SH R2011-00006 Paae 1 of 2 CONDITIONS: 1) The proposed project shall be consistent with all policies and provisions of the Shoreline Management Act, its rules, and the standards of the Mason County Shoreline Master Program. 2) The applicant shall meet the standards of the Conditional Use Permit review, including proper standards under the Allyn Urban Growth Area Village Commercial Zone (MCC 17.12.100) for setbacks, height, site coverage, and parking needs for the land uses proposed. 3) The applicant shall implement the proposed native plant landscaping plan in order to provide a re-established vegetation buffer along the saltwater frontage of Case Inlet and meet the intent of the Mason County Resource Ordinance fish and wildlife habitat conservation areas development standards. 4) The applicant shall provide proper ingress and egress for the proposed land use and secure the proper road traffic access permits from Washington Department of Transportation and Mason County Department of Public Works. 5) The applicant shall secure the review and approval by Washington Department of Fish and Wildlife and Department of Ecology of proposed vegetation removal of shoreline and/or wetland plants that will be done during site preparation and eventual replanting in the vegetation buffer. shall meet the fire protection standards of Mason Count in the construction and 6) The applicant s a t p y operation of a motel land use in the Allyn Urban Growth Area. 7) The applicant shall use best management practices to prevent debris and runoff from entering the waters of the State, both during and following construction. 8) The applicant shall submit to Mason County a stormwater plan designed to 2009 State stormwater management technical standards; that plan shall be stamped by an engineer and shall meet approval of the Mason County Department of Public Works. This permit has been granted by Mason County persuant to the Shoreline Management Act of 1971 and nothing in this permit shall excuse the applicant from compliance with any other federal, state or local statutes, ordinances or regulations applicable to this project but not inconsistent with the Shoreline Management Act. (Chapter 90.58 RCW). This permit may be rescinded pursuant to RCW 90.58.140(7) in the event the permittee fails to comply with the terms and conditions hereof. No permit authorizing construction shall extend for a term of more than five (5) years. If actual construction of a development for which a permit has been granted has not begun within two years after the approval of the permit by the Board of County Commissioners, the Board shall, at the expiration of the two-year period, review the permit, and upon a showing of good cause, extend the permit for one year. Otherwise, the permit terminates; provided that no permit shall be extended unless the applicant has requested such review and extension prior to the last regular meeting of the Board coming before the permit exipration date. Development includes retail areas in buildings,parking for land use, and reestablishment of native plantings along shoreline of North Bay/Case Inlet. By law, local governments must review all SDPs for compliance with the following: • The Shoreline Management Act(Chapter 90.58 RCW) • Ecology's Substantial Development Permit approval criteria(Chapter 173-27-150 WAC) • The Mason County Shoreline Master Program Local governments, after reviewing the SDP for compliance, are required to submit the SDPs to Ecology for filing. Your approved SDP has been received and filed by Ecology By law, Ecology must review Conditional Use Permits for compliance with: The Shoreline Management Act(Chapter 90.58 RCW) Ecology's Conditional Use Permit approval criteria(Chapter 173-27-160 WAC) • The Mason County Shoreline Master Program After reviewing Conditional Use Permits for compliance,Ecology must decide whether to approve, approve with conditions, or disapprove them. i�ii Our Decision: Ecology approves your Conditional Use Permit provided your project complies.with the conditions required by Mason County and the following Ecology conditions: 1. The native plant landscaping plan shall receive Ecology review and approval prior to site disturbance for planting. Please note, however,that other federal, state, and local permits may be required in addition to this shoreline permit. What Happens Next? Before you begin activities authorized by this permit,the law requires you to wait at least 21 days from the"date of receipt" -the date you receive this letter or the date Mason County receives their copy of this letter. Date of receipt is defined in RCW 43.21B.001 as follows: (1) "Business days" means Monday through Friday exclusive of any state or federal holiday. (2) "Date of receipt" means: (a)Five business days after the date of mailing; or (b) The date of actual receipt, when the actual receipt date can be proven by a preponderance of the evidence. The recipient's sworn affidavit or declaration indicating the date of receipt, which is unchallenged by the agency, shall constitute sufficient evidence of actual receipt. The date of actual receipt, however, may not exceed forty-five days from the date of mailing. This waiting period allows anyone (including you) who disagrees with any aspect of this permit, to appeal the decision to the state Shorelines Hearings Board. You must wait for the conclusion of an appeal before you can begin the activities authorized by this permit. The Shorelines Hearings Board will notify you by letter if they receive an appeal. We recommend you contact the Shorelines Hearings Board before you begin permit activities to ensure no appeal has been received. They can be reached at(360) 664-9160 or hiip://www.eho.wa.lzov.
