Dear Mr. Miller,
This letter is follow up to my recent site inspection for your logging permit application on
the above referenced 40-acre parcel. On March 26`h I walked the property and have the
following comments.
Steep Slopes:
The slopes on your property are greater than 15%(measured 20 to 25%) and therefore
fall under the jurisdiction of the section 17.01.100 (Landslide Hazard Areas) of the
Mason County Critical Areas Ordinance. You need to hire a qualified (per section
17.01.100.E.3)professional to prepare a geo-technical assessment (conforming to section
17.01.100.E.4). This assessment should be delivered to my attention. I will then forward
it to an engineer in Public Works for review. There will be a fee of approximately$50/hr
for his time. This fee would be payable at the time of permit issuance.
Wetland Buffer and Habitat:
I found the wetland just west of the NW corner of the property. However I didn't see the
buffer flagging that Lee Boad placed in February 2006. In the time since Mr. Boad did
his field investigations and wrote his report, Mason County's wetland regulations
(17.01.070) have changed considerably. No doubt the buffer has changed from the 85'
feet described in the 2006 Boad report. You will need to have Mr. Boad up date the
wetland report and flag the current buffer.
While on site (northern portion) I found several old snags that show evidence of recent
foraging by Pileated Woodpeckers. Pileated habitat is protected under section 17.01.110
of the Critical Areas Ordinance. Per the Critical Areas Ordinance you need to hire a
qualified professional to identify the snags requiring protection and to come up with a
plan that either protects them, or proposes compensating mitigation for their removal. If
you go with a mitigation plan to remove the snags, a Mason Environmental Permit
(MEP) and a Habitat Management Plan(HMP)will be required. Please let me know how
you plan to proceed.
Flagging
I noticed a lot of flagging on the property and it wasn't always clear to me what it was
for. Some of it appeared to be r/w flagging for your proposed access easements for your
future subdivision proposal. I assume that the white flagging along the west and south
property line is your buffer/tree retention area(although the area between the flags and
the property line looked deeper than the 20' indicated on your map). I saw similar white
flagging on your north property line, although your site plan does not suggest that you are
planning a tree retention area on that line. Please clarify this.
Stormwater&Erosion Control
I noticed that on the two portions of the site where all the vegetation has already been
stripped that the soil is very sandy with evidence of siltation having occurred during
recent rain events. I noted your silt fencing on the adjacent five acre parcel to the south
and how in at least one place,the flow of silt breached the silt fence. Dry grass had been
spread over the cleared area,but probably not enough of it to be very effective. For this
reason I think is important that you take aggressive measures to ensure minimal amounts
of soil movement. John Sliva will be reviewing your site plan and geo-technical
assessment for stormwater and erosion control issues too.
Land Modification Permit
Looking at your easement off of Riverhill Lane,it looks like a fair amount of cut and fill
will be required. I suspect that the creation of that access road will require a Land
Modification Permit. Please call Tami Griffey in the Building Department at extension
356 for more information.

Letter of Incompleteness

Dear Mr. Miller,
I recently received your application for a forest practices application(FPA). I know that
you worked hard to prepare a complete application but unfortunately it is incomplete and
can not be processed in its current condition. Below is a list of the item(s)that need more
attention before the application can be deemed complete:
(1) Thank you for the site map included with the application. I appreciate that it shows
property lines, contours and the small wetland. However the map needs to be revised
to be consistent with the requirements of 11.05.120.A (below). I have highlighted the
items that most concern me. If you have not done so already please be sure that the
flagging requirements of 11.05.120.B are also established on the ground.
A map requirements of 11.05.120.A:
(1) Harvest boundaries and tree retention areas.
(II) The approximate location of any structures.
(III) The location of all existing and proposed streets, right-of-ways, easements, skid
roads, haul roads, and landings within the proposal.
(IV) The location of future land development including stormwater management
facilities and vegetation to be retained for site landscaping, open space, wildlife
habitat, screening, and/or buffers.
(V) Site topography at contour intervals of 40 feet.
(VI) Critical areas and critical area buffers regulated pursuant to the Critical Areas
Ordinance.
(VII) Drainage ways and culverts.
(VIII) Site area targeted for further harvest including proposed timing.
(IX) North arrow and scale shall be shown on all site plans. The scale shall be no
smaller than one inch to 200 feet.

