RE: Planning Notes for PAR2016-00017: Sargents Oyster House
Dear Mr. Rehe,
The following notes will be kept in the parcel file #12220-50-08001 and in Tidemark under
PAR2016-00017 (accessible using the web). Please let me know if changes are required or if
you need additional information or clarification.
These notes reflect the necessary permit applications and documents needed for the
County's Planning Department to review the proposal to relocate the historic Sargents
Oyster House from its original overwater location to a new overwater location on Port of
Allyn Property. Once all applications and documents have been reviewed, the Planner will
make a recommendation to approve or deny the proposal to the County's Hearing Examiner
(this proposal requires both County Hearing Examiner and State Department of Ecology
approval).
PROJECT UNDERSTANDING
The North Bay Historical Society has obtained the historic Sargent's Oyster House from its
previous overwater location and is proposing to restore the structure for use as an
aquaculture museum, education center and possible storage for aquaculture seed and
relocate the structure to a new overwater location in Allyn on property owned by the Port of
Allyn. The proponents believe the uniqueness of the historic structure and proposed uses
make the proposal a water-dependent use.
DEVELOPMENT REGULATIONS/ZONING
Current zoning is Public Open Space "POS" in the Allyn Urban Growth Area. This district
allows community recreation centers, which by definition includes facilities used for
recreational, social, educational and cultural activities. The proposed uses meet this
definition. No special permits required.

RESOURCE ORDINANCE
The saltwater shoreline is regulated under the County's resource ordinance and requires a
standard 100' buffer from the Ordinary High Water Mark (OHWM) landward. Development
within the buffer is prohibited with exceptions.
Mason County Code (MCC) 8.52.170 (d) (2) (B): Special Provision for Water-Dependent
Uses on Existing Lots. Applications for development defined as water-dependent uses shall
provide the standard one hundred-foot buffer along as much of the shoreline as possible
while making the minimum necessary adjustments to the buffer to provide for the water-
dependent use, as determined by the director. Such development shall meet the
requirements of other applicable regulations, including other resource ordinance sections
and the Mason County Shoreline Master Program.

Mason County Code 8.52.170 (d) (3): Provision for Decreasing Buffer. For major new
development, Mason County may decrease the buffer after consultation with the
Washington State Department of Fish and Wildlife and the Squaxin Island Tribe, after review
and approval of a habitat management plan, and after a public hearing. Mitigation must be
adequate to preserve or enhance the functions and values of the critical area. This means
that a finding must be made that the net effect of the proposal equal or better than applying
the standard buffers. If enhancement is part of the mitigation plan, then a greater level of
enhancement is required to offset the time lost while the enhancement matures.
The proposal as discussed in the Pre-Application conference would meet the exceptions
above and therefore would not require a Resource Ordinance Variance. Consultation with
the Tribe and WDF&W is required. Permits and documentation include (see Public Hearing
under Shoreline Master Program):
• Mason Environmental Permit
• Biological Evaluation (in lieu of Habitat Management Plan) and mitigation plan
SEPA
The proposal is not exempt from SEPA due to the inwater and overwater work.

SHORELINE MASTER PROGRAM
Mason County's Shoreline Master Program includes regulatory chapters for a variety of uses
but none that address the proposed use of a museum or education center. Therefore, the
proposal is considered an "unspecified use" and requires a Conditional Use Permit. Since it is
an unspecified use, the Master Program does not establish setbacks and would not be
required to obtain a variance. The assumed valuation of the proposal exceeds the
exemption level and will require a Substantial Development Permit. Both permit types
require a public hearing with the County's Hearing Examiner. All permits, special provisions
and associated documents will be reviewed at a single hearing.
• Shoreline Substantial Development Permit
• Shoreline Conditional Use Permit
• Public Hearing with County's Hearing Examiner
Special Note for Shoreline Conditional Use Permit:
Uses which are classified or set forth in the master program as conditional uses may be authorized
provided the applicant can demonstrate all of the following:
•That the proposed use will be consistent with the policies of RCW 90.58 and the policies of the
master program;
•That the proposed use will not interfere with the normal public use of the shorelines;
• That the proposed use of the site and design of the project will be compatible with other
permitted uses within the area;
•That the proposed use will cause no unreasonable adverse effects to the shoreline environment
in which it is to be located;
• That the public interest suffers no substantial detrimental effect.
Other uses which are not classified or set forth in the master program may be authorized as conditional
uses provided that the applicant can demonstrate, in addition to the criteria set forth above, that
extraordinary circumstances preclude reasonable use of the property in a manner consistent with the
use regulations of the master program.
Uses which are specifically prohibited by the master program may not be authorized.
In the granting of all conditional use permits, consideration shall be given to the cumulative impact of
additional requests for like actions in the area. For example, if conditional use permits were granted for
other developments in the area where similar circumstances exist, the total of the conditional uses should
remain consistent with the policies of the master program and should not produce substantial adverse
effects to the shoreline environment.

