FINDING OF FACT
WAIVER OF FOREST MORATORIUM # DRV 2020-00006
APPLICANT: Matthew Van Dijk
APPLICATION DATE: 6/15/20
Mason County has reviewed the above referenced application for a 2-acre waiver of the
six-year moratorium resulting from a permitted Class II forest practice activity (2417400)
and finds it in conformance with all applicable County land use regulations in effect at
the time of application.
FINDINGS
The proposed waiver of six-year moratorium is compliant with the following conditions:
The applicant has paid the prescribed fees.
The applicant has filed a complete application.
This six-year moratorium waiver is in conformance with the following Mason County
ordinances:
Forest Practice Moratorium Ordinance 11.04
1. The development area is no larger than two (2)acres in size.
See attached site map.
2. The harvest and reforestation of the property shall be completed as specified in
the approved forest practices application/notice.

3. There shall be no damage to a critical area or its associated vegetation area nor to
the shoreline area(if any)or any damage to those areas is repairable with
restoration.
No damage has occurred.
4. The proposed development is consistent with the Mason County Comprehensive
Plan and Development Regulations.

The proposed development is limited to residential use per the criteria of the
waiver process. The location is zoned RR-5 which is consistent with residential
development.
5. If necessary, mitigation shall be required for impacts to critical areas, stormwater,
and shorelines. Other mitigation may be required to prevent adverse
environmental impacts, pursuant to Mason County Ordinance #55-97, the
Environmental Policy Ordinance.
No mitigation required.
Title 15 Mason Development Code
This application for a waiver from the six-year moratorium has been processed as
a Type II permit with appropriate notices.
Comprehensive Plan and Development Regulations
The activity proposed for the site affected by this waiver from a six-year
moratorium is compatible with the Mason County Comprehensive Plan and
Development Regulations. The site is zoned Rural Residential 10.
Shoreline Master Program
This property does not contain land that falls within the jurisdiction of the Mason
County Shoreline Master Program. Designation: N/A . Any activity
in those portions of this site shall be consistent with the requirements of the
Shoreline Master Program.
Mason County Critical Areas Ordinance
Site contains or is within 300 feet of minimal slopes. A geotechnical report
or geological assessment was written for the site by and the checklist
approved as complete by county staff.

Stormwater and Erosion Control
An engineered stormwater and erosion control plan(by )was reviewed by
Fred Perryman in Mason County Public Works. The plan was approved with conditions
on

State Environmental Policy Act
This application for waiver from the six-year moratorium#DRV 2020-00006 has
been reviewed for SEPA compliance under case# SEP 2020-00029, and a
determination of non-significance has been made.
CONCLUSIONS
In conclusion,this application for a waiver from the six-year moratorium associated with
FPA 2417400 is consistent with the above criteria. The following types of permits may
be issued prior to 10/17/20 under this waiver.
1. Building permits for a single-family residence and/or for a residential outbuilding.
2. Single-family on-site septic permit.
3. Road access permit.
4. Earth modification permits.
5. Shoreline Master Program approvals.
6. Well and potable water permits.
7. Other approvals necessary to the development of a single-family residence and
outbuildings.
Any permit issued under this waiver shall be conditioned, as necessary,to limit the
approval to only that development consistent with the intent of section 11.04.340 of the
Mason County Forest Practice Ordinance # 11.04.
RECOMMENDATIONS
I,being a duly appointed designee of the Mason County Community Services
Department,hereby attest to and certify that appropriate provisions have been made for
this six-year moratorium waiver and hereby recommend approval.

