Notice is hereby given that Iglesia Asamblea de Dios Agua Viva International, who is the applicant for the above-referenced Mason County Special Use Permit, has been granted approval of that Special Use Permit. The request was reviewed on May 14, 2013 by the Mason County Hearing Examiner, with additional period for requested information, and approved with eight conditions, pursuant to the Mason County Title 17.05.044 Special Use Permit review criteria, specifically to construct a building exceeding 3,000 sq. ft. area on parcels in the Rural Residential 5 zone at 2 miles west of the Belfair Urban Growth Area. The proposal was reviewed through SEPA review per WAC 197-11-800 (1). This is a final County decision. No further appeals to the County are available. Appeal of this decision may be made to Superior Court or the appropriate administrative agency as regulations apply. It is the appellant's responsibility to meet all legal requirements of any appeal process. Time Limit for Action. Per the Mason County Code Title 15 - Development Code - No permit authorizing construction shall extend for a term of more than five years. If actual construction of a development for which a permit has been granted has not begun within two years after the approval, the Hearing Examiner shall review the permit and upon a showing of good cause, may extend the initial two year period by permit for one year. Otherwise, the permit terminates; PROVIDED that no permit shall be extended unless the applicant has requested such review and extension before the Hearing Examiner PRIOR to the expiration date. Work on approved project must begin by June 2015. This permit expires June 20, 2018. If you have questions or require clarification on these issues,please contact Allan Borden,Senior Planner with Mason County Dept. of Community Development at 360-427-9670 x365 I BEFORE THE HEARING EXAMINER FOR MASON COUNTY 2 Phil Olbrechts,Hearing Examiner 3 4 RE: Iglesia Asamblea de Dios FINDINGS OF FACT, CONCLUSIONS Agua Viva International OF LAW AND FINAL DECISION 6 Special Use Permit #DDR2013-00016 7 8 INTRODUCTION 9 The applicant requests a special use permit to construct an'8,000 square foot church 10 on a 4.16 acre vacant parcel located at the intersection of SR 300 and Gladwin Road near Belfair, Washington. The application is approved subject to conditions. 11 12 ORAL TESTIMONY 13 Staff Testimony 14 Allan Borden, Mason County senior planner, testified that the proposal is for a new 15 church with 6,000sq ft. footprint. The parcel is 4.61 acres. The current access to the property is on the east end. SR 300 runs along the north of the property. The 16 properties to the north and west are residential and are part of the Lynch Cove Subdivision. The shoreline is to the south of Gladwin Road along Bradley Road 17 (seen in exhibit 5). The zoning is rural residential five which permits the building of 18 churches. SEPA review was triggered primarily due to the proposed parking area because the size of the building is less than the 12,000sq ft. threshold that requires 19 SEPA review. The SEPA conditions focused on erosion control and stormwater treatment. In addition to the special use permit, the church would have to apply for a 20 building permit and submit a stormwater site plan. A notice of application was submitted to the newspaper in the beginning of April, and public notices were posted. 21 Several comment letters were received, and these were included in the staff report. 22 The congregation will consist of approximately 150 people. The property will need to add a septic system because it is not served by a sewer line. Exhibit 3 includes a 23 letter from a water utility provider who has offered to serve the site. In regard to accesses, if the access is placed on Gladwin Beach Road it will be maintained by the 24 county, but if the access is placed on SR 300 it will be handled by the Department of Transportation. Currently, the proposal is for one access off of Gladwin Beach Road. 25 The staff report details how the proposal meets conditions for a special use permit. Staff found that there will be some impacts from this proposal, but these impacts are not significant. There are no hazardous conditions from this land use, and there are adequate public facilities. The site is currently vacant and undeveloped so the nature SUP P. 1 Findings, Conclusions and Decision of the property will change with the building of the church; however, this change is I not detrimental to the surrounding areas. Title 15 review criteria are met by the 2 proposal. Transportation levels will not be changed beyond the acceptable standards. Staff recommends approval with four conditions: (1) water main extension 3 agreement and connection with Lynch Cove system should be completed; (2) site plan should include vegetation and fencing to screen the church from neighboring 4 properties, (3) adequate parking to meet county standards, and (4) a stormwater plan completed. Some of the public concerns include the change of character of the rural 5 residential zone and wetland damage. Public comments suggested there is a stream 6 on the property; however, according to Mr. Borden, there are no surface water features. There may be winter saturation on the site. Other public comments are in 7 regard to traffic concerns. 8 In answer to hearing examiner question,Mr. Borden noted that there is not a left turn lane from SR 300 to North Gladwin Road. The Washington State Department of 9 Transportation ("WSDOT") was notified of the project during SEPA review. 10 WSDOT made no comments. Public Works received a copy of the proposal and also did not make any comments. Gladwin is not an arterial road. There is no on-street 11 parking along Gladwin Road. The Lynch Cove Subdivision does not have street parking due to narrow streets. The building will be at least 30ft from the property 12 line. The vegetation and parking lot will be reviewed as a commercial use. The county will ask for at least 5ft of vegetative screening during the building permit 13 process. Mason County uses the 2005 Washington State Department of Ecology 14 ("DOE") Stormwater Manual,which prohibits any increase in stormwater production. Staff is unaware of any critical areas on site. There are slopes along the northeast 15 portion of Gladwin Road. Staff assesses critical areas by reviewing the critical areas map. 16 17 Applicant Testimony 18 Richard Moore, a representative of the applicant, stated that the zoning regulations allow a church to be built at the site without special permits; however, the special use 19 permit is to allow a larger church. The church services occur on Sunday and Tuesday evenings from 6-8pm which is a low traffic time. Both time frames are past rush 20 hour. In regard to visibility,the building will be 300ft from Gladwin Road. In regard 21 to noise, this church culture (Guatemalan) is not a noisy one. In regard to distance from homes, the nearest home to the church is over 250ft. The homes to the 22 northwest, along the shoreline, are the closest homes to the church. In regard to landscaping,the church plans to retain as many trees and other vegetation as possible. 23 In regard to a daycare, the Guatemalan culture does not use churches as daycares. There is not a lawn area planned for the site. The services include worship and then a 24 shared meal, thus the need for the enlarged church building. Some vegetation will be 25 cleared to build the detention pond; however, the area is already very clear and composed mainly of brush. Most of the area is covered in sugar sand which collects water. No water will leave the site, and the retention pond will be engineered for a 500-year storm. In regard to parking overflow, the church will use five large vans for SUP p.2 Findings, Conclusions and Decision carpooling. They also have access to an acre of land in Belfair for overflow parking. I The church searched for three years within the Belfair urban community, but was 2 unable to find a suitable location. In regard to the access off of SR 300, the retention pond would not have to be moved to accommodate it. The entrance from SR 300 3 would be to the west of the church building. In regard to using the Lynch Cove Community Park, the church members do not plan to use the surrounding area 4 amenities. In regard to wetlands, there are wetlands 200ft away, on the other side of 5 the road from the planned building. 