• DESCRIPTION & SIZE OF PROJECT/OCCUPANCY CLASSIFICATION & USE: The North Bay
Historical Society is proposing to restore the historic Sargents Oyster House and relocate it to the
shoreline at the Port of Allyn. The approximately 1,200 sq ft building would be used as an
aquaculture museum and education center. The proposed museum would be relocated to the area
currently occupied by 3,300 sq ft concrete boat ramp. The occupancy classification would be
Business and Education.
OCCUPANCY CLASSIFICATION & USE: B and E Occupancy
GENERAL NOTES:
Complete building permit applications will include the following information that is applicable to the project::
• SETBACKS TO PROPERTY LINES: Provide a site plan, drawn to scale. Clearly identify all structures,
including fences, fuel tanks and other similar items, with setback dimensions on site the plan. Overhangs
shall be limited in accordance with IBC 705
• DISTANCES TO OTHER STRUCTURES: Site plan, drawn to scale shall clearly identify distances, where
required include fire-resistive details, including continuity, &tested assembly details.
To be considered a separate structure each structure shall be located 20-ft from each other.
Referencing IBC 705.3, buildings located on the same lot shall be assumed to have an imaginary line
between the buildings, therefore to be considered a separate building a distance of 20-ft or more shall be
provided. Overhangs hall be imitated in accordance with IBC Table 705.2.
• FIRE RESISTANCE FOR EXTERIOR WALLS: When applicable include fire-resistive details, including
continuity, &tested assembly details.
When firewall are required to create a "separate" building the firewalls shall be constructed equal to 3-
hours or better assembly constructed in accordance with IBC Section 706.
• IDENTIFY TYPE OF CONSTRUCTION & PROVIDE ALLOWABLE AREA CALCULATIONS WHERE
NEEDED. See Chapter 5, IBC. Type VB construction includes structures constructed with combustible
construction such as wood framed structures. Type II construction includes steel structures constructed
ENTIRELY by non-combustible construction.
• FIRE-RESISTIVE RATED CONSTRUCTION & TYPE OF CONSTRUCTION :
Where required demonstrate compliance. Identify the location of the assembly, compliance to continuity
requirements and construction details:
EXTERIOR WALL(IBC704), FIRE WALL(IBC705), FIRE BARRIER (IBC706), SHAFT ENCLOSURES
(IBC 707), FIRE PARTITIONS (IBC 708), SMOKE BARRIERS (IBC 709), SMOKE PARTITIONS (IBC 710),
HORIZONTAL ASSEMBLIES (IBC 711), PENETRATIONS (IBC 712), FIRE-RESISTANT JOINT
SYSTEMS (IBC 713), FIRE-RESISTANCE RATING OF STRUCTUURAL MEMBERS (IBC 714), OPENING
PROTECTION (IBC 715), DUCT&AIR TRANSFER OPENINGS (IBC 716), CONCEALED SPACES (IBC
717), ETC,
• NUMBER OF EXITS REQUIRED/OCCUPANT LOAD:(IBC 1004): Table 1004 is used to determine
occupant load used to evaluate the structure for exiting purposes, plumbing fixture requirements, and other
code related concerns. Include design calculations, demonstrating how occupant loads were calculated,
on building plans.
Occupant load is needed to verify that adequate exits are provided and to verify that adequate
restrooms and other plumbing fixtures are provided in accordance with Chapter 29.
• EXIT PLAN: Clearly identify the exit path and exit signage on construction plans.
• ENGINEERING REQUIRED: Structures that do not comply with prescriptive specifications of the 2012
International Code (IBC) shall be designed in accordance with Chapter 16 of the IBC.
THE PLACEMENT OF THE STRUCTURE ON PIERS AND RELOCATION OF A STRUCTURE WILL
REQUIRE A WASHINGTON STATE DESIGN PROFESSIONAL.
Referencing Washington State RCW 18.08.410 - Structures 4000 sq. ft or more shall have all plan
pages reviewed and stamped by a Washington State licensed design professional. The review
shall include a code evaluation addressing life-safety, plumbing & mechanical evaluation, and
structural analysis. (ref. RCW 18.08.410) ALL PLAN PAGES SHALL BE STAMPED AND SIGNED
BY THE DESIGN PROFESSIONAL, including plumbing and mechanical pages.
• ACCESSIBILITY REQUIRED: YES, include compliance information including design calculations
demonstrating compliance to Chapter 11 and details demonstrating compliance to ANSI 117.1 in effect at
the time of submittal. Include information demonstrating compliance for restrooms, employee work areas,
parking spaces, accessibility to structure, drinking fountain, signage, etc. When required verify that
building plans contain compliance information.
• PLUMBING SYSTEMS (Chapter 29 Washington Amendment to IBC): Using IBC Chapter 10, determine
occupant load. The number of plumbing fixtures is determined based upon the occupant load. Plumbing
fixtures need not be provided for unoccupied buildings. Permitted building shall comply. On plans, include
design calculations for the following: water closets (M/F), Lavatories, Drinking Fountains, etc.
Occupancy dictates the structure shall provide restrooms in accordance with WAC Table 2902.1. When
the total occupant load is 15 or less separate facilities for male and female need not be provided, but the
fixtures and space must be accessible for persons with disabilities.
Referencing IBC/WAC 2902.2 separate plumbing fixtures shall be required for each sex, except when the
calculated occupancy load is 15 or less, than unisex fixtures shall be allowed. To calculate the number of
fixtures and referencing Table 2902.1 the following fixtures shall be required:
Plumbing fixture count can be for the entire facility, including all structures for compliance purposes.
Provide design calculations demonstrating how the fixture count was determined on construction plans.
• NON-RESIDENTIAL ENERGY CODE: ALL enclosed spaces require Non-Residential Energy
' Conservation Code (IECC/WSEC). Provide completed compliance forms (envelope & mechanical).

