Dear Mr. Wyble,
I understand as a result of the pre-application conference on June 26, 2014 that there
seems to be some confusion as to what county codes are applicable in this case.
Cannabis Care Foundation is an access point or dispensary for medical cannabis that
does not actually grow its own plants. As such, it was your position that this business
does not meet the definition of collective garden and therefore is not subject to the
codes that govern them in Mason County. I believe that more or less sums up your
position. Please correct if I am wrong.
Technically you are correct; Chapter 17.09 does not define access points or
dispensaries. This is because they were removed from the original legislation as
signed by the Governor and eventually adopted into state law. Nevertheless, part of a
collective garden is"delivering cannabis for medical use"'which is what Cannabis Care
does—it is a delivery point for medical cannabis. Dispensaries or access points are not
separately defined; however they are still part of a collective garden and still subject to
our codes. No land use is exempt from County codes and must fall into the category
that best describes its intent. If Cannabis Care as a supplier of marijuana is not a
collective garden,then the alternative is that it is a retail 502 operation -which I'm
guessing is not the case. Therefore,you are subject to Chapter 17.09 and are required
to comply with it and all other applicable county Codes.
We attempted to them the enclosed summary in July but had it returned due to an
incorrect address. Considering there were questions outstanding with respect to
applicable regulations,we held off and resending it until I could follow up with the
answers you needed. This letter will serve as that response. Please address the items
listed in the enclosed documents and submit your necessary applications as soon as
possible.

If you are in the process of obtaining permits we can consider you as in working
toward compliance. If we do not have active permits addressing the outstanding code
compliance issues,we will need to post a notice of violation at the site and request
that you cease and desist operations until compliance is reached. I am optimistic,
however that that will not be necessary.

PROJECT DESCRIPTION & SIZE:
When an existing structure will be used to operate a Collective Garden in accordance with Mason County Code
17.09 the applicant may use the Change in Tenant application form to obtain a permit. Complete the application
form following all instructions. Include required documents including a floor plan drawn to scale. In addition to
items listed on the form be sure to identify all elements required for a Collective Garden as specified in 17.09.003,
items A through M.
When the permit application is submitted the permit will be routed to all relevant departments to verify compliance
to department regulations. When all departments have approved the permit application the permit will be issued
and required inspections performed. Occupancy approval will be granted after all required inspections are
completed and approved.
The following information is essential to perform a plan review by the Fire Marshal's office. Proposed construction
plans and documents should include all relevant information listed below. Please note that the Fire Marshal
representative has made every attempt to identify all critical information that will be needed based upon the
information provided in the pre-application documents. Additional information may be necessary when the Fire
Marshal is presented with proposed plans for the project. The information provided below references the current
adopted codes. A complete list is provided at the end of this document.
• OCCUPANCY CLASSIFICATION & USE : Identify the occupancy classification(s) and specify use as
defined and specified in accordance to the current International Building Code (IBC), Chapter 3 and
International Fire Code (IFC), Chapter 2.
• CONSTRUCTION TYPE: Referencing IBC, Chapter 6 clearly identify the type of construction.
• WATER SUPPLY & FIRE HYDRANT: Referencing IFC, Section 508; clearly identify intended code
compliance, including type of water supply.
• FIRE FLOW: A copy of the approved method for determining fire flow is enclosed. Please provide a copy
of the completed worksheet with proposed construction documents.
• EMERGENCY VEHICLE ACCESS: A copy of the "Standards for Fire Apparatus Access Roads"
adopted through Mason County Building Code, Section 14.17 is attached. Verify that documents
clearly identify code compliance.
• ADDRESSING: Referencing IFC, Section 505 and Mason County Code Chapter 14.28, all new buildings
shall have an approved address. Applications for an approved address can be obtained on the Mason
County website at: www.co.mason.wa.us, Forms and Brochures, Community Development, the address
to the referenced web page is: http://www,co.mason.wa.us/forms/Community_Devindex.php. Each
building within the facility shall be distinguished with a separate identification so that emergency personnel
can find the building in the event of an emergency.
• EXITS: Verify that construction plans comply with IBC and IFC Chapter 10. Construction plans must
clearly identify all exits, exit paths, length, signage information, etc.
• AUTOMATIC FIRE ALARM: Referencing MCC17.09.003#I, the International Fire Code, and NFPA 72,
provide information demonstrating compliance. Note that automatic fire alarm systems shall require a
separate "Mason County Fire Protection System Permit Application". The application can be obtained by
going to same website and page referenced above.
• SPRINKLER SYSTEM: Referencing MCC 17.09.003#I, IFC and NFPA 13, provide information
demonstrating compliance. Note that automatic fire sprinkler systems shall require a separate "Mason
County Fire Protection System Permit Application". The application can be obtained by going to same
website and page referenced above.
• FIXED FIRE SUPPRESSION SYSTEM: Referencing IFC, provide information as needed on construction
plans demonstrating compliance. Note that fire suppression systems shall require a separate "Mason
County Fire Protection System Permit Application". The application can be obtained by going to same
website and page referenced above. Standpipe systems, where required, need to be clearly identified on
construction plans.
• KNOX BOX: Referencing MCC 17.09.003#H and IFC access shall be required, typically through use of a
knox box. Contact the local fire district to make arrangements for an approved key box, location, etc.

• GAS METERS/TANKS: Referencing The International Fuel Gas Code (IFGC) and NFPA 58 provide
compliance information as required within the referenced codes.
• STORAGE (TYPE, HEIGHT, ETC.) Referencing IFC, Chapter 19 (Lumber yards and wood working
facilities), Chapter 23 (High-piled combustible storage), Chapter 27 (Hazardous Materials), etc.
o Identify all materials to be stored, including commodity classification (see IFC2303 and Table 2306.2),
and type of plastics when applicable. Include anticipated quantities, loose or baled, anticipated height,

totally clueless about requirements to comply with Ordinance 30-13, Collective Garden amendments to Title 17. The
representatives"assured"Allan and I that the requirements do not apply to them because they provide"access" and do not grow.
Documents containing the requirements outlined in Title 17 were given to the representatives. They were told that Allan and
Debbera need to discuss with the Director to confirm whether there are exceptions we were not aware of related to dispensers
(access providers)who are not growing.
