Dear Applicant: As part of this department's review of your permit application, a Resource Lands and Critical Areas (RLC) site inspection was performed on your property. Below you will find comments made regarding the proposed development and its critical values. This information is based on County and State regulations as they exist to date. Riok Mraz Land Us Mason County Planning Department 8/14/2002 1 of 3 RLC2002-00064 Resource Lands & Critical Area Site Evaluation 8/14/2002 Case No.: RLC2002-00064 Comments: A field inspection of the suject property was conducted pursuant to a request for a pre-inspection to determine resource-related issues pertinent to the reconstruction of an espresso stand and the construction of a new storage building. The parcel contains frontage on Belfair Creek, a Type III stream per Washington Department of Natural Resources stream typing criteria. Research subsequent to the site inspection has determined Belfair Creek is a fish-bearing stream. The Mason County Resource requires buffers and setbacks from streams; the size of the buffer depends on the stream type. Type III streams require a 150' undisturbed vegetative buffer + a 15' building setback. Legal pre-existing structures and activities are grandfathered. Based upon field approximation it appears that the entire area proposed for redevelopment is within the stream buffer. Most construction activities within the buffer require a variance from the Resource Ordinance. A Habitat Management Plan (HMP), prepared by a qualified biologist, would be required to support the variance request. The HMP addresses impacts to the buffer and offers measures to preserve and protect the buffer or mitigate impacts. A copy of the Fish and Wildlife Habitat Conservation Areas chapter is enclosed. It includes details on the contents of an HMP. It also contains information about the variance procedure. The also contains a riparian wetland associated with the creek. Most of the wetland area was located in the northern portion of the parcel but no authoritative delineation or typing was conducted during the site inspection. Wetlands are also regulated by the Resource Ordinance and have buffers that are based upon the category of wetland. The Resource Ordinance allows for the remodel, repair, or change of use of an existing building within its existing footprint, plus or minus 10%, and provided the expansion does not increase any intrusion into the aquatic management area or stream buffer. This type of expansion does not require a variance. Removal of any native vegetation from the buffer also requires a variance and HMP. Removal of exotic vegetation, such as the Himalayn Blackberry, is allowed provided no disturbance to native plants occurs.
