1. Call to Order—The Chairperson called the regular meeting to order at 9:04 a.m.
2. Pledge of Allegiance— Patricia Vandehey led the flag salute.
3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2—Tim
Sheldon; Commissioner District 3—Terri Jeffreys.
4. Correspondence and Organizational Business
4.1 Correspondence
4.1.1 City of Shelton Metropolitan Park District sent a Resolution increasing valorem taxes for 2016.
4.1.2 Bureau of Indian Affairs sent a letter regarding an application for"in trust" property.
4.1.3 Island County sent a letter regarding Banks Vs Susan Drummond
4.1.4 Department of the Interior sent notification of PILT payment.
4.1.5 Port of Grapeview sent a letter in favor of marine deputy patrols.
4.1.6 Brad Bryant applied for the Parks Advisory Board.
4.2 News Release: Erika Schwender read a news release re: New rates for water&sewer utility
system.
4.3 News Release: Erika Schwender read a news release re: Free Christmas Tree Drop off&

7. Approval of Minutes — December 7, 2015 briefing minutes
Cmmr.Jeffreys/Sheldon moved and seconded to approve the December 7, 2015. Motion
carried unanimously. N-aye; S-aye; 3-aye.
8. Approval of Action Agenda:
8.1 Approval for the Chair to sign the 2016 Crimeshield Policy Washington Amendatory
Endorsement-Governmental Coverage form.
8.2 Approval of the Veterans Assistance Fund applications for: Food $375.00; Utilities $616.47;
Housing $775.00 and Burial $600.00 for a total of$2366.47 as recommended by the
Veterans Service Office.
8.3 Approval to extend the 2015 contract with Mental Health Professionals, LLC for Intensive
Clinical Case Management and Supportive Services from January 1, 2016 through January
31, 2016 and provide additional funding to cover services in January 2016 in an amount not
to exceed $5458.00 and will be paid by the Mental Health Fund.
8.4 Approval to reschedule the Tuesday, January 5, 2016 Commission meeting to 10 a.m. rather
than 9 a.m. in order for the Commissioners to attend the 2016 Legislative Send-Off meeting
that is scheduled for 7:30 a.m. to 9:30 a.m. at the Colonial House.
8.5 Approval to extend the 2015 contract with NW Resources II, Inc. for intensive case
management and supportive housing services in 2016 and adding an amount not to exceed
$115,998.00 for 2016. The funds will be paid from the mental health fund.
8.6 Approval for the Board to execute the resolution authorizing the County Road Load/Speed
Restrictions and Emergency Closing Orders for the remainder of 2015 and the 2016 calendar

8.7 Approval for the Board to execute the resolution for the County Road Projects for specific
County wide construction activities for 2016 as set forth in County Road Project numbers
2004 and 2005. Resolution 68-15 (Exhibit B)
8.8 Approval for the Board to execute the resolution establishing lane limits for traffic control on
eight Mason County bridges for the 2016 calendar year. The eight bridges are as follows:
1. Rossmaier Bridge
2. Stretch Island Bridge
3. Hliboki Bridge
4. Gosnell Creek Bridge
5. Eich Road 1 Bridge
6. Eich Road
7. Carson Bridge
8. Hunter Creek Bridge Resolution 69-15 (Exhibit C)
8.9 Approval of the Memorandum of Understanding between Mason County and Local Union No.
1504 of the American Federation of State, County and Municipal Employees, AFL-CIO, and
Council 2, Washington Council of County and City Employees (AFSCME)to modify the current
Collective Bargaining Agreement(CBA) to reflect 1) An across the board wage increase of
3.92% applied to bargaining unit members; 2) Medical premium contribution established at
$1102.00 for 2016; and 3) Reinstate Bi-lingual pay, consistent with other CBAs.
8.10 Approval of the Memorandum of Understanding between Mason County and the Mason
County Engineer's Guild to modify the current Collective Bargaining Agreement to reflect: 1)
An across the board wage increase of 3.92% applied to the bargaining unit members and 2)
Medical premium contribution established at $1102.00 for 2016.
8.11 Approval to amend Resolution 80-14 modifying the payment Schedule for the interfund loan
from Equipment Rental &Revolving to Current Expense. The Payment shall be made in full
with accrued interest on June 1, 2016. Resolution 70-15 (Exhibit D)
8.12 Approval of the resolution to amend the Mason County Personnel Policy Chapter 5 to add
Section 5.3 as Reclassification Policy and for it to become effective on January 1, 2016.
Resolution 71-15 (Exhibit E)
8.13 Approval of the resolution to amend Resolution 56-15 to revise the non-represented salary
scale range alignment by establishing a salary range 46, creating a Community Services
Department by merging Public Health and Human Services and Community Development,
and creating a Community Services Director at salary range 46. Resolution 72-15
(Exhibit F)
8.14 Approval of the Resolution authorizing Elected Officials and non-represented employee
salaries to reflect a 3.92% increase. This will maintain parity with the recommended
increases proposed for the members of the current Collective Bargaining Agreements within
the County. Resolution 73-15 (Exhibit G)
8.15 Approval of the Memorandum of Understanding between Mason County and Woodworkers
Local Lodge W38 I.A.M. representing the Mason County Deputy Prosecutors to modify the
current Collective Bargaining Agreement(CBA) to reflect: 1) an across the board wage
increase of 3.92% applied to bargaining unit members and 2) Medical premium contribution
established at $1102.00 for 2016.
8.16 Approval of the Memorandum of Understanding between Mason County and Teamsters Union
Local No. 252 representing Mason County Community and Family Health to reflect: 1) Across
the board wage increase of 1.92% applied to all bargaining unit members and 2) Clarification
that the bargaining unit classifications of Community Health Education Specialist and
Community Health Program Assistant receive the 2% adjustment specified in Article 9.
8.17 Approval of the Memorandum of Understanding between Mason County and Mason County
Sheriff's Office Employees Guild to modify the current Collective Bargaining Agreement to
reflect: 1. An across the board increase of 1.92% applied to bargaining unit members.

