I have been in contact with Jim Harrison of BUSH, ROED& HITCHINS, INC., discussed the
stormwater requirements pertaining to the proposed development of the service station with Jerry
Hauth, and feel the proposal is acceptable. The following email correspondence has brought a
couple of items in the Technical Information Report into compliance with County requirements:

requiring a Spill Control & Countermeasure plan is 42,000 gallons
or greater
of underground storage. . . the threshold is much lower for above
ground
storage. I've discussed the dead end sump versus oil water
separator with
the County Engineer, and checked how Ecology's Manual addresses
the issue,
and have come to the conclusion this proposal meets the minimum
requirements. I also took a closer look at the plans to satisfy
myself that
the collection area for the fueling area wasn't connected to the
stormwater
sewer system that receives most of the site's runoff, and see
where they
cross, but are kept separate.
The technical Information Report accompanying the plans contains
3 Core
Requirements which will need to be addressed differently than
promoted.
These are Core Requirements 6 through 8. Mason County employs an
Operation
and Maintenance (O&M) Covenant to ensure that the designed and
constructed
stormwater control and treatment facilities are operated and
maintained as
designed. Attached please find a copy of the Covenant Form the
County
employs. The Covenant should be appropriately filled out, signed
and
notarized by the responsible individual, recorded with the Mason
County
Auditor's Office, and a copy of the recorded covenant delivered
to Public
Works for monitoring and administration.
The O&M Covenant was developed partly to address the issue of
Financial
Guarantees and construction completion bonding. Belfair is an
unincorporated town in the County, and has no municipal power to
require or
administer the bonding alluded to in your core requirement V.
Core Requirement #8 alludes to a coalescing plate oil/water
separator, which

you intend to replace with the dead end sump. Because there
appears to be
no vehicle maintenance proposed at the fueling facility, a
coalescing plate
separator requirement by the County appears arguable, so is not
being
required at this time.

The underground fuel storage consists of one-20,000 gallon and
two-10,000
gallon capacity tanks for a total underground storage volume of
40,000
gallons. Please let me know if any additional information is
required.

Jim has called me and is rewriting their Core Requirements 6 thru 8 to bring them into
compliance with the County requirements. Jim also indicated that the O&M Covenant would be
completed and delivered to Public Works.
