NOTE: Copies of all FPA Applications will be forwarded to Mason County Public Works for stormwater and erosion
control review. Projects which disturb more than one acre(regardless of total lot size)will require an engineered
stormwater plan consistent with the Mason County Stormwater Ordinance(Chapter 14.48.)and the 2012 WSDOE
Stormwater Manual.Applicants will be charged for Public Works staff time to review these plans and applications.
Property owners should also be aware that the Washington State Department of Ecology(WSDOE)might ask for a
NPDES(National Pollution Discharge Elimination System)Permit.The threshold for such a permit is equivalent to
Mason County's threshold. WSDOE will notify applicants through SEPA review if a NPDES is required.An NPDES is
not a perquisite for FPA approval. It is the responsibility of the applicant to obtain this permit when required.

Mason County has reviewed the above referenced application for Class IV General Forest
Practices and finds it in conformance with all applicable County land use regulations in
effect at the time of application.
FINDINGS
The proposed FPA is compliant with the following conditions:

GENERAL PROVISIONS
1. The Grantee, its successors and assigns, agrees to protect the State of Washington and save it harmless from all claims,
actions or damages of every kind and description which may accrue to or be suffered by any person,persons,or property
by reason of the performance of any such work,character of materials used or manner of installation, maintenance and
operation,or by the occupancy of right of way by the Grantee;in case any suit or action Is brought against the Department
for damages arising out of or by reason of any of the above causes,the petitioner,its successors or assigns will,upon notice
of commencement of such action,defend the same at its sole cost and expense and satisfy any judgment arising therefrom
if determined adverse to the State of Washington.
2. During the progress of the work such barriers shall be erected and maintained as may be necessary or as may be directed
for the protection of the traveling public;the barriers shall be properly lighted at night.
3. Except as herein authorized, no excavation shall be made or obstacle placed within the limits of the State highway in
such a manner as to interfere with the travel over said road.
4. If the work done under this permit interferes In any way with the drainage of the State highway,the Grantee shall wholly
and at its own expense make such provision as the Department may direct to take care of said drainage.
5. On completion of said work herein contemplated all rubbish and debris shall be immediately removed and the roadway
and roadside shall be left neat and presentable and satisfactory to the Department.
6. All of the work herein contemplated shall be done under the supervision and to the satisfaction of the Department and
the entire expense of said supervision shall be borne by the party or parties to whom this permit is issued.
7. The Department hereby reserves the right to order the change of location or the removal of any structure or structures
authorized by this permit at any time,said change or removal to be made at the sole expense of the party or parties to
whom this permit is Issued,or their successors and assigns.
8. All such changes, reconstruction or relocation by the Grantee shall be done In such manner as will cause the least inter-
ference with any of the Department's work and the Department shall in no wise be held liable for any damage to the
Grantee by reason of any such work by the Department, its agents or representatives,or by the exercise of any rights
by the Department upon roads,streets,public places or structures in question.
9. This permit or privilege shall not be deemed or held to be an exclusive one and shall not prohibit the Department from
granting other permits or franchise rights of like or other nature to other public or private companies or individuals,nor
shall it prevent the Department from using any of its roads,streets, or public places,or affect its right to full supervision
and control over all or any part of them,none of which is hereby surrendered.
10. The Department may revoke, amend or cancel this permit or any of the provisions thereof at any time by giving written
notice to the Grantee. The Grantee shall immediately remove all facilities from the right of way.Any facilities remaining
upon the right of way 30 days after written notice of cancellation shall be removed by the Department at the expense
of the Grantee.
11. The party or parties to whom this permit is issued shall maintain at its or their sole expense the structure or object for
which this permit is granted in a condition satisfactory to the Department.
12. If the Grantee enters into a contract or agreement with a contractor to perform the work provided herein to be performed
by the Grantee, the Grantee for itself,its assigns and its successors in interest,agrees that it will not discriminate on the
basis of race,color,sex,or national origin in its choice of contractors and will include all of the nondiscrimination pro-
visions set forth in Appendix "A" from Title VI of the Civil Rights Act of 1964 and Section 162(a) of the Federal Aid
Act of 1973 (23 U.S.C. 3241, and as said Regulations may be amended. Breach of any of the above nondiscrimination
covenants shall be cause for cancellation as herein provided.
13. Any breach of any of the conditions and requirements herein made,or failure on the part of the Grantee of this permit to
proceed with due diligence and in gootl faith after its acceptance, with construction work hereunder,shall subject this
permit to cancellation as herein provided.
14. This permit is subject to all applicable provisions of Chapter 47.32 RCW and/or Chapter 47.44 RCW and
amendments thereto.