8.18 Approval for the Chair to sign the letter to the Natural Resources Conservation Service
requesting Federal assistance to restore damages sustained in December 2015 storms to a
levee on the Skokomish River.
Cmmr. Sheldon sought clarification on 8.5 and 8.3.
Cmmr. Sheldon asked if Item 8.7 is for specific projects?
Melissa McFadden said it helps with scheduling to have a CRP set up. She gave examples of
misc. items it may be used for.
Cmmr. Sheldon said there are many items to increase salary and a lot are for bargaining unit
and said some of the previous agreements have not yet expired.
Cmmr. Sheldon asked for items 8.9, 8.10, 8.11, 8.12, 8.13, 8.14, 8.15, 8.16 and 8.17 removed
for a separate vote.
Cmmr.Jeffreys/Neatherlin moved and seconded to approve Items 8.1-8.8 and 8.18
with the removal of 8.9, 8.10, 8.11, 8.12, 8.13, 8.14, 8.15, 8.16 and 8.17 for a
separate vote. N-aye; S-nay; 3-aye
Item 8.9 Approval of the Memorandum of Understanding between Mason County and Local Union
No. 1504 of the American Federation of State, County and Municipal Employees, AFL-CIO,
and Council 2, Washington Council of County and City Employees (AFSCME)to modify the
current Collective Bargaining Agreement (CBA) to reflect 1) An across the board wage
increase of 3.92% applied to bargaining unit members; 2) Medical premium contribution
established at $1102.00 for 2016; and 3) Reinstate Bi-lingual pay, consistent with other
CBAs.
Bill Kenny explained 8.9, 8.10, 8.14, 8.15, 8.16 and 8.17. He said there have been no salary
increases for these since 2008. He stated that on average Mason County is 12% below
comparable counties in pay.
Cmmr. Sheldon said the contracts don't end until the end of 2016 and asked if this is a gift of
public funds.
Mr. Kenny said it is not a gift of public funds. He confirmed this is for non-represented
employees and does include elected officials.
Cmmr. Sheldon confirmed that there is a sick leave cash out policy and received explanation
of how this works.
Testimony: There was no public testimony.
Cmmr.Jeffreys/Neatherlin moved and seconded to approve action items 8.9,
8.10, 8.14, 8.15, 8.16 and 8.17. Motion carried. N-aye; S-nay;3-aye
Cmmr. Sheldon said he doesn't feel we should give raises to elected officials. If the elected
official feels they should get paid more, they should take that up with the public. Cmmr.
Sheldon said he is trying to be consistent and he hopes people don't take this personally.

Cmmr. Neatherlin said retaining and keeping good employees is important.
Cmmr. Sheldon said he feels this will create a bow wave and it will be hard to sustain.
Item 8.11 Approval to amend Resolution 80-14 modifying the payment Schedule for the interfund
loan from Equipment Rental &Revolving to Current Expense. The Payment shall be made in
full with accrued interest on June 1, 2016.
Frank Pinter explained this item. They will use some levy shift funds.
Cmmr. Sheldon reiterated that the levy shift is confusing. He said he has concerns.
Cmmr.Jeffreys/Neatherlin moved and seconded to approve 8.11 to amend
Resolution 80-14 modifying the payment schedule for the interfund loan from
ER&R to Current Expense. The payment shall be made in full with accrued
interest on June 1, 2016. Motion carried. N-aye; S-nay;J-aye
Item 8.12 Approval of the resolution to amend the Mason County Personnel Policy Chapter 5 to
add Section 5.3 as Reclassification Policy and for it to become effective on January 1, 2016.
Bill Kenny explained this item. He said this needed to be more clearly defined in policy.
Cmmr. Sheldon asked Mr. Kenny a few questions. He doesn't understand the request
window and asked how a citizen could understand what's going on with this policy.
Cmmr.Jeffreys/Sheldon moved and seconded to approve item 8.12. Motion

