Call to Order—The Chairperson called the regular meeting to order at 9:03 a.m. 2. Pledge of Allegiance —Sharon Fogo led the flag salute. 3. Roll Call — Present: Commissioner District 1 - Randy Neatherlin; Commissioner District 2— Kevin Shutty; Commissioner District 3 —Terri Jeffreys. 4. Correspondence and Organizational Business 4.1 Correspondence 4.1.1 Meegan Danby sent letters about a review of her 2017 property taxes. 4.1.2 Liquor and Cannabis Board sent liquor licenses for Harmony Hill of Union located at 7362 E. State Route 106 Union, WA 98592. 4.1.3 Governor Jay Inslee sent a letter about Health Care Authority's Proposed Model for Full Behavioral Health Integration. 4.1.4 Vera &Associates sent letter of concern regarding the Pigeon Guillemot Habitat and of Possible Harm to that Habitat. 5. Open Forum for Citizen Input— None 6. Adoption of Agenda - Cmmr. Jeffreys/Neatherl in moved and seconded to adopt the agenda as published. Motion carried unanimously. N-aye; S-aye; J-aye. 7. Approval of Minutes—April 3, 2017 Briefing Minutes; March 28, 2017 &April 4, 2017 Regular Meeting Minutes. Cmmr. N eatherl in/Jeffreys moved and seconded to approve the minutes as written. Approval of Action Agenda: 8.1 Approval to have the Chair sign the amendment to agreement #W2RCLCP-1517-MaCoSo- 00038 with the Department of Ecology. This amendment is in the amount of$32,110 and will be used to facilitate an additional crew in the Litter Program. 8.2 Approval of Veterans Assistance Fund applications for: Utilities $528.83 and Housing $1,883.24 for a total of$2,412.07. 8.3 Approval of the"Notification of Final Cost"of County Road Construction projects completed in 2016 by county forces. 8.4 Approval of the Interlocal Agreement with North Mason School District authorizing services provided by the Public Works Department for vehicle, road or site maintenance, engineering, survey, GIS, emergency assistance, sign fabrication, fueling and materials supply. 8.5 Approval to authorize Public Works to select and hire HDR, a consultant from the County MRSC Consultant Roster, to complete the design and specifications for improvements at Eells Hill Transfer Station. 8.6 Approval to have Equipment Rental & Revolving (ER&R) declare a vehicle, office equipment, and miscellaneous shop parts surplus and dispose of at the Washington State Surplus sales. 8.7 Approval of the resolution to amend resolution 48-14 and Title 2, Chapter 2.46 of the Mason County, Washington, Code of Ordinances. This resolution designates the Support Services Director and the Emergency&Information Services Manager as Mason County's Americans with Disabilities Act coordinators for any internal or external complaints or grievances. (Ex.A- Res 20-17) BOARD OF MASON COUNTY COMMISSIONERS' PROCEEDINGS April 11, 2017 - PAGE 2 8.8 Approval of a resolution selecting The Mason County Journal as the official county newspaper for publishing certain legal publications. (Ex. B- Res 18-17) 8.9 Approval of the resolution to amend the Mason County Personnel Policy Chapter 13, to include assignment of County vehicles for take-home and operational considerations. (Ex.C Res. 19-17) 8.10 Approval to execute the Professional Services contract with Kristen Bishopp and Tirsa Butler to provide At Risk Youth and Child in Need of Services representation and to authorize Frank Pinter, Support Services Director to sign on behalf of the County. 8.11 Approval to extend the current contract with Kristen Bishopp for Public Defense representation and approval to authorize Frank Pinter to sign on behalf of the County. 8.12 Approval of the contract amendment with Blue Collar Agency authorizing an additional $4,600.00 in Lodging Tax funding to attend a festival in Seattle for tourism promotion. 8.13 Approval of the resolution for the distribution of the additional Public Utility District Excise Tax that was received from the Department of Revenue in the amount of$8,784.07. (Ex. D- Res 15-17) 8.14 Approval to enter into a contract with Mason General for Hepatitis B vaccines and respirator FIT medical reviews, testing and supplies and approval to have the Chair sign the contract. Cmmr. Jeffreys questioned item 8.1 asking if the agreement was originally meant to purchase a vehicle Theresia Ehrich from the Sheriff's office said that funds are meant for a second crew and advised that the funds are only good through June of this year so they need to move quickly. Cmmr. Jeffreys/Neatherlin moved and seconded to approve action items 8.1 through 8.14. Motion carried unanimously. N-aye; S-aye;J-aye. 9. Other