Approved per dimensions and setbacks on site plan submitted by TransOlympic Engineering Jan. 26,2011. 2.) The applicant acknowledges that the project will be completed as proposed, so that the project will be consistent with all applicable standards of the Mason County Resource Ordinance. 3.) A Hydraulic Project Approval from the Washington State Department of Fish Wildlife must be granted prior to construction. Proper erosion and sediment control practices must be used on the construction site and adjacent areas to prevent upland sediments from entering shoreline waters. Erosion control measures must be in place prior to any clearing, grading, or construction. These control measures must be effective to prevent soil from being carried into surface water by stormwater runoff. Sand, silt, and soil will damage aquatic habitat and are considered pollutants. Any discharge of sediment-laden runoff or other pollutapollutants to waters of the state is in violation of Chapter 90.48 RCW, Water Pollution Control, and WAC 173-201A, Water Quality Standards for Surface Waters of the State of Washington, and is subject to enforcement action. Any work in or adjacent to waterways that will adversely affect water quality must receive specific prior authorization from the Department of Ecology pursuant to WAC 173-201A-110. A short-term water quality standards modification may be issued if the proponent agrees to a number of specific construction practices and techniques designed to minimize water quality impacts. All areas disturbed or newly created by construction activities must be revegetated using bioengineering techniques, clean durable riprap, or some other equivalent type of protection against erosion when other measures are not practical. 5.) All construction and demolition debris must be removed from the site after project completion. Proper disposal of construction debris must be on land in such a manner that debris cannot enter or cause water quality degradation of State waters. 6.) All culverts shall be maintained in perpetuity to ensure that drainage will not overflow or become congested with debris. 7.) Temporary erosion control measures must be implemented to prevent water quality degradation of adjacent waters or wetlands. Install 140' of 18" CMP with three new catch basins. PROVISIONS 1. Work below the ordinary high water line shall only occur between MArch 9, 2011 and April 30, 2011. 2. NOTIFICATION REQUIREMENT: The Area Habitat Biologist (AHB) listed below shall receive written notification (FAX or mail)from the person to whom this Hydraulic Project Approval (HPA) is issued (permittee) or the agent/contractor no less than three working days prior to the start of construction activities. The notification shall include the permittee's name, project location, starting date for work, and the control number for this HPA. 3. Work shall be accomplished per plans and specifications "Schematic Repair Plan".dated January 26, 2011, approved by the Washington Department of Fish and Wildlife, except as modified by this Hydraulic Project Approval. A copy of these plans shall be available on site during construction. CULVERT 4. The culvert shall be installed to maintain structural integrity to the 100-year peak flow with consideration of the debris likely to be encountered. 5. The culvert shall be installed in'the dry or in isolation from the stream flow. Diverting the stream around the work site may be used providing downstream of the original outlet, the stream shall not be dewatered. If needed, a cofferdam or similar device may be used to pond water to the outlet or the water pumped to the outlet. 6. The culvert shall consist of a single barrel and shall be 18 inches or greater. EQUIPMENT 7. Equipment used for this project shall be free of external petroleum-based products while working around the stream. Equipment shall be checked daily for leaks and any necessary repairs shall be completed prior to commencing work activities along the stream. WATER QUALITY 8. If at any time, as a result of project activities, fish are observed in distress, a fish Rill occurs, or water quality problems develop (including equipment leaks or spills), immediately stop work except for efforts to control leaks or spills or prevent toxic substances from entering the water and notify the Washington Military Department's Emergency Management Division at 1-800-258-5990, and to the Area Habitat Biologist listed below. Work shall not restart on the project until approved by the Area Habitat Biologist. 9. Fresh concrete or concrete by-products shall not be allowed to enter the stream at any time during this project. All forms used for concrete shall be completely sealed to prevent the possibility of fresh concrete from getting into the stream. 10. Every effort shall be taken during all phases of this project to ensure that sediment-laden water is not allowed to enter the stream. This may be accomplished by placing a series of low gravel bag dams downstream of the project. The gravel bag dams shall consist of burlap bags filled with pea gravel. The streambed and dams shall be overlain with filter fabric on the upstream side of the dams. Accumulated silt shall be removed with the filter fabric upon completion of the project and the burlap bags shall be slit to allow the pea gravel to disperse downstream. Where necessary, hand tools may be used to ensure stream flow and fish passage are not impeded by the gravel. 11. Erosion control methods shall be used to prevent silt-laden water from entering the stream. These may include, but are not limited to, straw bales,filter fabric, temporary sediment ponds, check dams of pea gravel-filled burlap bags or other material, and/or immediate mulching of exposed areas. 12. Wastewater from project activities and water removed from within the work area shall be routed to an area landward of the ordinary high water line. 13. All waste material such as construction debris, silt, excess dirt or overburden resulting from this project shall be deposited above the limits of flood water in an approved upland disposal site. 14. Extreme care shall be taken to ensure that no petroleum products, hydraulic fluid, fresh cement, sediments, sediment-laden water, chemicals, or any other toxic or deleterious materials are allowed to enter or leach into the stream. 15. If high flow conditions that may cause siltation are encountered during this project, work shall stop until the flow subsides. Additional authorization from other public agencies may be necessary for this project. The person(s)to whom this Hydraulic Project Approval is issued is responsible for applying for and obtaining any additional authorization from other public agencies(local, state and/or federal)that may be necessary for this project. This Hydraulic Project Approval shall be available on the job site at all times and all its provisions followed by the person(s)to whom this Hydraulic Project Approval is issued and operator(s) performing the work. This Hydraulic Project Approval does not authorize trespass. Failure to comply with the provisions of this Hydraulic Project Approval could result in a civil penalty of up to one hundred dollars per day and/or a gross misdemeanor charge, possibly punishable by fine and/or imprisonment. All Hydraulic Project Approvals issued under RCW 77.55.021 are subject to additional restrictions,conditions,or revocation if the Department of Fish and Wildlife determines that changed conditions require such action.The person(s)to whom this Hydraulic Project Approval is issued has the right to appeal those decisions. If you proceed with an appeal,you may request an informal or formal appeal.WDFVV encourages you to take advantage of the informal appeal process before initiating a formal appeal.The informal appeal process includes a review by department management of the HPA or denial and often resolves issues faster and with less legal complexity than the formal appeal process.