13. The Grantee shall be responsible for constructing and maintaining the road approach(es)and appurtenances between the shoulder line of the
highway and the right of way line inclusive of surfacing and drainage. The Department has the right to Inspect all installetlons at the time of
construction and at any time afterward and to require that necessary changes and repairs be made.Unsatisfactory work will be corrected by the
Department,at the Grantee's expense,or access may be removed at the Grantee's expense.Directing of surface water from private property
onto Department right of way will not be permitted.
14. The approach shall be sufficiently sutfaced back an adequate distance from the edge of the pavement to prevent any mud tracking onto the
highway. Any mud (racked onto the highway shalt be Immediately cleaned up by the Grantee or his agent.
® 15. Standard highway warning signs designated as"Truck Crossing"sign,plate W11.6,shall be placed and maintained at Grantee's expense on
each side of the approach.Signs shall be In evidence only when access Is actually being used.If necessary flagman shall be provided.Sufficient
parking space shall be provided by the Grantee outside Department right of way so no vehicles will be parked on sold right of way.
❑ 16. All manholes,valve covers,and like appurtenances shall be constructed at such an elevation to conform to the shoulder elope from the edge of j
pavement or as directed by the Department.

11. All slopes,slope treatment,top soil,ditches,pipes,etc.,disturbed by this operation shall be restored to(heir original cross section and condition.
All hazards shall be marked by warning signs,barricades and lights.If necessary,flagmen shall be employed for the purpose of protecting the
traveling public.

18. During the construction and!or maintenance of this facility, the Grantee shall comply with the "Manual on Uniform Traffic Control Devices for j
Streets and Highways."
❑ 19. Bond coverage required to insure proper compliance with all terms and conditions of said permit will be furnished by a Blanket Surety Bond hold

at Headquarters in Olympia.
20. A surety bond in the amount of $ 4,000.00 written by a surety company authorized to do business In the State of Washington, �
shall be furnished to ensure compliance with any and all of the terms and conditions of this permit and shall remain in force until all work under this
permit has been completed and approved by the Department.
❑ 21. Before any log hauling operations begin, a surety bond In the amount of $ shall be furnished by the Grantee to protect
the Department against any damage to the highway and to ensure complete removal of the approach and cleaning up of the right of way to the
satisfaction of the Department. Approval of all clean up work shall be secured before the bond will be released. 1

R 24. Relative to advertising adjacent to all Stale highways,we wish to call your attention to the Scenic Vistas Act of 1971,Chapter 47.42 RCW and
State Transportation Commission ruling Chapter 468-66 WAC.Violation of this section of the statutes will be sufficient cause for cancellation of
this permit. On-Premise signs are allowed.
19 26. The Grantee shall notify the Department's representative upon completion of the work under this permit or franchise so that a final inspection can
be made.