Business (Department Heads and Elected Officials) - Sharon Fogo thanked the Commissioners for the ability to use REST funds to move the Clerk's office. She praised the maintenance and IT departments for the quick move. Cmmr. Shutty asked Sharon to discuss the upcoming program change. She said they will be changing over to the Odyssey program and discussed the ways it will help the Clerk's office. Chief Hanson discussed the jail overcrowding noting that it is still an issue. Cmmr. Neatherlin said he would like to have a briefing regarding the numbers. Chief Hanson agreed and noted that besides the 94 inmates, there are 18 in the alternative sentencing program. Cmmr. Shutty said the County needs to discuss long term options to fix the overcrowding issues. Cmmr. Jeffreys announced a meeting on Friday, April 14th to discuss possible diversion of those with behavioral health issues, which could help decrease the population. Jeff Vrabel updated the announcement for sealed bids on the Sandhill renovation. The date has been extended to May 4, 2017 at 4:00 p.m. 10. 9:30 a.m. Public Hearings and Items set for a certain time— 10.1 Public Hearing to consider the sale of real property located at 150 E. Panorama Drive, Shelton. Parcel #32021-56-01012. Staff: Frank Pinter (Ex. E- Res 16-17) Frank Pinter said the current offer is $4,000 and that he is seeking approval to move forward with the sale. Cmmr. Shutty opend the hearing for public comment. No comment. Cmmr Jeffreys/Neatherl in moved and seconded to approve the sale of real property located at 150 E. Panorama Drive, Shelton. A RESOLUTION NO. �-Q ._ Mason County's Americans with Disabilities Act Coordinators Amends Resolution 49-14 and Title 2 Chapter 2.46 of the Mason County, Washington, Code of Ordinances WHEREAS, the Americans with Disabilities Act was signed into law on July 26, 1990 and; WHEREAS, Mason County adopted Resolution 49-14 acknowledging compliance with the law and designating the Support Services Director and Emergency & Information Services Manager as ADA Coordinator contact persons for any internal or external complaints or grievances. Mason County, Washington, Code of Ordinances designated the Support Services Director and Emergency and Information Services Manager to be the designated contact and investigate complaints and grievances. NOW, THEREFORE, BE IT RESOLVED that the Board of Mason County Commissioners herby designates the Support Services Director and Emergency and Information Services Manager as Mason County's ADA Coordinators for any internal or external complaints or grievances and authorizes posting of the expanded Notice under the Americans with Disabilities Act. BE IT FURTHER RESOLVED that the ADA Coordinators shall post Mason County's ADA Grievance Procedure (Exhibit A) and Notice of Nondiscrimination (Exhibit B) in all County buildings. The Support Services Director and Emergency& Information Services Manager shall be designated as ADA contact persons for any internal or external complaints or grievances and will provide proper notice of this complaint procedure to the community and on official county bulletin boards and will provide complaint/grievance forms (See Attachment A and Attachment B attached to the resolution codified in this chapter and on file in the office of the county clerk of the board) in all county facilities where there is public access. (Res. XX-XX(part), 2017). 2.46.020 Contact persons—To review and investigate complaints. The Support Services Director or the Emergency& Information Services Manager will review, investigate and otherwise dispose of such complaints in a manner that meets the good of the service and will provide a quarterly report of any ADA concern to the board of county commissioners. (Res. XX-XX(part), 2017). EXHIBIT A co ADA GRIEVANCE PROCEDURE 1854 Mason County has adopted an internal grievance procedure providing for prompt equitable resolution of complaints alleging any action prohibited by the U.S. Department of Justice regulations implementing Title II of the Americans with Disabilities Act. Title II states,in part,that"no otherwise qualified disabled individual shall,solely by reason of such disability,be excluded from the participation in,be denied the benefits of,or be subjected to discrimination'in programs or activities sponsored by a public entity. Complaints should be addressed to: Mason County ADA Coordinator 411 North 5th Street Shelton,Washington,98584 (360)427-9670 1. A complaint should be filled in writing and contain information about the alleged violation such as the name,address,phone number of complainant and the location,date and description of the violation. Alternative means of filing complaints,such as a personal interview,will be made available for persons with disabilities upon request. 