The County has approved a geo-technical report prepared by Geotechnical Testing Laboratory and a stormwater and erosion control plan by Michael F. Wnek, P.E. PS. The conditions and specifications of these documents are the conditions of this determination. An Environmental Impact Statement (EIS) is not required under RCW 43.21 C.030(2)(c). This decision was made after review of a completed Environmental Checklist and other information on file with the Lead Agency. This information is available to the public upon request. There is no SEPA administrative appeal. s 5� Authorized Local Government Official Date MITIGATED DETERMINATION OF NONSIGNIFICANCE (WAC 197-11-350) SEP2005-00108 CONDITIONS OF THIS DETERMINATION 1) Stormwater and Erosion Control All clearing on this site shall be in accordance with a Drainage Report written by Michael Wnek P.E., P.S. dated 8/12/05. This document was approved by Mason County Public Works on 11/9/05. Escape of silty water or mud from the timber harvest area shall be considered a violation of County and State stormwater management regulations, and could subject the applicant(s) to civil fines or penalties. X 2) LANDSLIDE HAZARD Steep slopes on this property were studied by the Geotechnical Testing Laboratory and a geo-technical report was published in September 2005. All cutting shall be in accordance with this document. The report is available for public review during business hours at the Mason County Planning Department. The Department of Ecology(Ecology)reviewed the environmental checklist and has the following comment(s): WATER QUALITY:Roberta Woods(360)407-6269 During construction,all releases of oils,hydraulic fluids,fuels,other petroleum products, paints, solvents,and other deleterious materials must be contained and removed in a manner that will prevent their discharge to waters and soils of the state. The cleanup of spills should take precedence over other work on the site. The SEPA checklist indicated the applicant will apply for coverage under a Construction Stormwater National Pollution Discharge Elimination System(NPDES)permit.The permit application form,called a Notice of Intent(NOI), is available on Ecology's website at: http://www.ecy.wa.goy/programs/wq/stonnwater/construction/#Application. To avoid project delays,we encourage the applicant to submit completed forms and to publish public notices more than 60 days before the planned start of the project. WATER RESOURCES:Vicki Cline(360)407-0278 The proposed withdrawal from two wells is considered a single withdrawal and therefore is limited to 5,000 gallons per day combined for domestic uses per Chapter 90.44 RCW. Any ground water withdrawals in excess of 5,000 gallons per day or for the irrigation of more than one-half acre of lawn or noncommercial garden,requires a water right permit from Ecology. All water wells shall be constructed in accordance with the provisions of Chapter 173-160 WAC by a driller licensed in the State of Washington. Well reports must be submitted to Ecology within 30 days after completion of a well. All water wells that may be drilled must be a minimum of 100 feet from any known, suspected, or potential source of contamination.