Requirement #1 — Stormwater site plan
1: Construction road location noted on plan. Built using a 2"-4" crushed rock
base topped with 1 1/a" minus crushed rock.
2: Minimum 40' buffer to be maintained consisting of natural vegetation and
trees to be un disturbed. Per wetland study, there were no sensitive areas
noted.
3: Natural vegetative buffer will be utilized for sediment control.
4: Non-applicable. No soils onsite the need stabilization, not enough slope
5: Natural drainage features and constructed features as noted on site plan.
Narrative
1: 100 NE Ridgetop Ct. Belfair WA. Parcel #12319-42-50070
No permit numbers yet.
2: 5.05 acres. 1.28 acres will be cleared. 3/4 of an acre to be utilized for shop
construction, the remaining to be allowed to grow naturally.
3: Construction access/driveway is approximately 210' long by 16'wide built
out of crushed rock of varying sizes.
4: Soil types- 21-30" of sandy loam topping hard pan. Topography is mostly flat
with slight slopes of less than 5%. There appears to be a natural drainage
path, but no water has been observed entering or leaving the property.
5: Anticipated start date would be end of July or early August 2020 and last 2
months.
6: Clearing method was tracked excavator, use afterwards is residential.
Requirement #2
Element 1
Property corners have been surveyed and are marked in pink or pink/green
survey tape. Trees that are currently standing will remain so, as no further
clearing is required. In most areas the cleared areas is in excess of 100' from
property boundaries._Wetland study concluded no sensitive areas
recognized on property.
Element 2
Access road/driveway is already constructed using clean crushed rock
building materials. Driveway roughly 210 feet in length by 16 feet wide.
Element 3
Not applicable due to slight slope of property and large vegetative buffer
situated along downslope side of property.
Element 4
No soils to be removed.
Element 5
There will not be any cut and fill areas on the site. Stockpiles may be covered
in plastic to avoid erosion. There are no storm drain inlets,waterways or
drainage channels on property.
Element 6
Not Applicable
Element 7
12" culvert installed as noted on plan. There is a low spot on the property
that could have potential for water. Water has not been visible yet, culvert
placed as a precautionary measure.
Element 8
Not applicable. There will be no site runoff into channels, streams or other
natural drainage point. There are no steep slopes or erosive soils onsite.
Element 9
There is no known pollutants, but good housekeeping and preventative
measures will be taken.

Element 12
Design was created to fit existing topography and natural shape of the
property. Erosion control will be emphasized,all sediment will remain
onsite.

There has been no visible water run off or standing water. Wetland
reconnaissance was performed by The Wetland Corps on 6/13/2020. Report
turned in to Mason County. No wetlands, sensitive areas or setbacks/buffers
noted in the report.
Requirement #5
All stormwater run off will be managed onsite to prevent floodinganderosion
through dispersion and infiltration into natural vegetation.

FPA Storm water management plan

1: Proposal is to clear less than 2 acres of the 5.05 acre parcel under a granted
waiver envelope for this site. Soils on this site consist of roughly 26" of
sandy loam, glacial till underneath. Site is mostly flat with slopes of less than
5%. Plans have been submitted to build a 2944 square foot detached shop,
with a future single family residence to be built. Project will hopefully start
in July.
2: Construction access site is located towards the NE corner of the property.
Driveway is roughly 16' wide and extends into the property roughly 210 feet.
Driveway was constructed using 2" and 4" quarry spalls. Quarry spalls were
topped with 1 1/a" minus crushed rock and rolled and compacted. The
driveway crosses through a natural drainage path. At the lowest point of the
drainage, a 12" culvert was placed to allow potential surface water runoff.
Driveway was built using clean materials as to not allow track out onto paves
surfaces.
3: A site plan showing clearing limits, site egress, natural drainages and site
slope is included with this plan. A biological wetlands reconnaissance was
conducted for this site. No sensitive areas were found on the site and no
buffers were recorded.
4: The natural shape of this property is mostly flat with a slight slope to the
west. Natural slope of this property is less than 3% in most areas with the
greatest slope less than 5%. Due to the flat nature of this property, no soil or
slope stabilization measures are needed.
5: Run off from the site will be minimal due to the natural topography of the
site. BMP's will not be used as runoff will flow minimally into the large
vegetative buffers around the perimeter of the property.