6 Public Testimony 7 Leslie Kabelac testified that she is speaking on behalf of the Lynch Cove Community Club. She is concerned with the traffic pattern. The churchgoers are likely to begin 8 making loops around the Lynch Cove neighborhood to reach SR 300 via Loma Lee Road and avoid traffic. This will lead them to the Lynch Cove Community Park and 9 disrupt the quiet of the neighborhood. She does not believe there is a solution to the 10 traffic problem. The private park belongs to the Lynch Cove Community, and the owners do not want it used by the church members. The property has a stream on it 11 which is part of the Shoreline Master Plan. Lynch Cove community residents are also concerned that the retention pond is too close to their private water tank. Finally, she 12 believes the church will be used for more than just two services a week. 13 Ms. Wilson stated that the traffic situation is a major concern for the Lynch Cove 14 residents. Recently, a man was hit and killed on SRO 300. The intersection of Lorna Lee Road and SR 300 has many accidents. Traffic continues to increase every year 15 because of increased tourism. The churchgoers will utilize the property during the periods of the year when the weather is nice and will disrupt the surrounding 16 community. Many trees will be removed to build the church. Additionally, there are wetlands very close to the site. The Lynch Cove Community water runs through the 1 subject site. This area is not appropriate for this use. 18 Ken Van Buskirk testified that he has lived in Belfair for 50 years and co-manages 19 the Davis Farm. Previously, he served as a board member on the Great Peninsula Conservancy. He is a current member of the Mason County Planning Commission. 20 He is in contact with the Parrot property that abuts the subject site. He questioned 21 whether or not the property had been sold to the church already. He also asked if a traffic impact analysis or timber analysis had been done. Mason County is currently 22 going through a Shoreline Management Act update. His largest concern is with traffic. SR 300 is one of the shortest routes in the state because of Belfair State Park. 23 Traffic from the state park is very high on the weekends. The level of service on Gladwin Road is low (there are few/unclear road markings). The speed limit on SR 24 300 is 45mph, and the intersection with Gladwin Road is dangerous. 25 According to Mr. VanBuskirk, Mr. Parrot attempted to get a road vacation at the end of SR 300, but was unsuccessful. In regard to environmental concerns, the property is very steep with 120-150ft tall trees. There is a culvert under SR 300 at the western SUP p. 3 Findings, Conclusions and Decision portion of the subject property. This culvert could be a perennial stream. The Mason I County Planning Commission is in the process of updating the Shoreline Master 2 Program. The draft map (exhibit 15) places half of the subject property as a conservation designation. Therefore, the property will have to undergo a shoreline 3 permit to build the church. He recommends the hearing examiner visit the site to better understand the traffic and environmental impacts. Moreover, he recommended 4 postponing a decision until Mr. Parrot's comments (exhibit 13) are reviewed by county staff. Additionally, Mason County has struggled to meet conditions placed on 5 past special use permits, thus simply placing these conditions on decisions does not 6 ensure implementation. 7 Kama Peck commented that her main concern is the ingress and egress area to the site. The visibility at the planned access site is very bad because Gladwin Road 8 curves right before the turnout. If the access was placed farther down Gladwin Road there would be less chance of accidents. 9 10 Staff Rebuttal 11 Allan Borden noted that the property is more than 200ft from the shoreline. The sale of the property is pending. No traffic impact analysis has been completed. The 12 wetlands across the street are category 1 wetlands. Category 1 wetlands require 200ft buffers. The proposed project is on the opposite end of the property, thus the buffers 13 do not intercept with the special use proposal. The current designation is 14 conservancy. If the activities are not in the SMA, then there is no shoreline permit necessary. In regard to moving the road access on Gladwin Road, Public Works or 15 WSDOT would have to grant a road access permit. It is possible for the hearing examiner to require consultation with WSDOT in regard to road accesses. Mr. 16 Borden will review the vegetative buffer requirement to ensure it provides adequate 17 screening. 18 Applicant Rebuttal 19 Richard Moore said that, in regard to accessing the church from SR 300,there are 30- 40ft on Gladwin Road before the entrance road begins. Additionally,the church has a 20 110ft driveway before the parking area. There is no potential for traffic back-up. The 21 only other point that the access could be placed is in the far west end which would encourage churchgoers to utilize Lorna Lee Road. There will be no additional 22 stormwater leaving the property. In regard to the recent death on SR 300, the accident was alcohol-related and not a common occurrence. A phase 1 study was 23 completed on the property to determine the environmental factors. The setback for the retention pond will be a minimum of 30ft for the property. Mr. Moore works as a 24 general contractor. He is unaware of any culvert on the property. 25 EXHIBITS SUP p. 4 Findings, Conclusions and Decision Exhibits 1-11 identified in the "Case Index" of the May 1, 2013 staff report were 1 admitted during the May 14, 2013 hearing. Applicant. The applicant is Iglesia Asamblea de Dios Agua Viva 15 International. 16 2. Hearing. The Hearing Examiner conducted a hearing on the subject application on May 14, 2013 at 1:00 p.m., in the Mason County Commissioners 17 Meeting Chambers. The record was left open for a written staff analysis of comments 18 received from the Parrots, said analysis due May 17, 2013. Public response to the staff analysis was due May 21, 2013 and the applicant final 19 reply to all these comments was due May 23, 2013. The examiner noted during the May 14 hearing that the applicant could request more time for their final reply if 20 necessary. The applicant subsequently requested that the reply deadline be extended to June 4, 2013 and that request was granted. No untimely comments were admitted 21 into the record. The examiner conducted a site visit without accompaniment on May 22 28, 2013. 23 Substantive: 24 3. Site/Proposal Description. Iglesia Asamblea de Dios Agua Viva International 25 Church is seeking approval of a special use permit to construct an 8,000 square foot church building for their congregation of 100 to 150 persons in the Belfair area along with parking on a 4.16 acre vacant parcel located at the intersection of SR 300 and Gladwin Road near Belfair, Washington. Access to the proposal will either be from SUP p. 5 Findings, Conclusions and Decision Gladwin Road or directly from SR 300 if an access permit is acquired from WSDOT. 1 WSDOT has favorably commented upon direct access to SR 300. See Ex. 19. General topography of the 4.16 acre parcel is flat(less than 5 percent) in the west and central areas and nearly 15 percent slopes along Gladwin Rd.; an access exists at the east end of the property (Exhibit #5). The building foundations from previous 4 construction efforts remain onsite. 5 4. Characteristics of Area. In the vicinity are Belfair State Park 2 miles to the west, 6 residences in Lynch Cove subdivision to the west and north, and a restaurant and tideland properties to the east. The property is located near North Shore Road,which 7 is the key transportation route in the area. Lynch Cove and Hood Canal are situated 200 feet to the east and southeast. M.1. 8 5. Adverse Impacts. As conditioned, there are no significant adverse impacts 9 associated with the proposed use. Neighboring residents and others have raised 10 several valid concerns with the proposal and many of those concerns will have to be addressed through additional project review as required in the conditions of approval. ! 11 issues are more specifically addressed individually below. 