SUBJECT: Request to Use the Streamlined Fish Habitat Enhancement Process for Bear Creek

Dear Applicant and Agent:
The Washington Department of Fish and Wildlife(WDFW)has reviewed your application to use the
Streamlined Fish Habitat Enhancement Process under RCW 77.55.181.
Based on the information provided in the Joint Aquatic Resource Permit Application (JARPA), this
project does not meet the requirements for the Streamlined Hydraulic Project Approval process.
Specifically, your project appears to be a flooding project. Although your project may enhance fish it is
not the primary purpose of the project. To meet the streamlined process requirements the majority of
the proposals actions must be primarily for fish habitat enhancement. Channel changes for flooding
purposes does not meet the criteria for the Streamlined Process for Fish Habitat Enhancement.
However, the Washington State Department of Fish and Wildlife does support your efforts to enhance
fish habitat and will consider your application for a standard Hydraulic Project Approval should you
wish to apply.

Application for Streamlined Process for
FISH HABITAT ENHANCEMENT PROJECTS
Addition to the Joint Aquatic Permit Application Form (JARPA)
Under recent laws,you may qualify for a streamlined permit process with no fees,if your project is designed to enhance fish
habitat. If your project meets the requirements below,you are entitled to the streamlined Hydraulic Project Approval(HPA)
process,exemption from the State Environmental Policy Act,and exemption from all local government permits and fees. To
apply for the exemption process,the applicant must provide on the same day,the DARPA form and this cover addition to: the
Department of Fish and Wildlife(WDFW)and all applicable Local Government planning and permitting departments. Local
governments have 15-days to provide comments to WDFW,who will use these comments to aid them in making decisions(see
below for details).
APPLICANTS -To QUALIFY for the r1sh habitat enhancement exemption you must check at least one each from A and P:
A)Projects must accomplish one or more of the following fish habitat restoration tasks(check which one applies):

1) Submit this cover letter and a complete JARPA form as an application for the fish habitat enhancement exemption to the
Local Government planning department,and WDFW. These applications must be submitted on the same day starting a
15-day comment period. If significant concerns are raised during the 15-day comment period regarding adverse impacts that
cannot be addressed through HPA conditions,WDFW can determine that the project does not qualify for the exemption
process.If this determination is made,the applicant may re-apply to WDFW,the applicable Local Government,and any

3) The p&work covered by the exemption process must be for fish habitat enhancement. If only a piece of your project is for
habitat enhancement,the remainder of the project must be covered by the full permitting process.
4) If WDFW determines that your project meets the criteria for the exemption,your project is exempt from SEPA and from
local government permits and fees. You will have an answer from WDFW within 45 days of the receipt of this cover letter
and complete JARPA form.

are considered exempt and consistent with the revisions to the WACs,and local government fees are waived.
4. The law determines that"fish habitat enhancement projects that conform to the provisions of the act are determined to be consistent
with local shoreline master programs".
DEPARTMENT®F FISHAND WILDLIFE:
1. Upon receipt of a complete JARPA and request for the fish habitat exemption process,review the proposed project plan for
compliance with the requirements listed in section 1 and 2 of 2SHB 2879(also listed on page 1,applicant section#A and B).
a) If JARPA is incomplete or if it is determined that a project does NOT meet the exemption criteria,contact the applicant and
local government planning department and inform them the project does not qualify for the exemption. Return JARPA to the
applicant. The applicant may reapply to WDFW,the applicable Local Government and other permitting agencies for
approval under the full permitting process.
b) If JARPA is complete and the project meets the criteria, start the HP 45-day exemption process(defined below);
1. WDFW must allow 15 days for interested parties,and local governments to provide comments on the project—no approval action can
be taken within the first 15 days of receipt of the JARPA;
2. If comments are received,WDFW will decide whether the concerns raised can be mitigated through conditions of the HPA—if yes,
continue to#4. If no,WDFW will notify the applicant and applicable Local Government. The applicant may reapply to WDFW,the
applicable Local Government and other permitting agencies for approval under the full permitting process;
3. WDFW must approve or deny the HPA,or make a determination that the proposed work does not qualify for the
exemption process within 45 days.

information to help you and the agency identify impacts from your proposal(and to reduce or avoid impacts from Wroposal,if it can be
done)and to help the agency decide whether an EIS is required.
Instructions for applicants:
This environmental checklist asks you to describe some basic information about your proposal. Governmental agencies use this
checklist to determine whether the environmental impacts of your proposal are significant, requiring preparation of an EIS. Answer the
questions briefly,with the most precise information known,or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases, you should be able to
answer the questions from your own observations or project plans without the need to hire experts. If you really do not know the answer,

