Person I verbally gave permission to use my road (which was a logging road
over 50 years ago, when my father in law had the area logged), they would
not cut anything over 6", would clean up debris, and place a log at the base of
the road (to prevent others from entering).

Violated agreements
1. found one log 17" and many others over 6" in diameter.

3. broke culvert - threw piece across road
4. one rain - erosion on roadway and ditch on North Shore Rd.
5. culvert on North Shore Rd. is %2 blocked with mud and water is
standing.
Want
1. take care of existing and further erosion on roadside
2. put logs they cut on an angle along road to prevent erosion (or
whatever is needed to do)
3. block road with large (determine size) log at base of road, which
will be permanent and cannot be moved.
4. don't want bulldozer up hill again.
5. to have them pay lawyer's bill
6. give them reasonable time frame to resolve situation
7. If not taken care of you will have it fixed and bill them
I called the Perrys at 5 p.m. on 8/28/2001 and advised them I was in contact
with you. Christine, Mike's wife answered the phone and asked your name
and I gave it to her. They were sorry and within 15 minutes Butch, the
bulldozer man, called and said he would put seed in, bring my firewood to
replace the wood they cut and I just said no, don't do a thing until they hear
from you.

Enclosed you will find an enforcement letter regarding the excavation that took place on
the tax parcel numbers noted above.
A formal complaint has been received regarding the work performed on the above parcel
numbers. I have discussed this matter with the landowner, Mrs. Barbara Brown, and her
attorney, Daniel Graf. All parties, including the landowner, Mr. Michael Perry, and the
contractor Butch's Bulldozing, should be involved in the resolution of this matter.
Therefore, you need to coordinate with Mr. Perry and the landowner to determine who
will submit the required permit applications and materials.
If you are unable to reach an agreement between the three parties involved, a hearing will
be set before the Hearing Examiner and the three parties will be required to be present.

Dear Mrs. Brown:
This letter follows a site inspection that I conducted with you in October, in response to
your concerns regarding recent excavation on the tax parcels noted above. The
excavation was performed in an area that is classified as a"Landslide Hazard Area" per
Mason County Resource Ordinance section 17.01.100. Section 17.01.100 provides that
"[n]o grading shall be performed in landslide hazard areas prior to obtaining a grading
permit subject to approval, by the Director, based on recommendations contained in the
geotechnical report with slope stability, drainage, erosion control and grading
recommendations."
The excavation consists of approximately 200' of primitive road designed to serve as an
access road for a septic system. According to information that you provided, the system
serves four homes, but does not serve the residence at 12481 NE North Shore Road. The
excavated area needs to be restored in accordance with Mason County Resource
Ordinance section 17.01.200(l). 1 have enclosed a copy of the section for your review.
In addition to the restoration plan, the excavation requires an "after the fact" Land
Modification Permit if the grading exceeds 200 cubic yards, or an "after the fact" Mason
Environmental Permit if the grading is less than 200 cubic yards. The permit application
forms are enclosed, and "after the fact" permits are subject to triple fees. The permits
must be accompanied by a geotechnical assessment that meets the requirements of Mason
County Resource Ordinance section 17.01.100(E). I have enclosed a copy of the section
for your review.
In summary the following must be submitted to the Mason County Planning Department
by January 31, 200 1:
