Instructions for applicants This environmental checklist asks you to describe some basic information about your proposal. Please answer each question accurately and carefully,to the best of your knowledge. You may need to consult with an agency specialist or private consultant for some questions. You may use"not applicable"or "does not apply" only when you can explain why it does not apply and not when the answer is unknown. You may also attach or incorporate by reference additional studies reports. Complete and accurate answers to these questions often avoid delays with the SEPA process as well as later in the decision-making process. The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of time or on different parcels of land. Attach any additional information that will help describe your proposal or its environmental effects. The agency to which you submit this checklist may ask you to explain your answers or provide additional information reasonably related to determining if there may be significant adverse impact. Instructions for lead agencies Please adjust the format of this template as needed. Additional information may be necessary to evaluate the existing environment, all interrelated aspects of the proposal and an analysis of adverse impacts. The checklist is considered the first but not necessarily the only source of information needed to make an adequate threshold determination. Once a threshold determination is made, the lead agency is responsible for the completeness and accuracy of the checklist and other supporting documents. Use of checklist for nonproject proposals For nonproject proposals(such as ordinances, regulations, plans and programs), complete the applicable parts of sections A and B, plus the Supplemental Sheet for Nonproject Actions (Part U1. Please completely answer all questions that apply and note that the words"project," "applicant," and "property or site" should be read as"proposal," "proponent," and "affected geographic area," respectively. The lead agency may exclude (for non-projects)questions in "Part B: Environmental Elements"that do not contribute meaningfully to the analysis of the proposal. You are welcome to submit a public records request for any property or project, though all the pertinent information I have regarding the project is already publicly available on Ecology's public SEPA portal for the project, here: https://apps.ecology.wa.gov/separ/Main/SEPA/Record.aspx?SEPANumber=202403269. You are welcome to disagree with Mason County's determination to uphold the DNS and can appeal it. I've attached a letter specifically stating this, as well as our appeal regulations. This is the same letter I handed you in-person earlier today. As you stated, septic systems and drainfieds are not a subject matter that is familiar to me.That is why I contacted Travis Casey with the Department of Ecology and Rhonda Thompson with the Mason County Public Health Department, as you asked for points of contact in your previous email. Please know that a test hole for the lot was already dug for the project during the Large Lot Subdivision review, which occurred in 2023 and also went through SEPA review. The Mason County Environmental Health Department approved the creation of the lot based on the findings of the test hole. Regarding clearing the lot, that is the applicant's choice. So, if the applicant clears a portion of the lot and it turns out a septic system will not work in that location, that is at their own risk. I verified that the flagging done by the applicant is 150 feet from the edge of Decker Creek during my site visits on 07/16/2024 and 07/30/2024. No surveyor or formal survey is required for clearing land by either Mason County's Resource Ordinance (MCC 8.52) or Forest Practices Approvals chapter(MCC 11.05). All procedures and ordinances for Forest Practices Approvals can be found using the aforementioned link. Hello, The SEPA that was posted on the tree states there was a comment period. Am providing comments and concerns as a citzen who lives downstream of the decker creek. As we discussed about the issue on the phone. I mentioned about if you were living down stream you might have similar questions. If you want me to fill out a freedom of information request form or similar form the county uses i would be happyto do so. The SEPA has listed septic system as well to direct comments to you. If you could not answer the questions or able to handle the comments you should have listed a POC for the septic issues on the SEPA. From my observation and what I know about the area since I lived out here now for a few years now, it seems reckless of your department to clear a whole lot then dig holes to determine the soil type. If that is a procedure please provide the checklist the county uses or any ordinance that goes with it.This is why I requested the opnion and answers of someone from the Department of Ecology. Someone more familiar to this subject matter. Nothing personal. If you took offensive, it was not intended. This whole process intiatiad by you and your department as well taking the word of a applicant who may or may not be qualified seems rushed with no regard to meetingthe requirements as stated WAC 246-272A-0015 (1). As stated before, my concerns stem from my knowledge as a water distribution manager. If the on site sewage system particular the pressured system fails, that sewage well seep into the water table and highly likely end up in the creek. From what know a tank seems more safe for everyone's intrest. If however a tank is selected then the issue is how close to the easment and/or road. You have also stated the applicant has flagged out the buffer from the creek. Is he a surveyor? If so please provide the certification or records he as met the standards as defined in RCW 18.43.40. If you take the word of the applicant with no professional survey experience. Please walk me on where the county says that's ok. Appreciate all of your time as well be looking for a response. Have a good rest of the week. Despite not needing that granular of details, the applicant has still let me know that that they plan to put in a pressurized system. Earlier today I spoke with Travis Casey(Travis.Casey@ecy.wa.gov, 564-999-1142), a Nonpoint Project Specialist in Ecology's Water Quality Department.Travis assured me that the County's Environmental Health Specialists are qualified to determine whether the setback for a septic system is appropriate. I also spoke with Rhonda Thompson(RThompson@masoncountywa.gov or 360-427-9670 ext. 581), a Senior Environmental Health Specialist in the Mason County Public Health Department. Rhoda communicated to me that the required setback for drainfields to surface water is 100 feet and from septic tanks to surface water is 50 ft.The project would meet both of those requirements, but as stated above, design of the system will first require test holes to be dug to assure appropriate location of the drainfields. The location of the septic system on the site plan is proposed by the applicant—not set in stone. What is set in stone through this proposal is the clearing limit for logging. If you have septic seepage-related questions, I'd encourage you to contact Travis or Rhonda. Drain field will go right in the same water table as the creek. Which would be harmful to the creek. Thus information is not being publicly available 3 Who is the the the DOE came and determined that the septic system is gar enough away from the boundary? I don't belove the SEPA meets the requirements. SEPA record number 202403269, ???SEPA for FPA2024-00003???. Mason County File Number: SEP2024-00016. The project will include harvesting approximately.05 acres (21,200 sgft) of timber on a 5.28-acre lot.The harvested area will be converted to residential use, with a future single-family residence, septic system, and shop building planned. Decker Creek, which runs along the western property boundary of the site, is designated as a critical area by Mason County Code.An 150-foot vegetative buffer area surrounding Decker Creek, which is a Type F(fish bearing) stream, will not be cleared. The applicants are Cheryl and Michael Kerr. The SEPA 14-day comment period started yesterday (07/30/2024) and ends Wednesday,08/14/2024.The project is currently in the review process for a Class IV-General Forest Practices Approval through Mason County. I made the determination that the septic system is designed to be far enough away from the edge of Decker Creek. Mason County Code requires a 150-foot vegetative buffer, plus a 15-foot structural setback, for a total of 165 feet, from the edge of Decker Creek. I verified the buffer and setback on the site—the area that has been flagged by the applicant is outside Decker Creek's 150-foot vegetative buffer. This can be seen on the site plan submitted by the applicant(attached, page 3),which shows the "septic field location" is more than 165 feet from the edge of Decker Creek, even though it only needs to be more than 150 feet from the edge of Decker Creek because that would be the clearing limit(165 feet is only the setback for structures above grade).