2. A complaint should be filed as soon as possible,but no later than thirty (30) calendar days after the alleged violation. 3. An investigation,as may be appropriate,shall follow the filing of a complaint within fifteen(15) calendar days. The investigation shall be conducted by Mason County's ADA Coordinator. These rules contemplate informal but thorough investigations,affording all interested persons and their representatives,if any,an opportunity to submit evidence relevant to a complaint. 4. A written determination as to the validity of the complaint and description of the resolution,if any,shall be issued by the ADA Coordinator,and copy forwarded to the complainant no later than fifteen(15)calendar days after the investigation. 5. If the response of the ADA Coordinator does not satisfactorily resolve the issue,the complainant may appeal the decision within fifteen(15)calendar days after the receipt of the response to the Board of County Commissioners. A final decision will be made by the Board of County Commissioners within thirty(30) calendar days. 6. The ADA Coordinator shall maintain the files and records relating to complaints. Mason County shall retain these records for at least three years. 7. The right of a person to a prompt and equitable resolution of the complaint filed hereunder shall not be impaired by the person's pursuit of other remedies such as filing of an ADA complaint with the responsible federal department or agency. Use of this grievance procedure is not a prerequisite to the pursuit of other remedies. 8. These rules shall be construed to protect the substantive rights of interested persons to meet appropriate due process standards,and to assure the Mason County complies with the ADA and implementing regulations. AMENDING THE MASON COUNTY VEHICLE USE POLICY, CHAPTER 13 TO INCLUDE ASSIGNMENT OF COUNTY VEHICLES FOR TAKE-HOME & OPERATIONAL CONSIDERATIONS AND RESOLUTION 102-16 WHEREAS, it is the responsibility of the Mason County Board of County Commissioners to ensure proper use of public funds concerning the County practice of allowing employees to commute to and from work in County-owned or leased vehicles; WHEREAS, the Board of County Commissioners is to assure all County- owned or leased vehicles are used responsibly and centralized controls are in place to report taxable benefits if applicable; and WHEREAS, the Board of County Commissioners wish to restrict the number of county-owned or leased vehicles used by employees to commute to and from work. DISTRIBUTION OF PUD EXCISE TAX WHEREAS, the annual distribution of the PUD Privilege Tax was approved on July 5, 2016 pursuant to RCW 54.28.090; WHEREAS, additional PUD Privilege Tax funds have been distributed by the Washington State Treasurer in the amount of$8,734.05 due to a reporting error for years 2015 and 2016; NOW, THEREFORE BE IT HEREBY RESOLVED by the Board of Mason County Commissioners to distribute this additional amount to the Mason County Current Expense Fund. APPROVAL OF SALE OF SURPLUS PROPERTY WHEREAS, Mason County owns the real property parcel #32021-56-01012, 150 E Panorama Drive, Shelton, WA 9858, that was declared surplus by Resolution No. 18-13 at a public hearing on April 9, 2013; and WHEREAS, the Board of County Commissioners, upon the recommendation of the Property Manager, has determined that the property is surplus to the needs of the County; and WHEREAS, Mason County has received an offer to purchase the property in the amount of $4,000 from Timothy James and Heather Diane Burdick and a public hearing was held on April 11, 2017 to consider the offer; NOW, THEREFORE, BE IT FURTHER RESOLVED by the Mason County Board of County Commissioners that the property described above (parcel #32021-56-01012) is approved at the price of $4,000 to Timothy James and Heather Diane Burdick; and BE IT FURTHER RESOLVED, that the proceeds of the sale of said property are to be dedicated first to any delinquent property tax obligations and related penalties, expenses and assessments; and next to reimbursement of the Property Management expenses; and finally to the Current Expense Fund; and BE IT FURTHER RESOLVED, that Commission Neatherlin is authorized to sign the related closing documents and the Property Manager initiate payment of 6% fee of sale price to the County's real estate agent.
