The property is found in the SE '/4 of Section 29, Township 23 North, Range 1 West (See Figure 1. Site Vicinity Map). The property is owned by Belfair LLC c/o Brent Nicholson. This HMP addresses potential impacts resulting from the proposed construction that will fall partially within the buffer of a type F stream. The work addressed in this report includes a portion of the proposed building and expansion of an existing retaining wall, both to fall within the stream buffer. The section of the property outside of the buffer within the parcel will be occupied by the remainder of the building, utility easements, vehicle access roads, parking areas, and on site septic. The overall site plan has been designed to avoid the regulated stream buffer to the extent feasible, while meeting all other regulatory and logistical needs of the project. This report has been prepared to fulfill the requirements listed in Section J of Chapter 1701.040 of the Mason County Resource Ordinance. The objectives of this HMP are as follows: ■ To evaluate the potential adverse effects to critical area functions as well as fish and wildlife habitat resulting from the construction of a portion of the building occupying a footprint of 309 square feet within a type F stream buffer. The construction zone is proposed to begin 140-feet from the stream at the nearest point. ■ To evaluate the potential adverse effects to critical area functions as well as fish and wildlife habitat resulting from the expansion of an existing retaining wall which will capture an additional 15 square feet of stream buffer. The construction is proposed 100-feet from the stream at the nearest point. ■ To identify possible mitigation measures that could be implemented to offset the adverse effects resulting from the portion of the proposed project to occur within the stream buffer. The entire property has been used to accommodate a boat and marine accessories business for several decades. The southeastern half of the site consists of a compacted gravel area occupied by a series of storage buildings used for boats. The northwestern half of the site is occupied by a marine accessories and boat retail store and paved parking area. The property is bordered to the northeast and southwest by other commercial properties, to the southeast by a large forested ownership, and to the northwest by State Route 3. Topography throughout most of the property is generally flat, with the exception of the cut bank along the southeastern property line which elevates upward towards the forested riparian area on the adjacent forested ownership. 4 F f a S Z t ' \N. x [ n ,, J - Photo 1. In general the stream flows westerly into the commercially developed Belfair area where it is tight lined for several hundred feet prior to entering the lower Union River. The riparian area between the Belfair LLC property and the stream consists of a mature coniferous forest dominated by western red cedar with a common understory dominated by salmonberry and sword fern. The portion of stream buffer extending onto the Belfair LLC property is best described as functionally displaced in terms of riparian habitat. This is primarily due to the history of land use, impervious surface, and lack of any vegetation. Forested riparian area between Belfair LLC property and the stream 3.0 BACKGROUND AND LITERATURE REVIEW Preliminary research of this site included review of the U.S. Fish and Wildlife Service National Wetland Inventory (NWI), the Department of Natural Resources Stream Map, and The Washington Department of Fish and Wildlife Priority Habitats and Species Database. The National Wetland Inventory maps no wetlands within or in close proximity to the parcel. The Washington Department of Fish and Wildlife Priority Habitats and Species Map for Mason County shows no priority habitats for any listed species within the parcel. A species site for a "State Threatened Species" is mapped %2 mile to the west near the mouth of the Union River. A species site for"Other Priority Species" is mapped approximately %2 mile to the north. Because of the overall distance from these species sites to the project area TWC has not requested detailed species information from WDFW to include in this HMP. No aspects of this project are expected to affect nearby wildlife species. The Department of Natural Resources Water Resource Map identifies the stream located on the adjacent parcel to the southeast. The stream is mapped to drain westerly through the adjacent parcel to eventually flow into the Union River. See Figure 3 for the DNR Water Resource map. Mason County has recently changed the water typing system from the original Types 1,2,3,4 & 5 streams to Types S, F, Np & Ns streams. Although the codes are new, similar criteria are used to define water types. According to the WAC 222-16-030 Water Typing System, the stream meets criteria for a type F stream, as it is presumed to have fish use based on a channel greater than 2 feet wide, year round flow, and slope gradient less than 16 percent. The water typing system states: "Type F Water" means segments of natural waters other than Type S Waters, which are within the bankfull widths of defined channels and periodically inundated areas of their associated wetlands, or within lakes, ponds, or impoundments having a surface area of 0.5 acre or greater at seasonal low water and which in any case contain fish habitat. 