Page 1 of 6 CASE NOTES FOR BLD2007-01885 CONDITIONS FOR BLD2007-01885 1) By definition, propane tanks and heatpumps are structures, which must meet setback conditions. Please check your"Approved Site Plan" to ensure these structures meet the setback conditions listed. X 3) All other necessary permits from Mason County, Washington State and/or Federal Agencies that arejequired for this proposed development and construction must be obtained PRIOR TO SAME DEVELOPMENT AND CONSTRUCTION. X� 7) CONSTRUCTION PROCESS TO BE FIELD CORRECTED AS REQUIRED PER MASON COUNTY BUILDING DEPARTMENT AND THE ADOPTED BUILDING CODE. The construction of the permitted project is subject to inspections by the Mason County Building Department. All construction must be in conformance with the international codes as amended and adopted by Mason County. Any corrections, changes or alterations required by a Mason County Building Xspec�r�hall be made prior to requesting additional inspections. 8) All building permits shall have a final inspection performed and approved by the Mason County Building Department prior to permit expiration. The failure to request a final inspection or to obtain approval will be documented in the legal property records on file with Mason County as being non-compliant with Mason,Qounty ordinances and building regulations. Page 2 of 6 9) The international code requires a fire apparatus access road for every facility, building, or portion of a building that is more than 150'from an approved access road. Roads are required to meet the minimum Mason County Fire Marshal standards for Fire Apparatus Access Roads up to the point where such rq�d onnect with a county maintained public road or to another fire apparatus access road which connects to a county maintained public road. X 10) Provisions for surface/subsurface drainage control must be implemented with new construction or development on site and MUST NOT adversely impact adjacent parcels. Under the requirements of Mason County Stormwater Ordinance, either private ditches and drains will meet requirements of the stormwater ordinance or prior approval will be granted to use an existing utility and drainage easement dedicated for that specific purpose. For further information regarding this ordinance and the REQUIREMENT to obtain an ACCESS PERMIT for the installation/construction of a driveway or access connecting from a Mason County Road, Contact the Mason County Public Works Department prior to construction at Ext 450. For any construction which is proposed to be located within 25' of a Mason County road right of way, it is suggested to contact that office to review future planned work which may affect your project X ;;�, '-7— 11) Buffer vegetation to wetland and shoreline areas will be enhanced per the MEP2007-00103 plan, will be completed during site preparation and construction of the proposed residence. X C-2— 12) Concrete used for basement walls, foundation walls, exterior walls, porches, carport slabs, steps exposed to the weather, garage floor slabs and other vertical concrete work exposed to the weather shall have a minimum compressive strength of 3000 psi (IRC Table R402.2). X 6t= 13) Pressure treated wood manufactured after January 1, 2004 may contain high concentrations of copper which could quickly corrode metal fasteners, connectors and flashing. Install metal connectors approved for contact with the new types of pressure treated material. If an inspection is called for and plans are not available on site, then approval will not be granted. In addition, a re-inspection fee (refer to current fee schedule, minimum 1 hour)will be charged and must be collected by the Building Department prior to any further inspections being performed or approvals granted. X 4 " e 20) The plan review check list and corrections are part of the approved plans and must remain thereto. It is the responsibility of the applicant to make the corrections indicated on the plans. Once the plans are marked "APPROVED", they shall not be changed or altered without authorization from the Building Official. The permit holder is responsible to retain the complete approved set of plans on site for the duration of the project. Failure to comply and/or X mova�pproved documents will result in failure of required building inspections. 