All heated OR cooled areas need to meet WSEC/IECC Regulations. Commissioning Reports
required accordance with WSEC/IECC C408.
• LIGHTING: All non-residential structures shall comply with IECC/WSEC lighting requirements. Complete
compliance forms and provide a lighting plan that includes switching locations. WSEC forms and
information can be accessed at:
Task lighting for plant growth and maintenance is exempt. (ref. 405.5.1 #6)

• Ventilation and Indoor Air Quality Code compliance: Provide calculations when required.
• COMMERCIAL KITCHEN: Show compliance to Chapter 5 of the International Mechanical Code when a
kitchen is included in the project.
When the structure will be provided with a kitchen the kitchen must comply with specifications of the
Mechanical Cove. When cooking produces grease or smoke a type 1 hood with fire suppression system is
required. To properly evaluate provide information that clearly identifies what will be cooked and the
type of cooking that will take place in the kitchen.
• GEOTECH REPORT REQUIRED? YES X NO Soils evaluation
• PROVIDE A SPACE FOR STORAGE OF RECYCLED MATERIAL & SOLID WASTE (WAC51-50-009):
Identify the location.
• SPECIAL INSPECTION: Referencing IBC Chapter 17, Section 1704.1.1. Statement of special inspections
prepared by registered design professional in responsible charge. Complete a Special Inspection
authorization form.
• INTERIOR FINISHES: Include information demonstrating compliance to Interior finishes required in IBC
Chapter 8.
Gypsum board will comply with requirements for interior finish. If you wish to use another finish
material, including plastic please provide information about the material and submit with permit
documents. Clearly identify finish material in cross section of construction plans.
• STORAGE SPACES: Identify the space. Include material stored, anticipated quantities, height, and if
hazardous such as solvents, fertilizers gases, etc. include MSDS sheets for each product.
• STORAGE RACKS greater than 5'9" shall be permitted either with the proposed project or separate
building permit. Where required documents shall include design information demonstrating stability for
seismic conditions. Special inspection may be necessary, reference IBC Section 1707.6 and 1705.3 (4.5),
storage racks, provide compliance information.
• MECHANICAL EQUIPMENT: Identify the location and type of mechanical equipment located within, and
outside the structure. Address foundation and support systems for equipment. Where new equipment will
be placed on site provide UL listing information and/or construction details stamped by a Washington State
licensed design professional. Where applicable include duct information and duct support compliance
information.
• SUSPENDED CEILING SYSTEMS: Provide details and specifications relating to suspended ceilings
where applicable. Details shall be designed and approved for seismic loading in accordance to IBC
Chapter 16. Where required designate special inspection plan.
• FIRE MARSHAL REQUIREMENTS: Carefully review Fire Marshal comments requirements including fire
' protection requirements and identify compliance information on the proposed building plans. Show the
location of fire extinguishers and identify type. The following items are required:
FIRE MARSHAL COMMENTS ARE PENDING
• WATER SUPPLY & FIRE HYDRANT: Referencing IFC, Section 508; clearly identify fire hydrant location if
