Below you will find comments made regarding the proposed development and its critical values. In some cases, setbacks for development from shorelines, steep slopes, streams, and wetlands must be included in your specific proposal; these setbacks are included as part of the comments listed below. This information is based on County and State regulations as they exist to date. These regulations may change and may affect the requirements for development of the subject property. Sincerely, Scott Lonqanecker Land Use Planner Mason County Planning Department 6/22/2004 1 of 3 SP12004-00167 Site Inspection 6/22/2004 Case No.: SP12004-00167 Comments: Pre-inspection for Scott Russell: The site is located within the Belfair Urban Growth Area (UGA). Standard minimum residential building setbacks for this area include 5-foot side and rear yard setbacks and 10-foot front yard setbacks. The adjacent land uses are predominantly single-family residential. These setbacks may change in the near future due to the future adoption of a Belfair UGA comprehensive plan. These setbacks are measured from any structures above grade such as roof overhangs, and other appurtenance and structures, including heat pumps etc. Other setbacks can apply when critical areas are present such as streams, wetlands, steep slopes etc. The subject property is not located within jurisdiction of the Mason County Shoreline Master Program. General lot description: The lot is gently slopes. Slopes do not exceed 15%. The site is divided by an access easement into two separate pieces. The property is heavily forested with the exception of a small area, possibly 40 by 60 ft. next to a regulated type 4 stream. Streams: As discussed above, a regulated type 4 stream was observed on-site, which requires a standard 100-foot buffer, plus 15-foot building setback without variance approval. This area was cleared without benefit of County review or permits within 15-20 feet of the stream. A Stop Work Order was posted during the site visit for unpermitted clearing of the stream buffer. The stream is unmapped, but appears to be a type 4 (perennial non-fish bearing) based upon physical characteristics. It is possible it could be a type 3 however if fish are present. Construction within a regulated stream buffer requires review and approval through a Mason County Resource Ordinance variance process. Part of this process requires that the applicants prepare a Habitat Management Plan (see Resource Ordinance section 17.01.110 J.). A list of wetland / environmental consultants is enclosed for your review, although you may use others not listed as long as they are qualified habitat biologists. Currently the local planner that would review a variance request to build within the stream buffer is Rick Mraz, ph. 360 427-9670 ext. 577, if you have questions about the process. Also the County Enforcement Planner is Kristin French, ext. 593 if you have questions about resolving the unpermitted stream buffer clearing. Resolution of this issue will require restoring the site to its previous state. In order to expedite future proposals on-site, you may consider working with a habitat biologist immediately to develop a restoration plan, since this violation will delay review of other proposals, such as a variance to reduce the stream buffer for 6/22/2004 2 of 3 SP12004-00167 Site Inspection 6/22/2004 Case No.: SP12004-00167 construction of a residence.
