The request was approved pursuant to the Mason County Resource Ordinance No. 77-93, specifically for the construction of a Rite Aid Pharmacy within a stream buffer and setback. The proposal underwent SEPA Review. This is a final County decision. No further appeals to the County are available. The Examiner approves the 10 requested permit subject to the conditions recommended by staff. 11 ORAL TESTIMONY: 12 Charles Mead McCoy III, Mason County Planner, introduced the Staff Report 13 together with accompanying exhibits. See Transcript. The Examiner asked why a buffer reduction was employed in this case instead of a variance. Staff explained that 14 the applicants would not qualify for a variance. Lee Boad, the applicant's biologist, added that this was a unique project where the affected buffer area was completely 15 cleared and ecologically segregated from the stream it is supposed to protect. 16 EXHIBITS: 17 See "Case Index" attached to the Staff Report dated September 17, 2007. 18 19 FINDINGS OF FACT 20 Procedural: 21 1. Applicant. The applicant is Be Fair, LLC. 22 2. Hearing. The Hearing Examiner conducted a hearing for the subject application on September 25, 2007, at or about 1:00 p.m., in the Mason County Board 23 of Commissioners Meeting Chambers. 24 Substantive: 25 {VE0675333.DOC;1/13009.900000/} Be Fair LLC - Buffer Findings, Conclusions and Decision P. 1 3. Site Description/Proposal. Applicant proposes to locate a Rite Aid 1 pharmacy with a footprint of approximately 17,468.75 square feet (107.5 feet x 162.5 feet) partially within the stream conservation buffer area and building setback of Belfair Creek. In conjunction with the project, the applicant proposes to combine the subject parcel with the adjoining parcel under a boundary line adjustment (the BLA is not before this hearing examiner and not a part of this decision). The total combined 4 acreage of the parcels will be 2.18 acres. The parcels abut the riparian zone of Belfair Creek along the southeast rear boundary line of the subject parcel. Two onsite existing commercial buildings and their associated sewage treatment systems will be 6 removed, and one commercial building and a new sewage treatment system will be constructed. Applicant also proposes to extend an existing retaining wall an 7 additional 15 linear feet within the stream conservation buffer area. The combined intrusion into the conservation buffer area by the building and retaining wall is 8 approximately 324 square feet. 9 The required Conservation Buffer Area for Belfair Creek, measured from the ordinary 10 high water mark (OHWM), is 150 feet, with an additional 15-foot building setback. The buffer reduction is requested because a small portion of the proposed structure 11 lies within the buffer/setback of Belfair Creek. The proposed building will be sited at least 100 feet from the creek's ordinary high water mark (OHWM). The side-yard 12 property lines are adjacent to existing commercial developments (i.e., North Mason County Chamber of Commerce Building and professional offices). The fronts of the 13 subject parcels abut State Route 3. 14 Belfair Creek is within the Urban Growth Area (UGA) of Belfair and has been 15 severely altered and modified due to its urban surroundings. According to the Staff Report, the creek is a "tight-lined" stream for a significant length in crossing under 16 State Route 3 and is a tributary of the Union River. The stream may become a spawning and rearing habitat for salmon and trout if downstream barriers to fish 17 passage are removed. The area within the buffer that will be developed under this 18 proposal was described in the Habitat Management Plan as "functionally displaced"; the area is dominated by non-native plant species and compacted parking areas for 19 boats, vehicles, and trailers. 20 The applicant proposes to offset the encroachment of the wall and building in the buffer with planting of approximately 2,271 square feet. The proposed area to be 21 restored with native-plantings is indicated on the Site Plot Plan. See Attachment 2 to 22 Staff Report. The proposed restoration area is immediately adjacent to the waterward side of the retaining wall and its proposed extension. A planting plan detailing the 23 proposed placement of all plantings and a summary of the total costs of habitat restoration has yet to be submitted by the Applicant, and submission to and approval 24 by staff of such a planting plan is a condition of this approval. 25 {V Eo675333.DOC;1/13009.900000/} Be Fair LLC - Buffer Findings, Conclusions and Decision p. 2 4. Characteristics of the Area. The general area is a highly urbanized 1 environment in the center of Belfair's UGA. Many commercial businesses occupy 2 the area surrounding State Route 3. 