5.0 APPLICABLE SETBACKS The proposed project is within the jurisdiction of Mason County. Ordinance 17.01.040 identifies Fish and Wildlife Habitat Conservation Areas (FWHCA's) adopted by Mason County. The FWHCA setback applicable to this project is as follows: Habitat Type Buffer Building Setback from Buffer Type F Stream 150' 15' 6.0 DESCR.IPTION OF HABITAT AND SPECIES 6.1 Puget Sound Chinook(Oncorhynchus tshaw ty sha) -Threatened Listed as threatened since March 24,1999 adult Puget Sound Chinook spawn in several rivers and streams flowing into Puget Sound. This stream does not contain habitat characteristics typical of chinook systems due to limited size and flow. A substantial reach of the lower portion of the stream has been tight lined for several hundred feet which substantially hinders any anadromous fish access. The lower union river is known to support small runs of Puget Sound Chinook. These fish are assumed to be of hatchery origin but have maintained some level of natural production over the last decade. PO Box 2854 Belfair,Washington 98528•Cell Phone 360-620-0618.Office Phone 360-372 2421•boad40@peoplepc.com Rite Aid Pharmacy fRvIP June,2007 Page 6 The mainstem of the Union River was listed as a final designation in the NOAA Fisheries Northwest Region Critical Habitat Designations for West Coast Salmon and Steelhead in Washington-August 2005. Although the on-site stream does not support suitable habitat for Chinook, water quality, sediment, and nutrient supply from this stream may affect the mainstem of the Union River. The project proposal includes mitigation and tactical design intended to protect and maintain water quality of the stream. Given the absence of spawning habitat, limited surface area of stream buffer displacement, and mitigation proposed, this project is not expected to impact Puget Sound Chinook. 6.2 Hood Canal Summer Chum(Oncorhynchus keta)- Threatened Hood Canal Summer Chum spawning areas in proximity to the site include the Union River and, historically, the Tahuya River. Recovery efforts are in place to restore naturally spawning summer chum populations to the Tahuya system while the Union stock remains healthy. Summer chum are present from August to mid October in the lower Union River. The type F stream within the parcel is within the lower Union River watershed which is part of the Summer Chum ESU. The portion of the stream in proximity to the project site is likely inaccessible due to downstream blockages. Measures are provided in this plan to protect water quality and aquatic habitat downstream. Given that no modification to the existing forested riparian area are proposed, no impacts to summer chum or their habitats are predicted to occure 6.3 Puget Sound Steelhead (Oncorhynchus mykiss)- Threatened Listed as Threatened since May 2007, Puget Sound Steelhead spawn in several streams throughout Puget Sound. Spawning usually occurs in moderate to steep gradient sections of streams, usually in heads of riffles or the tails of pools where hydraulic conditions are conducive to intragravel flow. Side channels and the anterior portions of islands are also used. Spawn timing for summer steelhead runs typically ranges from mid May through October while winter run steelhead are present from December through May. Adequate cover from predation, water temperature, and spawning gravel are important factors for instream habitat, while little is currently known about specific marine habitat requirements. The Type F stream may support suitable steelhead habitat in the lower reaches although documentation of their presence is not available. As with summer chum and Chinook, access to the stream reach in proximity to the project site is likely limited due to downstream blockages. The overall project described in this report is not expected to impact water quality or aquatic habitat important to all native fish species including steelhead. 6.4 Bull Trout (Salvelinus malma)-Threatened Bull trout typically inhabit very cold, clear headwater streams at high elevations that are supported by snowmelt. For spawning and early rearing, bull trout require loose, clear gravel, relatively free of fine sediments. None have been documented in the Union River watershed. Given the lack of suitable habitat and documented occurrence, the proposed project is not likely to have any adverse impacts on bull trout. 6.5 Bald Eagle (Haliaeetus leucocephalus)-Endangered Habitat areas associated with Bald Eagle include uneven aged coniferous stands with some old-growth components. Nests are typically constructed in larger trees with dead or broken tops providing an unobstructed view of nearby water. Snags and trees with exposed lateral limbs, or dead tops are used as perches and defense stations. There are no documented Bald Eagle nesting sites within 114 mile of the project area. The proposed project will not require any tree removal. Given there are no important habitat features within the project area and bald eagles are not present within the project area, this project should have no adverse impacts on bald eagles. 6.6 Marbled Murrelet(Brach)ramphus marmoratus)-Threatened Marbled Murrelets are typically associated with coastal habitats and nest in old-growth forests. Murrelets may fly as far as 50 miles inland to nest, however the average distance is roughly 5-miles from nest to sea. It is only during the summer breeding months that they are commonly found inland. During non-nesting seasons they live at sea. Murrelets require tall mossy trees in coniferous old growth forests with cavities on thick branches where they can construct a cup nest 20-40 meters above the forest floor. Murreletts have been documented laying eggs on rocky ground habitats only when a sufficient forest is unavailable. There are no documented nesting sites surrounding the project site. No potential nesting trees are within the project area. This project is not likely to adversely impact Marbled Murrelet, given there are no documented nesting sites or potential nesting trees in the vicinity of the project area. 6.7 Northern Spotted Owl (Stria occidentalis caurina)- Threatened Spotted owls require a large amount of land for their nesting and hunting grounds; pairs may occupy up to 58 sq. km. They are territorial and do not migrate, but they may shift their ranges slightly in response to seasonal changes Suitable spotted owl habitat includes trees relatively large in diameter, multi-layered forest canopy with a moderate to high canopy closure in overstory, midstory, and understory, large, tall, live trees with cavities, broken tops, mistletoe, or platforms of branches capable of holding accumulated organic matter suitable for use as a nest. Currently there are no spotted owl nesting sites documented in proximity to the project site. There are no areas within the ownership suitable for spotted owl use. As spotted owls are currently not present, and the project is of a scale that has no impact on forested areas, no impacts to spotted owl or their habitat are expected result from the proposed project. 