The violation(s) are occurring at the following property: Enforcement Case No.: BCC2012-00022 Parcel No.: 12329-44-00010 Site Address: 23730 NE State Route 3, Suite D, Belfair, WA 98110 ❑ Our office has been notified that the hood and duct system serving the cooking equipment for the Fiesta Mexican Restaurant located at 23730 NE State Route 3 in Belfair is not UL300 compliant and has not been corrected to comply with code specifications. Since 2009 Mason County Fire District 2 Inspectors and Mason County Building Inspectors have made periodic compliance inspections that resulted in a list of corrections reports notifying the owner that the hood system is not a code compliant system and needs to be replaced. A permit was applied for in July 2010 and issued in September 2011. No inspections have been requested or performed to verify that the hood and duct system is compliant. In addition required permits have not been obtained to address the non-permitted kitchen expansion. Failure to install the required hood and duct system and obtain a permit for the kitchen expansion along with required inspections, makes the cooking equipment and kitchen meet the definition of a dangerous structure in accordance to Mason County Code, Chapter 14 and Section 302 of the 1997 Uniform Code for the Abatement of Dangerous Buildings. Today the restaurant is posted with dangerous building notices at each exit/entry. Occupancy and use of the restaurant is not approved and considered a violation of Mason County code, Section 14.12.050. According to the Mason County Assessor records, parties named above hold legal interest in the parcel and are therefore subject to enforcement action for failure to comply. The parties shall respond to this county within twenty days of the postmark. Order YOU ARE HEREBY ORDERED to abate code violations: 1) Install the hood and duct system in accordance with plans and specifications of permit number FIR2010-00024. The permit was issued on September 12, 2011 and will expire if no inspections are requested on or before March 12, 2012. If the permit is allowed to expire additional fees shall be required before inspections will be performed. 2) Apply for and obtain a permit for the kitchen expansion and repair to existing hood. After successful inspection of items #1 and #2 the building inspector will be able to remove the "Dangerous Building Notices" and grant occupancy and use of the kitchen. Penalties This notice is to inform you that in the event that you fail to comply, we will pursue additional enforcement action against you, including but not limited to recording against the parcel, civil infractions, liens against the property through the Mason County Hearings Examiner process and/or criminal prosecution as allowed under Title 15.13 of the Mason County Code. Note that the removal, mutilation, destruction or concealment of the Notices posted on March 6, 2012 would be deemed a separate violation of Title 14. Based on the plans submitted the Type 1 hood was expanded and 3 new appliances were added,there is no record of a permit being issued for thr expamsion.The plans appear to show mechanical code violations.The main duct is a 1 OX 10 inch and a second 1 OX 10 duct from the new hood section was added.This will not work the exisitn duct needed to be enlarged to accomidate the new duct being added to it as well as a new Fan on the roof up sized to take in the new hood.There may be more issues,a pre-inspection will need to be done to determine code compliance. A new set of plans for the hood and duct system is to be submitted for review and approval. The manager with Feista Mexican rest.(Alberto)came in,he was to pick up the old permit and call for all required inspections.I also I went over with him some of the issues with the hood and duct system. He was instructed to contact an HVAC contractor to fix the hood.He was told that the work required a mech.permit and drawings were to be submitted with an application.I let him know that the hood and the surrounding areas were to be cleaned on all grease and that an inspector would be by on Monday to make sure it was clean. During an inspection of the Fiesta Mexican Restaurant located at 23730 State route 3 in Belfair he observed an outlet located in the kitchen that had burned and 1/2 was gone. Apparently they are still using this outlet. I believe there were other electrical issues as well. I have cc'd this message to Mr. Hicks. Perhaps he would like to elaborate. Mason County is planning to post the restaurant tomorrow which would not allow use or occupancy of the restaurant because of a non-compliant hood and duct system and the restaurant owner failed to obtain required permits when they expanded their kitchen. Apparently they have exiting issues as well.
