In the past weeks I have been in contact with several different people from the Environmental
Protection Agency (EPA) regarding the applicability of the Code of Federal Regulations (CFR)
Section 40 to the proposed Wilson Oil card lock facility to be located on the Benyon/Sandy's
Deli property in Belfair. The people from EPA I've been conversing with include Carl Kitz, Bill
Longston, Keith Cohon, Dana Stallcup, and Phil Haynes.
The issue I've been trying to resolve is whether the proposed construction on the Benyon
property, next to an existing fueling facility, raised the existing underground storage of fuel on
the property over EPA's threshold of 42,000 gallons for requiring an SPCC Plan.
This morning during a conference call with Mr. Mike Wilson representing Wilson Oil and Mr.
Haynes of the EPA, Mr. Haynes stated that EPA's policy addressing two fueling facilities located
side by side on a single property under different operators are considered two separate facilities.
In the proposal at hand, each individual facility stores less then the 42,000 gallon threshold
underlying the requirement for an SPCC Plan, and therefor an SPCC Plan is not required..
One last feature remains to be addressed, that being the creation and implementation of an
Operation and Maintenance Covenant. Part of Ecology's plan for the Puget Sound Basin calls
for ongoing maintenance programs within the basin jurisdictions. Mason County employs an
Operation and Maintenance Covenant (O&M), that places the burden of ongoing maintenance on
the facility owner. Attached please find a copy of the O&M Covenant form Ecology has
approved for use by Mason County. The stormwater facility owner should be directed to
complete the form, have their signature notarized, record the signed notarized document with the
Mason County Auditor's office, and deliver a copy of the recorded instrument to Public Works
for monitoring and administration.
The project will be considered complete when the facilities are completed, inspected and
accepted, and the O&M Covenant is in effect. The proponents should notify this office at some
time near the completion of the stormwater features installation to schedule an inspection.

Following the completion and inspection of the stormwater control features, and after receipt of
the recorded O&M Covenant I will notify your office that the stormwater features and
documentation are complete and acceptable.