CONDITIONS
1. ARCHAEOLOGICAL RESOURCES
Archaeological or historical resources, such as ruins, sites, buildings, artifacts, fossils, or
other objects of antiquity that may have significance from an historical or scientific
standpoint, which may be encountered by the developer/contractor, shall not be
further disturbed. If the developer/contractor encounters any such artifacts, he/she
shall immediately stop work and notify Mason County and the Washington State
Department of Archaeology and Historic Preservation. Failure to do so may result in civil
penalties.
2. SLASH ABATEMENT
This Forest Practice Application indicates that forest debris resulting from the proposed
logging operation may create an extreme fire hazard under RCW 76.04.600 and WAC
332-24-650. An extreme fire hazard could be created if one or more of the conditions
found in WAC 332-24-650 is located within 100 feet of the running surface of a public
road; or is within 500 of an existing structure and/or designated public use area, which
is not owned by the owner of the fire hazard area.
The land owner is fully liable in the event of fire, if he or she fails to appropriately abate
the hazard. Extreme fire hazards shall be abated by removing the forest debris, or by
other means approved by the Washington State Department of Natural Resources
(DNR).
3. HOURS OF OPERATION
Noise associated with this application shall not exceed what is allowed under Mason
County Code 9.36. Operations shall start no earlier than 7:00 AM and shall end before
8:00 PM on a daily basis.
4. STORM WATER & EROSION CONTROL
Escape of silty water or mud from this property shall be considered a violation of County
and State storm water management regulations and could subject the applicant(s) to
civil fines or penalties. Work shall conform with the requirements of October 2018
Drainage Report/Stormwater and Erosion Control Plan prepared by SCJ Alliance.
5. ACCESS
Applicant is responsible for obtaining any necessary permits for access on to SR 3 from
the Washington State Department of Transportation.

I just talked with our manager Kell Rowen about the situation. The site is greater than the
maximum required setback of 225'from the wetland that sits on the County line. The
NHD overlay does show a non-fish stream within proximity of the MTA site, but based
on my field inspection(see photo below), we do not believe that this feature rises to the
level of a regulated stream in our Critical Area Ordinance. On that basis, we are
comfortable not requiring a study or letter such as what Ron has requested. However, if
this project were challenged, having a letter from a biologist confirming what appears to
be obvious could come in handy. Your choice.

Thanks for the response Ron. I had originally included an attachment to the Forest
Practices Application that addressed the proximity of the wetland and streams. Michael
had told me he visited the site and saw no stream/wetland issues over the phone.
MTA has a limited grant funding so I wanted to make sure we weren't having them do
something that didn't need to be done if it was resolved as part of the FPA.
Based on your correspondence, I want to confirm that Michael's site visit assessment is
not official and we need to have a wetland biologist prepare the written confirmation
mentioned above.

Regarding the WSDOT access permit, we are still in process with the Construction Agreement

In order prevent further confusion about parcel numbers associated wit this project, I'm trying to
determine if the MTA project is now fully contained on the their own parcel (TPN 12321-41-60000),
or if any of it overlaps on to Overton's TPN 12321-41-00000. As nearly as I can tell, no map exist
of this parcel,just the mets and bounds legal description (linked below),which is difficult to read
without a corresponding survey map. If the lot is a square, then I think that some of the activity in

For my purposes,all I need is marked.That said,at some point it would probably behoove MTA to have the parcel surveyed.
In other issues.We figured out how the MTA site became it's own legal lot and it checks out.The new parcel number is 12321-41-60000.
How close are you on submitting the Land Modification permit?The next thing that I need to do on this case is to review the Drainage Report using the submittal checklist that was provided on 11/16.After
that comes the issuing of a SEPA determination which will cover both the FPA and the Land Mod.It would be nice to have the Land Modification permit on file when that happens,but possibly it isn't
actually required.I'm going to meet with other County staff who will be reviewing later phases of this project to get their thoughts.I'll get back to you with more information when I have it.

