Dear Mr. Shearer:
I have reviewed the packet of information you provided and am returning it for
modification and completion. Specific items which require your attention are
the following:
* An application fee of $650 is due and owing. Please make your check
payable to the Department of Natural Resources.
* The lower portion of the County or Municipality Approval for Surface
Miring (SM-6) must be completed by Mason County officials.
* Standard Reclamation Plan (SM-8A) -
Page 1 , Name of Applicant - You indicated just your name, most
applicants indicate their business name. Is this an error or is
the permit to be in your name? Please clarify.
Page 2, HYDROLOGY - Needs to be completed to the best of your
knowledge. The present response is not adequate. A suggestion is
to contact your neighbors who have wells and determine the depth
of water in their wells. Also, a local well drilling firm may
have this information.
Page 5, EROSION CONTROL - Temporary water-control response of "no"
requires an explanation of the design of the storm water runoff
retention capacity to meet the 25-year/24-hour peak event. The
topography of your site is such that it appears storm water runoff
would not leave the site. In effect, the rainfall would percolate
into the ground. Since you are not washing your products, there
is no need for wash ponds or drainage treatments. This may be
proper if this is indeed the situation. Please clarify.
Page 6, SLOPE REQUIREMENTS FOR QUARRIES AND . . . MINES -
Reclamation blasting was checked "yes. " This was probably done in

Page 7, BACKFILLING - There appears to be some confusion regarding
the term backfilling. In reference to the Surface Mining Act,
backfilling is defined as mining to a slope angle steeper than the
eventual reclaimed slope and then refilling or backfilling the
existing void with material other than what is found at the mine
site.
This is not to be confused with the mining of an area to the
approximate reclaimed slope angle and then grading the slope to
the final slopes indicated on the plan. Please clarify.
Page 8, FINAL DRAINAGE CONFIGURATION - Reconstructed drainages
were addressed previously and the appropriate response should be
noted here. Page 8, SITE CLEANUP - Needs to be completed. In
your particular situation the appropriate response may be "not
applicable, " please clarify. Page 8, REMOVAL OF DEBRIS - Needs a
response to address the issue.
Page 10, REVEGETATION - Your response was "yes, " which requires an
explanation of how the work will be accomplished. There is a
response required for the documentation relating to the subsequent
use.
Page 10, RECOMMENDED PIONEER SPECIES - This portion was left
unanswered. I recommend hydromulching the sloped areas upon
completion of mining. It is more expensive to apply than hand
casting of grass seed, but the seed grows more readily, thereby,
reducing erosion and promotes revegetation more rapidly. This in
turn allows the Department of Natural Resources (DNR) to terminate
a permit and release the required reclamation security sooner,
which reduces your overall costs for the long term.
Page 12, FINAL RECLAMATION MAP - This is unclear in that there
needs to be two cross sections indicating the final slopes. The
cross sections should depict the before and after configurations
of the site. They should be at 90 degree angles to each other
across the long and short axis of the site.
Page 12, FINAL CHECK - The signature block portion was left
incomplete and needs to be completed. The DNR will approve the
information when it is satisfied with the information.

As soon as the fees are paid, the completed forms and reclamation plan
modified, I will proceed with the application process.
A reclamation security is required for all Surface Mine Reclamation Permits.
The amount: of the security is based upon the state's estimate of the costs
required to reclaim a specific site should the operation default on the
reclamation permit. There is no specific minimum, however, rarely have I seen
values less than $5,000.
I am enclosing a variety of security options for your review and use. Most
small operations prefer to use the Saving Account Assignment or the Savings
Certificate Assignment. The reason, I suspect, is that they have a hard time
securing a bond or the expense of the bond is too high to justify.

null and void; otherwise it is to remain in full force and effect. In accordance with RCW 78.44, this bond secures completion of
reclamation for the area to be surface mined after the signature date of this bond and any previously disturbed areas on the Premises on
which reclamation has not been satisfactorily completed and approved.
PROVIDED, However, the Surety shall not be liable under this bond for an amount greater in the aggregate than the sum designated in
the first paragraph hereof and any reasonable legal fees that the Department may incur to recover the security.The Surety shall not be
liable for surface mining performed on the Premises after a date sixty days after the Surety mails a cancellation notice to the Principal
and the Department of Natural Resources, Olympia, Washington. The bond shall remain in full force and effect as respects obligations
related to surface mining performed on the Premises before that date unless the Principal files a substitute bond or other performance
security approved by the Department of Natural Resources or unless the Department of Natural Resources otherwise releases the Surety