21) The"approved" site plan is required to be on-site for inspection purposes. If an inspection is requested and the"approved" site plan is not on site, then approval will not be granted. In addition the following credit from Table 9-1 shall be completed: Opyion 1A, High efficiency HVAC Equipment, AFUE 92% X 152 23) A permanent certificate, completed by the builder or registered design professional, shall be posted within three feet of the electrical distribution panel. The certificate shall list the predominant R-values of insulation installed in or on ceiling/roof, walls, foundation (slab, basement wall, crawlspace wall and/or floor), and ducts outside the conditioned spaces; U-factors for fenestration; and the solar heat gain coefficient(SHGC) of fenestration. Where there is more than one value for each component, the certificate shall list the value covering the largest area. The certificate shall list the type and efficiency of heating, cooling, and service water heating equipment, duct leakage rates including test conditions as specified in WSEC Section 503.10.2, and air leakage results if a blower door test was conducted. Building envelope air leakage control shall be considered acceptable when tested to have an air leakage less than 0.00030 Specific Leakage Area (SLA) when tested with a blower door at a press of 50 Pascals (0.2 inch w.g.). Testing shall occur at any time after rough in and after installation of penetrations of the building envelope, including penetrations for utilities, plumbing, electrical, ventilation, and combustion appliances and sealing thereof. The blower door test results shall be recorded on the permanent certificate required located near the electrical distribution panel. Air leakage testing is not required for additions less than 750 square feet. Reference WSEC 105.4 Certificate and 502.4.5 Building Air Leakage Testing. Compliance certificates are available online at the WSU Energy program website titled, "WSEC 2009 Certificate"and are available in %.or'h sheets. The Mason County Permit Center will also have some available. X BLD2007-01885 Please refer to the following pages for conditions of this permit. Page 4 of 6 24) A minimum of 50 percent of all luminaires shall be high efficacy luminaries unless lighting compliance was approved using the options available in WSEC Section 1520 or 1530. Luminaires providing outdoor lighting and permanently mounted to a residential building or to other buildings on the same lot shall be high efficacy luminaries unless permanently installed outdoor luminaires are controlled by a motion sensor(s)with integral photocontrol photosensor or installed in or around swimming pools or water features. All fluorescent fixtures must be fitted with T-8 or smaller lamps (but not T-10 or T-12 lamps). Reference WSEC 505. X 25) REQUIREMENTS FOR ROOF COVERINGS. Roof coverings shall be applied in accordance with the applicable provisions of the current code and the manufacturer's installation instructions. X /.. 26) A Mason County Stormwater Management Worksheet was completed and signed as part of this building permit application. Design, sizing, placement, inspection and maintenance of stormwater management systems shall be the responsibility of the owner/agent of the developed parcel. It is the owner/agent/contractor's responsibility to ensure that Mason County Department of Public Works has approved the stormwater site plan for this parcel prior to the commencement of any development activities. *NOTE if Stormwater Management option "A"was selected on the Small Parcel Stormwater Management Application/Worksheet the document entitled "Managing Storm Drainage on Small Lots, The Small Parcel Stormwater Site Plan"constitutes an approved plan based on the criteria listed on the application/worksheet. If the development has, or will have, a septic/drainfield system you are responsible for contacting Mason County Division of Environmental Health to ensure that the stormwater system will not adversely affect the septic system of this, or any other, parcel. You may also wish to consult with the septic design professional involved with the project. By calling for a final inspection of the building permit the owner/agent/contractX is acknowledging that all components of the stormwater management system have been installed as approved on the stormwater site plan. All engineering and/or architectural documents are a part of the approved set of plans and shall remain attached thereto. If documents are removed, approval will not be granted. Occupancy is limited to the approved and permitted classification. Any non-approved change of use or occupancy would result in permit revocation. X 47/'L 29) The demolition and disposal of debris must meet the regulations of Mason County and Olympic Region Clean Air Agency(ORCAA). It is unlawful for any person to cause or allow the demolition (or major renovation) of any structure unless all asbestos containing materials have been identified and removed from the area to be demolished. All propane tanks must meet t installation requirements and minimum setbacks as listed in the Mason County Fire Marshal's Standards for the Installation of Propane Tanks. Page 5 of 6 31) Fuel piping shall be inspected after the installation of fuel piping is complete, and before the attachment of fixtures, appliances, or shut-off valves. At the time of inspection the test pressure shall be no less than 10 psi held for no less than 15 minutes. Appliances to be attached to the fuel piping system shall not be-used until the final inspection has been performed and approved by a Mason County building inspector. X 32) All property lines shall be clearly identified at the time of foundation