At the March 9, 2018 pre-application conference for the Belfair Park and Ride project, Ron Buckholt commented
that Mason County GIS show a wetland and unclassified stream near the Mason Transit Authority(MTA) Belfair
Park and Ride parcel.
The wetland is 500 feet to the northeast of the MTA parcel and will not be impacted by the MTA Park and Ride
project.
The Mason County GIS database does show a stream crossing the southeast quadrant of the MTA parcel. Based
upon site visits and topographic survey,this stream does not exist as mapped in the Mason County GIS system.
There are several logging roads through and adjacent to the MTA parcel. One of the logging roads that crosses
the MTA parcel has a roadside ditch with periodic culverts. Based on site visits,this roadside ditch and
associated culverts convey seasonal runoff but do not appear to be continuously connected to downstream
systems. We are proposing to re-route this roadside ditch around the MTA Park and Ride facility and enhance it
with plantings.The new ditch alignment will maintain the seasonal surface drainage but is still not expected to
connect to downstream systems.Therefore, this flow does not meet the definition of a Type 5(NS) stream.

COMMITMENT CONDITIONS
1. DEFINITIONS
(a) "Knowledge"or"Known":Actual or imputed knowledge, but not constructive notice imparted by the Public Records.
(b) "Land":The land described in Schedule A and affixed improvements that by law constitute real property.The term
"Land"does not include any property beyond the lines of the area described in Schedule A, nor any right,title, interest,
estate, or easement in abutting streets, roads, avenues, alleys, lanes,ways, or waterways, but this does not modify or
limit the extent that a right of access to and from the Land is to be insured by the Policy.
(c) "Mortgage":A mortgage,deed of trust,or other security instrument, including one evidenced by electronic means
authorized by law.
(d) "Policy': Each contract of title insurance, in a form adopted by the American Land Title Association, issued or to be
issued by the Company pursuant to this Commitment.
(e) "Proposed Insured": Each person identified in Schedule A as the Proposed Insured of each Policy to be issued
pursuant to this Commitment.
(f) "Proposed Policy Amount": Each dollar amount specified in Schedule A as the Proposed Policy Amount of each Policy
to be issued pursuant to this Commitment.
(g) "Public Records": Records established under state statutes at the Commitment Date for the purpose of imparting
constructive notice of matters relating to real property to purchasers for value and without Knowledge.
(h) "Title":The estate or interest described in Schedule A.
2. If all of the Schedule B, Part I—Requirements have not been met within the time period specified in the Commitment to
Issue Policy,this Commitment terminates and the Company's liability and obligation end.
3. The Company's liability and obligation is limited by and this Commitment is not valid without:
(a) the Notice;
(b) the Commitment to Issue Policy;
(c) the Commitment Conditions;
(d) Schedule A;
(e) Schedule B, Part I—Requirements;
(f) Schedule B, Part II—Exceptions;and
(g) a counter-signature by the Company or its issuing agent that may be in electronic form.
4. COMPANY'S RIGHT TO AMEND
The Company may amend this Commitment at any time. If the Company amends this Commitment to add a defect, lien,
encumbrance, adverse claim,or other matter recorded in the Public Records prior to the Commitment Date, any liability of
the Company is limited by Commitment Condition 5.The Company shall not be liable for any other amendment to this
Commitment.
5. LIMITATIONS OF LIABILITY
(a) The Company's liability under Commitment Condition 4 is limited to the Proposed Insured's actual expense incurred in
the interval between the Company's delivery to the Proposed Insured of the Commitment and the delivery of the
amended Commitment, resulting from the Proposed Insured's good faith reliance to:
(i) comply with the Schedule B, Part I—Requirements;
(ii) eliminate,with the Company's written consent, any Schedule B, Part II—Exceptions; or
(iii) acquire the Title or create the Mortgage covered by this Commitment.
(b) The Company shall not be liable under Commitment Condition 5(a)if the Proposed Insured requested the amendment
or had Knowledge of the matter and did not notify the Company about it in writing.
(c) The Company will only have liability under Commitment Condition 4 if the Proposed Insured would not have incurred
the expense had the Commitment included the added matter when the Commitment was first delivered to the
Proposed Insured.
(d) The Company's liability shall not exceed the lesser of the Proposed Insured's actual expense incurred in good faith and
described in Commitment Conditions 5(a)(i)through 5(a)(iii)or the Proposed Policy Amount.
(e) The Company shall not be liable for the content of the Transaction Identification Data, if any.
(f) In no event shall the Company be obligated to issue the Policy referred to in this Commitment unless all of the
Schedule B, Part I—Requirements have been met to the satisfaction of the Company.
(g) In any event,the Company's liability is limited by the terms and provisions of the Policy.

