Permanent boundary markers shall be visible from one to the next, such that the entire perimeter of the site could be reestablished using the Global Positioning System, if the boundary markers were destroyed. All permit area posts shall be maintained for the duration of this reclamation permit. 5. The permitted depth at this site is 60 vertical feet from the original pre-mining topographic ground surface. No excavation shall occur below an elevation of 40-feet mean sea level. If additional mining depth is anticipated the reclamation plan must be revised prior to exceeding the permitted depth. r ' r Exhibit A,70-012367 2 of 2 6. The 30-foot setback shall be marked with posts and maintained interior to the permit area as detailed on reclamation map Figure 1. Additionally, a 100-foot setback shall be maintained as a buffer for the type-4 stream as detailed on Figure 1. 7. A revised reclamation plan shall be required, including a hydrogeologic evaluation of the permit area vicinity if, in the opinion of the Department, groundwater flow into the permit area constitutes wet mining as the project progresses. 8. All remaining topsoil and subsoil shall be excavated, stockpiled and maintained on site for use in final reclamation. Stockpiles shall be seeded with grasses during storage to prevent erosion unless immediately placed on an adjacent reclamation segment. Topsoil shall not be removed or sold as a product from the permit area. Soil shall be replaced to a minimum depth of 0.5-feet on the slopes and pit floors subsequent to ripping over-compacted native material. 9. If importation of soil or any other off site material intended for use in reclamation is proposed, the source and volume must be identified and written approval must be obtained from the Department's region surface mining inspector prior to importation. 10. Slope construction shall be accomplished using the cut and fill method to reclaim unconsolidated slopes. A reclamation setback equal to or greater than the depth of mining, or current excavated lift, shall be required interior to any permanent buffer. Reclamation setbacks shall be located and marked with easily visible posts or other marker as mining approaches the setback and shall be maintained until slope creation is complete. 11. Reclaimed slopes shall, at minimum, vary between 2 and 3-feet horizontal to 1-foot vertical unless required to blend adjacent or existing slopes. Reclaimed slope faces shall not be straight or planar and shall incorporate a break in slope ratio, or other best management practice, to dissipate runoff energy. Slope faces shall be sinuous and variable and right angles and shall be eliminated. All reclaimed slopes must remain stable upon completion of reclamation. 12. The total area disturbed, at any one time, is to be minimized by progressive reclamation and slope construction. Reclamation activities shall, to the extent feasible, be conducted simultaneously with the surface mining. 13. Revegetation shall be completed as detailed in Form SM-8A. Revegetation shall be initiated immediately after completion of topsoil spreading and grading. Noxious weeds shall not be considered acceptable vegetation and natural revegetation only shall not be deemed satisfactory. Prior to any variation from the revegetation plan, written approval must be obtained from the Department. 14. The permit holder or operator shall maintain a complete copy of this permit, including these conditions and the approved reclamation plan with additions and amendments, at the mine site during mining and reclamation activities. Supplemental Text FEB 2 0 2003 Peninsula Topsoils, L.L.C. `-7e010 Application for Reclamation Permit 9Y and tartr� #70-012367 Introduction The following report is presented to support a revision to an existing reclamation permit issued to Scarsella Brothers, Inc. The mine is being purchased by Peninsula Topsoils,LLC. When the new owners are satisfied that the reclamation of depleted segments by the previous operators complies with the Department of Natural Resources requirements and sale of the property has been finalized, the final transfer of permit will take place. Ms. Carol Serdar, Reclamation Specialist with DNR's Central Region, has outlined the required standards for this phase of reclamation, although the subsequent use is been altered and approved by Mason County as Residential R-20. The site is located about 1 mile north of Beifair in Section 20, T23N, R01W. (See Drawing 1- Site Plan and Drawing 2 - Site Access Map.) This reclamation plan covers a 60-acre permitted gravel pit, of which 7 acres have been disturbed to date. Several previous operators have mined the site since February of 1984 (?). Most recently, Scarsella Brothers Inc. operated the pit until 1995, when they last submitted an Annual Surface Mine Report. The proposed subsequent use of the property after mining is slated as Residential R-20. A revised NPDES plan, Sand and Gravel General Permit, Number WAG 50-1245, has been prepared and is currently in force. Sale of the existing 'fill" stockpile will commence immediately followed by plans to mine