4 A. Traffic. The most significant issue associated with the project is traffic. N 12 uch of the traffic going to the church will have to make a left turn off of SR 300, 13 either onto Gladwin Road or directly onto the project parcel if the applicant succeeds in acquiring an access permit from WSDOT. Gladwin is a narrow and steep road with site distance problems as it curves away from SR 300. At hearing staff noted 14 a that WSDOT had been notified of the project but had not expressed any concerns. 15 The examiner requested that staff directly contact WSDOT again to see if they had any issues with the left turn. In response, WSDOT expressed several concerns 16 including site distance for the intersection and the location of the access point proposed along Gladwin Road. See Ex. 16. WSDOT recommended that the '0 17 intersection of Gladwin Road with SR 300 be realigned or in the alternative that the 18 applicant prepare a traffic study. Subsequently, WSDOT concluded that a direct access to the property from SR 300 would also be appropriate if an access permit is 19 acquired. See Ex. 19. The recommendations of WSDOT will be incorporated into the conditions of approval. 20 The examiner's site visit of the proposal revealed that Gladwin Road is narrow 21 with no shoulder. Despite this, the project doesn't involve any street frontage improvements and none are recommended by staff. Staff testified at the hearing that 22 the proposal had been submitted to the County public works department and that public works did not comment. It is unclear if public works actually reviewed the 23 project and this cannot be taken for granted given the concerns raised by WSDOT when they were approached more directly a second time for comment. ?At the least, 24 street widening along the frontage of the church property may be appropriate to 25 provide for safe two way travel during peak traffic generation hours for the church. The conditions of approval will require public works to specifically address the issue, authorizing the department to require a traffic study or other expert evaluation as it deems necessary to assure for safe and efficient traffic flow. It may be that public SUP p. 6 Findings,Conclusions and Decision works had planned on reviewing the proposal for frontage improvements during I building permit review, but the site plan submitted for the special use permit should 2 already identify these improvements as well as the parking so that the impacts of the project can be more precisely addressed. It is recommended that this level of detail 3 be provided in future special use permit site plans. The site plan submitted by the applicant comes dangerously close to failing the level of specificity required by MCC 4 17.04.227(c). Neighbors have also raised a concern about church patrons using the roads of the 5 adjoining neighborhood to access SR 300. In point of fact WSDOT concluded that if 6 the Gladwin/SR 300 intersection is not realigned that left turns from SR 300 would be prohibited and church patrons would have to use the neighborhood roads to access the 7 site. However, it must also be bome in mind that the neighborhood roads are public roads and the adjoining property owners do not have exclusive rights to their use. 8 The rights of the applicant to use those streets must be balanced against those of the neighbors and any restrictions on access should be reasonably imposed. In this 9 regard, the conditions of approval will require staff to investigate the reasonableness 10 and feasibility of limiting exit turns from the property to "left turn only" in order to avoid use of the neighborhood streets located southwest of the project site or taking 11 o 4 similar measures to limit neighborhood access. B. Critical Areas. Comments were received that the project site contains a 12 spring, a culverted stream, steep slopes, trees and endangered species. The degree to which these environmental resources (generally called "critical areas") must be 13 protected has been legislatively set in the County's Resource Ordinance, Chapter 8.52 14 MCC, which is applied via a separate environmental permit also regulated by Chapter 8.52. Staff have reviewed the project site and the comments submitted by concerned 15 citizens and have concluded that there are no protected critical areas on site, or at least that the proposal does not trigger any Resource Ordinance protection. Given staff 16 ex erience and expertise in administering the Resource Ordinance and the absence of any expert opinion o e contrary, the examiner must e e s 1 ere are no critical areas adverse y affected 18 by the ro o Nothing in this decision should be construed as preventing staff from c anging its mind on the need for an environmental permit should it come to a 19 different conclusion in the future. C. Stormwater. Concern was raised over stormwater impacts. This is 20 another instance where the County Commissioners have adopted a comprehensive set 21 of regulations that sets a legislative standard for acceptable impacts. Specifically, Mason County has adopted the 2005 DOE Stormwater Manual in Chapter 14.48 22 MCC, which prohibits any increases in offsite stormwater flows caused by the proposal and also sets standards for water treatment and quality. As noted by staff 23 during the hearing,the applicant is required to obtain a separate stormwater permit for its proposal and approval of this permit will assure compliance with the County's 24 stormwater standards. Mr. Parrot raises some valid points in Ex. 17 regarding the 25 existence of a restrictive layer and the presence of an aquifer recharge area. The conditions of approval will require the stormwater plan to address the test bore results identified by Mr. Parrot and shall formulate an analysis that reasonably assures staff that the stormwater controls will adequately protect any aquifer recharge area affected SUP p. 7 Findings. Conclusions and Decision by the proposal and that the proposal is otherwise compliant with the Resource 1 Ordinance as it applies to aquifer recharge areas. 2 D. Neighborhood Compatibility. Churches are authorized in the RR5 zone. The conditions of approval and County regulations require buffering and screening 3 from adjoining properties. The church itself will be located more than 300 feet from Gladwin Road. Nothing further can be reasonably required to assure compatibility 4 and as mitigated and designed the church is determined to be compatible with surrounding residential use. 5 E. Water Service. Concerns were raised by one neighbor on whether there 6 was adequate water to serve the proposal. Aquarius Utilities, LLC, which provides water service to the project, commented that it had ample capacity to serve the 7 proposal. See Ex. 3. It is determined that the proposal is served by adequate water. F. Septic. The staff report notes there is adequate area on the property to 8 locate a septic system large enough for the proposal. G. Trespass. Neighbors expressed concern that patrons of the proposed 9 church will trespass upon Lynch Cove Community Park, a private beach located west 10 of the proposal. There is no concrete evidence that this will actually occur. However, the conditions will provide that if the neighbors are able to establish within a year's 11 time that the proposal is contributing to trespass, the applicant shall work out a mitigation plan to prevent trespass by measures such as posting no trespass signs on 12 the private beach or other forms of notice to church patrons that the park is private and should not be accessed without permission. 13 H. Parkin. Staff have concluded that there is sufficient space on the 14 property to accommodate legislatively adopted parking requirements as codified in Mason County Code ("MCC") 17.08.090. Compliance with those standards 15 establishes that the proposal provides for adequate parking. The conditions of approval require compliance with the parking standards. 16 17 CONCLUSIONS OF LAW 18 Procedural: 19 1. Authority of Hearing Examiner. MCC 15.03.050(10) and 17.05.042 20 provide the Examiner with the authority to review and act upon Special Use Permits. 21 Substantive: 22 23 2. Zonin . The area is zoned as Rural Residential 5. 