Item 8.13 Approval of the resolution to amend Resolution 56-15 to revise the non-represented
salary scale range alignment by establishing a salary range 46, creating a Community
Services Department by merging Public Health and Human Services and Community

9. 9:30 a.m. Public Hearings and Items Set for a Certain Time—
9.1 Public Hearing —Continued from November 17, 2015 to take comments regarding rezone No
15-01 by Ronald Szalay to amend the outer boundary of the Belfair Urban Growth Area (UGA) and
rezone three parcels (parcel 12332-50-00094, 12332-50-00096 and 12332-50-90102). Staff: Allan
Borden.
Cmmr. Jeffreys/Sheldon moved and seconded to approve item 9.1 rezone No 15-01 by
Ronald Szalay to amend the outer boundary of the Belfair Urban Growth Area (UGA) and
rezone three parcels (parcel 12332-50-00094, 12332-50-00096 and 12332-50-90102).
Motion carried unanimously. N-aye; S-aye; J-aye
9.2 Public Hearing to consider the rezone of two parcels in the Belfair UGA (12320-41-00010 and
12320-44-00020) from R-4 to mixed use. Barbara Adkins gave the Board of copy of the letter from
Mr. Van Buskirk.

Cmmr. Sheldon asked Ms. Adkins about odor problems.
Barbara said she has not had any complaints pertaining to odor(s).
Chris Larson, Attorney for Seattle Inceptive group said he is available for questions. He said they are
simply trying to enclose some space.
Commission Discussion:
Cmmr. Jeffreys said land use issues are hard.
Cmmr. Sheldon said he thinks these businesses should be rural. He said there may other places that
are more appropriate for marijuana.
Cmmr. Neatherlin thanked Seattle Inceptive Group for the jobs they brought to Belfair.
Cmmr. Jeffreys/Neatherlin moved and seconded to approve rezone of two parcels in the
Belfair UGA(12320-41-00010 and 12320-44-00020)from R-4 to mixed use. Motion
carried. N-aye; S-nay; J-aye Ordinance 74-15 (Exhibit H)
9.3 Public Hearing to consider amendments to Future Land Use Map to expand a portion of the
Shelton UGA boundary.
Robert Johnston spoke about his boathouse and stated he wants this denied. He claims if it's
approved, additional damage can be done to the marina.
Cmmr. Neatherlin said they don't have anything to do with the Port.
Cmmr. Jeffreys/Sheldon moved and seconded to approve item 9.3 approving amendment
to Mason County Comprehensive Plan, ChapterXI,Shelton Urban Growth Area Plan,
Figure 1, Future Land Use Map as presented.
Motion carried unanimously. N-aye; S-aye;3-aye Ordinance 75-15 (Exhibit I)
9.4 Public Hearing to consider the following budget adjustments to the 2015 budget:
Public Health/Environmental (#150 Fund), $80,000.00 supplemental appropriation for a
Department of Ecology grant and Belfair Sewer Fund (#413 Fund), $125,000.00 budget transfer
from Real Estate Excise Tax Fund 2 (REEf 2)

10. Other Business (Department Heads and Elected Officials) —
10.1 Jim Madson spoke about CASA program and said they also have volunteer opportunities. He
said he is working with Dr. Apostle regarding truancy boards and they will need volunteers
from the community.
10.2 Sheriff Salisbury said in a short period of time today, they had 25 vehicle accidents due to the
ice on the roads. He reminded everyone to drive safely and be advised that there is black ice.
The Sheriff also reminded the Board that they have fewer deputies in Mason County compared
to comparable counties. He also shared that Bill Adam will be leaving to go to work at the
State Attorney General's Office. Sheriff Salisbury added that he would like to thank Bill Kenny
for making the point about the pay issues. Additionally,The Sheriff commented upon the
remarks of Mr. Burke made at previous meetings regarding certain areas near Golden
Pheasant Road. The Sheriff stated that between October 17 and November 4, there were 18
arrests in that area so they are working on it. Sheriff Salisbury reminded everyone that
although they are trying to clean up areas within the county, the MCSO cannot disregard civil
rights and just start arresting everyone and everything must be done within the law.
10.3 News Release: Loretta Swanson read a news release regarding the Levee emergency repairs.
She thanked the Board for their quick response.
11. Board's Reports and Calendar -The Commissioners reported on meetings attended the past week
and announced their upcoming weekly meetings.
12. Adjournment—The meeting adjourned at 11:50 a.m.