(2) The information on your application was a little sparse. Specifically for Section 6,
please let me know the yarding methods and net acreage for each unit. Your SEPA
checklist does not contain any directions. I am assuming that access is on Katchmack
Lane, please confirm this.
(3) Your SEPA checklist should have contained something called a Salmonids Checklist.
I am enclosing one for your use, please fill it out (to the extent necessary) and return
it to me.
I expect that when I visit the site I may find that I will need to ask for a geological
assessment, but that determination can wait for my filed visit. What I have written above
is only what I need to consider your application complete and begin the review. In order

A Habitat Management Plan as been written by The Wetlands Corps and shall be
recorded with the Auditor prior to issuance of the FPA.

approved by Todd Parkington of Alkai Consultants on 6/18/07. A second geo-

Re: Riverhill FPA
Dear Mr. Johnson,
This letter is a follow up on the status on the FPA application for the Riverhill Park site.
The SEPA comment period closed on February 12'h, with one comment received, from
WSDOE (you should have received a copy too). To be clear, if an NPDES is required,
you will be responsible for getting one; it is not a precondition for issuance of the FPA. I
just talked to Roberta Woods at DOE and she explained that a NPDES is only required
when a FPA is disturbing more than one acre AND the site as has offsite drainage
(natural or otherwise).
As far as Mason County is concerned the following items are needed before the FPA can
be issued:
1. The Lee Boad prepared HMP needs to be recorded with the County Auditor. The cost
for this will depend on the number of pages involved. I estimate the cost will be about
$60 (1 do not think that it is necessary to record every page of exhibits). On 1/28 I sent an
e-mail to Lee asking for a new copy of the HMP text with some minor changes.
2. We also need the paper work in place (contracts and performance bonds or other
securities) for 150% of the (market rate) cost of implementing the HMP and providing
five years of monitoring reports.
3. John Sliva of Public Works needs to approve the engineered stormwater plan(he is
using the one submitted with plat applications). I have no idea how long this will take.
Some of the neighbors to this site have made comments to me regarding your current
access. My understanding is that the road you are using is essentially a prescriptive
easement that you can use for access until you develop the plats. My understanding is not
a legal opinion and for the FPA phase of this project I am counting on you to know what
your access rights are and are not.
Once these items have been taken care of, the County can issue the FPA. One
complication is the SEPA condition that prohibits the logging of the property between
March 25`h and July 5`h. I would very much like to see all of the above wrapped up by
mid-June, so that you can have your permit in hand by the time the work restriction ends
on July 61h

Comment Period:
In accordance with section 17.01.120.0 of the Mason County Resource Lands and
Critical Areas Ordinance, a copy of the GDG Construction Mason Environmental Permit
(MEP) is being made available to all stipulated parties. Mason County officials have until
May 25th, to respond and outside agencies need to respond by June 1st. In the event that
no comments are received from a particular department or agency, within the comment
window, the Planning Department will assume that there are not any concerns. Written
comments should be sent to the address listed above.
Project Background:
GDG Construction has applied for a Class IV G logging permit(FPA) for a forty-acre
parcel that they own adjacent to the subject parcel of this application. GDG has
purchased an ingress/egress easement across the subject parcel in order to reach their
property. The location of the easement contains slopes as steep as 25% for which a geo-
technical assessment has been prepared and delivered to the County. At the time of this
notice, the assessment is awaiting assignment to a contract engineer for review. Because
the applicant wishes to develop this access prior to the expected issuance of the FPA and
because the applicant expects to move less than 200 cubic yards of material(therefor not
requiring a Land Modification Permit) a MEP becomes,by default,permit vehicle to
review the geo-technical assessment under. I have inspected the site and found no other
critical area issue at this location.