24 3. Shoreline Substantial Development Permit. There has been much discussion in this case about the applicability of the County's shoreline master program and even 25 suggestions that review of the subject application be delayed until changes to the master program have been completed. The permit under review is for a special use permit. The shoreline master program is administered through a separate permitting system and it is beyond the scope of this permit to determine whether or not a SUP p. 8 Findings, Conclusions and Decision shoreline permit is required or whether its criteria can be met If a shoreline permit is I required, the church could not be constructed without acquiring the permit. If 2 shoreline regulations did apply to this permit, delaying permit approval until the regulations are changed would not accomplish anything. This is because under this 3 state's judicially created vested rights doctrine, once a complete conditional use permit (and by extension, special use permit) is filed, the project vests to the regulations in 4 effect and subsequently enacted regulations do not apply. See Beach v. Board of Adjustment, 73 Wn.2d 343, 347 (1968); Weyerhaeuser v. Pierce County, 95 Wn. App. 5 883 (1999). Even if the decision were delayed until new shoreline regulations went 6 into effect, they still would not apply to the special use permit application. Finally, delay would also subject Mason County to liability under RCW 64.40.020, which 7 creates a cause of action for decisions that are not issued within mandatory deadlines. Chapter 36.70B RCW as implemented by County regulations, MCC 15.09.100, 8 require final decisions to be issued within 120 days of submission of a complete 9 application, subject to various `'clock stopping" exceptions. 10 4. Untimely Comments. As noted in Finding of Fact No. 2, at the close of the verbal portion of the hearing due dates were set for the submission of subsequent written 11 comments. Several comments were received after these due dates. Those comments were not admitted into the record because state law bars the consideration of untimely 12 submitted comments. This derives from the one hearing rule imposed by the Regulatory Reform Act, Chapter 36.70B RCW. In 1995 the state legislature adopted 13 the Regulatory Reform Act in order to streamline permitting procedures. One 14 recurring problem addressed by the regulations was the habit of municipal jurisdictions to indefinitely delay permit decisions through endless and repeated 15 permit hearings. It used to be a fairly common practice for municipalities to consider new evidence at the close of a hearing, thereby necessitating other hearings or further 16 evidentiary review. The Regulatory Reform Act now only allows one hearing per application. Once a hearing is closed, no new evidence can be admitted unless it 17 qualifies as "limited new evidence", which is widely interpreted by land use attorneys 18 as limited to new evidence a court could consider on judicial appeal under the Land Use Petition Act, Chapter 36.70C RCW. The untimely comments submitted for this 19 case do not meet the exceptions of Chapter 36.70C RCW. 20 5. Review Criteria and Application. MCC 17.04.227(c) requires a special use permit 21 for churches in the RR5 zone that are more than 3,000 square feet in area. Applicable special use criteria are quoted below in italics and applied through corresponding 22 conclusions of law. 23 MCC 17.05.044 SPECIAL USE REVIEW CRITERIA: 24 (I) That the proposed use will not be detrimental to the public health, safety and 25 welfare. SUP P. 9 Findings, Conclusions and Decision 6. As determined in Finding of Fact No, 5, there are no adverse impacts 1 associated with the project so it is not detrimental to the public health, safety and 2 welfare. 3 (2) That the proposed use is consistent and compatible with the intent of the Comprehensive Plan. 4 6. The proposed use is consistent with and compatible with the intent of the 5 Comprehensive Plan for the reasons identified at pages 3-4 of the staff report, adopted 6 and incorporated by this reference as if set forth in full. 7 (3) That the proposed use will not introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and 8 the community at large. 9 7. No hazardous conditions are expected, nor have any been identified as a 10 result of the proposal. 11 (4) That the proposed use is served by adequate public facilities which are in place, or planned as a condition of approval or as an identified item in the County's Capital 12 Facilities Plan. 13 8. As discussed in Finding of Fact No. 5, the proposal will be served by 14 adequate roads, water and sanitary waste disposal. There is nothing in the record to reasonably suggest that there are any other public facilities that could be potentially 15 inadequate. 16 (5) That the proposed use will not have a significant impact upon existing uses on 17 adjacent lands. 18 8. As noted in Finding of Fact No. 5, no significant impacts are expected to result from this proposal, including impacts on adjoining properties. 19 (6) If located outside an Urban Growth Area, that the proposed use will not result in 20 the need to extend urban services. 21 9. There will be no need to extend any urban services to the property. 22 I MISCELLANEOUS CRITERIA FOR ALL HEARING EXAMINER REVIEW: 23 MCC 15.09.055(C): Required Review: The Hearing Examiner shall review proposed 24 development according to the following criteria: 25 1. The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. SUP P. 10 Findings, Conclusions and Decision 2. Development does not impact the public health, safety and welfare and is 1 in the public interest. 2 3. Development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. 4 10. A determination of non-significance was issued for the proposal (Ex. 6), 5 satisfying the requirements of the Washington State Environmental Policy Act, as 6 codified in Title 6 MCC. No subdivision is involved (Title 16) and septic will be reviewed and approved by the County health department (Title 6 MCC). As 7 determined in Finding of Fact No. 5,the project will not create any significant adverse impacts so it does not adversely impact the public health, safety and welfare. Since it 8 provides a needed community service the proposal is in the public interest. Staff determined that the proposal does not lower the level of service for transportation or 9 park facilities and there is no evidence to the contrary. 10 DECISION 11 The application for a special use permit is approved subject to the following 12 conditions: SRL-�0 �ss Q. .e-d 1' 1. If area residents establish to the satisfaction of staff within a year of occupancy of 22 the church that church patrons are trespassing upon the Lynch Cove Community Park, staff may require the applicant to prepare and implement a mitigation plan 23 to reduce the trespass that may include reasonable measures such as posting no- trespass signs on the park, building a fence around the park, placing signs within 24 the church advising against trespass or some other measure that effectively 25 reduces the trespass. The applicant shall be required to consult with the park owners in formulating the mitigation plan. Permission from the beach owners shall of course be required for any measures that involve construction upon or alteration of the park property. SUP P. 11 Findings,Conclusions and Decision I `? 4. The stormwater plan shall contain an assessment of whether stormwater controls -' adequately protect water quality given the test boring information provided by Mr. Parrot in Ex. 14 and also that the retention pond will not contaminate the ' waters of the water tank referenced in the Kabelac testimony summarized in this 4 decision. If staff determines that the proposal does affect an aquifer protected by the Resource Ordinance, staff may require additional analysis by a qualified 5 individual at the expense of the applicant to assure that the proposal is consistent with the requirements of the County Resource Ordinance as it applies to aquifer 6 recharge areas. 7 8 5. a applicant shall secure a water main extension agreement, as part of the Lynch Cove Water System(WA No.49100U),with the provider Aquarius Utilities LLC, q to serve this church land use. 10 6. This report evaluates establishing a new church( ,00 sq. ft.