LOAD/SPEED RESTRICTIONS AND
EMERGENCY CLOSING ORDERS FOR COUNTY ROADS
NOTICE IS HEREBY GIVEN that pursuant to the emergency provisions of RCW 36,75.270 and RCW
46.44.080,all Mason County roads are hereby immediately subject to closure for travel by all vehicles exceeding the
weight and/or speed limits as listed herein for the remainder of 2015 through the 2016 calendar year. (Note:The Board
may suspend or extend the closure on any County Road by independent action according to the prevailing conditions.)
THIS ORDER shall supersede for the period designated,any previous order in conflict herewith,
provided that this order shall not supersede or modify any restrictions now in force covering load limits on bridges
located upon county roads.
THE COUNTY ROADS posted with the following load restrictions are closed to all vehicles with a gross
weight(vehicles and load)which exceeds the following load limits for the size of tires as stated in WAC 468-38-080
and as set forth below:

IN ACCORDANCE WITH RCW 36.75.270 and RCW 46.44.080,these emergency restrictions may be

WIZEN IMPOSING LOAD RESTRICTIONS pursuant to this Resolution,the Mason County Public
Works Department shall specify and display by posted signs,whichever of the above schedules of load restrictions is
necessary to protect the county road from damage.
NO ALLOWANCE SI3ALL BE MADE for any second gear axle suspended from the frame of the vehicle
independent of the regular driving axle,otherwise known as"rigid trail"axles. Allowance will be made for single tires
only on the front of any truck. The load distribution on any axle of a vehicle shall be such that it will not load the tires
on said axles in excess of the prescribed load,as above set forth. Any loading in excess of the specified maximums as
listed herein will be considered a violation of this order. If the motive power for any type of trailer is inadequate to
safely handle the specified maximum load as listed herein.for such trailer,then in that event,the load on the trailer shall
be reduced sufficiently to allow said truck and trailer to operate with safety.
PERMITS ALLOWING TRANSPORTATION ALONG RESTRICTED ROADS. Permits may be issued
by the Mason Comity Public Works Department to allow the operation of trucks transporting perishable commodities
or commodities necessary for the health and welfare of local residents on such county roads;which may be closed or
restricted. Such permit may include weight and speed restrictions,plus other restrictions deemed necessary to protect
the roadway from undo damage. Vehicles with a gross weight of less than 10,5001bs(GVW)shall be permitted to
operate at full capacity under this resolution.(By general rule emergency vehicles do not need a special permit,but may
require weight and speed restrictions.School buses maybe required to run emergency bus routes with possible speed
restrictions).

VIOLATION-TRAFFIC INFRACTION. Any violation of these restrictions constitutes an infraction under the
provisions of RCW 46.44.105;RCW 46.44.080. Any person found to have violated any posted limitations COUNTY
of a.highway or section of highway shall be assessed a monetary penalty of not less than one hundred and fifty dollars.
CIVIL LIABILITY PENALTY. Violators are also subject to civil liability for dne damage caused by such
violations as provided under RCW 46.44.110 and RCW 46.44.120.
POSTING ROAD CLOSURES. The county engineer or road operations&maintenance supervisor in and
for said Mason County is delegated the authority in the absence of said Board of County Conunissioners,and with their
permission to close any and all county roads by publishing and posting notice in accordance with RCW 47.48.020;
provided,however,that in of emergency or conditions,the county engineer or road operations&maintenance
supervisor may,without permission or delay,close county roads temporarily to all vehicles or designated class of
vehicles or place other conditions or restrictions by posting notice at each end of the closed portion of road or roads.
Such restrictions shall be effective immediately upon posting
THE BOARD OF COUNTY COMMISSIONERS OF MASON COUNTY hereby resolves to place the
above described Load Restrictions and Emergency Closing Orders in effect immediately and the county road purpose
described herein is declared a public necessity and the county road engineer shall be and is hereby ordered and
authorized to proceed as prescribed by law.