3 5. Adverse Impacts. The proposed building and extension of the retaining wall will intrude into the protected buffer of Belfair Creek. However, the potential 4 enhancement to the riparian function through restoration mitigation as set forth in the HMP, which is a condition of this approval, will more than offset the intrusion into a 5 "functionally displaced" buffer area dominated by non-native plant species and 6 compacted parking areas. The vegetation restoration may also continue to enhance protecting water quality in Belfair Creek as the native vegetation grows over time. 7 The replacement of two buildings and two sewage treatment systems with one building and one sewage treatment system will also mitigate the project. Finally, the 8 removal of potentially contaminated soils during excavation may also benefit the 9 immediate water quality of Belfair Creek and the Union River. CONCLUSIONS OF LAW 11 Procedural: 12 1. Authority of Hearing Examiner. Staff have framed the instant proceeding 13 as a Type III quasi-judicial decision. See MCC 15.03.015(c)(3)(C). MCC 14 15.03.050(10) provides the Examiner with the authority to review and issue a final decision regarding buffer reduction request. 15 Substantive: 16 2. Zoning and Comprehensive Plan Designation. The zoning designation of 17 the subject site is zoned General Commercial District (GC). The Comprehensive 18 Plan designation is Belfair Urban Growth Area. 19 3. SEPA Compliance. SEPA notice was posted and sent for agency review and comment on August 30,2007. A Determination of Nonsignificance was made by 20 Mason County. See Attachment 4 to Staff Report. The proposal required review and comment by Washington Department of Fish and Wildlife and the Skokomish Tribe. 21 No comments were received to posted, published, and mailed notice of the 22 application or SEPA determination. 23 4. Review Criteria. The substantive review criteria applicable to this matter are codified at MMC 17.01.110(D)(3) and MMC 15.09.050(c). These criteria are 24 recited and addressed below: 25 A. MMC 15.09.050(c) {VE0675333.DOC;1/13009.900000/} Be Fair LLC-Buffer Findings, Conclusions and Decision p. 3 1 MCC 15.09.050(c)(1): The development does not conflict with the comprehensive plan and meets the requirements and intent of the Mason County Code[.] 3 5. The development meets the applicable criteria, does not conflict with the Comprehensive Plan, and meets the requirements and intent of the Mason County 4 Code. The General County-wide Planning Goals and Policies in the Economic Development Element of the Comprehensive Plan provide that "Mason County shall 5 promote economic vitality while protecting and maintaining a rural lifestyle, 6 balancing business and industrial development with environmental protection." See Goal 1. Policy 1.1 directs the County to "Recognize that environmental quality and 7 economic development are complementary objectives that should be achieved simultaneously." The associated Action Statement provides that the County should 8 "Develop and maintain a business friendly environment that encourages business development compatible with the environment of Mason County." Goal 3 provides 9 that the County should "Support sustainable business and industrial development 10 which: 1) Strengthens and diversifies the economic base; 2) promotes predominantly living-wage jobs and economic opportunity that preserves a high quality of life for all 11 citizens, and; 3) develops and operates in a manner compatible with the natural environment." As discussed throughout this decision, the project meets the above 12 policies by increasing promoting economic vitality in a balanced manner with 13 environmental protection. 14 MCC 15.09.050(c)(2): The development does not impact the public health, safety and welfare and is in the public interest. 15 6. As discussed throughout this decision, the proposed development would 16 not adversely impact the public health, safety, and welfare and it is in the public interest. The proposed mitigation associated with the development would more than 17 offset the impacts of the development. 18 MCC 15.09.050(c)(3): The development does not lower the level of service of 19 transportation and/or neighborhood park facilities below the minimum standards established within the comprehensive plan. 20 21 7. The subject property is served by State Route 3. The County cannot impose concurrency on state highways. Moreover, there is no indication that the 22 development would lower the level of service of transportation. Although the Comprehensive Plan does not establish levels of service for park facilities, the 23 guidelines contained in the Comprehensive Plan (6.25 to 10.5 acres of open/park space per 1,000 people) are based on population and would not be measured in terms 24 of commercial development. See Parks and Recreation Comprehensive Plan, Chap. 6 25 -Level of Service Standards/Needs Analysis. {VEo675333.DOC;1/13009.900000/} Be Fair LLC -Buffer Findings, Conclusions and Decision p. 4 1 B. MCC 17.01.110(D)(3) 2 MCC 17.01.110(D)(3): Mason County may decrease the buffer after consultation 3 with the Washington State Department of Fish and Wildlife and the Skokomish Tribe, the Quinault Tribe and/or the Squaxin Island Tribe, after review and approval of a 4 Habitat Management Plan, and after a public hearing. Mitigation must be adequate to preserve or enhance the functions and values of the critical area. This means that a 5 finding must be made that the net effect of the proposal equal or better than applying 6 the standard buffers. If enhancement is part of the mitigation plan, then a greater level of enhancement is required to offset the time lost while the enhancement 7 matures. 