� footprint area; a portion of second floor area to increase size to 8,000 sq. ft. interior area) and associated parking and stormwater treat pond on one 4.16 ac.parcel of vacant Rural Residential 5 property 2 miles west of the Belfair WA. A Special Use Permit is necessary(Exhibit#2) as part of the public review required by the Mason County Development Regulations standards to evaluate the nature and scope of the church building size(greater than 3,000 sq. ft. size) and this proposed land use on Rural Residential 5 Lands in this area of Mason County. II. Applicant. Iglesia Asamblea de Dios Agua Viva International III. Property Location.At the northeast end of Gladwin Rd. at the intersection with State Route 300(North Shore Rd.), (Exhibit#4),one mile east of Belfair State Park;within the southwest '/4 of the northwest 1/4 of Section 31,Township 23 N.,Range 1 W. in Mason County Washington. [Parcel# 12331-32-00040]. IV. Evaluations. A. Characteristics of the site. General topography of the 4.16 ac. parcel is flat(less than 5 percent)in the west and central areas and nearly 15 percent slopes along Gladwin Rd.; an access exists at the east end of the property(Exhibit#5). The building foundations from previous construction efforts remain onsite. B. Characteristics of the area. In the vicinity are Belfair State Park 2 miles to the west, residences in Lynch Cove subdivision to the west and north, and the nearby restaurant and tideland properties to the east. The property is located near to North Shore Road, which is the key transportation route in the area. Lynch Cove and Hood Canal are situated 200 feet to the east and southeast. Adjacent to the project area,the shoreline designation along Lynch Cove is Conservancy Environment. Typical land uses are open space and natural habitat values. D. Com rehensive Plan Desi ation/Zonin . The Mason County Comprehensive Plan n � � ty p designation for the site is Rural Lands two miles from the Belfair Urban Growth Area. The zoning is Rural Residential 5 and churches are permitted land uses. V. SEPA Compliance. This proposed land use is not SEPA exempt per WAC 197-11- 800.1(b),as the proposed building is less than 12,000 sq. ft. in size,but has a parking area for use by 45 or more vehicles (Exhibit#6). Comments focused on erosion control and proper stormwater treatment on the property. VI. Other Required Permits. A building permit will be required for each proposed structure or structure modification. A stormwater site plan will be required during the review of the development permits,the level of review detail will depend on the extent of associated parking area. VII. Public Notification of Hearing. The Notice of Application(Exhibit#7)was published in the Mason County Journal for two weeks on March 28 and April 4, 2013. On April 18, 2013 a Notice of Application was posted at three sites and at the local post office. This notice was mailed to neighboring property owners within 300 feet on April 4,2013. An Affidavit of Posting of these notices was completed on April 30, 2013 (Exhibit#8). Two letters were received to date. The Grahams(Exhibit#9) stated concerns about activities associated with churches; Ms. Kabelac(Exhibit#10)was concerned with water availability to the church land use,impacts to stormwater travelling off-site to the south towards Hood Canal, and the use of the nearby community park lands. VIII. Project Description. Iglesia Asamblea de Dios Agua Viva International Church is seeking to construct a church building for their congregation of 100 to 150 persons in the Belfair area. A parking area associated with their church services is also proposed. There is adequate area on the property to locate a septic system to treat the effluent generated by the church land use. The applicant has submitted with the application materials a letter from Aquarius Utilities LLC (Exhibit#3)that can confirm the availability of water service from the Lynch Cove Water System to the property for drinking water, for septic service, and for fire protection of the property. The proposed access to the property from Gladwin Rd. is at the east end of the property near the intersection with State Route 300. A road access permit from Mason County Public Works or WA Dept. of Transportation will needed to be secured. IX. Analysis. The following additional information is required for analyzing the proposal, preparing the necessary conditions, and providing consistency with dimensional and performance standards and relevant county regulations. A. Mason County Development Regulations, Section 17.04.227(c.) This special provisions section of the Rural Residential 5 zone states that proposed church buildings that are greater than 3,000 sq. ft. in size require a Special Use Permit application and submittal materials(Exhibit#2). Iglesia Asamblea Church SUP staff report DDR2013-000016 Page 3 of 6 Revised 5/01/13 Staff Response: As a 6,000 to 8,000 sq.ft building is proposed, the review of a Special Use Permit is required. A Special Use Permit application was submitted by Iglesia Asamblea de Dios Agua Viva International Church and includes supplemental information for consideration in their request (Exhibit#11). This environmental site assessment provides supportive information about the location, vicinity, improvements present, historic use of the property, and potential hazards to consider about the subject parcel. B. Applicable Special Use Review Criteria(MCDR 1.05.046): 1. Will the proposed use be detrimental to the public health, safety and welfare? Staff Response:A county road(Gladwin Rd.) and State Highway 300 (North Shore Rd.) already exist on the south and north sides. Proper ingress and egress can be secured by a Mason County or WA. Dept. of Transportation Road Access Permit, taking into consideration sight distances along each road and the anticipated traffic generated from the change to church land use. The applicant will need to have a septic system designer validate that the proposed buildings and their intended uses will have no adverse effect on the proposed water system and on-site stormwater treatment system. Proposed buildings will need to be at least 25 feet from each front or road property line, as shown on the site plan in Exhibit#2. 2. Will the proposed use be consistent and compatible with the intent of the Comprehensive Plan? Staff Response: The applicant states that this church building proposal is consistent with GAM policies supporting protection of the environment, existing land uses,future residential land uses and rural character away from the urban growth areas. The Comprehensive Plan policies below are used for review: Rural Residential within the Rural Area. RU500a Ensure that rural residential development preserves rural character,protects rural community identity, is compatible with surrounding land uses, and minimizes infrastructure needs. RU-501 New development in Rural Areas should be guided by performance standards and design guidelines to enhance rural character,protect critical areas, and tailor development to the characteristics of individual sites. RU-502 Residential uses in Rural Areas should be at densities that can be sustained by rural levels of service for water, wastewater, drainage,police,fire, and schools. RU-503 Utilities and services in Rural Areas should be provided at levels suitable to rural densities including on-site septic systems,private wells or community water systems, and roads with gravel shoulders and open roadside drainage. RU-506 Land use and proposed development along the shoreline, streams, or adjacent uplands should provide protection from any increases in stormwater runoff and non- point pollution which degrade water quality. RU-512 Adjacent residential uses and non-residential uses in the Rural Area should be buffered or screened from each other. Existing uses will not be required to provide buffers or screens, except in the case of the expansion or intensification of use. The policies noted above reinforce that the location of this church proposal will not be contrary to the goals of the Comprehensive Plan and that development standards under the Rural Residential 5 zone will protect present and future land development in the vicinity. Several measures by the applicant will be implemented to attain a compatible development: connection to the Lynch Cove Water System is proposed; a large on-site septic system (to be designed) will be installed;stormwater drainage from the roofs and parking area will be treated in the proposed pond; the land use and buildings will be screened with adequate vegetation and fencing along the property perimeter. 