14.44.050 Permits--Required when.
(a) Permits Required. Except as specified in subsection (b)of this section, no person shall do any
grading without first having obtained a grading permit from the official. A grading permit shall be
required for a project involving excavation or fill that totals two hundred or more cubic yards of
graded material and is not exempted below. Grading activities not requiring a grading permit shall
comply with the standards listed in Sections 14.44.170 through 14.44.210.
(b) Exempted Work. A grading permit is not required for the following:
(1)When approved by the official, grading in an isolated, self-contained area if there is no danger
or hazard to adjacent private/public property or other improvements; (2)An excavation below
finished grade for basements and footings of a building, retaining wall or other structure
authorized by a valid building permit. This shall not exempt any fill made with the material from
such excavation or exempt any excavation having an unsupported height greater than five feet
after the completion of such structure;
(3)An excavation which: (a) is less than two feet in depth, or(b)which does not create a cut
slope greater than five feet in height and steeper than one and one-half horizontal to one vertical;
(4)A fill less than one foot in depth and placed on natural terrain with a slope flatter than five
horizontal to one vertical, or less than three feet in depth, not intended to support structures,
which does not exceed two hundred cubic yards on any one lot and does not obstruct a drainage
course;
(5)Cemetery graves;
(6) Refuse disposal sites controlled by other regulations;
(7) Excavations for wells or tunnels or utilities;
(8) Mining, quarrying, excavating, processing, stockpiling of rock, sand, gravel, aggregate or clay
where established and provided for by law, provided such operations do not affect the lateral
support or increase the stresses in or pressure upon any adjacent or contiguous property;
(9) Exploratory excavations under the direction of a soil engineer or engineering geologist;
(10)Grading on public rights-of-way done by or under the supervision or construction control of a
public agency that assumes full responsibility for the work;
(11) Grading necessary for agricultural operations, unless it causes hazards to property or public
road, or obstructs a watercourse or drainage;
(12) Maintenance of existing fire breaks and roads;
(13) Performance of emergency work necessary to protect life and property when urgent
necessity arises. The official shall be notified promptly and the person performing the work shall
apply for a permit within ten calendar days.
(14)Grading associated with a logging operation under a current forest practice permit.
Exemption from the permit requirements of this chapter shall not be deemed to grant
authorization for any other work to be done in any manner in violation of the provisions of this
chapter or any other laws or ordinances of Mason County. (Res. 141-96 (part), 1996).

Domestic sawlogs- Manke Lumber Co.delivered to their sawmill in the
Tacoma port area industrial park,
Pulpwood N. Mason Fiber sort yard approximately one mile east of subject
tract (see map).

RFPRODLJCTION
The old field in the middle of this tract has been planted with Douglas-fir
seedlings. There is also established a fair scattering of natural Doug fir
seedlings. On the average these young trees are about six years old and the stand
is about 50% of normal stocking. Their value is minimal until they get to be
about ten years old and hopefully the stand stocking level increases.
LAND
This report is basically a timber appraisal and the value stated reflect the net
value of the trees standing on the land. The method used to value the trees is
referred to as, in appraisal terminology, as the "income approach". However,
the land under the trees or determination of the bare land value involves a
different procedure commonly referred to as the "market approach". Because the
value the land and buildings, if any, will in all likelihood exceed the value of the
standing trees, the bare land should be appraised by a state certified real estate
appraiser. The land value determination will involve a separate report.
CRILISF STANDARD
A variable plot prism method was used to make field determination on the
standing timber. A total of sixteen (16 ) plots were taken at random locations
spread across the thirty-one (31 ) stocked acres in the two timber types. Trees
were tallied based on a twenty (20) Basal Area Factor prism. Tree diameters
were measured at diameter breast high (DBH) or at a point 4.5 feet above the
ground. Coverage consists of a 10.3 percent cruise.