RESOLITTION NO. -15
BRIDGE LIIIIITS
WHEREAS,RCW 36.75.270 gives the Board of Mason County Commissioners the authority by resolution
to limit or prohibit classes or types of vehicles on any county bridge and may limit the weight of vehicles which may
travel thereon. y
WIIEREAS,In compliance with the requirements of the Federal Highway Administration's National
Bridge Inspection Standards(NBIS)for specialized haul vehicle regulations,updated bridge load rating have been
completed as required;and
WHEREAS,load ratings have determined that two(2)of Mason County's sixty-four(64)bridges shall be
posted with a maximum load limits,and
WHEREAS,five(5)of Mason County's Sixty-four(64)bridges shall continue to be posted as one lane.
Additionally,one(1)bridge will continue to operate at one(1)lane with traffic lights for traffic control until
construction ofthe replacement bridge(currently underway)is completed,when it will return to two-way traffic in
two lanes.
NOW,THEREFORE,BE IT RESOLVED,that these restrictions be posted,as listed below,for the 2016
calendar year,unless the Board shall modify or remove such restrictions based upon the recommendation of the
County Engineer.

PAYMENT OF INTERFUND LOAN FROM ER&R TO CURRENT EXPENSE
WHEREAS,Resolution No. 80-14 was adopted.by the Mason County Commissioners
on December 23,2014 establishing an interfund loan from the Mason County Equipment Rental
&Revolving(ER&R)Fund to Current Expense in the amount of$348,672 to repay a vehicle
cash out;
WHEREAS,the Commissioners wish to modify the payment schedule to state payment
in full with accrued interest on June 1,2016 rather than three annual installments;
NOW THEREFORE BE IT RESOLVED,by the Mason County Board of
Commissioners to modify the payment schedule in Resolution 80-14 to state payment in full with
accrued interest on June 1,2016 rather than three annual installments.

POLICY
WHEREAS,each regular job title within the County is classified into one of the County's job
classifications for salary purposes.Each job classification is designated a particular salary or salary range
shown.on the County's salary range alignment,which is modified periodically by the Board of County
Commissioners,or as specified in the applicable union agreement
WHEREAS,no additions of staff(either part or full-time)or changes in salary and/or
classification are permitted without approval of the Board of County Commissioners. A reclassification

approval of the Human Resources Director,a promoted employee may be placed in a step higher than
that specified above.
If the Human Resources Director does not concur in a request for advanced step placement for a newly
hired or promoted employee,the Elected Official or Department Head may appeal that decision to the
Personnel Review Committee.The Personnel Review Committee is a three(3) member panel consisting
of a County Commissioner,an Elected Official and a Department Head.The Board of County
Commissioners appoints the members of the Personnel Review Committee.
.3 RECLASSIFICATION
A reclassification is a change in the allocation of a position from its current job classification to a
different job classification as a result of changed duties, responsibilities, and/or authority of a
position. Reclassification will be considered when an employee has been permanently assigned
to perform the primary functions of a different job classification or has been permanently
assigned significantly different duties which may warrant establishing a new job classification.
An employee may request reclassification by submitting a written request,which includes a
justification, to their Elected Official or Department Head. The Elected Official or Department
Head shall respond to the employee in writing within thirty (30) working days.
An Elected Official/Department Head may request reclassification of a position by submitting a
written request with justification and a revised Job Description to the Human Resources.
Human Resources shall respond to the request in writing within thirty(30)working days of
receipt of the request.
If approved or denied by Human Resources,the request may then be submitted to the Board of
County Commissioners, with written justification from the Elected Official/Department Head
for their review. The Board of County Commissioners shall respond to the request in writing
within thirty (30)working days of their receipt of the request. If approved by the Board,the
reclassification shall be effective as of the date of Board's action or either effective date as may
be set by the Board in such action. If the Board denies the request,the matter is closed.
Step placement of an employee who has been reclassified shall be the same as if the employee
had been promoted,transferred, or demoted, whichever is applicable.
5.4 PAYDAYS
County employees are paid semi-monthly on the 10th and 25th of each month and the payroll will be a
direct deposit into the bank of the employee's choice. If a regularly scheduled payday falls on Saturday
or Sunday, payroll will be a direct deposit on Friday. If a regularly scheduled payday falls on a holiday,
payroll will be a direct deposit on the last regular work day prior to the holiday.

NOW,THEREFORE BE IT RESOLVED that the Board of County Commissioners does hereby revise
the Non-Represented Salary Scale Range Alignment establishing a Salary Range 46, create a Community
Services Department and place the Community Services Director at Salary Range 46.