3. Will the proposed use introduce hazardous conditions at the site that cannot be mitigated through appropriate measures to protect adjacent properties and the community at large? Staff Response: The applicant has stated that there will be no hazardous conditions or activities associated with the proposed project facilities, so no mitigation to protect nearby properties is needed. The site assessment provided by the applicant discusses the old foundations of past proposals, but these will be removed from the site. The proposed church land use will have associated parking areas to the south of the planned church structure, as well as suitable stormwater treatment and erosion control strategies. 4. Is the proposed use served by adequate public facilities, which are in place, or planned as a condition of approval or as an identified item in the County's Capital Facilities Plan? Staff Response: This proposed land use will be served by a public water system (as noted in the Aquarius Utilities LLC letter) and on-site septic treatment system to serve the church land use. Proposed development wild follow Mason County codes for construction and occupancy. Public transit(Mason Transit) is available to this site location. Fire District#2 station is three miles away in Belfair. No demand for services requiring new capital facilities project is anticipated with the proposal. 5. Will the proposed use have a significant impact upon existing uses on adjacent lands? Staff Response: The project as proposed will not have any significant impacts upon the existing use on adjacent lands. The surrounding land uses to the north and east are residential or commercial on medium-sized parcels (Exhibit#5); and residential on small-sized parcels to the west. Land uses to the south are open space and recreational land uses. The proposal layout can be screened by existing vegetation and topography and by additional plantings and fencing along the boundaries of the subject property. The anticipated traffic from the church is Iglesia Asamblea Church SUP staff report DDR2013-000016 Page 5 of 6 Revised 5/01/13 estimated to be a mild generator, mostly occurring on Sundays, and have no adverse traffic effects on local road usage. 6. If located outside an Urban Growth Area,will the proposal result in the need to extend urban services? Staff Response: The proposal is two miles to the west of the Belfair Urban Growth Area. The applicant states that the existing water connection and septic system will provide the needed services for this land use. The site is accessible to Sheriff and fire protection services. C. Applicable Title 15 Review Criteria: Per section 15.09.050 (C)(1-3),the Hearing Examiner shall review a proposed development according to the following criteria. 1. The development does not conflict with the Comprehensive Plan and meets the requirements and intent of the Mason County Code, especially Title 6, 8, and 16. Staff Response: To address each Title: Title 6—Adequate septic and community water service shall be provided for this land use on the subject property. If the special use permit is approved, these services will need to support the public facility associated with the church building(s), and these services will be provided to proper state health standards. Title 8 - The proposal will be located outside of stream, shoreline, wetland, or landslide hazard critical areas and buffers as much as possible. If additional areas of land use are considered, state and county critical area standards must be integrated into the review of those proposals. Title 16—The proposed development is on one parcel, and no further subdivision of property is needed. 2. The development does not impact the public health, safety and welfare and is in the public interest. Staff Response: The proposed project will provide safe vehicle access to the property and the proper water and septic designed for the site and associated with the new church land use. Perimeter plantings near structures and fencing adjacent to property lines can screen the proposed buildings and land uses from adjacent residential land uses to the west, north, and east. 3. The development does not lower the level of service of transportation and/or neighborhood park facilities below the minimum standards established within the Comprehensive Plan. Staff Response: The anticipated traffic from the church is estimated to generate low to moderate amounts of vehicle traffic mostly during Sunday services, but not cause problems to adequate levels of transportation services. Neighborhood park facilities would not be required for this land use and the minimum standards established within the Comprehensive Plan will not be lowered. X. Project Analysis: Based upon these policies and regulations,the proposed land use and building size for a church conforms to the Mason County Development Regulations and the Comprehensive Plan. As proposed,the church proposal by Iglesia Asamblea de Dios Agua Viva International in the Rural Residential 5 zone is consistent with the Mason County Development Regulations. Staff recommends approval subject to the following conditions: 1) The applicant shall secure a water main extension agreement, as part of the Lynch Cove Water System(WA No. 49100U),with the provider Aquarius Utilities LLC,to serve this church land use. 2) The site plan included in the construction of the church shall integrate vegetation plantings and fencing or fence panels along property lines and near structures to screen the new development from adjacent properties. 3) Adequate parking areas shall be provided for this land use [1 stall per 4 seats or per 50 sq. ft. of floor area for assembly not having fixed seats] located on the subject properties. 4) A stormwater plan shall be prepared in compliance with MCC14.48.150, as part of site planning to address the control and treatment of runoff from roof and graded and parking surfaces during rainfall events. Gladwin Road Water Availability and Service Dear Mr. Moore: This will confirm your inquiry concerning water service from the Lynch Cove Water System. The subject property is a 4-acre wooded parcel situated between NE Gladwin Road and State Route 300 (see attached parcel map). This parcel is within our official service area as delineated in our 2008 Water System Plan Update, which was approved by the Washington Department of Health(see enclosed service area map). We also have a franchise with Mason County for the identical service area. The franchise confers on us the authority to operate, maintain,repair,upgrade and install water distribution facilities in the County roads within our designated service area. We recently completed a comprehensive improvement project for the Lynch Cove Water System which included new source, storage, electrical and piping facilities. As a result, the water system now has 4 wells pumping 275 gpm, 2 storage tanks holding 135,000 gallons, a booster pump station, and several miles of mostly 4-inch distribution pipe. The water system is approved for 304 connections and currently has 260 connections. The Lynch Cove Water System has ample capacity to serve the subject 4-acre parcel, regardless of the proposed use. Water quality is excellent, meeting all State and Federal standards. South of State Route 300, The Lynch Cove Water System serves all the lots of Beards Cove#1 plus several lots of an older waterfront subdivision(See attached drawing). Our water system(State I.D. #49100U) should not be confused with the Lower Lynch Cove Water System, a much smaller water system with service area limited to the plat of Lynch Cove#1. I have examined our records and inspected our facilities along Gladwin Road. The distance from Bryan Lane to a low point on the property 200 feet east of Lorna Lee Way is about 1460 feet. Use of 4-inch pipe size would be contingent on approval by Mason County. We have no objection to a qualified contractor installing the water main, provided our drawings and specifications are followed, and we are afforded the opportunity to inspect, test and certify the completed project. We have in-house engineering