inspection. X �2 33) All permits expire 180 days after permit issuance, or 180 days after the last inspection activity is performed. The Building Official may extend the time for action for a period not exceeding 180 days, upon the receipt of a written extension request indicating that circumstances beyond the control of the permit holder have prevented action from being taken. No more than one extension may be granted. X /" _ 34) ALL SURFACE WATER AND POTENTIAL RUNOFF WILL BE CONTROLLED ON SITE AND SHALL NOT ADVERSLY AFFECT ANY ADJACENT PROPERTIES NOR INCREASE THE VELOCITY FLOW ENTERING OR ABUTTING TO ANY STATE OR COUNTY CULVERTING/DITCHING SYSTEM OR ROAD WAY. X r�2 35) An inspection performed by a representative of the engineer of record, N.L. Olson &Associates, Inc., shall be completed on-site prior to the footing pour to verify that the subgrade and foundation are placed in accordance with their design specifications and placed on firm native soils. If taller stemwalls will be required as a result of the subgrade inspection a revised reinforcement schedule shall be provided by the engineer of record. A letter prepared by N.L. Olson &Associates, Inc shall be submitted to the Mason County Building Dept., PO Box 186, Shelton, WA 98584, prior to the footing inspection and also available for inspection. Must provide well log and satisfactory bacteriological sample. X �Z This permit becomes null and void if work or construction authorized is not commenced within 180 days, or if construction or work is suspended for a period of 180 days at any time after work is commenced. Evidence of continuation of work is a progress inspection within the 180 day period. Final inspection must be approved before building can be occupied. Proof of continuation of work is by means of a progress inspection. Box 1959 Silverdale WA 98383 RE: Continued Review of Building Permit BLD2007-01885 on Parcel Number 12220-50-k;EM Dear Mr. and Mrs. Root: This letter is to request additional information and application materials that will continue the review of your building permit.and the location of your proposed residence on the subject property located along North Bay Road in Allyn, WA. Staff recently observed the location of the proposed buildings on the property and noted the travel trailer and portable building present adjacent to the wetland and shoreline critical areas. Staff checked office records on past permitting or reviews done on the subject parcel. A site pre-inspection was done on this property in December 2006 [SPI2006-00313] that described certain wetland characteristics on the property at the time of inspection and concluded that a wetland study be completed prior to further development. This site information was provided at the request of the owner in March 2007. Your building permit submittal on October 30, 2007 did include a wetland study report and accompanying site plan. As noted in the 2006 site pre-inspection SPI2006-00313, development standards for both wetland and shoreline areas are applied in proposing development on this property. The wetland report provides a review of the wetland characteristics and conditions on the property and a 60-foot wetland buffer for the proposal, but the report site plan proposes minimal building setbacks [13 to 17 feet] and no vegetation buffers adjoining the edge of the mapped wetland areas. If this site plan is the project site plan, the wetland biologist must submit a wetland enhancement and/or buffer restoration plan that will compensate for wetland area and habitat losses resulting from the development not meeting the proper wetland buffer distance of 60 feet from the edges of wetland. To date, this restoration plan has not been received bx this Department, although it was requested in a Letter of Incompleteness, prepared by the permit planner Rebecca Hersha in November 2007. Another fact stated in the December 2006 site pre-inspection was a proposal that follows the shoreline area development standards. Part of that narrative stated: "Shoreline development is guided by the Mason County Shoreline Master Program and Resource Ordinance Fish and Wildlife Habitat Conservation Areas standards. Root progress letter Mar 2009.doc Any possible building would need to meet setbacks from the ordinary high water mark of the inlet, likely to be between 60 and 100 feet distance." The information provided in your permit application for the residence does not follow these standards. Proposed residences must meet the proper setback from the shoreline area, in this case measured from the ordinary high water mark along North Bay in a landward direction to the roof eaves of residences on adjacent properties. Rebecca Hersha's letter noted that this setback distance is 71 feet (resulting from the average of 42 feet distance for the house on the south and the 100 feet distance for the default setback on the north). Due to the alignment of the shoreline and wetland boundaries on this parcel, the submitted wetland site plan distance of 35 feet from