3.92%® INCREASE FOR ELECTED OFFICIALS AND NON-REPRESENTED EMPLOYEES
WHEREAS, RCW 36.40,080 states that the Board of County Commissioners shall fix and
determine each item of the budget separately and shall by resolution adopt the budget; and
WHEREAS, RCW 36.16.070 states that the Board shall fix the compensation of all employees;
and
WHEREAS, the Board has determined that the County's salaries for Elected Officials and
eligible Non-Represented employees should be adjusted; and
NOW THEREFORE BE IT RESOLVED, the Board has determined that a 3.92% increase for all
Elected Officials (whose compensation is under the purview of the Board) and Non-
Represented is to maintain parity with the recommended increases proposed for the members
of the current Collective Bargaining Agreements within the County and to acknowledge that
Mason County has demonstrated recruit and retain issues regarding employment, and is
significantly out of line with comparable jurisdictions and that employees have not received a
general wage increase for several years; and
WHEREAS, consistent with Board Resolution No. 67-13, the modification and amendment to
limiting the salary of certain Elected Officials to a percentage of that which is paid to the County
Commissioner(s) will continue as necessary to accomplish the afore-mentioned salary
increases;and
WHEREAS, consistent with the modification and amendment of Board Resolution No. 67-13,
which limited the changes in salary without specific approval of the Board will continue to allow
step increases for Non-Represented employees, consistent with policy; and
NOW THEREFORE BE IT RESOLVED, effective January 1, 2016, the Board of County
Commissioners does hereby amend the Non-Represented Salary Range Table by 3.92% to be
equitable and consistent with the majority of those employees under collective bargaining
agreements.

ORDINANCE amending the Belfair Urban Growth Area Zoning Map adopted by the Mason
County Board of County Commissioners under the authority of RCW 36.7oA.
WHEREAS,the Washington State.Growth Management Act(RCW 36.7oA)requires each
site specific rezone amending the Belfair Urban Growth Area Zoning map be adopted by
Ordinance;and
WHEREAS, Seattle Inceptive Group LLC, hereinafter referred to as"Applicant",owner of
real property in Mason County has requested an amendment to the Belfair Urban Growth
Area Zoning Map as it affects their property; and
WHEREAS,Applicant's requesteo rezone includes parcel 12320-41-00010 which is 9.78
acres in size and parcel 12320-44-00020 which is 2.15 acres in size,for a total of 11.93 acres
to be rezoned from R-4.(Low Density Residential)to Mixed Use; and
WHEREAS, Applicant has proposed.a Development Agreement under the authority of RCW
36.70B in addition to the rezone request restricting the allowed uses in the approved Mixed
Use zone to Marijuana Production(pursuant MCC§17.17.006), Marijuana Processing
(pursuant MCC 517.17.007),and Detached dwelling per lot(one)pursuant MCC
§17.23.1300-9)only;and
WHEREAS, Section 3.7.05.080 of the Mason County Code provides criteria for consideration
in rezoning parcels from an existing land use zone to another zone,and is reviewed through
a public process in front of the Mason County Planning.Advisory Commission and the Board
of County Commissioners;and
WHEREAS, on November 30, 2015 Mason County Department of Community Development
Staff presented to the Planning Advisory Commission at a public hearing a staff report
recommending approval of the requested rezone, based on meeting the rezone criteria only
upon the condition that a Development Agreement be adopted herewith; and
WHEREAS,.said Development Agreement shall remain in effect until such time as the use
of the subject parcels discontinues from Marijuana Production and/or Marijuana Processing
and at such time the parcels will revertto their original zoning of R-4(Low Density
Residential), or such other district as the Board of County Commissioners deems
appropriate; and
WHEREAS at the November o 201 public hearing, Mason Count Planning Advisor

Commission considered the amendments,together with the Staffs Report and Applicant's
proposal for a Development Agreement and passed a motion to recommend approval of
the request with the Development Agreement;and
WHEREAS, on December 22, 2o:.5 the Board of County Commissioners considered the
Applicants request; and
WHEREAS,the Board of County Commissioners took public testimony from interested
parties, considered all the written and oral arguments and testimony, and considered all the
comments presented;and
WHEREAS,the Board of County Commissioners also considered the Staff Report and
recommendations of the Mason County Planning Advisory Commission; and
WHEREAS,the Board of County Commissioners finds that the proposed amendments to
the Belfair Urban Growth Area.Zoning Map comply with all applicable requirements of the
Growth Management Act and the Mason County Code,and that they are in the best public
interest; and
WHEREAS,the Board of County Commissioners conditions the rezone limiting the allowed
land uses through the adoption of a Development Agreement to be recorded by the
Applicant on the title of both parcels.
BE IT HEREBY ORDAINED,the Mason County Board of Commissioners hereby approves
and ADOPTS the attached Findings of Fact(ATTACHMENT A),the revisions to the Belfair
Urban Growth Area Zoning Map (ATTACHMENT B)and Development Agreement
(ATTACHMENT C)as submitted and described herein.