staff for design of the main extension. I understand that you are proposing to develop the property as a church campus, which would require fire protection. As you indicated, this would likely require an on-site storage tank and fire pump. Our distribution system could readily fill such a tank and keep it topped off as needed. The inlet would need to be metered, and means of controlling pressure fluctuations and flow rate in the supplying distribution piping would be necessary. You may be able to limit the volume of required fire storage by adhering to certain construction materials and methods, and by installing a fire sprinkler system. Water service for the church would be by a separate 1-inch metered connection, installed in the road right-of-way fronting the property. A permanent vegetative cover should be established on denuded areas at final grade if they are not otherwise permanently stabilized. Properties adjacent to the site of a land disturbance should be protected from sediment deposition through the use of buffers or other perimeter controls, such as filter fence or sediment basins. All temporary erosion control systems should be designed to contain the runoff from the developed two year, 24-hour design storm without eroding. Provision should be made to minimize the tracking of sediment by construction vehicles onto paved public roads. If sediment is deposited,it should be cleaned every day by shoveling or sweeping. Water cleaning should only be done after the area has been shoveled out or swept. Wash water from paint and wall finishing equipment should be disposed of in a way which will not adversely impact waters of the state. Untreated disposal of this wastewater is a violation of State Water Quality laws and statutes and, as such,would be subject to enforcement action. The zoning for the area is for Residential Use and should be kept as such. A church is NOT compatible with the surrounding lands. A church belongs within the"city" limits of Belfair,not along the beautiful shores of Hood Canal. Comments made by representatives of the church such as"measures will be taken to protect the community in question"are vague. What protection does the church feel the community needs as a result of its being established on the proposed site? The church representatives further state that"there will not be any significant impact upon existing uses of any adjacent lands". In the present day, most church attendees arrive via automobile. Traffic on North Shore Road is already impacted during the busy summer season. A church will bring additional traffic problems. Churches no longer only hold services for a few hours on Sunday. In these times, services and church related activities are commonly held at all different times during the day, evening and weekends. Additionally, congregations presently take on more and more roles such as day care centers, senior citizen activities,youth recreation, social services,to name a few. Churches often hold outdoor activities for youth in which loud music is played. We are not against churches in general but do not feel the proposed location is the best one for this particular use. We urge the Planning Department to keep the current zoning for residential use in place and deny the special use permit application of the Iglesia Asamblea de Dios Agua Viva. Because I did not receive a notice of this, I have some concerns. On the first page of the Notice Of Special Use permit it says construction of a 8,000 sq.ft.building. Then it says"to construct a building OVER 3,000 sq.ft. In size. How much OVER? Confusion continues,as,on the second page of the application,the Applicant Joaquin R(?) quotes the building as only 8,000 sq ft. Could you please clarify? In your Permit request you ask the Applicant to provide a site plan,including location of drinking water supply.The Applicant supplied you with a map where it notes a tiny square,well past 491 Gladwyn Beach Drive where it is written"public water connection".What is the source for the water? Is this a private well?How deep is it?Is it enough to supply two buildings,one 8,000 sq.ft.And another 3,000 or OVER sq.ft.?Will it affect our water table at our Lynch Cove Community well source on Bryan Lane?I am VERY confused when the Applicant states that"this property is served by adequate public facilities that are PRESENTLY in place". If this is true,can you please send me that information? If,in fact,the well must be drilled,will it pass County Code.15? It is a Private park on the cove. A concern has been noted that with a large input of people coming into the community, it will force us to hire a full-time Attendant to keep control. Robert Christensen, Robert Christensen Enterprises, LLC, indicated in the attached pre-survey questionnaire that he is not aware of any detrimental environmental conditions that could reduce the value of the property. There are no indications that the price of the Property will be altered based on any known REC. 1.4 SEARCH FOR ENVIRONMENTAL LIENS OR USE LIMITATIONS To assess the potential for environmental liens or activity use limitations on the Subject Property, ADESA researched information available at the Mason County Auditor's and Assessor's Office, Ecology's Environmental Covenant Registry and other pertinent regulatory databases listed in Appendix A of this report. During the course of this investigation, no environmental liens or use limitations were found in connection with the Subject Property other than those associated with the critical areas and their buffers. 1.5 PHYSICAL SETTING OF THE SUBJECT PROPERTY AND VICINITY The Subject Property is an irregular shaped, approximately 4.16 acre, undeveloped timber property. The Subject Property is located south of the intersection of NE State Route 300 and NE Gladwin Road, southwest of Belfair, WA, in an area of Hood Canal known as Lynch Cove. Based on information obtained from the USFWS National Wetlands Inventory online database, no wetlands have been identified on the Property. The area has been impacted by repeated complete and partial glaciations and crustal deformation related to the Cascadia subduction zone. In preparation for the development of the Properly, a subsurface geotechnical investigation was performed by Michael Staten, Envirotech Engineering, on February 25, 2013. Several test pits were dug to depths of 6.5-10 feet below the existing ground sup face to assess subsurface conditions. Mr. Staten provided the following description of the findings: "Soils within the upper 12 to 18 inches of natural ground were observed to be organic laden native soils. Most of the test pits on-site exhibited moist, brown and grey, loose to medium dense poorly graded sand (SP) with some gravel extending from near the ground surface to depths of at least 10 feet. Some areas of the property were observed to consist of approximately 3 feet of very moist, brown silt with sand(ML)soils overlying poorly graded sand (SP)." The soil types on the Subject Property have been identified through the USDA Natural Resource Conservation Service, Web Soil Survey. In order of prevalence, the dominate soil types on the Subject Property include: Indianola loamy sand, 5 to 15 percent slopes(lb). The Property does not contain areas within the 100 year flood plain as identified on FEMA Map Panel FM5301150135C, dated May, 1988. The Qva unit consists of well- sorted, fine-grained sand with lenses of coarser sand and gravel;there may also be areas of silt and clay deposits, and non-giacial deposits. Well logs for the Lynch Cove water system wells located to the southeast, reviewed on the Washington State Department of Ecology's online well log database, the static water level of the shallow aquifer is estimated to be 33-50 feet below the ground surface (bgs). Perched, shallow water bearing zones, low permeability surface soils may present in areas of the Property; although the majority of the Property consists of medium brown sand. Based on the topography, the presumed groundwater flow is to the southeast towards the Lynch Cove of Hood Canal. 