The Department of Ecology(Ecology)reviewed the environmental checklist and has the following comment(s): WATER QUALITY: Roberta Woods(360)407-6269 Erosion control measures must be in place prior to any clearing,grading,or construction. These control measures must be effective to prevent stormwater runoff from carrying soil and other pollutants into surface water or storm drains that lead to waters of the state. Sand,silt,clay particles, and soil will damage aquatic habitat and are considered to be pollutants. Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of Chapter 90.48 RCW,Water Pollution Control,and WAC 173-201A,Water Quality Standards for Surface Waters of the State of Washington,and is subject to enforcement action. Proper disposal of construction debris must be on land in such a manner that debris cannot enter the wetlands and their buffers or cause water quality degradation of state waters. Clearing limits and/or any easements or required buffers should be identified and marked in the field, prior to the start of any clearing,grading,or construction. Some suggested methods are staking and flagging or high visibility fencing. A permanent vegetative cover should be established on denuded areas at final grade if they are not otherwise permanently stabilized. Properties adjacent to the site of a land disturbance should be protected from sediment deposition through the use of buffers or other perimeter controls, such as filter fence or sediment basins. Cut and/or fill slopes should be designed to minimize erosion. Methods such as slope roughening, terraces,or pipe slope drains may be used. All temporary erosion control systems should be designed to contain the runoff from the developed two year,24-hour design storm without eroding. � i�i1 February 12,2008 Page 2 Provision should be made to minimize the tracking of sediment by construction vehicles onto paved public roads. If sediment is deposited,it should be cleaned every day by shoveling or sweeping. Water cleaning should only be done after the area has been shoveled out or swept. Wash water from paint and wall finishing equipment should be disposed of in a way which will not adversely impact waters of the state. Untreated disposal of this wastewater is a violation of State Water Quality laws and statutes and as such,would be subject to enforcement action. Source control Best Management Practices(BMPs)such as plastic covering,mulch,temporary seeding,and phased clearing(for example)should be used to control erosion during construction. More examples of effective source control BMPs can be found in Ecology's two stormwater management manuals,Stormwater Management Manual for Puget Sound(1992)and Stormwater Management Manual for Western Washington (2001). This project involves a forest practice conversion on more than one acre of land which already has offsite discharge to waters of the state. Coverage under the National Pollution Discharge Elimination System(NPDES)and State Waste Discharge General Permit for Stormwater Discharges Associated with Construction Activities is required for construction sites which disturb an area of one acre or more and which have or will have a discharge of stormwater to surface water or a storm sewer. An application can be downloaded from Ecology's website at hiip://www.ecy.wa.gov/programs/wq/stormwater/construction/#Application or you can contact Joyce Smith at(360)407-6858 for an application form. To avoid project delays,we encourage the applicant to submit a completed application form and to publish public notices more than 60 days before the planned start of the project. Approximately eight acres of the site are being set aside for Pileated Woodpecker habitat, stormwater control and greenbelt purposes, concentrated on the west and northwest portions of the property(see map exhibit). A Habitat Management Plan,prepared by The Wetland Corps,has been approved by Mason County and will be recorded with the County Auditor. Other than scattered snags used for Pileated Woodpecker forage,no other fish and wildlife habitat was found on the site. A Class II wetland exists just off site to the NW and will be appropriately buffered. Some slopes between 15 and 40% exist on,or near, the site. A geo-technical assessment was prepared by Geo-technical Testing Laboratory and reviewed and approved by Alkai Consultants. A separate geo-assessment for logging and road building to occur on the adjacent parcel (#12321-20-94120)has also been approved. LANDSLIDE HAZARD Timber removal and road construction shall be consistent with the conditions of a geo- technical assessment(s)written by the Geo-Technical Laboratory for this site. Violations of this condition shall be enforced per chapter 15.13 of the Mason County Development Code. X WETLAND BUFFERS A Type II wetland with a vegetative buffer of 150' plus an additional 15' building setback is located just of the NW corner of the site. The wetland edge was identified by Lee Boad of The Wetlands Corps and the entire buffer is located within Tract A of a Woodpecker Management Area that is to be created. Per section 17.01.070 of the Mason County Critical Areas Ordinance, no tree cutting shall occur with in this buffer. X PILEATED WOODPECKER MANAGEMENT AREA Snags showing evidence recent foraging by Pileated Woodpeckers were found on this property. Per the terms of a Habitat Management Plan created by The Wetland Corps, three tracts of land shall be preserved and enhanced to promote Pileated Woodpecker habitat(as well as for stormwater control on Tract A, community drianfield on Tract B and greenbelt purposes on Tract E). Tracts A, B &E shall average seven snags per acre and 70% forest coverage. Standing dead trees in the development area shall be moved to the Management Areas (or replaced with new snags if relocation is not feasible). The Habitat Management Plan for this project shall be recorded with the Mason County ' Auditor, and a bond, or other security agreeable to Mason County, shall be posted for performance was well as five years of monitoring by The Wetland Corps. X STORMWATER&EROSION CONTROL MEASURES Escape of silty water or mud from the timber harvest area shall be considered a violation of County and State stormwater management regulations, and could subject the applicant(s) to civil fines or penalties. The recommended best management practices detailed in section 5.4 of the Boad Habitat Management Plan and Revised Wetland Report (dated April 2007) shall be become conditions of this permit. Additionally, this Forest Practices Permit shall not be approved prior to County approval of an engineered stormwater plan for the logging phase of this project. X SLASH ABATEMENT This Forest Practice Application indicates that forest debris resulting from the proposed logging operation may create an extreme fire hazard under RCW 76.04.600 and WAC 332-24-650. An extreme fire hazard could be created if one or more of the conditions found in WAC 332-24-650 is located within 100 feet of the running surface of a public road; or is within 500 of an existing structure and/or designated public use area, which is not owned by the owner of the fire hazard area. The landowner is fully liable in the event of fire, if he or she fails to appropriately abate the hazard. Extreme fire hazards shall be abated by removing the forest debris, or by other means approved by the Washington State Department of Natural Resources (DNR). Assistance with creating an abatement plan can be obtained by calling DNR agent Karen Harris at 360-801-1111.
