Before the business opened there was a petition given to our county commissioner , Mr . Bill Hunter . The petition was to bring an investigation into the placement of a business of their statute in a residential area. 1 The day the business opened, the Sheriff was called because of the loud music and screaming . There was one wall complete and no visible noise barrier . Today the building stands as described, with one wall and no noise barrier . There is nothing to stop anyone, adult or child, from walking in there and hurting themselves on unattended equiptment . There is nothing to stop the noise coming from their business and it is assaulting the neighborhood daily . Chet ' s business hours are announced to the neighborhood by squealing tires and war hoops . It is like a constant teenage party during their working hours . We can not even count on a peaceful Saturday . To date, these are the 911 calls I have personally made for loud music , yelling and screaming: November 5 , 1990 , November 8 , 1990 , November. 14 , 1990 , November 20 , 1990 , January 4 , 1991 and January 24 , 1991 February 25 , 1991 Re: Chet ' s Truss Page - 2 On February 15 , 1991 and again on February 22 , 1991 , I spoke to the Sheriff ' s office to get a recommendation on how this problem could be solved. These 911 calls are not separate and isolated problems . They are the result of a constant and continuing problem and the lawful choice of remedying them. Chet 's Truss has a compllete _and total disregard to the people who live in this neighborhood and in this community . There were at least two 911 calls for them lighting illegal firecrackers before the business opened and when the school bus couldn' t pick up my daughter because of the road restrictions , Chet ' s Truss was running their fully loaded trucks at night . With their screeching tires and constant party, they are showing this community and their neighbors just how willing they are to make our lives miserable. (1943 c 174 sec. 1) 36.75.140 — The boards of the several counties of the state may adopt reasonable rules for the construction of Approaches which, when complied with, shall entitle a person to build or construct an approach from any abutting property to any county road. The rules may include provisions for the construction of culverts under the approaches, the depth of fills over the culverts and for such other drainage facilities as the board deems necessary. The construction of approaches, culverts, fills. or such other drainage culve is as may such reouired, shall b• undo the supervision de the board, and all such construction shall be at the expense of the person benefited by the construction (1943 c 174 sec. 2) 36.75.150 — Any person violating any of the provisions of RCW 36.7S.130 and 36.7S.140 shall be guilty of a misdemeanor. (1943 a 17S sec. 3) GENERAL PROVISIONS APPLICABLE TO ALL PERIMITS During the progress of the work such barriers and warning signs shall be erected and maintained as may be necessary or as may be directed for the protection of the traveling public:the barriers shalt.he properly lighted when necessary. In accepting this permit the petitioner, his successors or assigns, agrees to protect Mason County and save it harmless from call claims, actions or damages of every kind and description which may accrue to or be suffered by any person or persons, corporation or property by reason of the performance of any such work, character of materials used or manner of installation, maintenance and operation or by the improper occupancy of rights of way or public place or public structure, and in case any suit or action is brought against said Mason County for damages arising out of or by reason of any of the above causes, the petitioner, his successors or assigns will upon notice to him or them of commencement of such action, defend the same at his or their awn sole cost and expense and will satisfy judgment after the said suit or action shall have finally been determined if adverse to Maso❑ i- , Except as herein ai.tronzed, no excavation ihall be made or obstacle placed within the limits of a :aunty road in such manner as to Interfere with the travel over said road. Except as herein authorized, no excavation shall be made or obstacle placed within four (4) feet of the edge of the pasement. If the work done under this permit interferes in any way with the drainage of the county roads, the grantee shall wholly and at his uwn expense make such provision as the Mason County Road Engineer may direct to take care of said drainage. On completion of said work herein contemplated all rubbish and debris shall be immediately removed and the roadway and roadside shall be left neat and presentable and satisfactory to the Mason County Road Engineer, All work, workmanship, labor and material shall comply with the Washington State Electrical Code, and Washington State Department of Highways Standards and Specifications for Road and Bridge Construction dated January 1963. Installations to Specificatiuns of Civil Aeronautics Administration, In case of any damage to any roads, streets, public places, structures or public property of any kind can account of said work by the grantee, he will at once repair and restore said damage at his own sole cost and expense. No Saturday, Sunday or Holiday wurk permitted under this permit except in case of emergency, or between the hours of 6.00 PM and 6:00 AM the following work day. y Notify Local Fire District before opening any trench