1.6 SCOPE OF WORK This ESA has been completed at the request of Envirotech Engineering and Robert Christensen Enterprises, LLC to satisfy the due diligence requirement necessary to qualify for the innocent purchaser defense to CERCLA environmental liability. Specifically, this means the practices that constitute all appropriate inquiry into the previous ownership and uses of the property, consistent with good commercial or customary practice, to identify any current or historic Recognized Environmental Conditions (REC/HREC). The scope-of-work for this ESA adheres to the American Society for Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments (E 1527-05) and the United States Environmental Protection Agency (USEPA)All Appropriate Inquiry(AAI) Final Rule, 40 C.F.R. Part 312. • ASTM Standard E 1527-05 defines a REC as: "The presence or likely presence of hazardous substances or petroleum products on a property under conditions that indicate an existing release, a past release or a material threat of a release of any hazardous substances or petroleum products into structures on the property or into the ground, groundwater or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. No information was discovered to suggest a reason for the halt in construction. The Property is owned by W. Metsker Map of Mason County 1988 Thompson reviewed at the Washington State Library No structures or other signs of development are visible on the USGS Aerial Photograph reviewed at 1990 Property. The Property and Microsoft Research Maps online surrounding areas appear similar to (htf-i:i;; current conditions. A building permit application was submitted to Mason County by former Property owner Weldon Thompson. The application proposed the construction of a 28 unit multifamily Mason County Community 1990 residential development consisting of 2 Development, Permit File Review five-plex, 3 four-plex, and 2 tri-plex structures. The proposed development was to be named"Scenic Shores". The building permit does not appear to have ever been approved. Preliminary sewer and water availability documents filed with Mason County for the proposed Scenic Shore Mason County Community 1991 development on the Property. No Development, Permit File Review further action appears to have been taken regarding the Scenic Shores development No structures are depicted on the USGS Topographic Map reviewed at 1994 Property. Microsoft Research Maps online A pre-submission conference is submitted by the former owner Weldon Thompson,for the construction of two 2001 multifamily condominium buildings on Mason County Community the Property. The review of the historical use information above has revealed no REC. The historic references reviewed for this assessment suggest that the Subject Property has never been fully developed beyond its use as a timber/recreation property. Mason County development records suggest that several multifamily residential developments were proposed by the former owner of the Property, Weldon Thompson. Permit records suggest that a series of poured concrete building foundations were constructed on the Property in the late 1970's. During the field reconnaissance, conducted on February 25, 2013, the foundation segments were observed to be piled in the east-central portion of the Property. 3.0 INTERVIEWS ADESA contacted local government agencies to identify any current or historical information or reports of hazardous materials usage, storage, and/or releases that may have impacted the Subject Property. ADESA made reasonable efforts to contact previous property owners and conducted interviews modeled after the ASTM derived ADESA Phase I ESA User questionnaire (See Appendix C). Some previous property owners were not contacted due to the lack of usable contact information, and/or the likelihood that any information provided would be duplicative. Interviewee Information Obtained Date/Style Mr. Christensen indicates that the Subject Property Robert Christensen was acquired from the Estate of Weldon Thompson (owner), Robert in 2011. Mr. Christensen further stated that there 3/1/13 Christensen Enterprises, are no utilities or other improvements on the Environmental LLC Property, and that he is unaware of any current or Questionnaire historic land uses that could have led to detrimental environmental conditions on the Property. Kathy Soine Clerical 111, Mason Ms. Soine provided ADESA with historic property 3/12/2013 County Community permitting information for the Property. Telephone Development and Permitting Office Jess Mosley, Mr. Mosley reviewed the Mason County Environmental Health permitting/land use/general complaint database and Specialist, Mason found no information to suggest that any hazardous 3/4/2013 County Public Health, materials responses have occurred or that any Email Environmental Health recognized environmental conditions exist on the Division Subject Property. Mr. Hicks reviewed the Mason County Fire District Jeremy Hicks, Fire #2 records and found no information to suggest the 3/13/2013 Chief, Mason County use of petroleum UST/ASTs or that any hazardous Telephone Fire District#2 materials responses have occurred on the Subject Property. 7 PO BOX 1009•Tenino,rYA•98589 Phone:360-701-8797•Far:360-264-2028•emazl y Phase I Environmental Site Assessment `- ADESA �T- Mason County Tax Parcel#12331-32-00040 4.0 REGULATORY AND ENVIRONMENTAL DATABASE REVIEW As part of this assessment, ADESA performed a review of pertinent Local, State and Federal databases in search of potential documented Recognized Environmental Conditions (REC) in association with the Subject Property and/or properties within a 1-mile search radius. The regulatory database search information is presented in Appendix A of this report and is consistent with that specified by ASTM Standard E 1527-05 for government records review. Further, governmental databases not identified below indicate that no sites fitting those criteria exist within the ASTM specified search radius or were otherwise determined to be of no significance to this investigation. For a full listing of the governmental databases reviewed, see Appendix A. No listings for the Property were found in the databases searched and no surrounding sites of concern were identified within the ASTM search radius, which are likely to have contributed to detrimental environmental conditions on the Subject Property. See Appendix A for supplemental information regarding regulated sites and facilities in the vicinity. 5.0 SITE INSPECTION DETAILS On February 25, 2013, Mr. William W. Rutherford (ADESA) inspected the Subject Property for signs of current/historic recognized environmental conditions. The majority of the Subject Property is forested. Access to the interior areas of the Property was provided by a historic overgrown access road. ADESA observed poured foundation segments pushed into a pile in the east-central portion of the Property. Permit records obtained from Mason County Community Development suggest that the foundation segments were poured in the early stages of a planned multifamily residential development. There were no site observations that suggest the foundation segments were completed as structures. An approximately 500-gallon heating oil above ground storage tank(AST)was discovered to the north of the foundation segments. The AST appeared to have been disconnected at another location and placed on the Property. At the time of the site inspection the AST was empty and in fair condition with some signs of corrosion and no visible holes. It is not clear what, if any, were the uses for the AST in relationship to the Property. Field assessment of the soil beneath the AST did not yield any petroleum odors or other indications of petroleum impacts. An empty, open 55-gallon drum of Nox-Crete, concrete form releasing agent, was identified near the AST location. The Nox-crete may have been used during the pouring of the concrete foundation segments in the late 1970's. It is unclear whether the Nox-Crete drum contained more than residual amounts of product when it was left on the Property. No signs of distressed vegetation, petroleum/chemical odors or other indications of a release of hazardous materials were observed in the area of the drum, Minimal dumping of household waste, furniture and several oil filters was observed on the southern portion of the Property along the boundary between the Property and the neighboring residential lots to the southwest. ADESA observed no other signs of historic development or other indicators of potential REC.
