Bank, and Subway. 8 5. Adverse Impacts of Proposed Use. The proposed commercial use is compatible with neighboring commercial uses, and the Examiner finds no evidence in 9 the record that it will have a significant adverse impact. Neither staff nor project 10 neighbors have expressed any concern. 11 CONCLUSIONS OF LAW 12 Procedural: 13 1. Authority of Hearing Examiner. MCC 15.03.050(J) provides the 14 Examiner with the authority to review and act upon Type III decisions such as special use permit applications. 15 16 2. Notice of Application. According to staff, copies of notice of application and hearing were posted on site and at a public place. Said copies were also sent to 17 adjacent property owners within 300 feet of the subject property and published in the Mason County Journal. 18 Substantive: 19 20 2. Zoning Desipnation. As noted above, the area is designated as Mixed Use District zone in the Mason County Zoning Code. The Mason County Comprehensive 21 Plan designation for the site is Belfair Urban Growth Area. 22 3. Review Criteria and Application. Under MMC 17.23.140, private 23 recreation facility including game arcade is a permitted use subject to a special use permit in the MU Districts in Belfair UGA. The review criteria for a special use 24 permit application are governed by MCC 1.05.044, which are laid out below with applicable conclusions of law. In addition, all Type III decisions are subject to MCC 25 15.09.055(C). Special Use Permit Special Use Permit p. 2 Findings, Conclusions and Decision (BFP695003.DOC;1/13009.900000/) MCC 1.05.044(A): That the proposed use will not be detrimental to public health, 1 safety and welfare. 4. According to staff, there will be no likely detriment to the public health, 3 safety and welfare. As noted above, the County has not received any complaint in response to the Public Notice for the application. No potential detrimental effects 4 have been identified. This proposal does not constitute new urban growth requiring public services or facilities. It does not appear that the proposed game arcade will 5 increase the amount of traffic anymore than the existing businesses that are already 6 located off of SR 3. It appears that the game arcade will serve the existing urban community. 7 MCC 1.05.044(B): That the proposed use is consistent and compatible with the 8 intent of the comprehensive plan. 9 5. According to staff, there does not appear to be any conflicts with the 10 County Comprehensive Plan. The proposal is consistent with the general policies of the Comprehensive Plan Chapter III (Planning Policies), Section III-2 (Urban Growth 1 1 Areas), No. 2.30 (Belfair Urban Growth Area), BUGA 1 that incorporates the Belfair Urban Growth Area Plan 2004 by reference into the Comprehensive Plan, and U-205 12 of No. 2.31 that states that Mason County should plan for a variety of uses in the Belfair UGA, including residential, open space, public facilities, cultural facilities, 13 and commercial, retail and industrial uses. The proposed use is a commercial use 14 providing entertainment and food and beverage, and is compatible with the intent of the Comp Plan. 15 MCC 1.05.044(C): That the proposed used will not introduce hazardous conditions 16 at the site that cannot be mitigated through appropriate measures to protect adjacent 17 properties in the community at large. 18 6. No hazardous conditions are expected as a result of the proposal. This proposal is for the establishment of a pool hall/coffee and ice cream shop. 19 MCC 1.05.0440: That the proposed use is served by adequate public facilities 20 which are in place, or planned as a condition of approval or as an identified item in 21 the County's Capital Facilities Plan. 22 7. As indicated in the staff report, public facilities are in place and are adequate to service the proposed use. The proposed use will not require additional 23 public facilities. The proposed site lies within the existing Belfair Urban Growth Area, which already has adequate public facilities (roads, utilities, water, and septic) 24 in place. 25 MCC 1.05.044(E): That the proposed use will not have a significant impact upon existing uses on adjacent lands. Special Use Permit p. 3 Findings, Conclusions and Decision {BFP695003.DOC;1/13009.900000/} 8. There will be no significant impact upon existing adjacent land uses. 1 Adjacent land uses are all commercial uses that are compatible. As noted above, 2 there are several businesses adjacent to the proposed establishment and additional businesses within one mile of the proposed pool hall/coffee and ice cream shop. 3 MCC 1.05.044(F): If located outside the urban growth area, that the proposed use 4 will not result in the need to extend the urban services. 5 9. As noted above,the proposed use is located inside an urban growth area. 6 Type III Review in General 7 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review 8 proposed development according to the following criteria: 9 1. The development does not conflict with the Comprehensive Plan and meets 10 the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. 11 10. As noted above, this development is consistent with the Comprehensive Plan. The parcel is zoned as the Mixed Use District of the Belfair Urban Growth 12 Area where game arcades are permitted with a Special Use Permit. The proposal meets the intent of Mason County Code, Title 8 because it is outside of any stream, 13 shoreline, wetland, or landslide hazard area buffer/setbacks. Title 6 and 16 do not 14 apply. 15 2. Development does not impact the public health, safety and welfare and is in the public interest. 16 11. As indicated by staff, this development will have no discernable impact on 17 public health, safety and welfare; as a result, permitting the instant allowable use 18 within the zoning district is in the public interest. 19 3. Development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the 20 Comprehensive Plan. 21 12. According to staff, the proposal should not lower the level of service of 22 transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. The site of the proposed development is a 23 preexisting building with access off State Highway 3. The preexisting building has established designated parking. The proposed change in use does not present a 24 significant change in land use from the prior land. The number of proposed 25 accommodations (pool tables, dart boards, seating accommodations) limits the number of potential patrons. This report evaluates a proposal for a change in use and for the establishment of a pool hall/coffee and ice cream shop within an existing building in the Belfair Urban Growth Area. Staff recommends approval of the Special Use Permit. II. Applicant. Sean Allen. Ill. Property Location. 23692 NE State Route 3, Belfair, WA. Project is SEPA exempt per WAC 197-11-800. VII. Other Permits/Approvals. A Notice of Application and Public Hearing (Exhibit 4) was posted on the site, and at the corner of Belfair Street and SR 3, and at the Belfair Post Office on March 18, 2008 and in the Mason County Journal to run on March 20, and March 27, 2008. Affidavit of Posting Notice is marked as Exhibit 5 and the Affidavit of Publication is marked as Exhibit 6. The Notice of Application and Public Hearing was also mailed out to all property owners within 300 feet of the property owners on March 17, 2008. The proposal will require a Mason County Tenant Review Application (COM2008-00010) marked as Exhibit 7. No comments have been received to date. Vill. Analysis of Review Criteria. This proposal requires a Special Use Permit due to the requirements of Mason County Code Title 17 (Zoning), Chapter 17.23 (Mixed Use Districts in the Belfair UGA), Section 17.23.140 (Special Uses), No. 7 (Private recreation facilities including game arcades, batting cages, shooting galleries and skating rinks) is an allowed use within the Mixed Use District with a Special Use Permit. B. Applicable Special Use Review Criteria: See the applicant's answers to these criteria, marked Exhibit 8. 1. Will the proposed use be detrimental to the public health, safety and welfare? Staff Response: No potential detrimental effects have been identified. This proposal does not constitute new urban growth, require public services or facilities. Applicable Title 15 Review Criteria: Per section 15.09.050 (C) (1-3), the Hearing Examiner shall review a proposed development according to the following criteria. The proposal meets the intent of the Mason County code, Title 6. The existing sanitation facilities support the proposal. Title 8 and 16 do not apply.
