WASHINGTON 98124 S JUN 13 Regulatory Functions Branch Mr. Earnest Ayers East 1021 Benson Loop Shelton, Washington 98584 Dear Mr. Ayers: Reference your application dated May 19, 1983, concerning the proposed fill in Hammersly Inlet, Puget Sound near Shelton, Mason County, Washington. The work is required for upland bank protection. Paragraph 330.5(a)(13) of Department of the Army regulations dated July 22, 1982, authorized bank stabilization activities in waters of the United States provided (1) the bank stabilization activity is less than 500 feet in length, (2) the activity is nec- essary for erosion prevention, (3) the activity is limited to less than an average of 1 cubic yard per running foot placed along the bank within waters of the United States, (4) no material is placed in excess of the minimum needed for erosion protection, (5) no material is placed in any wetland area, (6) no material is placed In any location or in any manner, so as to impair surface water flow into or out of any wetland area, (7) only clean material free of waste metal products, organic materials, unsightly debris, etc. , is used, and (8) the activity is a single and complete project. Based on the information you have provided, the proposed work consists of constructing a bulkhead and stairway consisting of 52 cubic yards of concrete and placing 265 cubic yards of backfill along 360 lineal feet of waterfront property and will not involve the filling of wetlands. The work is authorized by nationwide per- mit provided the above criteria and enclosed conditions can be met. If you can comply with these conditions, an individual Department of the A nmy permit will not be required.