This project has components that focus on quality benefits to all species including those at risk under ESA listings. We will
restore of riparian function by preventing Bear Creek from eroding its banks during large rain events which have allowed high
velocity water to run over and through its banks causing the stranding of thousands of juvenile salmon per event This will be done by
bioengineering the placement of LWD in specific engineered locations to redirect the flow while protecting the unstable bank areas.
LWD is a key ingredient and component of habitat complexity in streams and rivers. Past management practices coupled with
removal of LWD from these systems has been a major contributing factor to salmonid habitat loss overtime. The addition of LWD
will help maintain habitat complexity while preventing loss of juvenile salmonids and trout through stranding. We will also construct
a by-pass channel for high flows which will decrease the pressure on the existing unstable bank. This channel shall be approximately
sixty (60)feet long and will remove no more that 50 cubic yards of material and we will place approximately 14 cubic yards of
streambed gravel in the channel. We will realign existing LWD for better function and add 5 pieces to reinforce the existing channel,
When completed we will replant the existing bank and reinforced bank as well as the overflow channel. We will also remove the
access road and repair fencing at access points.
12. Location of the proposal. Give sufficient information for a person to understand the precise location of your proposed project,
including a street address, if any, and section,township,and range, if known. If a proposal would occur over a range of area,provide the

No. The land is veritably flat and all access is well away from the actual construction. We will have no equipment in the
stream at anytime and we will place silt fences up during the construction period.
g.About what percent of the site will be covered with impervious surfaces after project construction(for example,asphalt or
buildings)?
None of the site will be covered by impervious surfaces.
h. Proposed measures to reduce or control erosion,or other impacts to the earth,if any:
Silt fences will be placed at both ends of the overflow channel and any other water at the time of construction will be pumped
around file site. The Summer flow is very small and in some instance this steam is dry during the construction window.

None other than from them few pieces of equipment being used. Most of the channel work and would placement will be by

3. Water
a. Surface:
1) Is there any surface water body on or in the immediate vicinity of the site(including year-round and seasonal streams,
saltwater,lakes,ponds,wetlands)? If yes,describe type and provide names. If appropriate,state what stream or river it
flows into. Bear Creek flows into the Union River which then flows into Hood Canal. At this point Bear Creek has
very low flow or no flow depending on the summer rainfall. We are anticipating low flow.
2)Will the project require any work over,in,or adjacent to(within 200 feet)the described waters? If yes,please describe
and attach available plans. Yes,we will be working in and around Bear Creek. (Plan attached)
3)Estimate the amount of fill and dredge material that would be placed in or removed from surface water or wetlands and
indicate the area of the site that would be affected. Indicate the source of fill material.

project,you still must summarize the proposed work here. Attach a separate sheet if additional space is needed.
We intend to modify the stream channel to flow around and to the northwest of the existing 90 degree
turn it now make which forces it over the bank at high flows. The project includes leaving reinforcing in
the stream bank at the 90 turn where we have placed sand bags and will remove them after monitoring
the effect of the channel change. This site overbanks on high rain events and floods three neighbor's
access roads, yards and fields. Leaving thousands of juvenile salmonids in the fields. We intend to
leave the bank reinforcement and to add LWD to the system to increase habitat.
PREPARATION OF DRAWINGS: See sample drawings and guidance for completing the drawings. ONE SET OF ORIGINAL OR GOOD QUALITY REPRODUCIBLE
DRAWINGS MUST BE ATTACHED. NOTE: Applicants are encouraged to submit photographs of the project site,but these DO NOT substitute for drawings. THE CORPS
OF ENGINEERS AND COAST GUARD REQUIRE DRAWINGS ON B-112 X 11 INCH SHEETS.. LARGER DRAWINGS MAYBE REQUIRED BY OTHER AGENCIES.
7b. Describe the purpose of the proposed work and why you want or need to perform it at the site. Please explain any specific needs that
have influenced the design.
As mentioned above the project will protect listed species at the juvenile stage and increase diversity of
habitat.
7c. Describe the potential impacts to characteristic uses of the water body. These uses may include fish and aquatic life,water quality,
water supply, recreation and aesthetics. Identify proposed actions to avoid, minimize, and mitigate detrimental impacts and
provide proper protection of fish and aquatic life. Identify which guidance documents you have used. Attach a separate sheet if

There will be no noticeable impact on the current system other than making a more normal bend in the
creek just above the current sharp bend. We will add wood along the stretch of the channel to add
diversity and more habitat. We will dewater using a pump and pipe during construction. However the
level of water in the creek at this time of year is negligible. All or any fish present will be moved and
then the pump area will be screened.

We intend to modify the stream channel to flow around and to the northwest of the existing 90 degree
turn it now make which forces it ovar the bank at high flaws. The project includes leaving reinforcing in
the stream bank at the 90 turn where we have placed sand hags and will remove them after monitoring
the effect of the channel change. This site overbanks on high rain events and floods three neighbor's
access roads, yards and fields. Leaving thousands of juvenile salmonids in the fields. We intend to
leave the bank reinforcement and to add LWD to the system to increase habitat.

OF ENGINEERS AND COAST GUARD REQUIRE DRAWINGS ON 8-112 X 11 INCH SHEETS. LARGER DRAWINGS MAYBE REQUIRED BY OTHER AGENCIES.

have influenced the design.
As mentioned above the project will protect listed species at the juvenile stage and increase diversity of
habitat.

There will be no noticeable impact on the current system other than malting a snore normal bend in the
creek just above the current sharp bend. We will add wood Along the stretch of the channel to add
diversity and more habitat. We will dewater using a pump and ,pipe during construction. However the
level of water in the creek at this time of year is negligible. All or any fish present will be moved and
then the pump area will be screened.