FINDINGS OF FACT
OPTION OF AMENDMENTS BELFAIR URBAN GROWTH
AREA ZONING MAP
1. Applicant has made application to Mason County for its consideration of amendments
to the Belfair Urban Growth Area Zoning Map.
2. Applicant is requesting an amendment rezoning parcel 12.320-41-0003.0(9.78 acres)and
parcel 12320-44-00020(2.15)for a total of 31.93 acres from R-4(Single Family or Low
Density Residential)to Mixed Use.
3. Mason County Development Regulations,Title 27, Section 17.05.o8o provides criteria
and characteristics for consideration in rezoning parcels from an existing land use zone to
another zone. A rezone request is reviewed through a public process in front of the Mason
County Planning Advisory Commission and the Board of County Commissioners.
4. A Development Agreement between the County and the Applicant will condition the
rezone to limit the land uses allowed to Marijuana Production(pursuant MCC§27.:LToo6),
Marijuana Processing (pursuant MCC§17.27.007), and Detached dwelling per lot(one)
.pursuant MCC§27.23.130(sg))only.
5. Based upon the evaluation of the Rezone Criteria together with Applicant's proposal for
conditioning the rezone through a Development Agreement, Staff would make the
following findings:
Criterions: Development allowed by the proposed rezone designation shall not damage
public health, safety and welfare is met as the current use would remain unchanged as a
legal nonconforming plant nursery. Due to the nature of the continued use, public access
is restricted and public safety increased by state regulations.
Criterion 2: The zone designation shall be consistent with the Mason County
comprehensive plan, development regulations, and other county ordinances, and with the
Growth Management Act; and that designation shall match the characteristics of the area
to be rezoned better than any other zone designation is met in that the current use will
continue under a the new zoning designation. The mixed use district permits the
production and processing of marijuana,which is the property's current legal non-
conforming use, as well as residential similar to surrounding current zoning.
Criterion 3: No rezone shall be approved if, either by itself or together with other
rezoning and/or development, whether actual or potential,the cumulative impacts of
such zoning would be to materially increase sprawling, low-density rural development,
or to significantly increase uses incompatible with resource-based uses in the vicinity is
met as the current use would not change.
Criterion 4: No rezone to more intensive land use shall be approved if, either by itself
or together with other rezoning and/or development,whether actual or potential,the
cumulative impacts of such zoning would be to materially increase demand for urban
services in rural areas, including, but not limited to,streets, parking, utilities,fire
protection, police and schools is met as the current use would not change.
Criterion ,: No rezone to more intensive land use shall be approved if, either by itself or
together with other rezoning and/or development, whether actual or potential,the
cumulative impacts of such zoning would be to materially interfere with the Growth
Management Act goal to encourage development in urban areas where adequate public
services and facilities exist or can be provided in an efficient manner is met at the
current use does not demand increased urban services and the expansion of that use
under a mixed use would not increase that demand.
Criterion 6: No rezone to more intensive land use shall be approved if, either by itself
or together with other rezoning and/or development,whether actual or potential,the
cumulative impacts of such zoning would be to materially interfere with the Growth
Management Act goal to encourage retention of open space,to conserve fish and
wildlife habitat,and generally to protect the environment, including air and water
quality is met as the current use will remain under the new zoning district and no
development will occur beyond the Development Agreement.
Criterion 7: No rezone to more intensive land use shall be approved if, either by itself
or together with other rezoning and/or development,whether actual or potential,the
cumulative impacts of such zoning would be to create pressure to change land use
designations of other lands or to increase population growth in rural areas as projected
in the Mason County comprehensive plan is met as the property and current use is
unique and unlikely to cause similar land use changes or a population increase in the
rural zones.
Criterion 8: These criteria shall not be construed to prevent corrective rezoning of land
necessitated by clerical error or similar error of typography or topography committed in
the original zoning of such land.This is not applicable to this request. Although there is
some indication that Applicant believes the property have may be mis-zoned
considered the current and past uses of the property,there is no tangible and historical