one is located within 400 ft of the project.
• FIRE FLOW: A copy of the approved method for determining fire flow is enclosed. Complete the
Commercial fire-flow worksheet to identify fire flow and fire protection that may be necessary. Note that
when fire flow is not available step 3 shall apply. See also requirements for IBC Table 503, allowable
areas:
0-500 sq ft.: no protection (mitigation) needed.
501-5,999 sq ft.: Install a NFPA 72 addressable fire alarm system OR construct firewalls in
accordance with IBC Section 706 to create maximum 2,000 sq ft fire areas.
6,000-12,000 sq ft.: Install NFPA 13 automatic fire sprinkler system OR install NFPA 72
addressable fire alarm system maximum 6,000 sq ft fire area with fire walls
constructed in accordance with IBC Section 706, OR construct firewalls in
accordance with IBC Section 706 to create maximum 2,000 ft fire areas.
12,000 sq ft. or more: Install NFPA 13 automatic fire sprinkler system.
• EMERGENCY VEHICLE ACCESS: "Standards for Fire Apparatus Access Roads: adopted through Mason
County Code Title 14 Section 14.17 is attached. Submit documents should clearly identify code compliance.
• ADDRESSING: Referencing IFC, Section 505 and Mason County Code Chapter 14.28, all new buildings
shall have an approved address.
• AUTOMATIC FIRE ALARM: Referencing IFC, Section 907 and NFPA 72, when proposed provide
information on plans that identifies your intent to install the alarm system. Automatic fire sprinkler system
require a separate permit.
• SPRINKLER SYSTEM: Referencing IFC, Section 903 and NFPA 13, when proposed provide information on
plans that identifies your intent to install the NFPA 13 fire sprinkler system.
• KNOX BOX: Referencing IFC, Section 506 and access shall be required. Contact the locat Fire District.

PRE-APPLICATION CONFERENCE REQUEST FORM
The purpose of the pre-submission conference is to identify and/or eliminate as many potential problems as
possible in order for the project to be processed without delay. Representatives for the Fire Marshal's Office,Building
Department, Environmental Health, Planning, and Public Works Departments > attend the meeting to discuss rules
and regulations applicable to the proposed project. Topics covered during the meeting will include the comprehensive
plan, shoreline program, zoning, availability of sewer and potable water, development concepts, building construction,
fire protection and life safety concerns of the proposed project.The pre-submission conference will be most informative
when you provide accurate and detailed information on the Pre-Application Conference Application Form and the site
plan.Applications will be accepted when all information is received and deemed complete.
Pre-Application Conferences are held every Wednesday and last up to one hour. To schedule a meeting

"POS" - PUBLIC OPEN SPACE
Sections:
17.10.710 Purpose: The "POS" district is intended to provide areas for essential public
uses and facilities necessary to the public convenience, and in particular to provide for public
park, recreational, and open space. Since certain special property uses have intrinsic
characteristics relating to their function or operation which may necessitate buildings or
structures associated with the special property use to exceed predictable height, bulk, and
dimensional or other development standards, those exceeding established standards are
reviewed through a special use permit process.