This timber cruise report is based on the income approach to appraising
property. The market place for standing timber and forestland is influenced by a
myriad of constantly changing factors. To use this report as a basis for sale of
forest real estate is not recommended. Timber cruising is an art form at best and
is meant to provide information on standing trees. Data collection is based on
industry wide timber cruising procedures which includes only a percentage of the
timber stand actually being measured. As a forest appraiser I can not guarantee
that actual harvest cut-out totals will equal the cruise information provided in
this report.

I think I have provided the additional information you need for my FPA. We are no
longer going to develop the 40 acre property into 120 lots. We are unable to obtain public
water. According to Environmental Health the property is only allowed 5,000 gallons of
water per day, so we plan on short platting the property to what that allows. At this time
I'm not sure how that would layout. If it is necessary for the permit I'll have our surveyor
draw something up for you. When you visit the 40 acres, I would like to be there to show
you the flagged corners. If you have any questions or need any further info,please give

Dear Mr. Miller,
Last month you asked me about a potential regulatory conflict that had been identified in
your June pre-application meeting for your proposed residential subdivision in the Belfair
UGA. The question had to do with minimum lots sizes and whether or not your proposal
would need to conform to the minimum size prescribed by the Department of
Environmental Health for lots dependent on septic systems or whether you could design
small lots that are consistent with urban design principles.
I followed up by speaking with Planner Steve Goins who had a recent discussion with
Environmental Health Manager Debbie Riley and DCD Director Emmett Dobey on this
topic. The result of the meeting was a determination that projects such as yours do not
need to conform to the Environmental Health minimum lots size so long as these lots are
serviced by a community drainfield until such time as sewer is available. (However such
community drainfields do need to be abandoned as soon as sewer is available).

Mr. McSems-
This is to follow-up on our discussion today regarding a proposed
development near Belfair on Katchemak Lane. Apparently a 132 unit
development is being planned that would utilize the existing crossing on
the Navy Railroad at Katchemak Lane. This crossing has been a concern
to the Navy for several years, and has been discussed with Charlie
Butros and several other Mason County managers regarding the need for
improvements. During recent discussions with WSDOT and Mason County
regarding the proposed Belfair Bypass on SR3 one of the proposals was to 0
connect SR3 to Old Belfair Highway at Katchemak Lane and Newkirk Road. D W
If this connection becomes a reality then improvement of this crossing ;0 M
can be included in the work. If it turns out that the Belfair Bypass 0 ;R
project does not construct a new roadway the concerns at this crossing M
remain to be addressed by the County and the Navy. These improvements rn -0
are necessary regardless of any future development, but become more r —I
critical if there is a possibility of expanded use. In order to assist 'n Z
you with your review of the proposed development I have listed several of the Navy's concerns regarding this crossing. rn =
1. The existing timber crossing is in the process of being repaired for m
vehicle and train safety. Further development of the area using this
crossing may require widening of the travel surface or an upgrade to
concrete or rubber.
2. The design and geometry of the crossing as a whole is very poor, and
the roadway profile does not meet current standards. There should be a
safe stopping distance for crossing vehicles to allow train passage, and
intersecting frontage roads or driveways should not be so close to the
crossing.
3. There are no signals for the crossing at this time, but addition of
a large residential development may require installation of crossing
lights at a minimum.
4. The existing frontage roads encroach onto Navy property as easements
have not been issued for them. This includes Katchemak Lane where it
turns northerly after crossing the railroad, as evidenced by a recent
aerial photo. These have been there for several years, and we recognize
that it would be a difficult process to have them removed. Our hope was
that these could be addressed during reconfiguration of the crossing.
Ultimately, it would be our desire to remove all of these from Navy
property unless there is justification for issuing easements.
5. Upgrades to the crossing due to private development should be funded
by the developer, not by the County or the Navy. Additional
maintenance, especially of new signals, must also be agreed on.

The Navy is certainly willing to assist in any way possible to maintain
the safety and integrity of the Navy Railroad and the County road.
