Dear Jack,
Under Mason County Code Chapter 13.38 NORTH BAY CASE-INLET SANITARY SEWER UTILITY
ADMINISTRATIVE CODE,the Director of Community Development Is responsible for the construction,
maintenance and operation of the North Bay sewer facilities. While this code is grossly out of date
and the operation of County utilities has long since been transferred to the Department of Public
Works,the language has nonetheless remained unchanged. Therefore, in my capacity as the
administrative Director,you requested that I review the sewer connection fees paid in association
with the above-referenced parcel to determine their compliance.
Resolution 145-99, dated December 14, 1999, established the sewer rates for the North Bay/Case
Inlet Sanitary Sewer System. According to that Resolution,the connection fees for a residential
single family dwelling was$1,800 for a gravity connection and $1,600 for a grinder pump
connection.
A notarized statement signed by Richard Knight, previous property owner, indicates that at the
time the property was sold to you the connections fees had been paid. Mr. Knight's statement does
not contain a date or an amount of those fees and no records of the payment have been located as
of this date. It has been suggested that the payment was$1,800; however the grinder pump
connection fee at that time was$1,600 which is more likely the amount of fees actually paid.
On March 12, 2002, Gary Yando, Director of Utilities and Waste Management, described in
correspondence to Mr. Knight that the Department was aware of the grinder pump and further
established a billing schedule. This schedule included three vacant parcels,with at least one
intended for residential use. There was no request for any payment of a connection fee.
Considering this information,together with the materials provided by the Department of Public
Works and past Resolutions adopted by the Board of County Commissioners, it is in my opinion
that the sewer connection fee has been paid for the subject parcel.
This is a final determination in response to your request.Any appeal of this determination is subject
to the procedure described in Section 15.11 of the Mason County Code.