7.0 ANNA.LYSIS OF EFFECTS The proposed project lies partially within the regulated buffer of a type F stream. Project scale in the protected area is as follows: Development Type Habitat Type Project scale within buffer Commercial building Type F stream buffer 309 sq. ft. Retaining wall addition Type F stream buffer 15 sq. ft. Total Type F stream buffer 324 sq.ft. 7.1 Vegetation Disturbance No disturbance to native vegetation will be necessary for this project. The portion of the stream buffer where the commercial building will be located is occupied by a compacted gravel area. Representative location of 309 sq ft building expanses Vi in the stream buffer. 7.2 Designated Critical Habitat for Salmonids None of the actions will destroy or adversely modify designated critical habitat. Actions described in this plan will not jeopardize the continued existence of any listed species. 7.3 Noise Pollution An increase in noise from construction activities is anticipated during operation hours. The project site is not within the radii of concern for any listed species that may be affected by increased noise. Wildlife species in proximity to the project area are likely adapted to noise and activity associated with commercial land use. 7.4 Temporary Increase in Sediment and Turbidity During Operation The proposed work has the potential to temporarily increase turbidity and suspended sediment within the project area. The elevated cut bank between the project area and the stream nearly eliminates potential for sediment runoff to reach the stream. Best Management Practices are recommended to avoid any potential impacts associated with sediment and turbidity that the project may cause. 7.5 Light and Glare The proposed project will result in an increase in light and glare commonly associated with commercial land use. The mature forested area between the Belfair LLC property and the stream will shield the shield majority of the stream corridor from increased light and glare. Additional planting of overstory trees is proposed in section 8.4 to increase the vegetative screen between the proposed project and the existing riparian corridor. No impacts to the PO Box 2854 Belfair, Washington 98528•Cell Phone 360-620-0618.Office Phone 360-372 2421-boad40@peoplepc.com Rite Aid Pharmacy HNT June 2007 Page 10 use of the site by riparian dependent species are expected to result from light and glare associated with this project. 8.0 MITIGATION MEASURES 8.1 Best Management Practices Recommended Best Management Practices for this project are as follows: • Consolidate the time period in which heavy earthmoving machinery is used. Earthwork activities should be implemented during the driest season of the year to minimize the risk of runoff related impacts to the stream. Any work requiring use of this type of equipment(such as site grading, road building, grubbing,cutting and filling) should also be done over short periods or events. • Minimize amount of erodible soils at any given time to the maximum extent feasible. • An storage or stockpiling of materials should take lace outside of the buffer. Y g P g P • Appropriate erosion control devices, such as silt fencing, mulch berms, and erosion control matting should again be used if needed during all aspects of the construction phase to mitigate potential erosion and runoff into the stream. • Check all equipment daily for leaks. Refueling and lubrication of equipment should occur off site. Do not store any fuel, lubricants, chemicals, or hazardous substances outside overnight within the stream buffer portion of the project area. • Do not apply any chemicals when there is a possibility of rain. • Clearly mark clearing and grading limits with orange ribbon or construction fencing. • Coinciding with, or immediately subsequent to the completion of the construction work, stabilization of bare ground should occur. Surfaces proposed for paving should be paved as soon as possible. 8.2 Avoidance Mitigation The net effect of this proposal will be habitat conditions equal to or better than what currently exist. The project does not include any aspects that would disturb or displace the forested riparian area. The site has been selected for this project based on the ability to meet the project needs without displacing any functioning critical area. With the exception of the 15 square foot portion of the retaining wall to be expanded partially into a cut bank, the entire PO Box 2854 Belfair,Washington 98528•Cell Phone 360-620-0618.Office Phone 360-372 2421•boad40@peoplepc.com Rite Aid Pharmacy HMP June,2007 Page 11 project area is located where existing buildings and/or compacted gravel boat storage areas currently exists. 