North Bay / Case Inlet does not meet either of the Shoreline Master Program and Resource Ordinance Fish and Wildlife Habitat Conservation Areas standards. Based on these facts, little area exists on this parcel that would not be unencumbered by the shoreline area buffer and building setback. A variance from the Fish and Wildlife Habitat Conservation Areas chapter may be requested to pursue residential development on this property. A Habitat Management Plan (HMP), prepared by a qualified biologist is required as part of the variance request to support the proposed development. The HMP addresses impacts to the buffer and offers measures to preserve and protect the buffer or to mitigate impacts of the development proposal (like the wetland restoration efforts). A copy of the Fish and Wildlife Habitat Conservation Areas chapter, including details on the contents of an HMP and the variance public review procedure, is available. A variance request (application and HMP) is evaluated by the permit planner who assists in the Hearings Examiner public review process. The shoreline and wetland buffer/ setbacks should be accurately identified on the project site plan that is submitted for a variance request and building permits. Application for a variance to these standards does not guarantee approval of the development as proposed. As stated above, the travel trailer, portable building, and fences have been located adjacent to the wetland and shoreline critical areas. Please note that structures or land uses done without building permits would still need to provide proper water supply and septage disposal, and shall be located at proper distances from property lines and from shore or wetland critical areas to meet current standards. Box 1959 Silverdale WA 98383 RE: Follow-up Letter on Building Permit BLD2007-01885 on Parcel Number 12220-50-13=- 1-7610 Dear Mr. and Mrs. Root: This letter is a follow-up on the March 11, 2009 letter to request additional information and application materials that will continue the review of your building permit and the location of your proposed residence on the subject property located along North Bay Road in Allyn, WA. That progress letter requested several applications and studies that are needed to further evaluate this building permit: 1. A wetland restoration plan has not been received by this Department, although it was requested in a Letter of Incompleteness, prepared by the permit planner Rebecca Hersha in November 2007. 2. An application for variance from the Fish and Wildlife Habitat Conservation Areas chapter may be requested to pursue residential development on this property. 3. A Habitat Management Plan (HMP), prepared by a qualified biologist, is required as part of the variance request to support the proposed development. As of this date, none of this material has been submitted to this office, and you have provided no letter or telephone conversation to respond to these issues or to discuss the permit review. A note entered by the Mason County Permit Assistance Center staff on September 26, 2008 indicates that no information had been submitted at that time, but the applicant wishes to keep the permit active. The Mason County Development Code Section 15.05.040(C) [a copy is enclosed] states that in order to make an application more complete, a Letter of Incompleteness is sent by the County to the applicant, and that if the requested information is not provided to the County within 180 days of the request, the application shall expire. Mason County staff sent a Letter of Incompleteness on November 6, 2007, and no written response has been made. As a result, the applicant now risks that no further action will be taken to evaluate their request, in this case, a residence along North Bay Case Inlet. Even if September 26, 2008 note date could be interpreted as the start of this 180-day period, the date of April 3, 2009 is day number 188 of this notification date and no response is yet made. If there is no response to this time of completeness issue by Wednesday April 15, 2009, your permit application will be deemed as an expired application. Another important County concern is that you have located residential land uses that do not meet the same development standards that are being evaluated in the Mason County Building Permit BLD2007-01885 review. You currently have a motor home and modular building sited on the property within the vegetation buffer and setbacks for the wetland and shoreline critical areas that are present on Parcel Number 12220-50-17003. If you do not submit the information stated above and do not complete the process as noted in the March 11, 2009 letter, you will be required to remove these structures from the property OR move these improvements outside of the vegetation buffer and building setbacks by applying for (or revising) the necessary building permits to site these improvements at correct distances. If this is your course of action, this must be done within 30 days and by Monday May 4, 2009.
