Neatherlin 291 NE Roy Boad Rd Belfair, WA 98528 RE: Stop Work Order Enforcement Case No.: ENF2001-00227 Dear Mr. Neatherlin, In response to a complaint received by this office, a site investigation was done at 291 NE Roy Boad Rd., Belfair, WA. The complainant indicated that non-permitted construction had recently occurred and that the construction encroaches into the required setback area. Upon inspection, it was determined that the complaint was valid and a Stop Work Order posted. Further information provided by Mason County Public Works verified that the non-permitted construction is within the Mason County Right of Way. The two issues are as follows: 1. Illegal construction of a residential addition in absence of the required building permits violates Mason County Ordinance 45-99, Section 14.08.030 and 1997 Uniform Building Code, Section 106.1. 2. Construction within the required setback area and within the Right of Way violates Mason County Ordinance 45-99, Section 503.1. In order to bring your site into compliance with Mason County laws and regulations, you will need to apply for and receive an after the fact building permit for the structure, remove that portion of the building that is located within the Mason County Right of Way and apply for and receive a variance for the portion of the structure located within 10' of the edge of the Right of Way. Enclosed is the permit application forms and variance request packet. A Stop Work Order was posted at 291 NE Roy Boad Road,WA, On September 12,2001,I visited 291 NE Roy Boad Road,Belfair, Mason County,Parcel No. 12329-14-00030,on September 12,2001 for the WA;Mason County parcel no. 12329-14-00030,in response to a complaint construction of a residential addition without the necessary building permits received by Mason County staff. I observed an addition to a residential required under MCC14.08.030(MCO 45-99)and Section 106.1 of the 1997 structure,approximately 24 feet by 24%s feet in size.