8.3 Minimization Mitigation The proposed project minimizes impacts to the stream buffer by limiting the square footage of encroachment to 324 square feet beyond what currently exists. Most of this encroachment(309 sq ft)will consist of a portion of the building to be located over what is a compacted gravel area. 8.4 Enhancement Recommendations To mitigate for the displacement of 324 square feet of regulated buffer a vegetative restoration area is proposed along the southeastern line of the Belfair LLC property. The overall goal being to enhance the vegetative screen between the project area and the existing forested riparian zone. Planting Area The area recommended for planting consists of the upland slope between the retaining wall and the southeastern property line. This overall surface area is approximately 2,271 square feet. It is occupied by both native and non-native shrubs with scattered big leaf maple. Photo 7. A minimum of 1 tree species and three shrub species from the above list are recommended. trees- 10' on center shrubs-3' on center These densities will eventually provide a dense, vegetative screen between the project area and existing forested riparian area. It is recommended that potted plants be used as opposed to bare root seedlings. Typically, planting should occur during winter dormancy. The optimum time for planting is during February and March, however, the need to complete the project in a timely manner may call for planting to occur outside optimum time periods. No machinery earthwork will be necessary to implement this mitigation; planting holes for specified vegetation installation will be hand dug. All installed vegetation shall be marked with colored flagging to facilitate monitoring inspections. The monitoring program is recommended to insure project effectiveness. Invasive Species Removal Invasive species such as Himalayan blackberry, reed canary grass, Japanese knotweed, and English Ivy may invade the enhancement zone. These species are stubborn competitors for light and nutrients and limit success of native plants. Invasive species should be removed from the enhancement zone should they invade. Persistent cutting during the growing season is sufficient to offset the rhizomes of invasive species if they become a problem. The information gathered will provide the following: 1) condition of reintroduced plant species; 2) the use of the site by wildlife species; 3) any unforeseen disturbance caused by the proposed project and associated aquatic habitat; 4) any occurrence of exotic species within the enhancement zone; 5) any corrective measures that may be deemed necessary to provide desired conditions. Two photo points will be established that portray the planting area from each side of the property. This monitoring will be in effect for the duration of three years. The information gathered will be provided in an annual report and submitted to the Director of Mason County Department of Community Development. 10.0 SUMMARY One stream meeting criteria for a type F stream is located on the adjacent property. Type F streams are regulated in Mason County, requiring a 150-foot buffer, with an additional 15- foot building setback. The portion of the property within the 150-foot buffer has been functionally displaced by a history of commercial land use as it consists of compacted gravel and storage facilities. The proposed project involves the construction of a commercial building that will fall slightly within the type F stream buffer (309 sq ft). A modification to the existing retaining wall will encroach an additional 15 square feet into the buffer as well. The overall site plan has been designed to avoid the regulated stream buffer to the extent feasible, while meeting all other regulatory and logistical needs of the project. Compensatory mitigation is recommended in the form of establishing a vegetative screen between the project area and the forested riparian area located on the adjacent property. This will be accomplished through native tree and shrub plantings within an available strip of land which occupies approximately 2,271 square feet. Mitigation Measures and Best Management Practices have been identified to avoid, minimize, and mitigate for impacts to the type F stream associated with proposed construction. Approximate Parcel Locations i 1 Onsite Soil Conditions based on Mason County Soil Survey Subject Site Soils: Everett gravelly sandy loam, 5 to 15 percent slopes (Eh) The Everett series consists of somewhat excessively drained, pale brown gravelly soils. They occur as inextensive gravel ridges on the glacial moraines or,more commonly,as fairly continuous outwash channels between ridges of Alderwood soils. They have developed upon assorted glacial till and outwash material. The rainfall is 45 to 60 inches a year. The vegetation is mainly drought-resistant madrone, manzanita, and kinnildnnick. Everett soils are droughty because the loose gravel and sandy subsoil and substratum offer little resistance to downward movement of water. The capacity of the surface soil to hold available moisture is low. Everett soils are in the eastern half of the county, in association with the Alderwood soils. They also occur in intricate patterns with the Kitsap and Indianola soils. Compared to the Grove soils, the Everett soils have a paler surface soil and subsoil and, in development,were dominated more by acid igneous parent rock. Everett gravelly sandy loam,5 to 15 percent slopes(Eh).-This is the most extensive Everett soil. Between May 1 and September 30, no soils shall remain exposed and un-worked for more than 7 days. Clearing limits and/or any easements or required buffers should be identified and marked in the field, prior to the start of any clearing,grading, or construction. Some suggested methods are staking and flagging or high visibility fencing. A permanent vegetative cover should be established on denuded areas at final grade if they are not otherwise permanently stabilized. All temporary erosion control systems should be designed to contain the runoff from the developed two year,24-hour design storm without eroding. Provision should be made to minimize the tracking of sediment by construction vehicles onto paved public roads. If sediment is deposited, it should be cleaned every day by shoveling or sweeping. Water cleaning should only be done after the area has been shoveled out or swept.