8 8. The evidence demonstrates that this criterion has been satisfied. The County formally notified and invited comment from both the Washington Department 9 of Fish and Wildlife and the Quinault Tribe. The requisite public hearing was 10 conducted on September 25, 2007. As noted above, the mitigation proposed by the HMT more than offsets the effects of proposed development on the site. The 11 mitigation that is offered in the HMT would contribute to improving water quality and other aspects of habitat for fish and wildlife in Belfair Creek's riparian zone. 12 Landscaping buffer requirements as required in Title 17 Belfair UGA Zoning & Development Regulations will also assist in general water quality and stormwater 13 management within the Belfair UGA. 14 The potential enhancement to the riparian function through restoration mitigation as 15 set forth in the HW, which is a condition of this approval, will more than offset the intrusion into a "functionally displaced" buffer area dominated by non-native plant 16 species and compacted parking areas for boats, vehicles and trailers. The replacement of two buildings and two sewage treatment systems with one building and one 17 sewage treatment system will also mitigate the project. Finally, the removal of 18 potentially contaminated soils during excavation may also benefit the immediate water quality of Belfair Creek and the Union River. STAFF REPORT I. Introduction: this report evaluates a request for a buffer reduction to locate a Rite Aid pharmacy with a footprint of approximately 17,468.75 square feet (107.5'X 1625) partially within the stream conservation buffer area and building setback of Belfair Creek (WDFW &WRIA catalogue number 15.504). The proposed building is currently sited at a distance of not closer than 100 feet from the creek's ordinary high water mark (OHWM) to the southeast on the adjacent parcel. This creek is within the Urban Growth Area (UGA) of Belfair and has been severely altered and modified due to its urban surroundings. It is a "tight-lined" stream for a significant length in crossing under State Route 3. It is a tributary of the Union River. It will offer potential spawning and rearing habitat for salmon and trout in the future when down stream barriers to fish passage are eventually removed. The site is a combined set of two parcels (12329-41-90230 & 12329-41-90190) that are to be joined together (BLA2007-00058). The BLA is not yet recorded with Mason County Auditor. There is also an existing retaining wall that is to be extended 15 additional linear feet within the stream conservation buffer area. The total acreage of the combined (2) parcels will be 1.72 + 0.46 = 2.18 acres. The combined intrusion into the conservation buffer area by both the retaining wall extension and the commercial building is approximately 15 sq. ft. + 309 sq. ft., respectively, equaling 324 total square feet. The amount of planted area offered in mitigation to offset the placing of the wall and building in the buffer is approximately 2,271 square feet. The Author of the Habitat Management Plan (HMP) describes the area within the buffer that will be developed under this proposal as "functionally displaced". The area is dominated by non-native plant species and compacted parking areas for boats, vehicles and trailers. The mitigation offered would improve the immediate area adjacent to the project to a greater degree than what has been proposed by the project to be developed as a commercial building. The proposed project is described and mitigation offered in the attached HMP (Attachment 1). The required Conservation Buffer Area measured from the ordinary high water mark (OHWM) of a Type "F" stream is 150 feet, with an additional 15-foot building setback. The buffer reduction is requested because a small portion of the proposed structure lies within the buffer/setback of Belfair Creek (Attachment 2). Date of Complete Application: 28 August 2007 V. Evaluations: A. Characteristics of the Site: The parcels to be developed as a commercial building site abut the riparian zone of Belfair Creek along the southeast rear boundary line of the subject parcel. The side-yard property lines are adjacent to existing commercial developments (i.e. North Mason County Chamber of Commerce Building and professional offices). SEPA Compliance, Public and Agency Comment: the SEPA (SEP2007- 00056) notice was posted and sent for agency review and comment on 30 August 2007. A Determination of Nonsignificance was made by Mason County (Attachment 4). No SEPA comments were received. Public notice of the Mason County Environmental Permit application and hearing date were posted onsite and at the Belfair Post Office on 8 August 2007 (Attachment 5). Notice of Mason County Environmental Permit hearing was published in the Shelton-Mason County Journal on September 6 and September 13, 2007. The proposal required review and comment by Washington Department of Fish and Wildlife and the Skokomish Tribe. No comments were received. A 28-day comment period followed. VII. Other Permits or Approvals: a Mason Environmental Permit application (MEP2007-00089) was received 28 August 2007 with this request for Provision for Decreasing Buffer (Attachment 3). A Stormwater Drainage Report was submitted for review and approval to Mason County Public Works. The proposal will require a Mason County Building Permit for the construction of a Commercial Building, and separate building