across any Roadway and when project is completed. Permittee shall notify Mason Countv Ruad Engineers before making any roadway cuts and immediately after completion of project. All of the work herein contemplated shall he done under the supervision and to the satisfaction of the Mason County Road Engineer and the entire expense of said supervision shall be burne by the party or parties to whom this permit is issued. The County Commissioners hereby reserve the right to order the change of location or the removal of any structure or structures authorized by this permit, at any time, said change or removal to be made it the sole expense of the party or parties to whom this permit is issued, or their successors and assigns. couAll such changes, reconstruction or relocation by the grantees shall be done in such manner as will cause the least interference with any of the Y's work and Mason County shall in no wise be held liable for any damage to the grantee by reason of any such work by Mason County, its agents or representatives, or by the exercise of any rights by the County upon the roads,streets, public places or structures in question. This permit or privilege shall not be deemed or held to be an exclusive one and shall not prohibit the County from granting other permits or franchise rights of like or other nature to other public or private utilities, nor shall it prevent the County from using any of its roads, streets, or Public places, of affect its right to full supervision and control over all or any part of them, none of which is hereby surrendered. The County Commissioners may revoke, annul, change, amend, amplify, or terminate this permit or any of the conditions he enumerated if grantee fails to :(imply with any or all of its provisions, requirements or regulations as herein set forth or through willful or unreasonable neglect, fails to heed or comply with notices given or if the utility herein granted is not installed or operated and maintained in conformity herewith or at all or for any cause or reason whatsoever. The party or parties to whom this permit is issued shall maintain at his or their sole expense the structure or object fur which this permit is granted in a condition satisfactory to the Mason County Road Engineer. He also called last Spring and spoke with Grace. He was surprised to hear the County did not have zoning for commercial development and the neighbors do not have input into the building permit for commercial truss factory. From: Miles Brainard 2020 Old Belfair Hwy . 275-3470 Location : east side of the Old Belfair Hwy . ,next door to 2020. Identity: Chet ' s Truss is clearing and grading an area for construction of a truss factory and all of the neighbors are outraged because of the noise impact this will cause in the quiet residential area . Mr . Brainard is acting as spokesman for the neighborhood because he is home more often and has access to a phone. He has a petition from several (60 )of the neighbors who do not want the factory to be there . He has lived there for 18 1/2 years and the neighbor even closer has lived there since the 40 ' s. He enjoys the yard with his grandchildren and is afraid he will no longer be able to enjoy the peace with his family if there is a truss mill there . They will work' at the factory on Saturdays also. So it will be 6 days a week of noise. He knows what kind of noise it will create because he has heard it in operation before. He is concerned also with the clearing they are doing now because the County required him to put in a culvert from the Hwy. with caution and he thinks Chet ' s crew may have just covered up a culvert that takes drainage from the Hwy and back toward the river. He is afraid that this will cause a flooding problem to the neighbors. Mr . Brainard wanted to know if there was a noise ordinance or something to address the noise. If not , why can ' t the Planning Dept . adopt one immediately. He questioned what it would take to create zoning . I informed him that it would take the Planning Dept. a couple of years and it would have to be the decision of the Commissioners to adopt the zoning . We cannot simply administer zoning to his area. That would be more like a moratorium of commercial development in the Old Belfair Hwy . area and it is very unlikely that the County would consider this an emergency situation where a moratorium was necessary but that either way the decision was not up to me . He stated that he and his neighbors were "going to do what they have to do to stop this guy ." If it takes hiring an attorney that is what he' ll do. He also said that he would continue to call the county until he gets some answer on what we are going to do about allowing the truss factory to go in or not . I told him that at this point we have not received any permit applications and when we do, the project will be reviewed as commercial development in which Planning will address the Parking and Public Works the access . It is possible that the building and planning department can work together to address the noise impact . I will check into that with my Director , Mike Byrne . I will also check on the culvert with the Public Works Dept. . Owner : Chet _ He owns and operates a truss factory out of Gorst and is planning on moving the entire operation to site in Mason County on Old Belfair Hwy. Site Inspection : Conducted on Sept .22 by Grace Miller and Wayne Krause to determine if the fill and grading was within 200' of Union River or it ' s associated wetlands. Findings: The fill did not appear to be on wetlands associated with Union River. It was not within 200' of the river. There was evidence of boggy soil being covered and buttercups were present . Most of the work had already been done. There were deep culverts and settling pons for the water drainage and settling . Wayne suggested these were common to the clearing of a construction site such as this one. We talked with the men doing the clearing and grading . They said it was Chet of Chet ' s Truss having them do the work and they did not know his last name.They said it would be a truss factory and did not have much more information to offer . 