BOX 578 1864 SHELTON, WA 98584 • (360) 427-9670 FINDINGS FOR MASON ENVIRONMENTAL PERMIT DATE: May 8, 1996 PERMIT NO.: RLC96-0086 PROPOSED ACTION: Anna Ahmed - NE 330 Makela Road, Belfair PN: 12320-24-90021 Excavate a ditch (3 ft. wide, 200 feet long, and 2 to 3 feet deep) to direct runoff in drainage area of untyped stream; proposal will control area of saturated soils and provide an area where septic drainfield may be located; materials excavated shall be bermed no more than 3 feet wide along downstream side of ditch. DEPARTMENT OF COMMUNITY DEVELOPMENT: a) The project site is within an untyped stream draining two creek channel areas that convey runoff during rainfall events. The stream flows in two distinct channels uphill of the project site but generally over the surface where the ditch is proposed. A less defined channel occurs downhill from where the ditch will begin and will be the location where the surface runoff will be directed. The material from the ditch will be placed on the downhill side to increase runoff interception and minimized other impacts to the stream. The area downhill, from the ditch to the east side of the Ahmed property, has been graded and grazed by livestock in the past and may have lead to the channel alteration of the untyped stream. When the ditch is completed, the area downhill of the channel will have less saturation at the surface and provide a location where effluent can be treated effectively within the drainfield. b) The property owner and septic system designer are attempting to resolve a failing septic system and requested the proposed ditch as part of the solution. The existing drainfield has been saturated by area seepage and has been verified as failing from dye testing by the County. The proposed drainfield area is downhill from the existing residence in an area that has good soils for septic treatment; but this area is being saturated by surface runoff from the untyped stream and subsurface seepage from the slopes adjacent to the proposed drainfield area. c) The Interim Resource Ordinance will allow work within streams and wetlands, as long as the owner applies for a Mason Environmental permit and meets the standards of the Ordinance. The owner and the designer have applied for the MEP and have supplied an Environmental Checklist for the proposal. A Mitigated Determination of Nonsignificance was issued on March 29, 1996 and comments from Department of Ecology were received on April 10, 1996 (their comments are in the Other Comments section). Recycled DEPARTMENT OF PUBLIC WORKS: No comments made because the proposal affects no county roads and involves minor alteration of an existing stream drainage. DEPARTMENT OF HEALTH (ENVIRONMENTAL HEALTH): Office of Water Quality has dye-tested the septic system and verified that inadequate treatment of effluent is occurring. Environmental Health has worked with the owner to resolve these problems. The owner has agreed to a septic tank and pre-treatment area near the house and a drainfield away from the house. In evaluating alternative sites for a drainfield, Environmental Health found that no other suitable nearby site could be found other than at a downhill location in a field where livestock have grazed in the past. This site has good soils for effluent treatment but is subject to inundation from the seepage from uphill slopes and from the surface - subsurface flows from the untyped stream. The septic designer proposed that a curtain drain system could capture the slope seepage, but the saturation from the stream could be redirected by a small ditch away from the potential drainfield area to the less defined creek channel downhill. This proposal would meet Environmental Health requirements but would also have to meet the Interim Resource Ordinance for impacts to the stream and wetland areas. FIRE MARSHAL: No comments made because the proposal does not require Fire Marshal review. COUNTY BUILDING OFFICIAL: No comments made because the proposal does not require a building permit and does not involve enough material to require a Mason County Land Modification Permit. OTHER COMMENTS: Washington Department of Fish and Wildlife Habitat Specialist Doris Small made a site visit with staff to look at the proposal with the septic designer. She agreed that the runoff from the upstream channel was flowing generally on the surface and away from the less defined channel downstream. The saturated soils were supporting buttercups and rushes that would be typical of areas that have poor drainage; many plant species often seen in wetlands were not present in the area of the proposed ditch. She felt that the excavation of the proposed channel would not be a significant change to the fish and wildlife habitat and would be an improvement in the way runoff is maintained in the stream channel. She did state that the work would need a State Hydraulic Project Approval and that reducing potential sedimentation could be accomplished by temporarily routing streamflows through a pipe while the ditch is made. Washington Department of Ecology comments focused on the presence of the seasonal drainage, the excavation of a ditch in saturated soils, the adequacy of the size of the ditch and the downhill berm, and the use of erosion and sediment control measures to protect water quality. The conditions connected with the SEPA review did specify that the applicant comply with the standards of the Hydraulic Project Approval, the berming of the downhill side of the ditch on a minimal area, and the routing of streamflow around the excavation site. The sediment control measures (silt fence along the berm and straw bales along the downstream channel) will also be included. CONCLUSIONS: Based upon the above comments, the Department of Community Development shall issue this Mason Environmental Permit with the set of four conditions. These conditions are attached so that the applicant will assure the public of Mason County that potential impacts (stream channel, routing of area runoff and seepage, and erosion-sediment control) are addressed in the excavation of this proposed ditch. X 2) Mason County Dept. of Community Development staff shall stake the alignment of the ditch to be excavated and the applicant or contractor shall follow that staked alignment when following the construction standards of the Hydraulic Project Approval. X 3) The excavated materials may be bermed on the downstream side of the ditch, but no farther than 3 feet from the edge of the ditch. X 4) To reduce erosion potential during excavation of the ditch, the streamflows may be temporarily captured and routed in a pipe downstream to the channel beyond the excavation or into the nearby field. X 5) The applicant shall use sediment control measures, such as silt fencing along the downhill berm and straw bales along the downstream channel, to reduce potential sedimentation in the stream channel during and after excavation of the ditch.