ORDINANCE amending the Mason County Comprehensive Plan,ChapterX1, Shelton Urban
Growth Area Plan, Figure 1, Future Land Use Map expanding the boundaryto include the
eastern portion of the Port Of Shelton's Oakland Bay Marina under the authority of RCW
36,7oA.80.
WHEREAS,the Washington State Growth Management Act(RCW 36.7oA.130)requires
each county, including Mason County,to take legislative action to review and revise its
comprehensive plan and development regulations to ensure that the plan and regulations
continue to comply with the requirements of the Act;and
WHEREAS,the County needs to address certain requests for comprehensive plan and
zoning changes to meet the goals and requirements of Chapter36.7oA RCW(Growth
Management Act);and
WHEREAS,the Port of Shelton, hereinafter referred to as"Applicant", owner of real
property in Mason County has requested an amendment to the Future Land Use leap of the
Shelton Urban Growth Area Plan, Chapter XI of the Mason County Comprehensive Plan as it
affects their property;and
WHEREAS,the Applicant's request is specifically to expand a portion of the Shelton Urban
Growth Area boundary to encapsulate the eastern portion of the Port's Oakland Bay
Marina;and
WHEREAS,the boundary,as adopted,runs concurrent with the City of Shelton at the
Oakland Bay Marina(Parcels:320215100001, 320213260570,3202oS770001, 3202o5706006,
and 3202o576o018)and bisects portions of it dock and boathouses resulting in multi-
jurisdictional regulation of a several parcels under a single ownership; and
WHEREAS,on September 28, 201S,the Mason County Planning Advisory Commission held
a public hearing to consider the amendments and passed, by a majority vote, a motion to
recommend approval of said changes; and
WHEREAS, on December 22, 2012 the Board of County Commissioners("Commissioners")
considered the Applicant's request took public testimony from interested parties,
considered all the written and oral arguments and testimony,and considered all the
comments presented; and
WHEREAS,the Board of County Commissioners also considered the Staff Report and
recommendations of the Mason County Planning Advisory Commission;and
WHEREAS,the Board of County Commissioners finds that the proposed amendment to the
Mason County Comprehensive Plan, Chapter XI,Shelton Urban Growth Area Plan, Figure 1,

$125,000 budget transfer from Real Estate Excise Tax Fund 2 (REET 2 - #351 Fund) to
Belfair Sewer Fund (#413 Fund)
WHEREAS, a notice was published and a public hearing was held in accordance with RCW
36.40.100 and RCW 36.40.195 and with Resolution No. 55-15. (see Attachment B which is
incorporated as part of this order).
THE BOARD OF COUNTY COMMISSIONERS OF MASON COUNTY, hereby approves the
following supplemental appropriation/budget transfer: Public Health/Environmental (#150
Fund),$ 80,000 grant; Belfair Sewer Fund (#413 Fund) $125,000 budget transfer.
BE IT FURTHER RESOLVED that this Supplemental Appropriation and Budget Transfer will
be expended and recorded in the 2015 budget as listed in Attachment A which is also
incorporated as part of this order.
PASSED in open session this 22nd day of December, 2015.

BUDGET TRANSFER/SUPPLEMENTAL APPROPRIATION -NOTICE OF HEARING
WHEREAS, by reason of conditions which could not be reasonably foreseen at the time of making the budget
for the year 2015, it is necessary to make provision for a Budget Transfer/Supplemental Appropriation to the budget
as required by RCW 36.40.100,and RCW 36.40.195 for the following:
Public Health/Environmental(#150 Fund)

Courthouse Building I,411 North Fifth Street,Shelton, Washington,is hereby fixed as the time and place for a
public hearing upon the matter of Budget Transfer/Supplemental Appropriation to the 2015 Budget for Public
Health—$80,000 and Belfair Sewer Fund-$125,000,
The Clerk of the Board is hereby authorized,empowered,and directed to cause notice of such
hearing to be published as provided by law.

Cmmr. Jeffreys/Sheldon moved and seconded to approve item 9.4 approving the
following budget adjustments to the 2015 budget:
Public Health/Environmental (#150 Fund), $80,000.00 supplemental appropriation for a
Department of Ecology grant and Belfair Sewer Fund (#413 Fund), $125,000.00 budget
transfer from Real Estate Excise Tax Fund 2 (REET 2). Motion carried. N-aye; S-aye; J-

10. Other Business (Department Heads and Elected Officials)—
10.1 Jim Madson spoke about CASA program and said they also have volunteer opportunities. He
said he is working with Dr. Apostle regarding truancy boards and they will need volunteers
from the community.
10.2 Sheriff Salisbury said in a short period of time today, they had 25 vehicle accidents due to the
ice on the roads. He reminded everyone to drive safely and be advised that there is black ice.
The Sheriff also reminded the Board that they have fewer deputies in Mason County compared
to comparable counties. He also shared that Bill Adam will be leaving to go to work at the
State Attorney General's Office. Sheriff Salisbury added that he would like to thank Bill Kenny
for making the point about the pay issues. Additionally, The Sheriff commented upon the
remarks of Mr. Burke made at previous meetings regarding certain areas near Golden
Pheasant Road. The Sheriff stated that between October 17 and November 4, there were 18
arrests in that area so they are working on it. Sheriff Salisbury reminded everyone that
although they are trying to clean up areas within the county, the MCSO cannot disregard civil
rights and just start arresting everyone and everything must be done within the law.
10.3 News Release: Loretta Swanson read a news release regarding the Levee emergency repairs.
She thanked the Board for their quick response.
11. Board's Reports and Calendar -The Commissioners reported on meetings attended the past week
and announced their upcoming weekly meetings.
12. Adjournment-The meeting adjourned at 11:50 a.m.