1 ) The clearing and grading does not come under the regulations of the Shoreline Master Program. 2) A building permit has not been submitted as of this date. 3) After speaking with Lenore it appears that the one thing that will be reviewed when the building permit comes through our department is the parking . (d)Mezzanines.Unless considered as a separate story the floor area of all mez- zanines shall be included in calculating the allowable fl,00r area of the stories in which the mezzanines are located. (e)Basements.A basement need not be included in the total allowable area,pro- vided such basement does not exceed the area permitted for a one-story building. (f)Area Separation Walls.1.General.Each portion of a building separated by one or more area separation walls which comply with the provisions of this subsec- tion may be considered a separate building.The extent and location of such area 1 separation walls shall provide a complete separation. When an area separation wall also separates occupancies that are required to be separated by an occupancy separation,the most restrictive requirements of each separation shall apply. 2. Fire-resistance.Area separation walls shall not be of less than four-hour fire-resistive construction in Types I,II-F.R.,III and IV buildinesRind two-hour tire-resistive construction in Type II One-hour,II-N or V buildings.The total width of all openings in such walls shall not exceed 25 percent of the length of the wall in each story.All openings shall be protected by a fire assembly having a three-hour fire-protection rating in four-hour fire-resistive walls and one-and one-half-hour fire-protection rating in two-hour fire-resistive wall 3.Extensions beyond exterior walls.,area separation walls shall extend to the outer edges of horizontal projecting elements such as balconies,roof overhangs, canopies,marquees or architectural projections. EXCEPTION:When horizontal projecting elements do not contain concealed spaces,the area separation wall may terminate at the exterior wall. When the horizontal projecting elements contain concealed spaces,the area sepa- ration wall need only extend through the concealed space to the outer edges of the projecting elements. The exterior walls and the projecting elements above shall not be of less than one-hour tire-resistive construction for a distance not less than the depth of the proj- ecting elements on both sides of the area separation wall. Openings within such widths shall be protected by fire assemblies having a fire-protection rating of not less than three-fourths hour. 4.Terminating.Area separation walls shall extend from the foundation to a point at least 30 inches above the roof. EXCEPTIONS: 1. Area separation walls may terminate at the underside of the roof sheathing,deck or slab,provided the root-ceiling assembly is of at least two- hour fire-resistive construction. 2. Two-hour area separation walls may terminate at the underside of the roof sheathing.deck or slab,provided: A. B. The entire building is provided with not less than a Class B roofing. 5.Parapet faces.Parapets of area separation walls shall have noncombustible faces for the uppermost 18 inches,including counterflashing and coping materials. 6.Buildings of different heights.Where an area separation wall separates por- tions of a building having different heights,such wall may terminate at a point 30 inches above the lower roof level,provided the exterior wall for a height of 10 feet above the lower roof is of one-hour fire-resistive construction with openings pro- tected by assemblies having a three-fourths-hour fire-protection rating. EXCEPTION:The area separation wall may terminate at the underside of the roof sheathing,deck or slab of the lower roof,provided: A. Where the roof-ceiling framing elements are parallel to the wall,such framing and elements supporting such framing shall not be of less than one-hour fire-resistive construction for a width of 10 feet along the wall at the lower roof. B. Where the lower roof-ceiling framing elements are perpendicular to the wall, the entire span of such framing and elements supporting such framing shall not be of less than one-hour fire-resistive construction. C. Openings in the lower roof shall not be located within 10 feet of the area sepa- ration wall. See Chapters 6 through 12 for special occupancy provisions. Allowable Area Increases Sec.506.(a)General.The floor areas specified in Section 505 may be increased by one of the following: 1.Separation on two sides.Where public ways or yards more than 20 feet in width extend along and adjoin two sides of the building,floor areas may be in- creased at a rate of 1 t/4 percent for each foot by which the minimum width exceeds 20 feet,but the increase shall not exceed 50 percent. 