6. LIABILITY OF THE COMPANY MUST BE BASED ON THIS COMMITMENT
(a) Only a Proposed Insured identified in Schedule A,and no other person, may make a claim under this Commitment.
(b) Any claim must be based in contract and must be restricted solely to the terms and provisions of this Commitment.
(c) Until the Policy is issued,this Commitment, as last revised, is the exclusive and entire agreement between the parties
with respect to the subject matter of this Commitment and supersedes all prior commitment negotiations,
representations, and proposals of any kind,whether written or oral,express or implied, relating to the subject matter of
this Commitment.
(d) The deletion or modification of any Schedule B, Part II—Exception does not constitute an agreement or obligation to
provide coverage beyond the terms and provisions of this Commitment or the Policy.
(e) Any amendment or endorsement to this Commitment must be in writing and authenticated by a person authorized by
the Company.
(f) When the Policy is issued, all liability and obligation under this Commitment will end and the Company's only liability
will be under the Policy.
7. IF THIS COMMITMENT HAS BEEN ISSUED BY AN ISSUING AGENT
The issuing agent is the Company's agent only for the limited purpose of issuing title insurance commitments and policies.
The issuing agent is not the Company's agent for the purpose of providing closing or settlement services.
8. PRO-FORMA POLICY
The Company may provide, at the request of a Proposed Insured, a pro-forma policy illustrating the coverage that the
Company may provide.A pro-forma policy neither reflects the status of Title at the time that the pro-forma policy is delivered
to a Proposed Insured, nor is it a commitment to insure.

OWNER'S POLICY OF TITLE INSURANCE - 2006
EXCLUSIONS FROM COVERAGE
The following matters are expressly excluded from the coverage of this policy,and the Company will not pay loss or damage,costs,attorneys'
fees,or expenses that arise by reason of:
1. (a) Any law, ordinance, permit, or governmental regulation (including those relating to building and zoning) restricting, regulating,
prohibiting,or relating to
(i) the occupancy,use,or enjoyment of the Land;
(ii) the character,dimensions,or location of any improvement erected on the Land;
(iii) the subdivision of land;or
(iv) environmental protection;
or the effect of any violation of these laws,ordinances, or governmental regulations. This Exclusion 1(a)does not modify or
limit the coverage provided under Covered Risk 5.
(b) Any governmental police power.This Exclusion 1(b)does not modify or limit the coverage provided under Covered Risk 6.
2. Rights of eminent domain. This Exclusion does not modify or limit the coverage provided under Covered Risk 7 or 8.
3. Defects,liens,encumbrances,adverse claims,or other matters
(a) created,suffered,assumed,or agreed to by the Insured Claimant;
(b) not Known to the Company, not recorded in the Public Records at Date of Policy, but Known to the Insured Claimant and not
disclosed in writing to the Company by the Insured Claimant prior to the date the Insured Claimant became an Insured under this
policy;
(c) resulting in no loss or damage to the Insured Claimant;
(d) attaching or created subsequent to Date of Policy(however,this does not modify or limit the coverage provided under Covered Risk
9 and 10);or
(e) resulting in loss or damage that would not have been sustained if the Insured Claimant had paid value for the Title.
4. Any claim,by reason of the operation of federal bankruptcy,state insolvency, or similar creditors'rights laws,that the transaction vesting
the Title as shown in Schedule A,is
(a) a fraudulent conveyance or fraudulent transfer;or
(b) a preferential transfer for any reason not stated in Covered Risk 9 of this policy.
5. Any lien on the Title for real estate taxes or assessments imposed by governmental authority and created or attaching between Date of
Policy and the date of recording of the deed or other instrument of transfer in the Public Records that vests Title as shown in Schedule A.
