Thank you for the opportunity to comment on the determination of nonsignificance for the Scott-Dock
Replacement project(SEP2009-00070) located at 371 Northeast Tiger Way East in Belfair as proposed by
Judy Scott. The Department of Ecology(Ecology) reviewed the environmental checklist and has the
following comment(s):

The applicant proposes to remove a structure(s)that may contain treated wood. Please refer to
Ecology's publication "Focus on Treated Wood Exclusion," available at
http://www.ecy.wa.gov/pubs/0304038.pdf,for suggested best management practices and disposal
requirements for treated wood. For additional information or clarification, please contact Dee
Williams with Ecology's Hazardous Waste and Toxics Reduction program,at(360)407-6348.
Property owners,developers,and contractors are encouraged to recycle all possible leftover
construction, demolition,and land clearing(CDL) materials and reduce waste generated. Recycling
construction debris is often less expensive than landfill disposal. Please visit
http://1800recycle.wa.gov to find facilities that recycle construction, demolition,and landclearing
materials in your area.
Please consider incorporating building materials that have been salvaged or are made from recycled
materials to the greatest extent possible in the project.

Any discharge of sediment-laden runoff or other pollutants to waters of the state is in violation of
Chapter 90.48 RCW,Water Pollution Control,and WAC 173-201A,Water Quality Standards for
Surface Waters of the State of Washington, and is subject to enforcement action.
Erosion control measures must be in place prior to any clearing,grading,or construction. These
control measures must be effective to prevent stormwater runoff from carrying soil and other
pollutants into surface water or storm drains that lead to waters of the state. Sand,silt,clay
particles,and soil will damage aquatic habitat and are considered to be pollutants.

Proper disposal of construction debris must be on land in such a manner that debris cannot enter
the water of the state;e.g.,Tiger Lake or cause water quality degradation of state waters.
During construction,all releases of oils, hydraulic fluids,fuels,other petroleum products,paints,
solvents,and other deleterious materials must be contained and removed in a manner that will
prevent their discharge to waters and soils of the state. The cleanup of spills should take
precedence over other work on the site.
The applicant should consider alternatives to treated wood or other chemically treated wood for in-
water construction of wooden structures. Over time,treated wood may contaminate nearby
sediment and cause toxicity for aquatic organisms.
Ecology's comments are based upon information provided by the lead agency. As such,they may not
constitute an exhaustive list of the various authorizations that must be obtained or legal requirements
that must be fulfilled in order to carry out the proposed action.

197-11-340(2). The Lead Agency will not act on this proposal for 14 days from the date shown
below, when the determination is final. Comments must be submitted to Dept. of Community

This worksheet was designed to help project proponents, and government agencies, identify when a project
needs further analysis regarding adverse effects on ESA (Endangered Species Act) listed salmonids. Salmonids
are salmon, trout and chars, e.g. bull trout. For our purposes, "ESA Listed Salmonids" is defined as fish species
listed as endangered, threatened or being considered for listing.
If ESA listed species are present or ever were present in the water shed where your project will be located, your
project has the potential for affecting them, and you need to comply with the ESA. The questions in this section
will help determine if the ESA listings will impact your project.

Dear Allan,
Does all the lumber used meet or exceed the standards established in'Best
Management Practices For the Use of Treated Wood in Aquatic and Other Sensitive
Environments'developed by the Western Wood Preservers Institute,Wood Preservation
Canada, Southern Pressure Treaters'Association,and Timber Piling Council,dated
August 1,2006,and any current amendments or addenda to it. Current amendments and
addenda include but may not be limited to'Amendment#1: CCA-Chromated Copper
Arsenate',dated October 25,2006; and 'Addendum#1: ACC-Acid Chromated Copper',
dated February 28,2007? Functional grating is not required for docks and floats on
freshwater lakes however this does not mean that it should not be considered on all new
docks and floats. Providing at least a 30%-50%grating would greatly mitigate the
negative environmental impacts this project may have, or be found to have as better
science becomes available. However,the Skokomish Tribes Tribal Historic Preservation
Officer will be providing comment as to the potential cultural impacts of this SEPA and
you should not move forward with the above project until you receive those comments.
