Below you will find comments made regarding the proposed development and its critical values. This information, is based on County and State regulations as they exist to date. Sincerely, Scott Lon n cker Land Us P nner Mason County Planning Department 9/24/01 1 of 3 RLC2001-00091 Resource Lands & Critical Area Site Evaluation 9/24/01 Case No.: RLC2001-00091 Comments The Shoreline Master program designation of the area is Rural as the property is adjacent to the Union River, and the property is within Urban Growth Area of Belfair. The purpose of the site visit was to determine what issues would be involved regarding the replacement of the existing residence with a manufactured home. Currently the existing home is lodged between the Union River (type 1, shoreline river) and Courtney Creek (type 3 stream). The Mason County Shoreline Master Program and Resource Ordinance both guide development on this property. Under the Mason County Shoreline Master Program, a minimum 25 foot building setback is required from the ordinary high water mark of the Union River, however the more restrictive Mason County Resource Ordinance, Fish and Wildlife Habitat Conservation Areas Chapter 17.01 .110 would apply a 165 foot buffer and building setback to both Courtney Creek and the Union River. Under the Mason County Shoreline Master Program, if the current residence was demolished and replaced, the new structure would have to meet the minimum 25 foot setback from the Union River. Under the Mason County Resource Ordinance existing structures may be repaired, remodeled or replaced in the existing footprint plus or minus ten percent without requiring a variance or Mason Environmental Permit. Expansion beyond 10 percent would require a variance if the structure was to be replaced within the 165 foot buffer / setbacks of Courtney Creek and the Union River. In this case these buffers overlap one another in the area proposed to place the new home. The applicants want to demolish the existing non-conforming home and replace it with a new manufactured home further away from both the Union River and Courtney Creek according to their site plan. They would also restore the area where the home is now to a more natural condition. This proposal would be a benefit to fish and wildlife habitat on the property and appears to be consistent with the goals of the Mason County Resource Ordinance. The existing residence foot print measured 1610 square feet and 10 percent over this would be 1771 square feet. If this residence is removed, another could be placed within the fish and wildlife habitat conservation area buffers of the Union River and Courtney Creek in the new proposed location with the following conditions. If the replacement unit is 1610 square feet or less, the Planning Department would only require a building permit and for the new structure to meet the minimum 25 foot setback from the Union River and to not reduce the buffer from Courtney Creek any further. If the replacement unit is up to 1771 square feet the same conditions would apply and a Habitat Management Plan would be required to mitigate for any increased impacts to the 9/24/01 2 of 3 RLC2001-00091 Resource Lands & Critical Area Site Evaluation 9/24/01 Case No.: RLC2001-00091 environment. If the replacement unit is more than 1771 square feet a variance would be needed in addition to a Habitat Management Plan. The requirements for these permits and processes are contained within the Fish and Wildlife Habitat Conservation Areas Chapter of the Mason County Resource Ordinance, (enclosed).
