Dear Mr. Tom Shearer,
This letter is to follow up on a conversation we had on April 26, 2002. We
discussed two separate matters, property improvements that you have made on our
property and the new storm water issues you expressed concern over.
Property Improvements:
Starting in December of 2000 we contacted you about property improvements you
have made on our neighboring parcel. We discovered these improvements after Apex
Engineering of Tacoma, WA completed a now recorded survey of property lines. These
include an existing 4' chain link fence and an existing propane tank. At that time we
requested that you either sign a license agreement permitting the improvements until we
decided to improve the property, or that you remove the improvements. We have yet to
receive any response to this offer and must now insist on the removal of the above
refinanced improvements.
We are requesting that you at your own expense remove these improvements and
return the property to its prior condition. We request that you complete this restoration
work within the next four weeks with a completion date no later than June 1" 2002. If we
do not receive written notice by May 10`h 2002 that the work is scheduled and will be
completed by the June I" date we will forward this letter onto our attorneys for action.
Storm water:
During our conversation over the above issue you raised concerns over stowage
being discharged from our property onto your home site. I am unaware of any existing
problem that is not naturally occurring. I request that you document any unnatural flow of
water being discharged onto your property and contact Mason County with a copy of any
findings being sent to my office.
We understand that the fence and tank improvements were not intentional and
hold no ill will over this situation. However we must resolve this situation and can no
longer spend any more time discussing the problem. We appreciate your prompt
attention to this matter. A copy of this letter will be sent to Larry Waters at the Mason
County Building Dept.