2.Separation on three sides.Where public ways or yards more than 20 feet in width extend along and adjoin three sides of the building,floor areas may be in- creased at a rate of 2t/2 percent for each foot by which the minimum width exceeds 20 feet,but the increase shall not exceed 100 percent. 3.Separation on all sides.Where public ways or yards more than 20 feet in width extend on all sides of a building and adjoin the entire perimeter,floor areas may be increased at a rate of 5 percent for each foot by which the minimum ex- 40 1991 UNIFORM BUILDING CODE 506-507 ceeds 20 feet.Such increases shall not exceed 100 percent,except that greater in- creases shall be permitted for the following occupancies: A. Group B,Division 3 aircraft storage hangars not exceeding one story in height. B. Group B,Division 4 Occupancies not exceeding two stories in height. C. Group H,Division 5 aircraft repair hangars not exceeding one story in height.Area increases shall not exceed 500 percent for aircraft repair han- gars except as provided in Section 506(b). (b)Unlimited Area.The area of any one-or two-story building of Group B and Group H,Division 5 Occupancies shall not be limited if the building is provided with an approved automatic sprinkler system throughout as specified in Chapter 38,and entirely surrounded and adjoined by public ways or yards not less than 60 feet in width. The area of a Group B.Division 4 Occupancy in a one-story Type II,Type III One-hour or Type IV building shall not be limited if the building is entirely sur- rounded and adjoined by public ways or yards not less than 60 feet in width. (c)Automatic Sprinkler Systems.The areas specified in Table No.5-C and Section 505(b)may be tripled in one-story buildings and doubled in buildings of more than one story if the building is provided with an approved automatic sprin- kler system throughout.The area increases permitted in this subsection may be compounded with that specified in Item 1,2 or 3 of Subsection(a)of this section. The increases permitted in this subsection shall not apply when automatic sprink- ler systems are installed under the following provisions: 1.Section 507 for an increase in allowable number of stories. 2.Section 3802(f)for Group H,Divisions 1,2 and 3 Occupancies. 3.Substitution for one-hour fire-resistive construction pursuant to Section 508. 4.Section 1716,Atria. Maximum Height of Buildings and Increases Sec.507.The maximum height and number of stories of buildings shall be de- pendent on the character of the occupancy and the type of construction and shall not exceed the limits set forth in Table No.5-D,except as provided in this section and as specified in Section 503(a)for mixed occupancy buildings. EXCEPTIONS: 1. Towers,spires and steeples erected as a part of a building and not used for habitation or storage are limited as to height only by structural design if completely of noncombustible materials,or may extend not to exceed 20 feet above the height limit in Table No.5-13 if of combustible materials. 2.The height of one-story aircraft hangars shall not be limited if the building is provided with automatic sprinkler systems throughout as specified in Chapter 38 and is entirely surrounded by public ways or yards not less in width than one and one-half times the height of the building. The story limits set forth in Table No.5-D may be increased by one story if the building is provided with an approved automatic sprinkler system throughout.The increase in the number of stories for automatic sprinkler systems shall not apply 41 507-509 1991 UNIFORM BUILDING CODE when the automatic sprinkler systems throughout are installed under the following provisions: 1.Section 3802(f)for Group H,Divisions 1,2,3,6 and 7 Occupancies. 2.Section 506 for an increase in allowable area. 3.Substitution for one-hour fire-resistive construction pursuant to Section 508. 4.Section 1716,Atria. ` 5.Section 3802(g)'for Group I,Divisions 1.1 and 1.2 Occupancies used as hos- pitals, nursing homes or health-care centers in Type II One-hour, Type III One-hour,Type IV or Type V One-hour construction. See Chapters 6 through 12 for special occupancy provisions. r Fire-resistive Substitution t.: Sec.508.When an approved automatic sprinkler system is not required through- out a building by other sections of this code.it may be used in a building of Type II One-hour.Type III One-hourand Type V One-hour construction to substitute for P YP the one-hour fire-resistive construction. Such substitution shall not waive or re- duce the required fire-resistive construction for: (a)Occupancy separations[Section 503(c)]. (b)Exterior wall protection due to proximity of property lines[Section 504(b)]. c)Area separations[Section 505(f)]. (d)Dwelling unit separations[Section 1202(b)]. (e)Shaft enclosures(Section 1706). x: (f)Corridors[Section 3305(g)and(h)]. (g)Stair enclosures(Section 3309). (h)Exit passageways[Section 3312(a)]. (i)Type of construction separation(Section 1701). Boiler,central heating plant or hot-water supply boiler room enclosures. Pedestrian Walkways Sec.509. (a) General. A pedestrian walkway shall be considered a building when determining the roof covering permitted by Table No. 32-A. Pedestrian walkways connecting separate buildings need not be considered as buildings and need not be considered in the determination of the allowable floor area of the con- nected buildings when the pedestrian walkway complies with the provisions of this section. (b) Construction.Pedestrian walkways shall be constructed of noncombus- tible materials.
