Upon conducting a site inspection, it was confirmed that dredging had occurred. The site conditions as described above constitute a violation of the Mason County Resource Ordinance — Fish & Wildlife Habitat Conservation Areas, Section 17.01.110, and the Shoreline Master Program, Section 17.50.060. To bring this site into compliance with Mason County Code, you will need to perform the following: • Apply for a Mason Environmental Permit, which will be subject to an after-the-fact penalty fee if the deadlines are not met- $380.00 when processed with another DCD permit. $1140.00 if deadlines are not met. Depending on invasiveness of restoration project may be waived completely. • Due to the disturbance of the vegetation within the buffer, you will need to hire a qualified professional to prepare a Restoration Plan that you will implement. The plan should include an estimate for the labor and materials that will be required to restore the site to its original condition. During those three years, a monitoring report should be submitted annually by a professional to address the success and failure rates of the project and describe any supplemental plantings that are necessary. I have included a list of biologists. Report review-$445.00 • Pay$255.00 Planning Enforcement fee. • Schedule a final inspection. I anticipate receiving fees and your Restoration Plan by September 14, 2009. • This letter shall serve as a warning notice as described under the Mason County Title 15, section 15.13.040. If the compliance guidelines as outlined within this letter are not met by the deadline specified herein, a Notice of Civil Violation will be issued to those parties responsible for documented violation(s) of Mason County code. A hearing may then be held in accordance with Title 15 and additional civil penalties or fines may be imposed if compliance has not been achieved. If you disagree with this Notice you may request in writing within 14 (fourteen)days of the service of the Notice, an appeal hearing before the Hearings Examiner. The request shall include a $2,500 fee and cite the Notice and Order appealed; it shall contain a brief statement of the reasons for seeking the appeal hearing. He is very upset as the land owner(neighbor in violation) has finished his fence, all the way down to the lake front. We know that he's violated the over six foot law, 50 foot lake setback law and possibly the 15 to 20 foot eavesment setback from road law. Also, the fence in front of our dwelling and behind his is some kind of violation. Please write me back this morning as my husband is really upset, he wants to make sure that the complaint has been filed and an inspection scheduled. We would like to meet the inspector out at the site. (80 Tiger Cove Lane (our address))ASAP.
