Michael,
A"Silt and Erosion Plan"apparently prepared by Eric Hurd for the proposed Continental Floral
Forest Practice Act/Timber Harvest has been received and reviewed by Public Works. Included
with the Erosion and Sediment(E&S) Control Plan, was a copy of your letter to Mr. Brad
Schauer expressing your concerns with proposed temporary and permanent stormwater
management, and your finding that a geotechnical assessment needs to be developed for the
proposed activities.
The plan,as submitted,only provides scant information,and in my opinion, does not provide enough
information to convey an intention of protecting neighboring properties from stormwater runoff impacts.
Since a geotechnical assessment is required to be prepared for this site, it should precede the proposed
logging activity(clear cut, partial or selective thinning,understory brush to remain, etc. ?)and should
specifically include recommendations pertaining to temporary as well as permanent stormwater runoff
management. A permanent stormwater quality protection plan should be required to be prepared to address
the permanent stormwater features needed to mitigate the development of new impervious areas on the
subject property. The Permanent Water Quality Protection Plan will need to be developed by a licensed
civil engineer, and should be developed to meet Ecology's 1992 Stormwater Manual Requirements for the
Puget Sound Basin,and should be developed to satisfy Ecology's downstream erosion control discharge
rate standards.
To summarize,the submitted plan does not appear to adequately protect neighboring and offsite properties
from construction stormwater runoff impacts. The E&S Plan should be returned to the applicant for
additional details and for incorporation of any geotechnical recommendations into the site's stormwater
management plans(temporary&permanent).

Dear Mr. Schauer,
This letter concerns your application for a Class IV FPA on the backside of your floral
business. I did a field inspection of the site yesterday and I have two concerns with your
application. The first concern is that no stormwater site plan or erosion sediment control
plan was submitted with the application(I did see a site plan but it doesn't address the
issue). Because I realize that you will soon be submitting a building permit for the
development of this portion of your property I contacted Alan Tahja of Public Works to
determine whether or not such documents would be required in this case. Mr. Tahja
informed me that at a minimum he would require an erosion sediment control plan that
would cover the site from logging through implantation of a permanent stormwater plan.
My second concern is that slopes in excess of 15% lay on your adjacent parcel to the
southwest,within 300 feet of your cut area. Per the Landslide Hazard chapter of the
Mason County Resource Ordinance, the proximity of the slope to your current proposal
triggers the requirement for a geo-technical assessment(which would be required for
your construction anyway). Please be sure that the resulting assessment contains all of the
elements cited in section 17.01.100.E.4.(1) (copy enclosed). Had a geo-technical
assessment been provided for your 2002 FPA, then none would be required now.
Please contact Alan Tahja at ext. 461 with any further question on the erosion sediment
control plan. Once this issue has been resolved I am planning to issue a SEPA DNS
(Determination of Non-Significance). If you have questions on anything other that the

This letter is in follow up to today's telephone conversation. I have made a SEPA
determination of non-significance for the logging portion of your project. I will be
posting your site soon and you will receive your copy of the SEPA document under
separate cover. The comment period closes on March 24`h and on the following day I will
be able to release this application(assuming that no substantive comments are received).
In the meantime I need to collect from you$78.44 to cover two hours of Alan Tahja's
review time. You can mail a check to my attention at the address above (payable to the
Mason County Treasurer)or you can have it hand delivered when your DNR paper work
is collected from me following the close of the SEPA review.

A geotechnical assessment prepared for the proposed Continental Floral Forest Practice
Act/Timber Harvest has been received and reviewed by Public Works.
The assessment report dispels concerns about slope stability,and makes recommendations for preserving
vegetation outside of the proposed building location,which can be accepted as an appropriate stormwater
Best Management Practice(BMP)for mitigating logging impacts.
Mason County's Stormwater Ordinance requires that an engineered Stormwater Site Plan be prepared
when either more than 5000 square feet of new impervious surfacing is being created,or when more than 1
(one)acre of ground is cleared. If either of these thresholds is exceeded,a Large Parcel Stormwater Site
Plan prepared by a licensed civil engineer will be required.
To summarize,the submitted geotechnical assessment may be considered adequate and
acceptable for the proposed timber harvest, conditioned on making recommendations contained
in the report conditions for permit approval.