in a northeasterly direction from previous mining. Mining will proceed to within 100 feet of a stream that flows in a northeasterly direction at the northern end of the pit. Depending on market conditions, mining may extend to the west in the central area of the pit. Mining operations will include excavation, stockpiling, processing, and shipping of mineral aggregate. Processing includes mobile and stationary equipment for crushing, washing, screening and asphalt production. Screening and washing are planned during the summer months using portable equipment. This campaign crushing will contribute to smaller retention pond size and better control of stormwater discharge. Excavation will be performed using a front-end loader. Rapid runoff rates during storms are a major concern due to unfavorable site geology. Aggressive ground cover revegetation will take place on disturbed areas just outside the operating area during the first year to reduce fine sediment discharge. However, a key feature is discharge to a deep, closed depression in the east-central portion of the mine, which should offer superior retention. 2 #70-012367 Question #15 Although there has been some confusion within the mining community as to what exactly "depth" is in relation to this question, the answer to this question is 60-feet (Written note from Matt Brookshire, DNR). The deepest part of the excavation is and will continue to be in the vicinity of existing mining activity. The west-central portion of the mine will be mined to a depth of approximately 20 feet in order to mine the predominantly sandy layer that is interpreted to be present here. Questions #16 -#19 There is an estimated 3,000,000 cubic yards of material to be mined at this site. Market fluctuations may occur. An inflated estimate per year of production is stated to allow for years when the market is high for aggregate. Some years, of course, will be much lower. 23B - Site Preparation Saving topsoil and subsoil The site is composed of recessional outwash gravels and sands with lenses of clay. Topsoil is thin at this site with an average depth of approximately 0.5 feet. Live topsoil handling will be utilized, as stockpiling of such thin reserves of topsoil will only result in degradation of this resource. There were no soil stockpiles at this mine when the sale of the mine took place. There may be one or more small soil storage areas as mining progresses. See Attachment B soil budget and Figure 3 Segmental Reclamation Agreement for topsoil movement direction. Soils in the area are generally sandy and impoverished. Because the topsoil budget indicates a moderate deficit, the soil will be used mainly on flatter areas, and revegetation will focus on deep-rooted trees that will help generate a new soil over time. Revegetation on Segment 1 will be monitored to access its success on the topsoil-impoverished substrate and, in the event that revegetation is inadequate, the revegetation procedures will be modified and monitored to assure improved performance. 23C - Setbacks and Screens A permanent undisturbed buffer is not planned for this site, as the 30-foot setback will be sufficient. Before Peninsula Topsoils, LLC. bought this site; mining had been completed up to the mine boundary in a couple of places. No backfilling is proposed for future mining. Backfilling was completed for parts of Section I that was disturbed by the previous operators of the mine. A backfill plan for that material was not dictated or suggested by DNR. There is a 100-ft buffer established along the Type 4 (T4) stream that was identified by Lee Boad, biologist. This stream was re-routed by a previous owner of the mine, and it does parallel contour lines as indicated. The stream location was mostly taken from information supplied by Lee Boad in two reports to Jack Johnson dated August 2002. (copies included in this packet) 23F Ground Water Groundwater tables are approximate and based on three excavated exploratory pits completed in May 2002. The pits are in the eastem part of the mine. Groundwater flow is presumed to follow the Union River valley south, then southwestward to Lynch Cove because of regional 3 #70-012367 topography and because the groundwater system is hemmed in by north-south hills cored with low-permeability older glacial sediments if not bedrock. Well logs are attached for properties in the vicinity of the pit. There is a possible perched aquifer on the southwest of this property. Well logs were briefly examined for wells in the vicinity of the mine; however, we have no opinion as to the need for a hydrology report Note that Leslie Geological Services does not perform Hydrogeology and is not licensed to perform such work in Washington.) The site will include at least three retention ponds for the control of stormwater discharge. Most of the capacity of these ponds will be in porous sediment above observed groundwater levels, so enlarging the ponds creates more capacity. In addition, a large 25-foot deep depression east of the main product stockpile in northern Segment VI will be developed as a constructed- wetland/retention pond.
