Page 1 of 3 CASE NOTES FOR F PA2017-00006 CONDITIONS FOR FPA2017-00006 1) ARCHAEOLOGICAL RESOURCES Archaeological or historical resources, such as ruins, sites, buildings, artifacts, fossils, or other objects of antiquity that may have significance from an historical or scientific standpoint, which may be encountered by the developer/contractor, shall not be further disturbed. If the developer/contractor encounters any such artifacts, he/she shall immediately stop work and notify Mason County and the Washington State Department of Archaeology and Historic Preservation. Failure to do so may result in civil penalties. A cultural r ource survey is required prior to post-logging site development. XXf Lz.4 2) HOURS OF OPERATION Noise associated with this application shall not exceed what is allowed under Mason County Code 9.36. Harvest operations shall start no earlier than 7:00 AM and all end before 8:00 PM on a daily basis. X 3) GEO-TECHNICAL A geological assessment has been prepared by Envirotech Engineering and the submittal checklist has been reviewed and found complete by Michael MacSems of Mason County Community Services Department. The applicant shall follow the recommendations of the sections 4.4 and 5.0 of the revised assess t. It is understood that,this assessment was written only to address logging. Page 2 of 3 4) FISH &WILDLIFE HABITAT BUFFERS This site is subject to multiple fish and wildlife and wetland buffers. Buffers are as follows: F-Stream: 150 ft with additional 15 ft building setback Ns-Stream: 75 ft with additional 15 ft building setback Wetland: 200 ft with an additional 15 ft building setback The proposal exceeds the required buffers (at most locations) by 100' or more. The unit corners have been flagged. No activity is to occur within that buffer,a ept as allowed under section 17.01.110.F of the Mason County Critical Areas Ordinance. 5) STORM WATER & EROSION ONTROL Escape of silty water or mud from this property shall be considered a violation of County and State storm water management regulations, and could subject the applicant(s) to civil fines or penalties. This project is represented as disturbing less than one-acre of ground and creating less than 5,000 sq ft of new impervious surfaces. J _ G 6) SLASH ABATEMENT This Forest Practice Application indicates that forest debris resulting from the proposed logging operation may create an extreme fire hazard under RCW 76.04.600 and WAC 332-24-650. An extreme fire hazard could be created if one or more of the conditions found in WAC 332-24-650 is located within 100 feet of the running surface of a public road; or is within 500 of an existing structure and/or designated public use area, which is not owned by the owner of the fire hazard area. The land owner is fully liable in the event of fire, if he or she fails to appropriately abate the hazard. Extreme fire hazards shall be abated by removing the forest,de ris, or by othe7rans approved by the Washington State Department of Natural Resources (DNR). X This permit becomes null and void if work or construction authorized is not commenced within 180 days, or if construction or work is suspended for a period of 180 days at any time after work is commenced. Evidence of continuation of work is a progress inspection within the 180 day period. Final inspection must be approved before building can be occupied. We have a dilemma. In his report Lee Boad describes three F streams (Belfair, Mindy and?) and three Ns or Np streams. The problem is that the locations of these streams is shown on Figure 2, which is illegible due to being a multi-generational black and white photocopy of a color page. Your maps(SEPA exhibits) only show Mindy and Belfair Creeks. Where is the third F- stream and the three non-fish streams? Without a legible copy of Figure 2,this is a mystery. I did look for these when on site today and a found some damp draws off the main logging road in the center of the property,but I have no idea it this is what Lee was talking about or not. Although these may seem minor,this is a serious dilemma as I have a report from a qualified biologist stating the these streams exist and I can not ignore that. On top of that, future owners of this property are going to looking at the SEPA review for this FPA for guidance with site development and we need to be as accurate as possible. I need you to do one of two things; either get a legible version of Figure 2 from Lee Boad or hire another qualified consultant to provide a second opinion. There is another environmental piece that concerns me. I understand that your photo map (SEPA Exhibit B) is intended to be your harvest boundary map, and it shows (with a dashed green line) a 200'buffer from Mindy Creek (150'is all that is required)which is good, but Exhibit A, shows the buffer for the wetland and it is larger, in places,than the buffer is Exhibit B. Approval of this FPA will be contingent a harvest boundary map that shows the all the required buffers. I saw the buffer flagging were it crosses the road but I did not bush whack down toward the western property line to measure which boundary the flagging is set for. Do you know? I suspect that I will need to revisit the site with the proper equipment to make some measurements in locations where the wetland buffer exceeds the creek buffer. I am leaving on vacation here shortly but will be back on the 28th. Thank you, Michael MacSems PS: Thank you for sending me the article on wetland banking.