permit for the construction of the retaining wall extension and replacement. A three-year plant monitoring program, from the time of initial planting, will be required by the County, with annual reports submitted yearly on the anniversary date of the initial plantings. A Title Notification of Habitat Management Plan shall be recorded with the County Auditor's Office prior to final approval of the building permit. Vill. Analysis: Buffer reduction is considered a Type III quasi-judicial decision. Thus Hearing Examiner approval is required. Staff finds that the request is generally consistent with the provisions stated in the Mason County Resource Ordinance and the Fish and Wildlife Habitat Conservation Areas chapter (Section 17.01.110): "For major new development, Mason County may decrease the buffer after consultation with the Washington State Department of Fish and Wildlife and the Skokomish Tribe, the Quinault Tribe and/or the Squaxin Island Tribe, after review and approval of a Habitat Management Plan, and after a public hearing. Mitigation must be adequate to preserve or 9 enhance the functions and values of the critical area. This means that a finding must be made that the net effect of the proposal [is] equal or better than applying the standard buffers. If enhancement is part of the mitigation plan, then a greater level of enhancement is required to offset the time lost while the enhancement matures." General Commercial District zoning in the Belfair UGA allows for this type of use (Attachment 6). The required conservation buffer for a Type "F" stream is 150 feet plus a 15-foot building setback for a total distance of 165 feet from OHWM. Stream typing is per Washington Department of Natural Resources stream typing criteria. The proposed mitigation described in the attached HMP will meet the above requirements, in Staff's professional opinion, as adequately offsetting to a greater degree the effects of proposed development on the site. The mitigation that is offered in the HMP would contribute to improving water quality and other aspects of habitat for fish and wildlife in Belfair Creek's riparian zone. Landscaping buffer requirements as required in Title 17 Belfair UGA Zoning & Development Regulations will also assist in general water quality and stormwater management within the Belfair UGA. Two onsite existing commercial buildings and their associated sewage treatment systems will be removed in exchange for the construction of one commercial building and a newly constructed sewage treatment system - is also part of the overall project proposal and general site mitigation. Removal of potentially contaminated soils during excavation could also benefit the immediate water quality of Belfair Creek and the Union River. IX. Staff Discussion: in Staff's professional opinion the chosen site for the structure will place the building at a significant distance from Belfair Creek, with the potential of enhancing riparian function through restoration mitigation as described in the HMP. The new proposed site will minimize conservation buffer vegetation disturbance as much as possible. With the proposed native vegetation enhancements in the HMP meant to mitigate impacts due to commercial development, improvements should continue to occur in protecting water quality in Belfair Creek as the vegetation continues to grow over time. X. Conclusions: upon the above discussion the proposal is consistent with the Mason County Resource Ordinance 77-93. Staff recommends approval of the proposal subject to the conditions listed below. f 1. Developers and individuals shall be required to control erosion during construction. w 2. The Stormwater Drainage Plan, as submitted, will need to be approved or modified as required by Mason County's Department of Public Works, before the PlanningDe r Department ent may approved a building permit for the project. 3. The existing natural vegetative buffer shall remain undisturbed by any construction and/or development activities on the parcel. J 4. The provisions and recommendations of the Habitat Management Plan shall be implemented in its entirety and in a timely fashion. 5. All upland areas disturbed or newly created by construction activities shall be seeded, vegetated or given an equivalent type of erosion protection (silt fencing or straw matting) 6. A monitoring plan shall be enacted whereby a qualified biologist shall submit a report detailing the condition of the restoration area. This report shall be due on the anniversary date of the issuance of the building permit and shall be submitted annually for three years. ✓7. A survival rate of 90% of plantings is required each year during the three- year monitoring period. If survival falls below 90%, the applicant shall replant to restore the required survival percentage and shall extend the monitoring report the necessary period to address the re-plantings. 8. No degradation of water quality shall occur as a result of this project. 9. A Title Notification of Habitat Management Plan shall be recorded with the County Auditor's Office prior to final approval of the building permit. J 10. A site plan depicting all native planting locations and a cost analysis for the restoration will need to be submitted and approved to the Planning Department prior to permit approval. XI.
